Opis:
The article describes the progress of judicial reform in Ukraine from the time it gained independence to present days. The article analyzes the main stages of judicial reform, including their timeframes, related legislative regulations and content of reforms. It has been proved that the judicial reform in Ukraine is far from its completion, and the requirement of consistency of its implementation can be accomplished through recognition of judicial law as a branch of law which regulates social relations related to administration of justice.

Opis:
The paper will focus on requirements and thresholds set for the judiciary by the Damages Directive. Answered will also be questions on the specialization of courts and its application in Central and Eastern European (CEE) Member States of the EU, as well as on the involvement of national competition authorities (NCAs) in court proceedings. The paper provides also general thoughts regarding the specialization of courts and confronts them with the judiciary structure in CEE Member States in the context of private enforcement of competition law. While there is no uniform model of a judicial system, the paper provides a critical analysis of the centralization, specialization and decentralization of private enforcement models, taking into account also the importance of the training of judges. The relationship between NCAs and courts will be discussed whereby the role of NCAs in private enforcement defines the responsibility of the given public authority in private enforcement as a country’s policymaker.

Opis:
The role of alternative dispute resolution (ADR) in the management of cases and disputes in Nigeria and across the globe cannot be overemphasized. The judicial arm of the government is the arm responsible for interpretation of laws in Nigeria and the judiciary’s role in preserving the rights of citizens across Nigeria also cannot be overemphasized. It ensures that the society is stable in the face of insta-bility and ensures that lawlessness is not maintained. The judiciary ensures that laws made by the legislature are obeyed by ensuring that those who violate the provisions of any established laws are punished. In doing all these, it has been established that the system of administering justice in our courts in Nigeria is extremely slow. Considering the foregoing, alternative dispute resolution as a means of settling disputes has been of tremendous help in easing the hardship of getting cases resolved through the court system. This paper examines ways through which alternative dispute resolution has assisted the Nigerian judicial system and the need to use alternative dispute resolution the more in order to ensure that number of cases handled by courts are drastically reduced. Recommendations are made at the end of the research.

Based on a sociological research, the author of this article aims to identify the beliefs and the attitudes of a group of BA and MA students enrolled in university programs of Juridical Science, regarding their apprehension of the principles of justice - as the central value of the Romanian judicial system. This would contribute to the implementation of justice in the actual Romanian economic, political, and judicial structure. The data analysis provides the necessary information for comprehending the extensions of justice and injustice within the specific social context. A real distance between reality and the political doctrines, and the classical and post-modern philosophical theories of justice as well can be noticed. The resulting conclusions could provide solid settings in order to develop a number of strategies/public policies to shape a more honest society.

Opis:
This study systematically investigates the primary issues and obstacles impeding the establishment of a functional and credible judiciary in Kosovo, adopting an international perspective. The research methodology includes a combination of qualitative and empirical analytical approaches to concrete actions based on a review of relevant literature, reports, and legal documents. This paper concludes that Kosovo should be ready to reach compromises, strengthen the independence, professionalism, transparency and accountability of judges and prosecutors, and increase public confidence in justice, to achieve a successful reform in the judicial system. The paper offers several recommendations for improving the quality and efficiency of justice in Kosovo, such as promoting cooperation and coordination with international factors in this field.

Jury courts existed in all the partitioning countries, and after 1918 they were to operate in all parts of the reborn Polish state. Their activities were suspended indefinitely in the former Prussian and Russian partitions. Only the former Austrian partition operated until 1938, when the Sanacja authorities liquidated them. Jury courts adjudicated only criminal cases –concerning the most severe crimes and political crimes. Recently, more attention has been devoted to jury courts and the participation of the social factor in the judiciary in Polish science, but so far, no publications in English have appeared on this subject. In the article, the author presents a short description of the jury’s activity in Poland and discusses three hypotheses about the activity of the jury in Polish science.

Opis:
The scientific article is devoted to the definition of directions of improvement of the jury trial in civil proceedings of Ukraine. It unveils the historical origins of formation of the jury trial as one of the important democratic institutions, which provides the possibility of direct participation of people in the administration of justice and is a civilized means of protecting civil society from judicial arbitrariness and corruption in the judiciary. Two models of jury trial are described: the Anglo-Saxon and the continental. The existing scientific controversy on the expediency of the functioning of the jury in civil proceedings and the effectiveness of some, including complex, civil cases with the participation of the jury are described. It is argued that the reasons for the inefficiency of the jury trial in Ukraine are the non-transparent system of forming the jury lists, the lack of state funding for the jury trial, public misunderstanding of the benefits of the jury trial, and thus the non-acceptance of the jury by the vast majority of citizens and their evasion of the duties of jurors. It is concluded that it is inexpedient to preserve the jury trial in civil proceedings in its current form, as this will only harm the tasks of civil proceedings. The authors propose the ways to improve the model of the jury trial in civil proceedings in Ukraine, in particular, by building a transparent system for forming a list of jurors as a result of outreach work among the population and decent pay for jurors.

Artykuł zawiera krótkie omówienie dotychczasowej historiografii polskiej i zagranicznej. Omawia zjawiska zachodzące w miastach prywatnych w trzech wyróżnionych przez autora okresach. Uwagę skoncentrowano na niektórych zagadnieniach: statusu prawnego, a zwłaszcza podległości jurysdykcji miejskiej, treści przywilejów wydawanych dla Żydów oraz ich roli w gospodarce miast prywatnych.
The paper contains a short discussion of historiographical body of work on the subject, both Polish and foreign. It touches upon phenomena observed in private towns in three periods selected by the author. Emphasis is placed on selected issues: legal status, especially the scope of jurisdiction of the municipal judicial system, content of privileges issued for Jews, and their importance for the economy of private towns.

People appear in the courtroom when they engage in various disputes with others and have diverse problems of their own. The courts are supposed to provide them with a space where they can obtain justice, in accordance with the law. It is no less important, however, that while pursuing this goal the courts should deal with people’s problems in a way that makes the people willing to accept and comply with their decisions. The central issue defining the scope of this empirical study was the question of what element of the construct of procedural justice promotes behaviors associated with legitimacy and compliance with the law in the Polish judicial system. The author set out to investigate what identified procedural justice in Polish legal culture and what variables pertaining to the context of legal proceedings it was related to. The sample consisted of 115 individuals taking part in civil court proceedings conducted in civil divisions of district courts. Based on analyses performed on research results it can be concluded that behaviors associated with legitimacy and compliance with the law in the Polish judicial system is determined by the sense of fairness experienced in the courtroom, whose structure is built by experiences such as being given the opportunity to speak, being treated with respect, the judge’s impartiality, the comprehensibility of the language used and procedures applied in the courtroom, and the sense of influence on the final outcome of the proceedings.
