Opis:: The thesis is about prohibiton of sex discrimination in employment in theEuropean Union law. The main purpose of the thesis is the analysis of theEuropean Union law acts that concern combate sex discrimination inemployment as well as the presentation of extra-legal activities. The workpresents also an analysis of legal acts in Polish national law with respectfor agreement to the European Union law. It was based on theliterature,1the European Union and national legislation. The study verifiedthe assumption that the rights of women and men to equal treatment inemployment are effectively protected by the legal and non-legalinstruments.

Opis:: The aim of this paper is to present some remarks on the problems of the European Union as a system of 27 member states. It may be useful to deal with these problems on the grounds of a simple scheme based on the systems theory. This scheme requires to analyse the system of the European Union in association with its natural and artificial environment. European Union is in fact a multifunctional tool for several particular centres of power. It would be difficult to describe the European Union as ‘controllable’. One must not forget that there is some opposition with regard to the European Union. Numerous problems are generated within the member states. It seems to be reasonable to expect that the structure of the European Commission should be compatible with the real problems of the European Union and its member states. These matters require further research.

Opis:: Resilience is an increasingly relevant feature of contemporary security policy. It is no longer a buzzword, it has turned in recent two decades to an analytical term useful in the study of continuity and adaptive change in objects and systems, including social and political systems. States and organizations have become increasingly aware of benefits drawn from the ‘resilience dividend’ for the sake of internal security, public order and systemic stability. This paper is dedicated to resilience as an objective and a feature of the European Union as a security community. In this respect, resilience is conceived as the capacity of the EU as an international organization to prepare for disruptions and to build and reinforce capacity to achieve revitalization from past crises and failures. Since resilience is predetermined by situational awareness, preparedness, risk assessment and anticipation, intelligence is meant to become a core and indispensable form of organized activity of the state or a security community. Therefore, the emergence of an EU intelligence community should be identified with the growing need to enhance resilience and preparedness of the EU and its member states in the face of threats and dangers challenging security, stability and order within the Union. A thesis developed in this paper claims that the EU has been developing its joint intelligence capabilities with direct reference to resilience building and crisis management capabilities as principal mechanisms of security governance in the EU.

Opis:: Praca odpowiada na pytanie, jak opodatkowane są dywidendy zagraniczne (wypłacane z jednego państwa członkowskiego Unii Europejskiej do drugiego państwa członkowskiego), pod reżimem polskiego, europejskiego i międzynarodowego prawa podatkowego. Celem pracy jest ukazanie różnic i podobieństw w zakresie opodatkowania dywidend pod wskazanymi reżimami prawnymi. Praca skupia się na omówieniu postanowień polskiej ustawy o podatku dochodowym od osób fizycznych i prawnych, Modelu Konwencji OECD i opartych o niego umów o unikaniu podwójnego opodatkowania, oraz dyrektyw Rady Unii Europejskiej (Dyrektywa 90/435/EWG).
The main task of this thesis is to show how cross-border dividends are taxated under polish, european and international tax law. Autor shows similarities and differences between those tax legal regimes in case of taxation of dividends.

Opis:: The article refers to Polish membership in the European Union and the liberal perspective of its analysis. The paper discusses the shortages of the liberal approach. The article accepts the liberal thesis regarding the opportunities that the accession to the EU opens up for Polish development. It notes the significance of the European mechanisms of regional cooperation. Nevertheless, the paper emphasises that the liberal perspective ignores the inequalities of power in the European Union and misses some serious tendencies, both at the level of the community and in the domestic politics, that impede the state’s development. Thus, the article refers to the limited competitiveness of the Polish economy and the state’s difficulties with the identification of its interests in the dynamic and variable international environment. It warns against the marginalization of Poland as “semi-peripheral” member of the European Union. The main conclusion of the paper is that the case of Polish membership in the EU is too complicated to close it in the liberal frameworks. The liberal perspective needs a realist correction. It is extremely important in the context of the challenges that Poland faces together with the crisis of the European integration.

Opis:: The article focuses on the European Union law concerning a transfer and restructuring of undertakings, namely on the Directive 2001/23/EC, Directive 98/59/EC and Directive 2002/74/EC. It explains basic definitions adopted by a legislator for the application of these provisions. On the basis of selected case studies, the article identifies when a transfer of undertakings takes place, taking into account selected characteristics of this process. Only under certain circumstances a transfer and restructuring of undertakings are legally recognized, as it has been clarified by the European courts in their rulings. Protection of the rights of employees in the case of a transfer and restructuring of undertakings is directly connected with this subject matter, which has been elucidated in the elaboration.

Opis:: The opinion supports the Court’s decision that a different treatment of digital books supplied electronically and books supplied in tangible media is sufficiently justified and does not infringe the rule of neutrality and the rule of equal treatment. The judgement argues that to allow the Member States to apply for a diminished VAT rate to electronically supplied digital books would hamper the consistency of the Union’s aim to exclude all electronic services from the category which is subject to a diminished VAT rate. According to the author of the opinion, in the current state of matters, states are not legally allowed to engage in legislative activities with an aim to modify the way of taxation of e-publications
