Opis:
Im folgenden Beitrag, der den Teil einer umfassenden deutsch-polnischen kontrastiven Studie zur sprachlichen Unhöfl ichkeit und Hatespeech in parlamentarischen Debatten ausmacht, habe ich mich auf die Identifi zierung und Charakterisierung von Hatespeech konzentriert. Das Korpus bilden Stenogramme von zwei Reden. Während im Sejm Krzysztof Kasprzak als Vertreter eines Komitees seine Rede der Gesetzesinitiative „Stop LGBT“ gewidmet hat, hat im Bundestag der AfD-Abgeordnete Jens Maier über Bedrohungen seitens des Islams gesprochen. Die Rede im Sejm wurde am 28. Oktober 2021 und die im Bundestag am 6. November 2020 gehalten. Untersucht wurden einerseits die Argumentationsstrategien beider Redner, andererseits welche Ähnlichkeiten und Unterschieden dabei vorkommen. Wie die Analyse gezeigt hat, können Fragmente beider Reden als Hate Speech klassifi ziert werden, weil sie LGBT und Muslime diff amieren und verunglimpfen. Es wurden negativgeladene Lexeme und Ausdrücke verwendet, die zur Auslösung von negativgeladenen Assoziationen und Zuschreibung von negativen Attributen gedient haben. Durch die Verwendung von Negation möchte Maier den Mangel an positiven Werten des Islam hervorheben, während Kasprzak zum Ziel hat, seine Durchsetzungskraft zu implizieren. Darüber hinaus manipuliert der polnische Redner, indem er die Sorge um polnische Familien und Kinder ausdrückt, um dadurch seine Angriff e auf LGBT zu rechtfertigen und vergleicht LGBT mit Nazismus, um die Gemeinschaft dadurch herabzuwürdigen. Auff orderungen sind dagegen für die Rede Maiers charakteristisch. Sie lassen sich auf zwei allgemeine Formeln zurückführen: Man muss etwas gegen Muslime in Deutschland tun und Man muss den Muslimen in Deutschland etwas entziehen.
In the following article, which is part of a comprehensive German-Polish contrastive study on linguistic impoliteness and hate speech in parliamentary debates, I have focused on the identification and characterization of hate speech. Th e corpus consists of stenograms from two speeches. While in the Sejm Krzysztof Kasprzak dedicated his speech to the Stop LGBT law initiative, in the Bundestag the AfD MP Jens Maier spoke about threats from Islam. The speech in the Sejm was held on the 28th of October 2021, and the speech in the Bundestag on the 6th of November 2020. On the one hand, the argumentation strategies of both speakers were examined, as well as the similarities and differences between them. As the analysis showed, fragments of both speeches can be classified as hate speech because they defame and denigrate LGBT people and Muslims. Negatively charged lexemes and expressions were used, which served to trigger negatively charged associations and the attribution of negative features. By using negation, Maier aims to emphasize Islam’s lack of positive values, while Kasprzak aims to imply its assertiveness. In addition, the Polish speaker manipulates by expressing concern for Polish families and children in order to justify his attacks on LGBT people and compares LGBT people to Nazis in order to demean the community. Incitements, on the other hand, are characteristic of Maier’s speech. They can be traced back to two general formulas: Something must be done about Muslims in Germany and Something must be taken away from Muslims in Germany.

The article deals with the problem of hate speech in the legal, cognitive, and linguistic fields and presents an analysis of the different views and interpretations of this problem in academia. The terms “hate speech" and “hostile language" are semantically delimited in the Ukrainian language as non-identical. Specific examples are given of the use of hate speech from the Ukrainian press and online media. The article proposes criteria for value judgments which do not represent hate speech. Statements about national and racial characteristics and identity are considered. The article proposes a specific algorithm for the implementation of linguistic expertise regarding the detection of hate speech.
W artykule zajęto się problemem mowy nienawiści w sferze prawnej, poznawczej i językowej oraz dokonano analizy różnych poglądów i interpretacji tego problemu w środowisku akademickim. Terminy "mowa nienawiści" i "wrogi język" są w języku ukraińskim semantycznie rozgraniczone. Podano konkretne przykłady użycia mowy nienawiści z ukraińskiej prasy i mediów internetowych. Zaproponowano kryteria ocen wartościujących, które nie stanowią mowy nienawiści. Rozważono wypowiedzi dotyczące cech narodowych i rasowych oraz tożsamości. Zaproponowano specyficzny algorytm realizacji ekspertyzy lingwistycznej dotyczącej wykrywania mowy nienawiści.

The aim of the article is a study into legal instruments for minority protection from discrimination in public space based on ethnic or national origin. As an example a case study of a phrase „concealed German option” and its consequences for German minority and Silesian ethnic group is used. The research question is as follows: how legal instruments for protection from discriminatory language in public space are shaped in relation to non-dominant groups with diverse legal status? The hypothesis assumes, that legal status of the group have a significant meaning for protection from discrimination of the group as a whole, but also for individuals who belong to the group from actions degrading human dignity. The structure of the article encompasses an introduction to the situation of German minority in Poland and Silesian ethnic group, legal documents analysis and analysis of the social and political circumstances of functioning of both groups in public space. The conclusion states, that both German minority and Silesian ethnic group are discriminated in public space, what is especially related to limitations of the right to cultivate and manifest one's own identity. Despite this situation, existing legal instruments are not enough to change it, furthermore – their today's application only deepens the problem.
Celem niniejszego artykułu jest zbadanie narzędzi ochrony grup mniejszościowych przed dyskryminacją w przestrzeni publicznej ze względu na pochodzenie etniczne lub narodowe. Jako przykład posłuży studium przypadku określenia „ukryta opcja niemiecka” i jego konsekwencje dla mniejszości niemieckiej i śląskiej grupy etnicznej. Pytanie badawcze zostało ujęte w następujący sposób: jak kształtują się instrumenty ochrony prawnej przed dyskryminującym językiem w przestrzeni publicznej w odniesieniu do grup niedominujących o różnym statusie prawnym? Struktura artykułu obejmuje wprowadzenie do problematyki mniejszości niemieckiej w Polsce oraz śląskiej grupy etnicznej, analizę aktów prawnych oraz kontekstu społeczno-politycznego funkcjonowania obu wymienionych grup w przestrzeni publicznej. Konkluzjaartykułu wskazuje, że zarówno mniejszość niemiecka, jak i śląska grupa etniczna w przestrzeni publicznej podlegają różnorakim przejawom dyskryminacji, związanej przede wszystkim z ograniczaniem prawa do kultywowania i manifestowania swej tożsamości. Mimo to istniejące instrumenty prawne nie wystarczają, by zmienić ten stan rzeczy, co więcej – aktualne ich stosowanie jedynie go pogłębia.

The author attempts from the axiological perspective of the media, as well as from the semiological and linguistic perspectives, to answer the question of what the role of media language is in shaping and promoting real attitudes of hostility and hatred, and conversely, how cultural and media tendencies shape hate speech in the media. The author does not analyse the material aspect of language, but rather tries to look critically at certain trends shaping new forms of media language that bear negative values.

The aim of the study was to present the main threats related to the use of the Internet by the Polish youth and to analyse them with particular emphasis on issues related to hate speech. Using the Internet, apart from its undoubted usability, brings with it a number of threats, among which are: malware (including spyware, ransomware, “crypto-miners” and adware), invasion of privacy (both by private individuals (stalking) and advertising companies), phishing, spam, hate speech, paedophilia, human trafficking, cyber-bullying, and, less frequently, targeted attacks. According to the survey, nearly 70% of the respondents encountered threats on the Internet. The phenomenon of hate speech affects 37% of respondents who fell victim to it and 18% who practised hate speech.

Towards a materialist account of derogatory speech

The topic of this essay is derogatoriness of speech in the sense of its capacity to harm or offend in a way that is commonly taken to be unacceptable in a liberal society. I take the folk terms slur and hate speech to aim at capturing this aspect. The question I am interested in is: what makes speech derogatory, as opposed to merely insulting? I identify two main ways of approaching this question, both in public discourse and in philosophical theorizing: an expressivist approach (derogation consists in expression of hateful attitudes, e.g. Marques 2023, Jeshion 2013) and an identitarian one (derogation results from violating people’s right to self-identification, including choice of respectable terms for the group they belong to; e.g. Anderson and Lepore 2013). I argue that both approaches face difficulties with their theoretical foundations and empirical adequacy, but more importantly they are politically problematic, as they allow for powerful social groups to label any dissent or criticism as derogation. The common problem of the expressivist and identitarian approaches is that they are essentially subjectivist, basing their construal of derogatory speech on the attitudes of either, respectively, the speaker or the target. However, not every inimical attitude is derogatory, and not everyone who feels insulted is thereby derogated - in the strongly normative sense implied by our concepts of slurs or hate speech. One can stipulate additional extra-subjective conditions under which the attitudes in question support classifying some speech as derogatory - but that makes it doubtful if relying on the attitudes is necessary at all. I propose an account of derogatory speech that does away with subjective conditions and defines derogation as property of speech that is a material part of social practices of discrimination and subordination. Instead of considering the (unavoidably opaque and often self-serving) attitudes of actors in a public sphere, we should focus on the material analysis of actual, objectively observable practices. To substantiate this approach to derogatory speech it is necessary to explain how it can materially contribute to practices of discrimination and subordination. To do this I refer primarily to theories of social practice and ideology found in the work of Sally Haslanger (2012, 2018) and Louis Althusser (1971). On the view I outline, the role of speech is not to create social situations of subordination, but to legitimize and reproduce them. Derogatory speech interpellates its targets as subordinate subjects of already existing practices of discrimination and violence. That is also why offending or insulting speech targeted at those in power cannot constitute derogation.

The article is divided into two main parts. It refers to selected data on hate crimes recorded in Poland and Police effectiveness regarding preventing, investigating and combating such kinds of crimes. Based on available sources there is no problem with extremist activity in a large-scale in Poland nowadays, but for sure there is an urgent one with the increasing number of hatemotivated incidents, both with its social impact. Awareness-raising and educational campaigns that aim at promoting respect for human rights and tolerance for diversity are much needed in this matter. Also, law enforcement agencies, including Police, play a key role while tackling racism and bias. An uncontrolled and unpunished manifestation of hate, both with the lack of an appropriate and unequivocal state response to such incidents, also quiet, social approval to hate-motivated behaviours, seem to be the main components of extreme movements growing. Thus, the main aim of the article was to describe the phenomenon of hate-motivated incidents that were reported in Poland within the past years and to diagnose Polish police officers’ skills, knowledge and qualification in this field, both qualitative analyses of accessible training programmes. Selected terms (racism, discrimination, intolerance, xenophobia and hate speech) and symbols (the Celtic Cross, the SS-Totenkopf and the Triskele) that promote hate were defined (part 1) both with Police officers’ identification accuracy. Research results presented in this article were gathered by using a variety of methods and techniques, both theoretical and empirical (part 2). The data that refers to Police competence in the context of preventing, investigating and combating hate crimes was mainly collected as a part of a doctoral research conducted by the author in 2012–2014.
