W kolejnym rozdziale szczegółowo opisano instytucję zielonych zamówień publicznych w prawodawstwie Unii Europejskiej. Omówiono instrumenty używane w proekologicznych zamówieniach publicznych, takie jak systemy zarządzania środowiskowego i audytu, oznakowania ekologiczne, kryteria ekologiczne w budownictwie i sektorze energetycznym. W dalszej kolejności opisano możliwości zastosowania tych instrumentów w postępowaniach o udzielenie zamówienia publicznego. Tę część opracowania uzupełnia analiza strategii i planów oraz wybranego orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej. W trzecim rozdziale omówiono zasady i najważniejsze normy polskiego prawa zamówień publicznych. Następnie dokonano charakterystyki postępowania o udzielenie zamówienia publicznego, ze szczególnym uwzględnieniem warunków udziału w postępowaniu oraz kryteriów oceny ofert. Opisano istniejące w krajowym porządku prawnym instrumenty, które mogą zostać wykorzystane jako kryteria środowiskowe w zamówieniach publicznych. Podsumowanie tej części pracy stanowi analiza najważniejszych strategii i planów. Ostatnia część opracowania zawiera praktyczną analizę funkcjonowania zielonych zamówień publicznych zarówno w Unii Europejskiej, jak i w Polsce. Omówiono w niej sposoby monitorowania stosowania kryteriów środowiskowych przez zamawiających. Szczegółowo opisano także przykłady dobrych praktyk w wykorzystaniu pozacenowych kryteriów oceny ofert, ze szczególnym uwzględnieniem kryteriów ekologicznych. Uzupełnienie opracowania stanowi podsumowanie i szczegółowa bibliografia obejmująca bogaty wykaz aktów prawnych Unii Europejskiej i Polski, literaturę przedmiotu oraz akty planowania i strategie.
The compilation raises the issue of the principle implementation that is based mainly on the sustainable development and the principle of integration in Polish and European environmental law, in the context of green public procurement. The first part discusses the basic precepts of Polish and European environmental law with particular emphasis on the maxim of sustainable development and integration. The following chapter, presents in detail, the institution of green public procurement in the European Union legislation. What is more, the section above presents the instruments being used in pro-environmental public procurement, such as the systems of environmental management and audit, eco-labels, environmentally-friendly criteria in the architectural engineering and the energy sector. Subsequently, the report also includes the capabilities of the instruments’ application in procedures for the award of a public contract. This part of the study was supplemented with an analysis of strategies and plans and selected case-law of the Court of Justice of the European Union. The third chapter discusses the principles and the most important standards of Polish public procurement law. Afterward, the procedure for awarding of the public contract was characterized with particular emphasis on conditions for participation in the proceedings and evaluation criteria of tenders. Additionally, it has been proven that the instruments which exist in the national legal system might be used as an environmental criteria in public procurement. The conclusion of this part constitutes the analysis of the most significant strategies as well as plans. The last part of the development includes the practical analysis of the functioning of green public procurement in the European Union, and in Poland. It covers the manners, in which the application of environmental criteria should be monitored. Furthermore, the content of case study encompasses a detailed description of the examples of good practices in the use of non-price evaluation criteria, with peculiar stress on environmental criteria. Consequently, the complementary study also involves a summary and detailed bibliography with extensive list of European Union and Polish legal acts, references, the acts of planning and strategies.

Opis:: Green Public Procurement is an undisputable potential, although still used to a limited extent in Poland. Creating demand is a domain of the public sector, since it is the largest beneficient of goods and services in the economy. The aim of this article is to show the importance of green public procurement, especially for the participants of this market - the Contractors. In particular, law regulations, related with public procurement, have been analyzed. According to assumptions of green procurement, the strategy of reducing negative impact on the environment should take into account all elements of the production chain, and therefore all suppliers. Standards selected properly for this purpose should cover the entire product lifecycle starting from its design, through manufacturing to disposal, and should address all environmental aspects that are affected by the company's business. The research also made an attempt to assess the engagement of contractors in the eco-procedures and the status of their knowledge on green public procurement.

Opis:: Research background: Economic growth is unsustainable. However, a circular economy has the potential to lead to sustainable development, while decoupling economic growth from the negative consequences of resource depletion and environmental degradation. The EU's strategy of climate neutralization in 2050 developed, inter alia, into a European Green Deal action plan aiming at the efficient use of resources by moving to a cleaner, circular economy. More sustainable EU food system is a cornerstone of the European Green Deal. The European Commission's goal is 25% of agricultural land to be used for organic production in 2030. The question is if it is possible to reach the objective with the use of current incentives. What else may be done to encourage European farmers to convert to organic farming? Purpose of the article: The aim of this research is to review the development of organic agriculture in Europe and the EU and to identify incentives for farmers to convert to organic farming. Methods: First of all, the methodological approach is to iteratively review the existing literature to frame the problem. Secondly, the data on organic agriculture in Europe is to be analyzed to answer the research questions. The analysis is based on international statistics, mainly collected by FiBL, IFOAM, EC Agri-food data portal and Eurostat..Fitting the trend functions to the actual data has been made in three scenarios (pessimistic, realistic and optimistic). These trend functions were used for the long-term forecasts of the share of organic farmland in the EU. Findings & value added: The long-run forecast might be treated as a goal, which can motivate to act more intensively to achieve the objective. The existing measures, including organic farming payments, are not sufficient to meet the goal of massive increase in the acreage under organic production. It is necessary to develop new incentives e.g. Green Public Procurement, innovative and effective media campaigns, development of a dynamic network of actors within the organic food supply chain with the use of blockchain technology.

The article presents the importance of green public procurement in accordance with the European Union new guidelines for construction investments and road transport as priority areas. Attention was drawn to new requirements in line with the European Commission guidelines on the legal aspects of green public procurement and environmental criteria in the life cycle of buildings and vehicles for green public procurement were presented. The main initiatives that should be taken in the areas of construction and transport to meet the criteria of green public procurement were also indicated.

Opis:: This article delineates how a shift in the priorities of EU laws can change public procurement’s current centre of gravity from its fixation on the lowest price to that of a more balanced consideration of different societal goals. There is an acknowledgement that public money can meaningfully contribute to support for social justice and the fight against climate change and environmental degradation. To this end, the present EU legal framework, together with more advanced experiences in Italy and in a few other EU Member States, are illustrated before an analysis of the many initiatives currently under consideration by the EU law makers as per the European Green Deal and the Sustainable Products Initiative. The article then highlights the need to reconsider the theory of public procurement law and practice as well as the current EU legislative framework for public procurement (and concessions).
Niniejszy artykuł ma na celu przedstawienie, w jaki sposób środek ciężkości zamówień publicznych przesuwa się ze stanowiska, w którym główny nacisk pada na najniższą cenę, do stanowiska, w którym w sposób bardziej wyważony uwzględnienia się różne cele społeczne, do osiągnięcia których mogą przyczynić się środki publiczne, w tym takich celów, jak walka o sprawiedliwość społeczną i przeciwdziałanie zmianom klimatycznym oraz degradacji środowiska. Ocena działań podejmowanych przez wybranych prawodawców – państw członkowskich UE – w ramach Europejskiego Zielonego Ładu i inicjatywy na rzecz zrównoważonych produktów zostanie poprzedzona charakterystyką obecnych ram prawa unijnego oraz doświadczenia Włoch i kilku wybranych państwach członkowskich. Następnie w artykule podkreśla się nowe spojrzenie na formalne oraz praktyczne uwarunkowania funkcjonowania systemu zamówień publicznych (w tym umów koncesji) w ramach Unii Europejskiej.

Opis:: Purpose: Governments in many countries are trying to prevent climate change. One way of doing this is through green public procurement that consists of procuring goods, services and works with a reduced environmental impact during their life cycle compared to goods, services and works with an identical purpose that might otherwise have been procured. So the paper aims to examine private companies’ readiness to provide green goods and services in response to demands of green public procurement. This may encourage public entities to wider use of green public procurement because they may be afraid of an inadequate amount of companies that can meet the procurement criteria. The paper provides tips on how to organize the work of a public institution to make green public procurement more widespread. Design/methodology/approach: The methods used in this study were literature analysis, statistical survey, static analysis and case study. By means of a statistical survey and analysis, the relationship between the knowledge of employees of a given company regarding the knowledge of concepts related to green public procurement and the type of position was demonstrated. On the other hand, with the help of a case study, it was shown how an existing public procurement can easily be transformed into a green public procurement. Findings: In order to achieve sustainable outcomes, it is necessary to introduce internal regulations of public organisations relating to the integration of environmental considerations into tendering procedures. Public organisations should realise how easy it is to turn a public procurement into a green public procurement and that companies are already ready to do it. Almost any company can meet the environmental requirements to participate in green public procurement, the criteria depend on the ingenuity of the public organisations' staff. The main difficulties in including environmental aspects in tendering procedures include insufficient knowledge and experience of the contracting authorities in their practical application. Originality/value: The paper discusses the role of green public procurement, as well as how to manage a public organisation, what to do to make green public procurement widely used. Relevant knowledge of public employees, political will, as well as the fashion for green public procurement are important in the introduction of the above mentioned procurement. The paper also focuses on the private company's point of view.

GREEN PUBLIC PROCUREMENT IN THE EUROPEAN UNION The share of public procurement in the GDP of the European Union is over 14%. The ambitious goals set by the European Union in the scope of decarbonization of the economy and protection of the natural environment will not be possible to achieve without the involvement of the public sector. The chapter discusses the dilemmas related to the application of green public procurement in line with the principles of the circular economy. Taking into account the potential hidden in these contracts, recommendations regarding increasing their practical significance were formulated.

Opis:: The aim of the article is to show how one of the most active and demonstrative management tool for furthering sustainable development can be successfully implemented through a Central and Eastern European example. The Green Procurement Hungary Project (GPH project) was conducted in order to develop a toolkit most suitable for implementing green (public) procurement, in order to use the enormous purchasing power of public and private organizations for furthering sustainable consumption, eco-production and all together sustainable development. The article shows the relationship between sustainable-, green- and social procurement, introduces the state-of-the art of green public procurement in the EU with specific attention to the CEE countries and shows the methodology developed in the GPH project. This methodology has great significance for practitioners and policy makers as well for the implementation of sustainable procurement. Even on the European level, for example by the development of funding opportunities and by the evaluation of project proposals these experiences are valuable.
Celem artykułu jest ukazanie, jak jedno z najczęściej stosowanych narzędzi z zakresu zarządzania można wykorzystać do wspierania rozwoju zrównoważonego, na przykładzie Europy Centralnej i Wschodniej. Projekt węgierskich zielonych zamówień (The Green Procurement Hungary Project, GPH project) wprowadzono, aby poszukiwać najlepszych rozwiązań w tym zakresie. Celem jest wykorzystanie ogromnej mocy nabywczej firm publicznych i prywatnych dla wspierania zrównoważonej konsumpcji i eko-produkcji, a poprzez to zrównoważonego rozwoju. Artykuł ukazuje powiązania pomiędzy zrównoważonymi, zielonymi i społecznymi zamówieniami, wskazuje na najnowsze rozwiązania przyjęte w UE, szczególny nacisk kładąc na kraje Europy Wschodniej, omawia także ich stronę metodologiczną. Ten ostatni aspekt jest niezwykle istotny dla praktyków i polityków, jak również w kontekście bezpośredniego wdrażania zielonych zamówień. Nawet na ogólnoeuropejskim poziomie, przykładowo poprzez rozwój instrumentów finansowych, czy sposobów oceny zgłaszanych wniosków, te doświadczenia są bez wątpienia wartościowe.

Opis:: The paper presents the implementation of Integrated Product Policy in Poland in the light of the European activities. It analyses the EU laws within this scope.
