Opis:: The authors have been involved in the functioning of the private sector in Poland for over twenty years. These are not only theoretical considerations, but supported by extensive experience. Both as police officers supervised specialized armed protective formations and participated in the process of training security personnel. They were also consultants in the creation of the first legal regulation in Poland which defines the rights and obligations of both security staff and entrepreneurs conducting business in this area. Currently, they are security auditors in large entities protected by SUFO. On a daily basis, they examine the level of services provided by these formations, they indicate weaknesses, errors or legal deficiencies negatively affecting the performance of tasks entrusted to security personnel. In this publication, they point to contemporary terrorist threats resulting, among other things, from the uncontrolled wave of migration that is sweeping through Europe. They present examples of spectacular terrorist attacks that took place in European countries in 2017. Against this background, they perceive the necessity of optimal functioning of the state security system not only at the government and local government levels, but also at the local level served by commercial security entities.

Opis:: Od momentu utworzenia pierwszych straży miejskich na podstawie ustawy o Policji z 1990 r. [8] straże gminne (miejskie) przeszły daleko idącą transformację. Zakres ich działania na rzecz społeczności lokalnej został znacznie rozszerzony, od realizacji zadań porządkowo-administracyjnych do realizacji zadań związanych z bezpieczeństwem i porządkiem publicznym. Choć terenem działania straży nadal jest teren gminy, której organy ją utworzyły (rada gminy), jej działania mają o wiele szerszy zasięg, mając na uwadze efekty jej funkcjonowania, szczególnie w zakresie bezpieczeństwa i porządku publicznego. Straż gminna (miejska), zarówno jako samodzielnie funkcjonujący podmiot, jak i współpracujący z innymi podmiotami, takimi jak Policja, straże pożarne, pogotowie ratunkowe czy też inne służby ratownicze, zajmuje istotne miejsce wśród podmiotów należących do systemu bezpieczeństwa i porządku publicznego, którego efekty funkcjonowania wychodzą daleko poza teren gminy i społeczności lokalnej.
Since the establishment of the first city guards pursuant to the Police Act of 1990 [8], the municipal police (city guards) have undergone comprehensive transformations. The scope of their activities provided for the local community has been significantly extended, from the implementation of activities related to maintaining order and administrative tasks to the execution of tasks related to public safety and order. The main operating territory of the city guards remains the municipality whose bodies have established them (i.e. the commune council), and yet their activities are far more extensive than that, particularly if one takes into account the effects of their operation, especially in the field of public security and order. Both as an independent entity and in cooperation with other entities, such as the Police, the fire service, medical ambulance service or other emergency services, the municipal police (city guards) occupy an important position among entities that form a part of the public security and order system, the operational effects of which go far beyond the territory of the commune and the local community.

Opis:: The considerations presented in this article are based on several assumptions. First of all, the human environment and the set of its elements are constantly changing. In the early periods of evolution and development of humanity, man lived in conditions given by nature itself, no different than in natural conditions. However, even then, he was also exposed to threats, mainly natural, including disasters. Secondly, with the passage of time and development there was a very large population increase, which caused changes in quite primitive interpersonal and social relations. More and more organized communities, states began to emerge. With this development, new threats also appeared. In addition to the natural threats, which were already natural by their very name, the threats of a social nature began to emerge from the natural world around us, characterized by continuous and dynamic changes. Thirdly, man, who wanted to effectively deal with the problems of the threats he faced, created safety systems. One of them is the public security system. Fourthly, in today’s security environment there is a paradox that in practice these systems function, and in theory there is no commonly accepted definition of public security. The circumstances outlined above determined the shape of this article, the essence of which was to work out a compromise definition of public security based on the interpretation of this concept by recognized authorities in the field of law, administration and security.

Opis:: The author benefitted from the support of the private security sector as the Chief Officer of the City Police. When, after leaving the service, he was the President of the Polish Association of Employers Protection Branch “Małopolska”, one of the basic objectives of his activity was to ensure a high level of functioning of the private security sector as an important component of public security. Optimisation of the use of private security companies to ensure public security and order is one of the basic directions of his practical operation and research conducted by him. In the article, the author discusses the role of the private security sector and the tasks set for this sector. The genesis of security companies, their evolution and development in various countries of Europe and the world is covered. Much attention is devoted to the de-monopolisation of security in Poland, in which the security companies played a special role. The author outlines the most important objectives of private sector development in Poland as a specific type of economic activity. The basic concepts related to the functioning of security companies are explained, exposing their priority task, which is the protection of facilities, areas and equipment important for the functioning of the state. The author shows that the current level of terrorist threats implies the need for greater involvement of security companies in providing security to facilities constituting the critical infrastructure of the state. The role of specialist armed security formations in this area is highlighted. In the conducted research process, a positive answer to the main question is given, demonstrating that security companies are currently an important element of the public security system in Poland, and their use in this area should be constantly strengthened.

Opis:: Bezpieczeństwo publiczne jest stanem będącym przedmiotem normatywnym wielu aktów regulujących obszary wymagające szczególnej troski państwa. Pojawia się ono w ich treści już w XVIII w. Mimo to nie doczekało się definicji normatywnej – legalnej. Sytuacja taka powoduje, że zdefiniowanie bezpieczeństwa publicznego stało się przedmiotem uwagi doktryny. Konieczność taka wynikała z potrzeby ujednolicenia jego stosowania przy realizacji norm prawnych je zawierających. W niniejszym opracowaniu autor podjął próbę przedstawienia ewolucji pojęcia bezpieczeństwa warunkowaną zmiennymi okolicznościami społeczno-gospodarczymi państwa. Ich prezentacja stała się podwaliną do zrozumienia współczesnych określeń bezpieczeństwa publicznego, szczególnie tych, które funkcjonują po uchwaleniu Konstytucji Rzeczypospolitej Polskiej z 2 kwietnia 1997 r. Stały się one zasadniczym elementem pozwalającym poszukiwać własnego ujęcia bezpieczeństwa publicznego. Pozwoliło również skonfrontować je z pojęciem porządku publicznego często używanego jako jedna konstrukcja z bezpieczeństwem publicznym. Dały także podstawy odniesienia bezpieczeństwa publicznego do bezpieczeństwa wewnętrznego państwa. Przedstawiony materiał pozwala ocenić zróżnicowanie pojęcia bezpieczeństwa publicznego zależne od kontekstu jego ujęcia. Dokonana w opracowaniu próba poszukiwania ujęcia bezpieczeństwa publicznego została uwieńczona propozycją jego definicji oraz współzależnej definicji porządku publicznego.
Public security is a condition of a normative subject, many regulations cover the special concerns of the state. It appears in them as early as in the eighteenth century. Still, its normative (legal) definition has not been coined. As a consequence, the provision of a definition of public security has become a subject of interest for the doctrine. This necessity resulted from the need to unify its application during the process of implementation of the relevant legal norms containing it. In the study, the author attempts to present the process of evolution of the concept of security, conditioned by the changing socio-economic circumstances of the state. Their presentation became the foundation for understanding the contemporary terms of public security, especially those that function after the adoption of the Constitution of the Republic of Poland of April 2, 1997. They have become an essential element that enables us to search for our own definitions of public security. It also allows us to confront it with the notion of public order, which is often used in conjunction with the notion of public security. Apart from that, they constitute the basis for the reference of public security to state internal security. The evidence provided allows us to evaluate the differentiation of the notion of public security depending on the context. The attempt to grasp the essence of public security made in this paper resulted in the provision of its definition as well as the definition of the interdependent notion of public order.

Opis:: Rozważania przedstawione w niniejszym artykule oparto na założeniu, że bezpieczeństwo może być postrzegane przez pryzmat wielu kryteriów, co powoduje wyodrębnienie między innymi bezpieczeństwa publicznego. Praca poświęcona została problemom identyfikacji i eksplanacji systemu bezpieczeństwa publicznego. W rezultacie opracowano artykuł, na który złożyły się treści dotyczące syntetycznego przeglądu definicji systemu i jego cech. Posłużyło to do przedstawienia struktury i reguł funkcjonowania systemu bezpieczeństwa publicznego, natury jego elementów z uwzględnieniem zagadnień relacji między nimi oraz współdziałania. W artykule dokonano przeglądu wartościowej literatury naukowej z zakresu bezpieczeństwa wewnętrznego oraz bezpieczeństwa publicznego państwa. Tak zastosowana procedura posłużyła do wskazania obszarów jednomyślnie określanych oraz tych, które wskazują na wyraźne różnice interpretacyjne problemów poruszanych w środowisku osób zajmujących się problematyką systemu bezpieczeństwa publicznego. Układ artykułu jest rezultatem zastosowania reguł eksplanacji tegoż systemu.
The considerations presented in this article have been based on the assumption that public security can be perceived from the viewpoint of several criteria, which allows the distinction of, inter alia, public security. The study is dedicated to problems underlying identification and explanation of the public security system. As a result the devised article included contents of a synthetic overview of the definition of the above mentioned system and its features. It was used to present the structure and rules of functioning of the public security system, the nature of its elements, including issues of relations between them and cooperation. The article reviews valuable scientific literature in the field of internal security and state public security. The procedure applied in such a way was used to indicate explicitly defined areas and those that indicate clear interpretation differences of problems raised in the community of people dealing with issues of the public security system. The layout of the presented article is the result of applying the explanation rules of this system

Opis:: The article aims to show the selected challenges and pathologies that affect the private security agencies in Poland. The author first indicates problems related to the legal regulations concerning the protection of persons and property, the most important of which concerns the amendment of the acts regulating the performance of some professions; then he briefly defines the organizational problems of most companies in the security sector, pointing out that the entrepreneurs in the private security sector often have no idea how to develop their own companies, have great difficulties with adapting to the changing market of the security services, do not keep up with the innovations, which all lead to offering their customers the solutions that are already outdated. This article also describes significant problems related to the market trends, with the indication of the growing costs of the remuneration of employees in this sector and the use of various forms of employment and the irregularities related to it. Finally, some of the most important problems are listed as the pathologies of the entire industry. This leads to the conclusion that the private security agencies in Poland are an incredibly significant element of the functioning of the security system, which without significant legislative changes will not fully function as intended and in accordance with its function. The presented results prove that the research on the functioning of the security agencies should be carried out on a continuous basis due to their direct impact on the internal security of the country.
