Opis:: According to the bill, the act should enter into force on 1st of July 2017, although without certain articles, which are supposed to enter into force later. In case of a non adoption of the act the European Commission can initiate proceeding under article 258 Treaty on functioning if the European Union, urging to remedy the infringement. If the state does not eliminate the breach, the case may be brought before the Court of Justice of the European Union. If the Court finds that the complaint was justified, a financial penalty may be imposed on the country. The penalty is adopted in the form of a lump sum or a periodic financial penalty.

Opis:: Rozwój parlamentaryzmu w Polsce po okresie transformacji ustrojowej wyznaczył nauce prawa konstytucyjnego niezwykle wysoki „popyt” na nowe rozwiązania ustrojowe. Intensywnie rozwija się też komparastyka poszukująca nowych rozwiązań w ustrojach innych państw po to, by wciąż doskonalić instytucje prawne . Na tle tych procesów można dostrzec także rozwój zagadnień dotyczących kontrolnych funkcji instytucji publicznych nad innymi podmiotami, co wiąże się z podstawowym problemem, polegającym na tym, że w życiu społeczno-politycznym są widoczne zdarzenia o różnorakim charakterze; część z nich powoduje wszczęcie czynności kontrolnych w celu zbadania zgodności tych działań z przepisami prawnymi. Fenomenem jest szybki rozwój i coraz powszechniejsze zastosowanie instytucji komisji śledczych Sejmu, które są bytami ze styku zagadnień ustrojowo-politycznych i realnej polityki. Niniejsza praca będzie poruszała zagadnienia dotyczące rozwiązań systemowych dotyczących kontroli parlamentarnej w Polsce, aby na jej tle można było lepiej dostrzec rozwój i wzrost zastosowania w praktyce instytucji komisji śledczej. Poświęcona będzie także zbadaniu podobnych rozwiązań w innych systemach prawnych oraz opisaniu prawnego zarysu tej instytucji a także pozycji komisji śledczej w systemie organów publicznych.
Development of (evolution of) parliamentarism has appointed constitutional in poland after period of structural (government) transformation on new structural (government) solutions science high right. It spreads out in other structures of states intensively too searching for new solution for komparastyka, in order to perfect legal institutions still. It is possible to sight development of (evolution of) question on background over other subjects these processes also concerning check function institution public, that is tied with basic problem, rely on it, that visible events are in social and politic life about different character; part causes initiating of check action (function) from they for this researching correspondence of (conformity of) operation with legal regulations. Fast development (evolution) is wonder and general employment of institution of commission of investigating sejm more, which (who) is life from (with) -political question structurally (government) styku and real politics (policy). The present (hereby) work will move questions in poland concerning solution system concerning control parliamentary, in order to it was possible to sight development (evolution) on its (her) background better and incrementation of (growth of) employment in practice of institution of investigating commission. Devoted will be in other legal systems researching of similar solution also and description of legal outline of (plot of) this institution as well as in system of public organ position of investigating commission.

Opis:: This paper presents the way the European Commission (EC) views the European Union’s future and its own future role. It argues that despite the new rules introduced by the Treaty of Lisbon, the EC will not become overly politicized after the 2014 European elections. The paper also outlines the case for political union through a “democratic federation of nation states”, as proposed by the President of the European Commission Jose Manuel Barroso in State of the Union 2012, and discusses the Commission’s proposals for further economic integration in the Eurozone and the EU in general, with special focus on the European Semester procedure and the EU’s new economic governance. The Commission’s projects are then put in the context of predictions about the EU’s future, made by researchers dealing with the subject.

Opis:: In a recent judgment in ERGO Poist’ovňa, a.s. v Alžbeta Barlíková, the Court of Justice of the European Union attempted to clarify the ambit of Article 11 of Council Directive of 18 December 1986 on the coordination of the laws of the Member States relating to self-employed commercial agents, that is the circumstances where a commercial agent’s right to remuneration may be extinguished should a negotiated transaction not be executed between the principal and the client. Notably, the Court held that in the event of even partial non-execution of a negotiated contract between the principal and the third party client, provided it happened due to no fault on the part of the principal, the agent’s right to commission is proportionately extinguished. The paper discusses the judgment in the light of previous CJEU case law and the Polish transposition of the said European standards with a view to finding any potential divergences between the two. The paper notes two problems. First, Polish law, as opposed to Slovak law, does not recognize an automatic termination of an insurance contract in the event of default on the part of the customer. Conversely, whether such an effect eventuates is left to contractual discretion of the parties. Second, Polish courts have been recently willing to substitute unjust enrichment for contractual liability even where, it appears, complainants have valid claims under Article 7614 of the Civil Code.

Opis:: On 28 December 1944, the Central Jewish Historical Commission (CŻKH) was established at a meeting, During the first few months of its life, a dense network of regional branches was established, with five voivodship commissions (in Kraków, Wrocław, Warsaw, Białystok and Katowice) and twenty-one lower-level local commissions. The Kraków branch launched intensive efforts in many areas as soon as it was established. In a report on his July 1945 inspection there, CŻKH representative Noe Grüss declared: “The Central Jewish Historical Commission looks with pride and satisfaction at the works of the Kraków Commission, which is the only unit so far to have exceeded the task of gathering materials and became a co-author of the great work of recording the tragedy of Polish Jewry”.The archives of the Kraków Commission, deposited at the Jewish Historical Institute, are the wealthiest of the regional Central Commission records held there. Its contents attests to the vigorous efforts of the Kraków branch, the value of the research done by it, and it also warrants the hypothesis about its unique accomplishments, confirmed by subsequent scientific careers of its employees.

Opis:: Nas últimas décadas, com o processo de redemocratização ocorrido a partir dos anos de 1980, os países da América Latina implementaram importantes medidas para enfrentar o legado autoritário nas sociedades contemporâneas. Opis:: Opinion of the Venice Commission about amendments to the Constitutional Tribunal Act of 2016 was prepared upon the request of the Polish Minister for Foreign Affairs, Witold Waszczykowski. In his request, he identified the constitutional issues to be examined by the Commission. As stated by the Commission itself, the opinion referred to the composition of the Constitutional Tribunal. In its Opinion, the Commission makes an assessment, recommendations and suggestions, at the same time declaring its continuing support. In this respect, it did not go beyond the standard procedure, which does not prejudge the issue of whether it is right in its assessments. The Polish authorities are not legally bound by the findings of the Commission’s Opinion which, however, contains some recommendations and suggestions that deserve response.
