    Opis:
    The opinion deals with the Deputy’s bill submitted in consequence of the adoption of the resolution of the Supreme Administrative Court concerning procedural capacity of the head of commune, mayor and president of town. According to the author, the purpose of the bill is justified and correct, but its provisions are internally inconsistent. The bill introduces changes in legislation by spot method, which deprives the system of consistency and internal logic.

    Opis:
    The Senate bill implements the obligation to adjust the law to the judgment the Constitutional Court of 4 December 2012 (Ref. No. U 3/11). The bill involves a change in the Supreme Court Act by adding specific elements required from the request of the Public Prosecutor General for annulment of a final judgment in relation to a case that, at the time of adjudication – because the person concerned – did not fall within the jurisdiction of Polish courts or in which at the time of adjudication court action was not admissible. The bill also provides for establishing a procedure for examination of requests by the Supreme Court. The authors of the opinion conclude that the changes proposed by the Senate are flexible and can be used both in relation to judgments pronounced both in civil proceedings and in criminal proceedings.

    Celem pracy jest wyczerpująca analiza zagadnienia zadań samorządu gminnego, dokonana na podstawie obowiązujących aktów prawnych oraz poglądów doktryny. W pierwszej części została dokonana klasyfikacja norm prawa administracyjnego oraz ich wpływ na konstrukcje zadań. Druga część została poświęcona samorządowi gminnemu poprzez przybliżenie źródeł prawa oraz szczegółową analizę obecnego stanu prawnego w zakresie klasyfikacji oraz wykonywania zadań. Ze względu na zawężony zakres rozważań, celem pracy jest wykazanie istoty i charakteru prawnego regulacji, bez wchodzenia w szczegółowe materie normatywne.
    The aim of the work is an exhaustive analysis of the problem tasks municipal government, made ​​on the basis of existing legal acts and views of doctrine. The first part is about classification and standards of administrative law and their impact on construction of tasks. The second part is about municipal self-government by bringing the sources of law and a detailed analysis of the current legal status in the classification and perform tasks. Due to the restricted range of considerations, the aim of this work is to demonstrate the essence and nature of legal regulation, without going into specific normative fabrics.

    Opis:
    Kwestia zdolności sądowej jednostek organizacyjnych Krajowej Administracji Skarbowej nie jest uregulowana jednolicie. W sprawach stricte cywilnych nie mają one zdolności prawnej, a w konsekwencji nie przysługuje im zdolność sądowa. W postępowaniu cywilnym nie występują zatem samodzielnie, a jedynie jako reprezentanci Skarbu Państwa. Natomiast w postępowaniu odrębnym w sprawach z zakresu prawa pracy i ubezpieczeń społecznych jednostkom organizacyjnym Krajowej Administracji Skarbowej przysługuje szczególna zdolność sądowa na podstawie art. 460 § 1 k.p.c. Celem artykułu jest rozstrzygnięcie, w jakim zakresie jednostki organizacyjne Krajowej Administracji Skarbowej korzystają ze szczególnej zdolności sądowej. Zależy od tego m.in. odpowiedź na pytanie, kto w obecnym stanie prawnym powinien być stroną pozwaną w sprawach z powództwa funkcjonariuszy Służby Celno-Skarbowej, w szczególności w postępowaniach sądowych o zasądzenie równoważników pieniężnych za brak służbowego lokalu mieszkalnego.
    The capacity to be a party to court proceedings in the case of the organisational units of the National Revenue Administration has not been regulated in a uniform manner. They do not have legal capacity in strictly civil matters and, by extension, they do not have capacity to be a party to court proceedings. Therefore, they do not act on their own in civil proceedings; they only act as representatives of the State Treasury. Conversely, the organisational units of the National Revenue Administration have special capacity to be a party to court proceedings pursuant to Article 460 para. 1 of the Civil Procedure Code in separate proceedings on matters concerning labour and social security law. The purpose of this paper is to decide to what an extent the organisational units of the National Revenue Administration take advantage of their special capacity to be a party to court proceedings. Depending on the outcome, it will be possible to answer, among other things, who should be the defendant in cases brought by the officers of the Customs and Tax Task Forces, particularly in court proceedings for the award of financial equivalents for the lack of tied accommodation.

    Opis:
    So far, the legal representation of the State Treasury has raised serious doubts in Polish law. They were eliminated by the Act of 16 December 2016 on the principles of state property management. It aligned the provisions on legal (material) representation of the State Treasury with those concerning representation before courts and other authorities.
