Tytuł:: Consultations on the system of Indigenous and Afromexican communal security and the right to be consulted in Mexico

Opis:: The right to be consulted is a legal institution that originated in 1989 in the United Nations Convention 169, requiring states to conduct a consultation process of Indigenous peoples and communities on issues potentially impacting them. The Mexican state has subsequently implemented the right to be consulted in its legal system. The consultation processes were often riddled with inconsistencies and the violation of the rights of Indigenous communities and peoples. In this paper I analysed the case study of the consultation process in Guerrero, by researching press articles, engaging in participant observation and conducting interviews. I looked for similarities between the Guerrero consultations and past consultations in Juchitán, Sonora, and Campeche. I identified several violations and manipulations consistent with the history of the right to be consulted. In the last part of the article, I compared the proposed acts and established their potential impact on security in Guerrero.

Opis:: In recent years, the social dimension of cultural heritage has gained significance in international law. A better understanding of the human rights dimensions of cultural heritage has resulted in substantial recognition of the right to heritage; a right that has not been explicitly regulated in international law. This article aims to analyse the path that cultural heritage law has taken to adopt a human rights law dimension. It also discusses the construction of the right to heritage and maps the connections and disconnections between and within cultural heritage law and international human rights law frameworks. The article uses the example of Indigenous peoples as a referent, due to the special bond that many may have to cultural values which play a significant role in the formation of Indigenous identity. In this context, I argue for a human rights approach to cultural heritage, which offers not only participation but also the co-creation of heritage together with local and Indigenous communities.

Tytuł:: Ochrona praw ludności tubylczej w Ameryce Łacińskiej
The Protection of Indigenous Rights in Latin America

Opis:: The main aim of this thesis is to present the normative protection of the indigenous peoples in Latin America and outline their actual situation along with the indication of actions that could improve it. Because of the complexity of matter, the study focuses only on select examples that best illustrate the situation in Latin America. The work starts with an explanation of the term “indigenous”, due to the doubts that appear about its range of use. Then it presents particular indigenous rights and deliberations about whether the situation of the autochthons should actually be regulated in a special way. The present work also analyzes select national and international legal acts, which grant rights to the indigenous, and confronts them with the factual situation of this group. Special attention is put on the issue of the right to self-determination, discussed through the case of the Mapuche tribe. Finally, the study describes mechanisms and institutions created with the purpose of protection of indigenous people in Latin America.
Głównym celem niniejszej pracy jest przedstawienie ochrony normatywnej, jaka jest obecnie zagwarantowana ludności tubylczej w Ameryce Łacińskiej, oraz przybliżenie ich faktycznej sytuacji wraz ze wskazaniem działań mogących wpłynąć na jej poprawę. Ze względu na obszerność zagadnienia, opracowanie to skupia się jedynie na wybranych przykładach, które najlepiej obrazują sytuację panującą w Ameryce Łacińskiej. Pracę rozpoczyna objaśnienie pojęcia „tubylec” z uwagi na wątpliwości, jakie pojawiają się co do jego zakresu. Następnie zaprezentowane są poszczególne prawa tubylcze oraz rozważania, czy sytuacja autochtonów rzeczywiście powinna być uregulowana w specjalny sposób. Analizie poddano wybrane akty prawa krajowego i międzynarodowego przyznające prawa ludności rdzennej i skonfrontowano je z faktyczną sytuacją panującą wśród tej grupy. Szczególna uwaga została poświęcona kwestii prawa do samostanowienia, przedstawionego na przykładzie ludu Mapuche. W końcowej części pracy opisano mechanizmy i instytucje stworzone w celu ochrony praw ludności tubylczej Ameryki Łacińskiej.

Opis:: This paper sets out a new reconstruction of indigenous rights as a field of sociological research. Questioning the dominant pluralist paradigm in such inquiry, it claims that indigenous rights are primarily the results, not of socially embedded customs, but of interactions between international law and national law. It then proceeds to explain that, to capture such rights, a focus on social integration and national citizenship is required. It uses this framework to explain indigenous rights as elements of a global legal order that facilitates the construction of citizenship, especially in societies in which citizenship has been subject to deep strain.

Opis:: Niniejsza praca ma na celu pokazanie sposobów walki o prawa ludności rdzennej w Meksyku, jakie zostały podjęte przez Zapatystowską Armię Wyzwolenia Narodowego (EZLN). Społeczności rdzenne zmagają się z nieustanną dyskryminacją i marginalizacją ze strony społeczeństwa i władzy państwowej. Zwalczanie dyskryminacji i marginalizacji, a także dążenie do poszanowania i tolerancji jest niezwykle ważne jak również trudne. Zapatyści, wykorzystując różne metody w dążeniu do obranego przez siebie celu, m.in. korzystając z nowoczesnych technologii – w tym czerpiąc korzyści, jakie daje im Internet - stali się prekursorem na tle innych meksykańskich partyzantek, a ponadto, zdobyli zainteresowanie opinii publicznej na całym świecie. Praca przedstawia genezę powstania Zapatystowskiej Armii Wyzwolenia Narodowego oraz podjętą przez nich walkę zbrojną, następnie zaś koncentruje się na pokojowych działaniach – walce za pomocą słowa oraz kilku istotnych projektach, które stały się niezwykle ważne dla rozwoju ruchu zapatystów.
Main goal of the thesis is to show the ways in which Zapatista National Liberation Army (EZLN) fought for indigenous people rights in Mexico. Indigenous communities are struggling with discrimination and marginalization either from society and state. Dealing with discrimination and marginalization is very important, but also difficult. Another difficulty is promotion of respect and tolerance. Zapatists are using several methods to spread their point of view - one of the used methods is internet. They became a forerunner compared to other Mexican guerrillas. By doing that, they also gained worldwide public attention. The thesis starts from the origins of the Zapatista National Liberation Army and their armored warfare on the peacefully activities ends. Those activities are mainly focused on verbal fight or other key operations and projects which have been very important for the grow of the Zapatista Movement.
