Criminal labour law and the implementation of the Platform Work Directive

It evaluates how criminal labor law mechanisms, particularly misdemeanor sanctions, have functioned in prior implementations of EU directives concerning temporary agency work and posted workers. The analysis highlights the limited practical impact of fines imposed under existing labor laws and questions their adequacy in achieving the directive's goals of effective, proportionate, and dissuasive enforcement. Drawing from comparative legislative patterns, the paper explores which specific duties of digital labor platforms - especially those related to algorithmic transparency, information rights, and occupational safety - could be legally sanctioned. The discussion also considers whether administrative penalties might provide a more robust framework for protecting platform workers' rights. Ultimately, the study contributes to a broader reflection on the role of penal labor law in addressing regulatory gaps in the digital labor market.

Opis:: The article is dedicated to microworkers-highly precarious, often "invisible" workers whose labour is pivotal for the development of artificial intelligence (AI). It examines how crowdwork platforms such as Amazon Mechanical Turk, Appen and Clickworker organise the work of globally dispersed workers annotating data. It argues that, more often than not, this kind of work is performed in a highly structured, yet intransparent way, and is subject to substantial algorithmic control. This gives rise to the question of the employment classification of formally independent microworkers. The paper discusses this issue in light of the proposed Directive on the improved working conditions of platform workers.

Opis:: Platform work (the gig economy) has generated numerous legal disputes in the EU concerning the legal status of persons performing work through digital platforms and the manner in which algorithms manage their activities. In recent years, the Court of Justice of the European Union (CJEU) has delivered key judgments shaping the provisions of Directive (EU) 2024/2831 of 23 October 2024 on improving working conditions in platform work and strengthening the oversight of algorithmic management. Regulation, especially concerning this latter aspect, required cross-border attention, as managerial decisions previously taken by human supervisors have been replaced by algorithms, resulting in increased work pressure and deterioration of working conditions. The present study analyses those judgments of the Court of Justice of the European Union relevant to determining the employment status of platform workers, as well as to algorithmic transparency and oversight. The article also examines judicial rulings and administrative decisions, primarily from Spain and Italy, which have significantly shaped the European regulatory approach to platform work. The analysis addresses the legal bases, conclusions from jurisprudence, and implications for implementing Directive 2024/2831.

Opis:: Opracowanie dotyczy polskiego prawa pracy polskiego z perspektywy przekształceń zachodzących w świecie pracy. Artykuł przedstawia koncepcję stosunku pracy w świetle kodeksu pracy, podstawy prawne wykonywania pracy na własny rachunek oraz umowy cywilnoprawne o świadczenie usług. Ponadto przedstawia atypowe formy zatrudnienia w Polsce, w tym nieobowiązujące już przepisy o telepracy, a także aktualne przepisy dotyczące pracy za pośrednictwem agencji pracy tymczasowej oraz pracy zdalnej. Zdaniem autora polskie regulacje i tradycyjne koncepcje prawne nie są wystarczająco elastyczne i nie odzwierciedlają złożoności współczesnego świata pracy, w szczególności nie uwzględniają wyłaniających się nowych form wykonywania pracy zarobkowej. Polskie prawo pracy jest zakorzenione w XX w. i nie stworzyło konstrukcji prawnych, które byłyby odpowiednie dla uregulowania gospodarki opartej na krótkotrwałych umowach oraz chroniłyby pracowników platformowych i pracowników na żądanie. De lege lata Uber oraz inne platformy cyfrowe de facto nie są objęte standardami prawa pracy, a więc ustawowa ochrona osób pracujących za pośrednictwem aplikacji jest niewystarczająca. Rozwój gospodarki opartej na krótkotrwałych umowach pogłębia prekaryjną sytuację wielu uczestników rynku pracy. W konsekwencji mamy do czynienia z nieustanną erozją standardów ochrony pracy.
The contribution deals with Polish labour law from the perspective of the transformation of the world of work. The elaboration introduces the Labour Code concept of employment relationship, legal basis of an independent economic activity, as well as civil law contracts to render services. Moreover, it presents atypical forms of employment in Poland, including previous regulations on telework, and current regulations concerning temporary agency work and remote work. In author’s opinion, Polish regulations and traditional legal concepts are not flexible enough and not suitable to reflect the complexity of the contemporary world of work, particularly in light of the emergence of different legal forms of paid work performance. Polish labour law is rooted in the twentieth century and it did not ‘invent’ the prototypes that would be appropriate to regulate either the gig economy or the status of platform workers and on-demand workers. De lege lata Uber and other electronic platforms are de facto immune from labour law standards. Therefore, the statutory protection of individuals working via application is inadequate. The development of the gig economy is deepening the precarious position of numerous labour market participants. Consequently, we have to do with the continuous erosion of labour protection standards.
