Opis:: Technological development has never been so rapid as today. Due to the emerging technologies, their users gain considerable advantages in their everyday life. At the same time, such facilitation has an effect on our privacy and entails a risk of a wide range of information becoming easily available to unauthorised entities or persons. However, the risk is even greater when the scope of data required to get access to a particular solution becomes broader. In some cases, the amount of data requested from the user seems largely redundant. In this context, it is worth mentioning, for example, biometric data increasingly used for authentication of the user wishing to access applications by means of fingerprint scanning or facial recognition. The question is whether this is really necessary in all situations, or possibly in some circumstances the use of biometrics may pose a greater threat to privacy than to the information protected this way. The author presents the current restrictions on the use of biometric data, along with their assessment.

Opis:: The Internet of Things is a modern technology that affects every area of human life, includ- ing employment relationships. IoT enables the processing of specific personal data categories, including biometric data, and entails the risk of employers interfering with employee privacy. Due to the use of intelligent solutions, the issue of employee privacy, which is, in princi- ple, a personal right subject to protection, becomes significant. The relationship between an employee and an employer includes two subjects of legal protection, the meeting of which may lead to internal contradiction. There is the employee’s dignity and privacy, on the one hand, and protection of reasonable interests of an employer, on the other. A definition of the concept of the Internet of Things and its applications was introduced. Moreover, the author proposed setting a specific legal framework for this and discussed the issue of biometric data. It was also shown how far IoT solutions, which make it possible to analyse and describe the personality of an individual, may interfere with the information autonomy of a person. As a consequence, the employer’s interference with employee privacy cannot be unrestricted, because it should be limited by purpose and lawfulness. This is the purpose of the current legislation.

Opis:: Celem niniejszej publikacji jest przedstawienie problematyki przetwarzania danych wrażliwych, w tym danych biometrycznych, w toku badań naukowych oraz w zwiąku z realizacją celów tych badań. Podniesiono konieczność pogodzenia ochrony danych osobowych z wyzwaniami badawczymi, zwłaszcza związanymi z możliwościami wykorzystania nowatorskich technologii w celu skutecznego wykrywania i zwalczania różnych form przestępczości. W artykule omówiono przepisy europejskie związane z podjętą problematyką, tj.: rozporządzenie Parlamentu Europejskiego i Rady Unii Europejskiej 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (nazywane w skrócie RODO) i krajowe, zawarte w ustawie z dnia 10 maja 2018 r. o ochronie danych osobowych (Dz. U z 2019 r. poz. 1781). Dokonując przeglądu rodzimej literatury odnoszącej się do ochrony danych osobowych wskazać można wiele opracowań dotyczących danej tematyki. Autorzy, w szczególności w opracowaniach monograficznych poddają analizie zagadnienie ochrony danych osobowych w kontekście ochrony danych w polskim procesie karnym, w sprawach cywilnych, czy w odniesieniu do sektora działalności oświatowej. W artykule skupiono się na jednym z nieczęsto podejmowanym na łamach opracowań naukowych aspektów, jakim jest ochrona danych osobowych pozyskiwanych do celów badań naukowych. Publikacja ma na celu przybliżenie standardów obowiązujących w zakresie ochrony danych osobowych w kontekście prowadzonych badań empirycznych. Zagadnienie jest na tyle złożone, że wymaga wnikliwego omówienia, zwłaszcza, że wielu badaczy podejmując wyzwanie i trud badań naukowych musi mierzyć się z problemem ochrony danych osobowych, zarówno prowadzących badania, jak i uczestników procesu badawczego. Wobec tej konstatacji jest zasadne przedstawienie fundamentalnych zasad prowadzenia badań w sytuacji konieczności pozyskiwania w ich toku danych osobowych. Inspiracją do zmierzenia się z tym niewątpliwie trudnym zagadnieniem były prace związane z realizacją projektu naukowego. W artykule omówiono przepisy prawne i dobre praktyki, które mogą stanowić swoiste kompendium wiedzy służące każdemu uczestnikowi projektów badawczych.
Der vorliegende Beitrag befasst sich mit der Verarbeitung sensibler Daten, einschließlich biometrischer Daten im Rahmen wissenschaftlicher Forschung und im Zusammenhang mit der Verwirklichung der Ziele dieser Forschung. Die Verfasser nennen die Rechtsgrundlage, dann die Verhaltensnormen, als auch die Gründe für die Legalisierung der Datenverarbeitung sowie die Rechte des Einzelnen in Bezug auf die Verarbeitung seiner Daten zu wissenschaftlichen Forschungszwecken. Die Notwendigkeit, den Schutz personenbezogener Daten mit den Herausforderungen der Forschung in Einklang zu bringen, wurde angesprochen, insbesondere im Hinblick auf das Potenzial, Spitzentechnologien zur wirksamen Aufdeckung und Bekämpfung verschiedener Formen von Kriminalität einzusetzen. Der Artikel befasst sich mit den europäischen Rechtsvorschriften, die mit der vorliegenden Problematik in Zusammenhang stehen, d. h. mit der Verordnung (EU) 2016/679 des Europäischen Parlaments und des Rates vom 27. April 2016 zum Schutz natürlicher Personen bei der Verarbeitung personenbezogener Daten zum freien Datenverkehr und zur Aufhebung der Richtlinie 95/46/EG (Datenschutz-Grundverordnung) sowie mit den nationalen Rechtsvorschriften, die im Gesetz vom 10. Mai 2018 über den Schutz personenbezogener Daten enthalten sind (Dz. U z 2019 r. poz. 1781). Bei der Durchsicht der einheimischen Literatur über den Schutz personenbezogener Daten kann man auf zahlreiche Studien zu diesem Thema verweisen. Hier werden insbesondere in monographischen Studien die Frage des Schutzes personenbezogener Daten im Rahmen des Datenschutzes im polnischen Strafverfahren, dann in Zivilprozessen oder im Zusammenhang mit dem Bildungssektor analysiert. Der Artikel befasst sich mit einem Aspekt, der in wissenschaftlichen Studien oft nicht behandelt wird, nämlich dem Schutz personenbezogener Daten, die zu Forschungszwecken erhoben werden.Die Veröffentlichung soll einen Überblick über die für den Schutz personenbezogener Daten im Rahmen der empirischen Forschung geltenden Normen geben. Das Thema ist so komplex, dass es eine gründliche Diskussion erfordert, zumal viele Forscher, die sich der Herausforderung und dem Aufwand wissenschaftlicher Forschung stellen, mit dem Problem des Schutzes personenbezogener Daten konfrontiert werden, und zwar sowohl für diejenigen, die die Forschung durchführen, als auch für die Teilnehmer des Forschungsprozesses. In Anbetracht dieser Tatsache ist es gerechtfertigt, die Grundprinzipien der Durchführung von Forschungsarbeiten in der Situation darzulegen, in der die Erhebung personenbezogener Daten im Rahmen der Forschung erforderlich ist. Die Inspiration, sich diesem zweifellos schwierigen Thema zu stellen, kam aus der Arbeit im Zusammenhang mit der Durchführung des wissenschaftlichen Projekts. In dem Artikel werden rechtliche Bestimmungen und bewährte Praktiken erörtert, die als eine Art Kompendium für jeden Teilnehmer an Forschungsprojekten dienen können.
The aim of the article is to present the issues related to the processing of sensitive data, including biometric data, in the course of scientific research and for the purpose of achieving the objectives of such research. This study indicates the purposes of scientific research, the legal grounds, standards of conduct, premises legalizing data processing and the rights of persons in the scope of processing their data. It is important to reconcile the protection of personal data with research challenges, especially related to the possibilities of using innovative technologies in order to effectively detect and fight various forms of crime. The publication discusses European regulations: Regulation 2016/679 of the European Parliament and of the Council of the European Union of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/WE and national provisions contained in the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2019, item 1781). During the literature review a number of studies relating to the protection of personal data was identified. The authors, in particular in monographs, analyse the issue of personal data protection in the context of data protection in the Polish criminal trial, in civil or educational cases. This publication focuses on one of the aspects not often discussed in scientific studies, which is the protection of personal data obtained for the purposes of scientific research. The publication aims to introduce the standards in force in the field of personal data protection in the context of empirical research. The issue is so complex that it requires in-depth discussion, especially since many researchers, taking up the challenge and effort of scientific research, have to face the problem of personal data protection, both for researchers and participants in the research process. In view of this conclusion, it is reasonable to present in this publication the fundamental principles of conducting research when it is necessary to obtain personal data in the course of research. The article discusses legal regulations and good practices that may constitute a specific compendium of knowledge for everyone who participates in research projects.
Цель данной статьи — представить вопросы, связанные с обработкой конфиденциальных данных, в том числе биометрических, в ходе научных исследований в связи с достижением целей проводимого исследования. Авторы указывают на правовую основу, стандарты поведения, предпосылки, позволяющие законно обрабатывать данные, а также права лиц при обработке персональных данных для достижения целей научных исследований. Поднимается вопрос о необходимости согласования защиты персональных данных с научно-сследовательскими задачами, особенно связанными с возможностью применить инновационные технологии для эффективного раскрытия и борьбы с преступностью. В статье рассматривается европейское законодательство, касающееся данного вопроса, в частности: Регламент 2016/679 Европейского парламента и Совета Европейского союза от 27 апреля 2016 года о защите физических лиц при обработке персональных данных и о свободном обращении таких данных, а также отмене Директивы 95/46/EC (т.н. РОДО), а также национальное законодательство, в том Закон от 10 мая 2018 года о защите персональных данных (Вестник законов РП от 2019 года, поз. 1781). Изучая отечественную литературу, касающуюся защиты персональных данных, нельзя не отметить многие работы, посвященные этому вопросу. Авторы, особенно в монографических трудах, анализируют вопрос защиты персональных данных в контексте защиты данных в польском уголовном процессе, в гражданском процессе или в связи с сектором образовательной дея- тельности. Статья посвящена одному из аспектов, который не часто рассматривается в научных исследованиях, а именно защите персональных данных, полученных для целей научного исследования. Целью настоящей статьи является описание действующих стандартов в области защиты персональных данных в контексте проведенных эмпирических исследований. Этот вопрос настолько сложен, что требует подробного обсуждения, тем более, что многие ученые, занимаясь научными исследованиями, вынуждены сталкиваться с проблемой защиты персональных данных, как лиц, проводящих исследования, так и участников исследовательского процесса. В связи с этим вполне оправдано представить основные принципы проведения исследований в ситуации необходимости сбора персональных данных в ходе проведения исследования. Источником мотивации при решении этого, несомненно, сложного вопроса стала работа, связанная с реализацией научного проекта. В статье обсуждаются правовые положения и передовой опыт, которые могут служить своего рода компендиумом для каждого участника исследовательских проектов.

Opis:: Given the growing popularity of biometrics, doubts about the conditions for biometric data processing can be noticed in practice. These inaccuracies take place in various areas of law, including labour law. This article provides a theoretical discussion on the processing of special categories of data. It aims to point to the need for appropriate legal regulations to ensure the security of the processing of biometric data of employees and candidate employees. The article starts with clarifying the concept of biometric data and discusses the practical aspects of the use of biometric tools. Further on, the author analyses the legal regulations concerning the processing of biometric data in the relations between the employer as the personal data controller and the employee as the data subject. As a result of the studies carried out, a position was presented which indicates that the employer who processes biometric data of employees and candidates for employment should always find out whether he has legal justification to process the data in question. This article is one of the few studies on the processing of biometric data in Polish literature on the subject. The main purpose hereof is to present situations under the current legislation, in which the employer can process biometric data of its employees. The article is a form of universal presentation of the problem and may be of interest especially to legal practitioners.
Z uwagi na wzrost popularności technik biometrycznych w praktyce można zauważyć pojawiające się wątpliwości dotyczące przesłanek warunkujących przetwarzanie danych biometrycznych. Przedmiotowe nieścisłości pojawiają się na gruncie różnych dziedzin prawa, w tym na gruncie prawa pracy. Niniejszy artykuł zawiera rozważania teoretyczne dotyczące przetwarzania danych szczególnej kategorii. Jego celem jest zwrócenie uwagi na potrzebę stworzenia odpowiednich regulacji prawnych służących zapewnieniu bezpieczeństwa przetwarzania danych biometrycznych pracowników oraz kandydatów do pracy. Artykuł rozpoczyna się od wyjaśnienia pojęcia danych biometrycznych oraz traktuje o praktycznych stronach wykorzystania narzędzi biometrycznych. W dalszej części autorka poddaje analizie regulacje prawne dotyczące przetwarzania danych biometrycznych w relacjach pomiędzy pracodawcą jako administratorem danych osobowych a pracownikiem jako podmiotem, którego dane są przetwarzane. W wyniku przeprowadzonych badań zaprezentowane zostało stanowisko wskazujące, że pracodawca przetwarzający dane biometryczne zatrudnionych pracowników oraz kandydatów do pracy powinien każdorazowo ustalać, czy dysponuje przewidzianą przez przepisy prawa przesłanką legalizującą przetwarzanie tych danych. Niniejszy artykuł jest jedną z niewielu prac w polskim dorobku piśmienniczym na temat przetwarzania danych biometrycznych. Głównym celem jest zaprezentowanie sytuacji, w których pracodawca może zgodnie z aktualnie obowiązującym stanem prawnym przetwarzać dane biometryczne swoich pracowników. Artykuł stanowi formę uniwersalnego przedstawienia problemu i może być przedmiotem zainteresowania zwłaszcza praktyków prawa.

The paper is to familiarize the readers with the notion and the fundamental principles of the processing of the biometric data of natural persons, taking into account the problematic issue of voluntary consent given by employees to their biometric data being processed by their employers.

Opis:: Biometrics is the science of human recognition by means of their biological, chemical or behavioural traits. These systems are used in many real life applications simply from biometric based attendance system to providing security at a very sophisticated level. A biometric system deals with raw data captured using a sensor and feature template extracted from raw image. One of the challenges being faced by designers of these systems is to secure template data extracted from the biometric modalities of the user and protect the raw images. In order to minimize spoof attacks on biometric systems by unauthorised users one of the solutions is to use multi-biometric systems. Multi-modal biometric system works by using fusion technique to merge feature templates generated from different modalities of the human. In this work, a novel scheme is proposed to secure template during feature fusion level. The scheme is based on union operation of fuzzy relations of templates of modalities during fusion process of multimodal biometric systems. This approach serves dual purpose of feature fusion as well as transformation of templates into a single secured non invertible template. The proposed technique is irreversible, diverse and experimentally tested on a bimodal biometric system comprising of fingerprint and hand geometry. The given scheme results into significant improvement in the performance of the system with lower equal error rate and improvement in genuine acceptance rate.

Opis:: The purpose of this article is to draw attention to the possibility of using new methods for the identification and verification of individuals, i.e. biometric techniques. Nowadays, the use of biometrics grows, which entails the adaptation of legal norms to current trends. The author points out the changes in the protection of biometric data in connection with the introduction of the GDPR, especially in the context of making biometric data as a special category.
