Opis:
The purpose of this study is to present selected aspects of complex issues of transformations in the public administration system of Ukraine, and changes of administrative law in the context of the European integration process. The author, on the one hand, points to new possible duties of public administration bodies created by the European integration process, and, on the other hand, raises attention to new challenges facing the public administration reform, in particular in the candidate states to the European Union, such as Ukraine. The author establishes strong links between the public administration reform and the European integration process. It is of great importance if an aspiring EU member is to prepare its administration well for the challenges of EU membership.

Opis:
Medical Device Regulation (MDR) entered into force in 2017 and became applicable in 2021. In the context of Europeanization and the European Union (EU) multilevel governance system, regulations are used as a means of unification. EU has gradually increased the degree of convergence in medical devices, even though medical devices pertain to the health sector, which is within the Member States’ competence. Despite MDR being a regulation, its preamble states that its aim is to harmonize rules for the placing on the market and use of medical devices on the EU market. This article analyzes the level of convergence introduced by the MDR and its impact on regulatory complexity. Our findings demonstrate that many relevant elements, such as mandatory CE marking, reached the level of unification, whereas some that are still to become legally effective, such as the European database on medical devices (EUDAMED), went further and reached the highest level – supranational and integral joint administrative capacities. Unlike the expected inverse correlation between EU convergence and regulatory complexity, our findings revealed that due to delays in bringing into effect certain unifying elements, de facto, MDR introduced additional constraints compared to the previous Medical Device Directive (MDD) framework. This leads to the main finding of this research, which is that the MDR convergence increase has led to a conflicting outcome – an increase in regulatory complexity.

Opis:
The EU Member States are characterised by long and varied institutional history, with different trajectories in their evolution. There is a complex system of relations between the institutions of the European Union and the authorities of the Member States, which are called as the European Administrative Space. This is a multidimensional concept, and it promotes intensive cooperation between administrative actors, and their activities from each level. The European Administrative Space is the area, in which increasingly integrated administrations jointly exercise power delegated to the EU in a system of shared sovereignty. This article explores the reasons for and the consequences of this development.
Państwa członkowskie UE charakteryzują się długą i zróżnicowaną historią instytucjonalną, z różnymi trajektoriami ich ewolucji. Istnieje niezwykle złożony system relacji między instytucjami Unii Europejskiej a organami publicznymi państw członkowskich, który nazywany jest europejską prze strzenią administracyjną. Jest to koncepcja wielowymiarowa, która obejmuje intensywną współpracę między organami administracji oraz ich działania na każdym poziomie. Europejska przestrzeń administracyjna to obszar, w którym organy administracji państw członkowskich we wzajemnej współpracy wykonują uprawnienia przekazane UE w ramach systemu wspólnej suwerenności (ang. shared sovereignty). Niniejszy artykuł bada przyczyny i konsekwencje rozwoju tego obszaru.

Przedmiotem publikacji jest zagadnienie „agencyfikacji” europejskiej przestrzeni administracyjnej. Problem wzrostu liczby europejskich urzędów regulacyjnych, tzw. agencji zdecentralizowanych został poddany analizie przez pryzmat ich autonomii instytucjonalnej. Z ponad trzydziestu gremiów tego typu jako przykład posłużyła Europejska Agencja Bezpieczeństwa Lotniczego, która dysponuje szerokim katalogiem uprawnień o charakterze decyzyjnym i quasi-regulacyjnym.
The paper analyzes problems connected with the processes of “agencification” identified in the European administrative space. The growing number of European regulators, especially decentralized agencies, is analyzed through the prism of their evolving institutional autonomy. From more than thirty such bodies existing in the EU, the Author chose to focus on the example of the European Aviation Safety Agency, which has a wide catalogue of decision-making and quasi-regulatory powers.

The primary objective of the study was to determine the unique characteristics of the axiology of the law of the European legal space and its impact on the development of the administrative courts system in Poland by indicating its rooting in legally expressed values, as well as in extra-legal values that are common axioms of the European legal space discussed herein. It was noted that international law – which is the background of the study – determines the basis for the operation of a democratic state, thus exerting a fundamental and significant influence on the formation of standards of democratic states in Europe, including the administrative court system in Poland. The achievement of the primary objective of the deliberations will be assisted by two intermediate objectives. The first one, seeking to lay the foundations for the introduction of the aforementioned “European legal space” category as a normative category that includes a common axiology of law, which underlies the democratic state, including the nature of human rights, through the analysis of the legal and non-legal norms that form that category. The achievement of the second intermediate objective, on the other hand, will make it possible in fine to treat that space as a normative and axiological concept to rot the unique structure of the administrative court system in Poland as one of the structural elements of the democratic system. In the literature on the subject, the issue of the axiology of the law of the European legal space from the standpoint of its impact on the administrative court system in Poland has not been analyzed in a comprehensive manner, and the available publications only partially address this topic, which prompted the study of the issue stated in the title of this paper. By setting the framework for the deliberations, they were narrowed down to the European legal space, which was considered to be the normative space of influence of European international organizations, namely the Council of Europe, the European Union, and the Organization for Security and Cooperation in Europe. The purpose of the specific scope of the conducted analyses have resulted in the use of specific research methods. The dogmatic-legal method was the leading method, and it is present virtually all parts of the deliberations. The position of the doctrine was analyzed Polish and foreign monographs and papers, as well as acts of universally applicable international law and those of a regional nature. The case law of international courts was also analyzed. The author made an extensive use of the legal-comparative method. It proved useful in the search for a way to define the concept of the European legal space, as well as other concepts, due to the need to confront the legal achievements of the international organizations that make up that space.
