Opis:
The present text addresses the relationship between democratically and legally elected state authorities and the armed forces, which are one of instruments of governance at the state level. Through the analysis of the concepts of “apoliticism”, “subjectivity” and “objectivity” of the military in relation to state institutions, the author concludes the institutional dimension of the civilian democratic control over the armed forces, then enriching it with a non-institutional context. This allows to finally capture the essence and functional characteristics of the multidimensional phenomena, namely the civilian, democratic control over the armed forces in today's state.

Opis:
Celem tego opracowania jest przedstawienie istoty cywilnej, demokratycznej kontroli nad Siłami Zbrojnymi RP i przebiegu jej ustanowienia w Polsce, w okresie przemian społeczno-politycznych w kraju zapoczątkowanych w 1989 r. oraz w nowych uwarunkowaniach geopolitycznych w Europie Środkowo-Wschodniej. W tym czasie władze Polski doskonale oceniły sytuację strategiczną w obszarze bezpieczeństwa w otoczeniu naszego kraju i rozpoczęły aktywne działania na rzecz jego włączenia w zachodnie struktury bezpieczeństwa. Doskonale zdawano sobie sprawę z konieczności przeprowadzenia reform w całym systemie bezpieczeństwa Polski, który w tym czasie nie spełniał demokratycznych standardów obowiązujących członków Sojuszu Północnoatlantyckiego. Jednym z pilnych wymogów była restrukturyzacja Sił Zbrojnych RP z jednoczesnym ustanowieniem cywilnej, demokratycznej kontroli nad nimi. W opracowaniu nawiązano do wzorców cywilnej, demokratycznej kontroli nad wojskiem, opracowanych i prezentowanych przez wielu myślicieli i publicystów zachodnich, zajmujących się powyższą problematyką w tym okresie. Należy nadmienić, że w czasie rozpoczęcia przemian – w tym obszarze – w państwach członkach Układu Warszawskiego brakowało doświadczeń. W dalszej części opracowania przedstawiono wysiłki czynników politycznych państwa polskiego w celu ustanowienia cywilnej, demokratycznej kontroli nad Siłami Zbrojnymi i przeprowadzenia wojska przez trudny, skomplikowany proces restrukturyzacji. W zakończeniu przedstawiono potrzebę usprawnienia relacji cywilno-wojskowych, które mają znaczny wpływ na sposób funkcjonowania Sił Zbrojnych i informowania społeczeństwa o sprawach obronnych.
The purpose of this study refers to the presentation of the civil and democratic aspects of the control over armed forces of the Republic of Poland as well as the course of its establishing in Poland in the period of political and social transformations in Poland launched in 1989 and with regard to new geopolitical determinants appearing in the Central and Eastern Europe. The authorities of Poland at this time perfectly evaluated the strategic situation concerning the security around our country and undertook activate efforts to introduce it into the western security structures. It was perfectly known that it was necessary to carry out reforms with regard to the whole security system of Poland which at this time did not meet democratic requirements binding placed for NATO members. One of an urgent requirement referred to the restructuring of the armed forces of the Republic of Poland with a simultaneous establishing of a civilian, democratic control over them. This study refers to examples of civilian, democratic control over the army prepared and presented by numerous Western thinkers and publicists dealing with the above mentioned themes during that period. It shall be stated that at the beginning of the transformations within that area member countries of the Warsaw Pact had no sufficient experience. A further part of the study presents efforts of political factors of Poland undertaken to establish a civilian democratic control over armed forces and to lead the army through a difficult and complicated process of restructuring. The conclusion presents the need to enhance the civil and military cooperation which exerts a considerable impact on the manner of the operation of armed forces and informing of the society about defense matters.

The article presents the most serious threats to the image of the Polish Army. The beginning of the research period was adopted in 2009 as the moment of starting the process of professionalization. It was a period in which missions outside the country were a particularly important threat to image. In the light of public opinion, nowadays the most serious threat is the partial politicization of the image of the army.After identifying the most serious image threats, the problem of researchers was formulated and expressed in the question: how people and institutions responsible for creating the image of the Polish Army should counteract to the most serious image threats?In this article, the recapitulated research was accompanied by the hypothesis that in order to counteract the most serious image threats, there should be an extension of civilian meaning and democratic control over the army. This control should include actions of state authorities protecting the military from the negative image-related effects of political decisions and ongoing political rivalry.

The purpose of the study “Civilian and democratic control over the Armed Forces on the background constitutional principles” is to analyze legal position of the Armed Forces in state and operating of a complex mechanism of public authorities conducting a policy of defense of the state by means of Armed Forces. The need to analyze these legal regulations is justified by the fact that expressed in article 26 of Polish Constitution principle of civilian and democratic control under politically neutral Armed Forces is a novelty in Polish constitutional law. Consequently, the scope of study concerns the constitutional status of army under "normal" functioning of the Basic Law and the entire legal system. This means the total omission of different role of the Armed Forces under a state of emergency, in the variant of martial law, a state of emergency and natural disaster. Presented in four chapters comments have enabled to perform the necessary legal analysis in the area of institutionalized civilian control over the Armed Forces carried out by the competent authorities of the State. The Constitution has created specific model of functioning Armed Forces in a democratic state and a model of command and control of their activities by civilian public authorities.
Celem niniejszej pracy "Cywilna i demokratyczna kontrola Sił Zbrojnych na tle zasad konstytucyjnych Rzeczypospolitej Polskiej", jest analiza pozycji prawnej Sił Zbrojnych w państwie, jak również analiza działania złożonego mechanizmu funkcjonowania organów publicznych realizujących politykę obronną państwa przy pomocy Sił Zbrojnych. Potrzeba przeprowadzenia analizy w tym obszarze prawnym uzasadnia okoliczność, iż wyrażona expressis verbis w art. 26 Konstytucji zasada cywilnej i demokratycznej kontroli nad neutralnymi politycznie Siłami Zbrojnymi stanowi novum w polskim prawie konstytucyjnym. Praca ta jest opracowaniem relacji między państwem a Siłami Zbrojnymi RP na tle zasad konstytucyjnych zawartych w Konstytucji RP z dnia 2 kwietnia 1997 r. W związku z tym zakres przedmiotowy pracy dotyczy konstytucyjnego statusu wojska w warunkach „zwyczajnego” działania ustawy zasadniczej i całego systemu prawa. Oznacza to całkowite pominięcie w dokonanej analizie, odmiennej roli wypełnianej przez Siły Zbrojne w warunkach stanu nadzwyczajnego, w wariancie stanu wojennego, wyjątkowego i klęski żywiołowej. Przedstawione w czterech rozdziałach uwagi pozwoliły dokonać niezbędnej analizy prawnej w obszarze zinstytucjonalizowanej cywilnej kontroli nad Siłami Zbrojnymi wykonywanej przez właściwe organy państwa. Konstytucja stworzyła bowiem swoisty model funkcjonowania Sił Zbrojnych w warunkach państwa demokratycznego oraz model kierowania i kontroli ich działalności przez cywilne władze publiczne.

Opis:
The paper stresses the need to reform the European Central Bank with the aim to strengthen the democratic legitimation of this institution within the particular EU governance system. Indeed, the study argues for more accountability of the ECB before the citizens without giving up independence. The analysis (also conducted from a comparative-law point of view) shows that the objective can be assured fostering a stronger involvement of the Parliament firstly in the procedure for the appointment of the Members of the ECB’s Executive Committee, within a wider reform of the whole EU institutional setup and of the Eurozone’s organization in particular.
W artykule podkreśla się potrzebę zreformowania Europejskiego Banku Centralnego w celu wzmocnienia jego demokratycznej legitymizacji w ramach konkretnego systemu zarządzania UE. Badania dowodzą, że EBC powinien wykazać się większą odpowiedzialnością przed obywatelami, nie rezygnując przy tym z niezależności. Analiza (również prowadzona z punktu prawnoporównawczego widzenia) pokazuje, że cel ten można osiągnąć przez większe zaangażowanie Parlamentu przede wszystkim w procedurę mianowania członków Komitetu Wykonawczego EBC – w ramach szerszej reformy całego układu instytucjonalnego UE, a organizacji strefy euro w szczególności.
