Opis:: The author analyses the legislation concerning the electoral process, including regulations on election campaign expenditures, the duration of election campaigns and the supervision exercised by the National Electoral Commission. In the author’s opinion there are no significant shortcomings regarding the Polish legislation and the practice of its application, which could lead to misuse of administrative resources (public resources) during the electoral processes.

Opis:: The author stated that the lack of complying with the National Electoral Commission’s proposal on changes in electoral districts in the elections to the Sejm and Senate will result in an internal inconsistency of the Electoral Code with regard to elections to the Sejm. It will also cause a violation of the constitutional principle of equality in elections. On the other hand elections conducted in accordance with the legal framework without the NEC’s proposal will be valid. Doubts as to the validity of the elections may arise, if the Constitutional Tribunal considers the current provisions (i.e. not-amended as the NEC suggested) unconstitutional.

Opis:: In December 2017 and January 2018, the Sejm and Senate, thanks to the votes of the deputies of ruling party Law and Justice, passed hugely controversial law amending inter alia Polish Electoral Code. Its adoption was opposed by the parliamentary opposition, by the electoral administration bodies and by many experts, however unsuccessfully. The enactment of this law destabilises the electoral system without a clear or evident need and treats the electoral code as a political instrument. Secondly, it does not provide the sufficient time for adaptation (vacatio legis), which may jeopardise free and fair local elections and the stability of the political system. Thirdly, the bill contains numerous unclear provisions and is in many parts written in a careless and contradictory way. Such amendments do not correspond with the European standards, described in the Venice Commission’s Code of Good Practice in Electoral Matters.

Opis:: The article discusses the jurisdiction of the Constitutional Tribunal and opinions of the doctrine on the subject of the introduction of single-member electoral districts in elections to the Senate, the possibility to vote by proxy and correspondence voting, a trial to extend the voting period over two days, and the introduction of limitations concerning the resources used during an election campaign. The adoption of these solutions emerged to meet the expectations of the doctrine, and fulfilled postulates of representatives of the electoral apparatus, in an essential way altering the electoral law, but simultaneously it aroused significant controversies. The Constitutional Tribunal was faced with a difficult task to evalu-ate them from the point of view of compatibility with the Constitution. Its adjudication was in advance doomed to criticism, because the Tribunal could only assume the point of view of a part of the doctrine’s representatives. The analysis carried out in this article enables the constitutional regulations concerning elections to be viewed in a new way.

Opis:: The paper reports the Third International Conference “Challenges of Contemporary Electoral Law” that took place in Toruń on June 12, 2015. It presents the discussion and conclusions of the expert panel chaired by Professor Andrzej Sokala, the leading expert in the constitutional and electoral law in Poland. The conference report describes challenges and solutions which has been discussed during the meeting by scholars, representatives of the judiciary and professional experts. Opis:: The aim of this paper is to prove the thesis that there is a need to distinguish between the terms “election day” and “voting day”. The following research methods will be used in the study: formal and dogmatic – to show the views of representatives of the legal doctrine, historical and legal in order to analyse documents of the National Electoral Commission and judicial decisions. Apart from the literature, the research is based on the sources of law in chronological order, taking into account their hierarchy. On the basis of terminological differences and linguistic inaccuracies in them, the author proposes to amend the law and formulates specific wording of the proposed provisions, expressing the hope that the results of the research will have an impact on the functioning of a legally aware society.

Opis:: The position on the motion of the President of the Republic of Poland stated that the challenged provision of the amendment to the Electoral Code, which among the voters entitled to vote by post in the elections to the bodies constituting local self-government units, omits those voters who were subject to compulsory quarantine, isolation or home isolation on the voting day, is unconstitutional. The promoter also raised the objection of a defective legislative process with respect to the entire amendment Act by reason of the improper – in his opinion – representation of the Sejm, claiming that the contested Act did not originate from a body meeting the constitutional requirements of representation. In this respect, the author of the position proposes discontinuing the proceedings, and in the event that this proposal is not accepted, to declare that the Act is compatible with the Constitution.

Opis:: The position of the Sejm refers to application of the Marshal of the Sejm initiating proceedings before the Constitutional Tribunal. The position of the Sejm it was stated that the questioned provision of the Act – Electoral Code, in so far as it limits the competence of the Marshal of the Sejm to change the date of presidential elections after an occurrence of unpredictable, extraordinary circumstances hindering or preventing the holding of elections on the originally scheduled date, is unconstitutional. According to the applicant, the challenged provision violates the Constitution because it introduces additional, non-constitutional deadlines binding the Marshal of the Sejm in ordering elections to the office of the President of the Republic of Poland. It also excludes the constitutional competence of the Marshal of the Sejm to change the date of these elections and limits the possibility of ordering presidential elections by indicating a statutory holiday.

Opis:: Przedmiotem analizy jest nowy organ administracji wyborczej – korpus urzędników wyborczych. Instytucja ta została wprowadzona ustawą z 11 stycznia 2018 r. o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych, stanowiąc nowelizację ustawy z 5 stycznia 2011 r. – Kodeks wyborczy. Doświadczenia z przeprowadzonych od 2018 r. elekcji w Polsce pozwalają na wstępną ocenę wprowadzonej regulacji kodeksowej dotyczącej nowego aparatu administracji wyborczej – korpusu urzędników wyborczych. Dokonana analiza przyczyni się do sformułowania propozycji rekomendacji mających na celu wyeliminowanie bądź zminimalizowanie dostrzeżonych dotychczas problemów i nieprawidłowości w pracy tego aparatu.
The subject of the analysis is a new body of the election administration – the corps of election officials. This institution was introduced by the Act of January 11, 2018, amending certain acts in order to increase the participation of citizens in the process of selecting, functioning and controlling certain public bodies, by amending the Act of January 5, 2011 – Electoral Code. The experience from the elections conducted in Poland since 2018 allows for a preliminary assessment of the introduced code regulation concerning the new apparatus of the election administration – the corps of election officials. The analysis will contribute to the formulation of proposals for recommendations aimed at eliminating or minimizing the problems and irregularities noticed so far in the operation of this apparatus.

Opisano również dylematy związane z określeniem osób, które mają czynne i bierne prawo wyborcze w wyborach lokalnych (obywatelstwo i wiek) a następnie problem zwiększenia udziału kobiet w życiu politycznym, czyli podjęto próbę uzyskania odpowiedzi na pytanie, czy w Polsce są potrzebne parytety płci i kwoty na listach wyborczych? Przedstawiono także opinię autora dotyczącą jednomandatowych okręgów wyborczych w wyborach lokalnych i wprowadzone przez kodeks wyborczy alternatywne sposoby głosowania (głosowanie przez pełnomocnika, głosowanie korespondencyjne).
In modern democracies, an important place is occupied election. The article provides an overview of selected electoral problems and dilemmas, which should be addressed by law experts, politicians and voters. The article taken into account the changes made by the electoral code of 2011, the beginning of the dilemmas raised related to identifying people who are active and passive right to vote in local elections (citizenship and age). Then the problem of increasing the participation of women in political life, whether in Poland or are needed and the amount of gender parity on electoral lists? In this paper we find the opinions of the author on one-mandate constituencies in local elections. Finally, we will put electoral code of alternative voting (vote by postal, postal vote).
