Opis:: Issues concerning homosexuality is well known both in the documents of the Catholic Church, as well as in the case law of the Roman Rota and the judgments of the ecclesiastical tribunals. Currently, homosexuality is a serious social problem, psychological and legal. The issue of homosexuality more often appears in ecclesiastical tribunals, as a cause of inability of people to take the essential obligations of marriage. Homosexuality causes inability to distinguish carefully the particular subject of matrimonial consent and conduct a critical assessment of the person affected by these disorders, which is unable to transfer the rights and assume the obligations of marriage.

Opis:: In the decision of the Roman Rota c. Jarawan the case of invalidity of the marriage due to inability to take up significant marital obligations by the respondent was examined and decided (a negative decision was issued in the first instance and a positive in the second instance). The Rotal judges subjected the decision of the second instance to decisive criticism by, i.a., a few experts, and decided that it indicates the acceptance of relative inability by the court, which is clearly inconsistent with the canonical norm 1095, n. 3 of the Code of Canon Law.

Opis:: In the ecclesiastical courts, classical methods, such as psychological conversation and assessment, are used as they are considered the most valuable psychological means. The testing methods and questionnaires are of great importance to the legal expert as well. However, they do not always constitute a crucial addendum like in other psychological researches. The investigational techniques mentioned above are merely to help the legal expert to resolve his doubts. The fact that those methods are implemented does not raise the value of the final motion, even though it is important that the techniques used by the expert touch upon not only the present mental state of the person being tested but also the past.

Opis:: One of the most important tasks of the Social Insurance Institution (ZUS) is its mandate and obligations in the field of auditing. First of all, the ZUS verifies whether contributions are paid, and whether obligations related to social insurance are complied with. Furthermore, the ZUS carries out audits of the judicature on temporary inability to work with regard to the regularity of medical certificates and sick leaves, and formal control of medical certificates. Findings of such audits are the basis for decisions that impose on the auditees certain obligations or force them to concrete behaviours.

Opis:: From the analysis of the cases for the annulment of a marriage result that encephalopathy as a personality disorder causes a serious lack of discretionary judgment concerning the essential matrimonial rights and obligations mutually given and accepted (can. 1095 CIC No. 2 of 1983) and the inability of people to take up and fulfill the essential obligations of marriage (can. 1095 CIC No. 3 of 1983). In the judgments of ecclesiastical tribunals Judging College, opinions can be found which point to a defective functioning of personality traits, in this specific case of encephalopathic personality, which is a consequence of damage to the central nervous system. Disturbed encephalopthic personality does not always automatically lead to the inability of people to take the essential obligations of marriage, yet its impact on the psyche and consequently the ability to make a covenant marriage is quite significant as evidenced by studies of psychiatric and religious processes. This article presents decisions of the ecclesiastical courts which show that the disturbances caused by encephalopathy result in the inability to create positive and lasting marriages. In addition, people with this type of personality were not able to give valid consent, despite the declared willingness to persevere in marriage and made promises to change their current behavior.

Opis:: This article shows that addiction to work (workaholism) can be a potential cause of person’s inability to contract marriage in the light of canon law. Workahlism is one of contemporary addictions, in which an individual gets addicted to certain actions and not substances. Nevertheless, addiction in consideration causes particular effects, also mental, and it strongly influences person’s functioning. It mainly causes damages to interpersonal bonds, personal life disruptions, health deterioration, reduction of happiness and even the loss of life. This paper describes the phenomenon of workaholism (a concept, diagnostic criteria, stages of development, causes and consequences of addiction to work). Next it presents how workaholism affects ability to take upon significant marriage duties. Presented analysis is based on Canon 1095 of The Code of Canon Law. This article might be of use for Church courts employees, in terms of interpretation of The Code of Canon Law: Canon 1095 in the context of addictions. It may also have scientific application.

Opis:: The paper presents an attempt to analyze the interview with Natalia within the framework of sociology of poverty and from a social exclusion perspective. The information about the origins of Natalia’s interview is delineated. In the main part of the text, the author refers to the concept of the badge of ability, described by Richard Sennett and Jonathan Cobb, as a tool of social categorizing and valuing and introduces the corresponding notion of the badge of inability, ascribed to the unprivileged group members. Furthermore, the influence of both kinds of badges on the situation of Natalia’s family of origin, on her life course, and self-description are indicated with some remarks on the narrator’s biographical and identity work. The last part of the paper presents the narrator’s understanding of the world of poverty and social exclusion, its mechanisms, and conditionings.

Opis:: One of the most important subsystems of the vehicles and machines operating currently in industry and transportation are the rotating subsystems. During the subsystems operation, due to the forcing factors influence, the technical state of them is changing and the failure can occur. In order to avoid such a situation the technical state should be identified online. To do this the analysis of the subsystems vibrations is performed. The identified technical state should be considered in a context of the ability and different inability states. Therefore, the first step of the diagnostic procedure is the ability and different inability states identification. In the article, it is proposed to accomplish this goal by the vibrations analysis in time domain. The described research started with the vibration signals acquisition using the experimental stand. In this way, the vibration signals for ability and different inability states were obtained. Afterwards, the signals were divided into learning and testing data sets. For each signal from learning data set, several characteristics were calculated, and they selected the most significant among them. Using the selected characteristics, the signals from the testing data set were analysed. Thanks to it, the testing vibrations signals were counted among the signals collected on the rotating subsystem operating in ability or selected inability state. The result of the performed studies and the accuracy of the technical state of the tested system identification can be found at the end of the article.

Opis:: Tematem pracy jest omówienie instytucji niepoczytalności w polskim kodeksie karnym. Rozdział pierwszy pracy dotyczy historii niepoczytalności. Zostało w nim również opisane zmieniające się postrzeganie chorób psychicznych co ma bezpośrednie przełożenie na rozwój instytucji niepoczytalności. Praca omawia metody ustalenia niepoczytalności oraz analizuje polskie rozwiązanie ustawowe z podkreśleniem roli jakie pełnią zasada winy oraz godności człowieka w świetle instytucji niepoczytalności. W rozdziale drugim została dokonana analiza członu psychiatrycznego art. 31 kodeksu karnego. Zostały w nim opisane podłożona niepoczytalności – choroba psychiczna, upośledzenie umysłowe oraz inne zakłócenie czynności psychicznych. W pracy została zawarta analiza najczęściej występujących chorób psychicznych w prawnokarnym kontekście stwierdzania niepoczytalności, do których można zaliczyć schizofrenię, paranoję, cyklofrenię. Praca zawiera również przegląd najważniejszego orzecznictwa dotyczącego niepoczytalności, zostały w niej opisane ciekawe oraz istotne przypadki stosowania instytucji niepoczytalności. W rozdziale trzecim została dokonana analiza członu psychologicznego art. 31 kodeksu karnego. Zostały w nim omówione niemożność rozpoznania znaczenia czynu oraz niemożność pokierowania swoim postępowaniem. Praca akcentuje role psychiatrii, psychologii oraz biologii jako nauk o fundamentalnym znaczeniu w rozumieniu instytucji niepoczytalności oraz ich wpływ na kształtowanie się regulacji prawnych dotyczących sprawców niepoczytalnych.
The subject of the thesis is the discussion of the institution of insanity in the Polish penal code. The first chapter of the work deals with the history of insanity. It also describes the changing perception of mental illness, which has a direct impact on the development of the institution of insanity. The work discusses the methods of determining insanity and analyzes the Polish statutory solution, emphasizing the role played by the principle of guilt and human dignity in the light of the institution of insanity. The second chapter analyzes the psychiatric component of Art. 31 of the Criminal Code. It describes the causes of insanity - mental illness, mental retardation and other mental disorders. The paper contains an analysis of the most common mental illnesses in the criminal law context of diagnosing insanity, including schizophrenia, paranoia, and cyclophrenia. The work also contains an overview of the most important jurisprudence regarding insanity, it describes interesting and important cases of appling the institution of insanity. The third chapter analyzes the psychological part of Art. 31 of the Criminal Code. It discusses the inability to recognize the meaning of the act and the inability to direct one's behavior. The work emphasizes the roles of psychiatry, psychology and biology as sciences of fundamental importance in the understanding of the institution of insanity and their impact on the shaping of legal regulations concerning insane perpetrators.
