The article discusses the circumstances in which a breach of a software licence agreement additionally constitutes a copyright infringement. According to the Court of Justice of the European Union, a breach of a clause in a software licence agreement constitutes such an infringement if the clause relates to the intellectual property rights of the owner of copyright in the computer program in question. However, due to the fact that various and constantly evolving licensing models are used, it is not always obvious how to qualify a particular clause. The article explores this issue in connection with clauses that repeat statutory regulations, clauses that relate to the time or territory of use, clauses that limit the purpose of use of software and clauses that describe the scope of use in connection with licence metrics.
W artykule omówiono przypadki, w których naruszenie zobowiązań z umowy licencyjnej na korzystanie z oprogramowania komputerowego dodatkowo stanowi naruszenie majątkowych praw autorskich. Zdaniem Trybunału Sprawiedliwości Unii Europejskiej, naruszenie postanowienia umowy licencyjnej stanowi naruszenie majątkowych praw autorskich, gdy takie postanowienie odnosi się do praw własności intelektualnej podmiotu praw autorskich do tego programu. Jednak z powodu istnienia różnych i wciąż zmieniających się modeli licencyjnych, nie zawsze jest oczywiste, jak należy zakwalifikować dane postanowienie.
