This master's thesis presents the issues of leading a person, through abetting or aiding, to taking their own life. The aim was to comprehensively present the criminal law, criminological, and forensic aspects of the discussed phenomenon. An essential element was also to present a theoretical, as well as a practical approach, through conducting dedicated research.The thesis consists of six chapters. The first chapter presents the definition of the word suicide, its types, and statistics related to suicide and crimes regulated in Article 151, Article 190a § 3, and Article 207 § 3 of the Criminal Code. The second and third chapters are dedicated to legal regulations in Poland and other selected countries, mainly the United States of America. The fourth chapter focuses on the criminological aspects of the presented phenomenon, the perpetrator and the victim, their motivations, the issue of farewell letters and the Internet's influence on suicide. Chapter five describes the forensic aspects of the crime, including forms of committing, methods of taking one's own life, as well as investigation, and identifying the perpetrator. Chapter six presents the research conducted on files and the conclusions resulting from them.
Niniejsza praca magisterska przedstawia problematykę doprowadzenia poprzez namowę lub udzielenie pomocy do targnięcia się człowieka na własne życie. Celem było kompleksowe zaprezentowanie zarówno aspektów prawnokarnych, kryminologicznych, jak i kryminalistycznych omawianego zjawiska. Istotnym elementem było również przedstawienie ujęcia teoretycznego i praktycznego, poprzez przeprowadzenie własnych badań. Praca składa się z sześciu rozdziałów. W rozdziale pierwszym przedstawiono definicję słowa samobójstwo, jego rodzaje oraz statystyki związane zarówno z samobójstwem, jak i przestępstwami uregulowanymi w artykule 151 k.k., artykule 190a § 3 k.k. oraz artykule 207 § 3 Kodeksu karnego. Drugi i trzeci rozdział poświęcone są regulacjom prawnym obowiązującym w Polsce oraz w wybranych państwach, głównie w Stanach Zjednoczonych Ameryki. Rozdział czwarty skupia się na aspektach kryminologicznych prezentowanego zjawiska, osobie sprawcy oraz pokrzywdzonego, motywacjach którymi się oni kierują, a także listach pożegnalnych i wpływie Internetu na samobójstwo. W rozdziale piątym opisano kryminalistyczne aspekty przestępstwa, m.in. formy jego popełnienia, metody odebrania sobie życia, a także oględziny i metody identyfikacji sprawcy. W rozdziale szóstym zaprezentowano przeprowadzone badania aktowe oraz wnioski z nich wynikające. - Dostawca treści:
