Przedmiotem niniejszej pracy są wzajemne rozliczenia stron nieważnej umowy kredytu indeksowanego do waluty obcej. Temat ten stał się szczególnie istotny w postępowaniach między konsumentami a bankami dotyczącymi abuzywności klauzul indeksacyjnych w kredytach indeksowanych do franka szwajcarskiego. W pracy przeanalizowano orzecznictwo sądów krajowych oraz Trybunału Sprawiedliwości Unii Europejskiej dotyczące braku możliwości utrzymania w mocy umowy kredytu indeksowanego do waluty obcej zawierającej niedozwolone postanowienia oraz rozważono możliwe sankcje dotykające taką umowę. Zasadniczą część pracy zajęło omówienie podstawy prawnej i zasad wzajemnych rozliczeń stron, kwestii wymagalności oraz przedawnienia roszczeń stron. Szczególną uwagę poświęcono dopuszczalności domagania się wynagrodzenia za korzystanie z kapitału.
The subject of this thesis is the mutual settlements of the parties to an invalid credit agreement indexed to a foreign currency. This issue has become particularly relevant in proceedings between consumers and banks concerning the unfair terms in loans indexed to the Swiss franc. The thesis analyzed the jurisprudence of national courts and the Court of Justice of the European Union regarding the impossibility of maintaining an agreement indexed to a foreign currency containing unfair terms and considers possible sanctions affecting such an agreement. The main part of the thesis was devoted to discussing the legal basis and rules of mutual settlements of the parties, the issue of maturity of a claim, and the limitation of claims of the parties. Particular attention was paid to the admissibility of demanding remuneration for the use of capital. - Dostawca treści:
