Opis:: The purpose of this paper is to provide an opinion on the regulation of freedom of conscience in the constitutions of European Union countries (with the exception of Italian and Polish regulations). The author concludes that freedom of conscience is guaranteed in all European Union countries. In most of them, it is expressed explicitly in the Constitution, and in other countries, it is guaranteed under Article 9 of the Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950.

Rozdział drugi poświęcony jest dogmatycznej analizie przepisów konstytucyjnych oraz innych ustaw. Kolejny rozdział dotyczy analizy poszczególnych orzeczeń Trybunału Konstytucyjnego związanych z wybranymi aspektami tytułowej wolności. Ostatni rozdział poświęcony został omówieniu niektórych orzeczeń Europejskiego Trybunału Praw Człowieka w sprawach dostępu obywateli polskich do lekcji religii/etyki i obecności krzyży w salach lekcyjnych oraz krótkiemu podsumowaniu stanowisk zajętych przez Trybunał w Strasburgu i Trybunał Konstytucyjny w omawianych sprawach.

Opis:: This opinion deals with a bill concerning conscientious objection clause in relation to doctors, contained in Article 39 of the Act on the Professions of Doctor and Dentist. The opinion emphasizes that the said provision (clause) in the current form is a manifestation of Poland’s constitutionally guaranteed freedom of conscience and religion. However, in so far as it on the same time imposes – on doctors guided in their professional practice by conscience – a duty to indicate the possible ways of obtaining diagnosis or treatment from another doctor, imposes limitations on their constitutional freedom of conscience and religion (Article 53 of the Constitution). An amendment of Article 39 of the Act, proposed in the bill, aims at strengthening the guarantee of that freedom. The responsibility for ensuring that patients have access to information about the institutions from which they can obtain medical assistance rests with the State.

Opis:: This opinion deals with a bill which limits doctors right to conscientious objection in medical relations. The author claims that the bill imposes on doctors disproportionate limitations of their constitutionally protected freedom of conscience (Article 53 of the Constitution). The bill does not prove that the proposed regulation is actually necessary for the protection of other constitutional values. It was emphasized that legal enforcement of the performance of controversial medical services by those who have raised ethical doubts about some of these services, undermines the essence of the freedom of conscience guaranteed by the Constitution and, consequently, the guarantees of State’s ideological impartiality and freedom of expression of religious or philosophical beliefs in public life.

W tym celu zostaną zidentyfikowane i zbadane kluczowe zagadnienia mające znaczenie dla oceny tego tematu. Dla ich identyfikacji, autorka odniesie się przede wszystkim do wiodących, przedmiotowo relewantnych tematów debaty publicznej, jak również zagadnień spornych pojawiających się w orzeczeniach - zarówno na szczeblu krajowym, jak i międzynarodowym. Wśród wyróżnionych problemów znajdą się tematy takie jak m.in. obecność symboliki i ubioru religijnego w przestrzeni szkolnej oraz konfliktu programu zajęć szkolnych z zasadami danej religii. W kontekście polskim, autorka zbada ewolucję wolności sumienia i wyznania w systemie prawnym, przedstawi obowiązujące regulacje, jak również pochyli się nad implikacjami faktycznymi. Jednym z poruszonych zagadnień będzie również kwestia granicy prawa do decydowania o wykształceniu religijnym między decyzją rodziców a dziecka. Powyższe analizy mają prowadzić do obrony tezy, iż nie można mówić o pełnej wolności sumienia i wyznania w kontekście obecności religii w szkołach w Polsce i Europie.
This paper attempts to examine the topic of freedom of conscience and religion in the context of the presence of religion in schools in Poland and Europe. For this purpose, key issues relevant to the assessment of this topic will be identified and examined. In order to identify them, the author will first of all refer to the leading, subject-relevant topics of the public debate, as well as contentious issues appearing in judgments - both at the national and international level. Among the problems highlighted will be topics such as, inter alia, the presence of religious symbols and clothing in the school space and the conflict of the school curriculum with the principles of a given religion. In the Polish context, the author will examine the evolution of freedom of conscience and religion in the legal system, present the current regulations, as well as consider the factual implications. One of the raised issues will also be the question of the limit of the right to decide about religious education between the decision of the parents and the child. The above analyses will lead to the defence of the thesis that one cannot speak of full freedom of conscience and religion in the context of the presence of religion in schools in Poland and Europe.

Opis:: Question about the condition of social ethics, public morality and politics leads us to the notion of conscience and freedom of conscience. Traditionally, the term conscience has its origin in philosophy of morality and in religion. However, contemporary sociological research in Poland demonstrates that many social actors, predominately institutional Catholic representatives or politicians, within the public debate play a battle over morality. The article, in light of the empirical data and theoretical approach, undertakes the analyses on public morality and religion, bioethics, law, and politics to discuss the quest of ethical rigourism and political moralism. Nonetheless, in the context of the public debate over the freedom of conscience and its socio-political implications the author argues that religious and political debate over public morality is often an object of ideological manipulation.

Opis:: Ochrona wolności sumienia i wyznania, jednej z podstawowych kategorii wolności praw i człowieka, w przypadku zawodów medycznych pełni szczególną rolę. Znajduje to wyraz w normowaniu przez ustawodawcę sytuacji, w których lekarz może powstrzymać się od wykonania świadczenia zdrowotnego niezgodnego z jego sumieniem. Z drugiej strony ze względu na to, że prawo do ochrony zdrowia, podobnie jak wolność sumienia i wyznania, jest konstytucyjnie gwarantowane, państwo zobligowane jest również do zapewnienia dostępu do opieki zdrowotnej swoim obywatelom. Powoduje to konieczność wprowadzenia ograniczeń możliwości zastosowania przez lekarzy klauzuli sumienia oraz obarczenia skorzystania z niej obowiązkami mającymi zagwarantować pacjentowi dostęp do świadczenia zdrowotnego. Sposób, w jaki należy rozwiązać tę konfliktową sytuację między sumieniem a normą prawną, pozostaje kwestią sporną, w której obszarze prezentowane są różne poglądy i stanowiska.
Protection freedom of religion and conscience, it's one of the basic rights of human rights and freedom, which plays vital role in medical jobs. The act regulate issue in which case doctor is able to reject health benefit, which is against his conscience. On the other hand right to health care as well as freedom of conscience and religion is guaranteed by government, which is obligate to provide healthcare to citizens. Consequently restrictions has to be imposed in order to limit permission of use conscience clause by doctors and has to guarantee access to healthcare. The way of solving the problem between the conscience and law has been a debatable point. In this specific issue, there are different ideas and standpoints.

Opis:: The religious factor occupies the remarkable place in the political process of state. The end of the XX-the beginning of the XXI century has been affected by the attraction to the strengthening of trends of the mutual usage by these worlds all possible resources for the achievement of the personal strategic goals. The role of religious organizations in the parliamentary and presidential election campaigns of the recent years has been examined. The official positions of the religious organizations in which the tendency to the separation of the spiritual and political life is clearly traced. It has been emphasized the active involvement of the religious organizations in the political life of the regional and district levels, local communities, which quite often openly support certain candidates, or parties. It is found out, on the example of the Volyn region, that quite not uncommon are the cases of the direct participation of the religious organizations’ representatives in the struggle for the deputy mandates in the bodies of government of the different levels. These tendencies are mostly expressed on the districts’ levels. For the first time the representatives of the priesthood won the deputy mandates in the district councils of Volyn region in 1994 (local councils of the second convocation). Characteristically, that starting from the given convocation the clergy had constant representation in the district councils despite the changes of electoral system to the local councils, though the cases of the membership in the political parties had been extremely rare. The investigation showed, that the summarizing of the results of election campaigns to the local councils, in this section, is being possible only at the regional level, as in the councils of some areas there were not clergy representatives in any of convocation.
