    The aim of this paper is to analyze the concept of “self-deception” by Robert Trivers in the context of politics of memory. Robert Trivers is a well known American scientist who developed the theory of self-deception. His book entitled “The Folly of Fools. The Logic of Deceit and Self-Deception in Human Life” is among the most important in this field of research. A particularly distinct branch of his inquiry regards historical narration. He gives several examples of self-deception in history of mankind. Some of his remarks seem to be valuable from the perspective of politics of memory which is defined as a kind of policy aimed at stimulating historical narration in a certain way. In order to analyze the application of self-deception to politics of memory, some examples given by Trivers are critically investigated. In the summary the evaluation of the Triver’s self-deception in the context of politics of memory is given.

    The article concerns the phenomenon of self-deception and its implications for law and legal practice. The work, which is divided into several parts, in the first section presents a philosophical approach to the concept of self-deception. Various philosophical approaches to this issue are commented and discussed by author. In addition, the author also presents his own position. The next segment of the work is devoted to the discoveries of empirical sciences (psychology, neuroscience, etc.) which try to experimentally explain the reasons of self-deception. This chapter allows author to discuss the origins of this phenomenon. The third chapter deals with the occurrence of self-deception in the family sphere. In the last part of the work, the author presents his own conclusions about self-deception and its impact on legal practice, particularly on legal proceedings.
    Artykuł dotyczy zjawiska samooszukiwania i jego implikacji dla nauki prawa i praktyki prawniczej. Praca, która jest podzielona na kilka części, w pierwszej kolejności prezentuje filozoficzne ujęcie koncepcji samooszukiwania. Różne filozoficzne podejścia do tego zagadnienia opatrzone są komentarzami autora. Ponadto przedstawia on również własne stanowisko w tym zakresie. Następny segment pracy poświęcony jest już odkryciom nauk empirycznych (psychologii, neuroscience, etc.), które próbują w sposób eksperymentalny wyjaśnić przyczyny powstawania tego zjawiska w ludzkim umyśle. Rozdział ten pozwala autorowi podjąć dyskusję na temat genezy tego zjawiska. Rozdział trzeci dotyczy z kolei tematyki występowania zjawiska samooszukiwania w sferze rodzinnej. W ostatniej części pracy autor przedstawia własne wnioski oraz konkluzje dotyczące wpływu samooszukiwania na praktykę prawniczą, w szczególności zaś na postępowania sądowe.

    What are the explanatory values characteristic of concepts consid-ering humans as entities aimed at maximizing expected utility by means of coherent and logical decisions? Do citizens who are ac-tive in politics behave according to the expectations of rational choice theorists? Reviews of premises constituting rational choice theory are found in the works of authors representing multiple dis-ciplines. The vastness of these views will not be discussed within the limitations of the present article, though I have focused on the output of selected disciplines: evolutionary biology, neuroscience, and social and cognitive psychology. Among the phenomena that question the theory I have included: emotions and feelings, uncon- scious prejudices, heuristics, self-deception and the monological belief system.
