Opis:: The 11Q5 scroll is the longest and best-preserved manuscript containing psalms. In col. XXVII, it includes a hitherto unknown work, bearing the title “David’s Compositions.” Beginning with the critical edition, through various works devoted to the analysis of the composition from col. XXVII (2–11), the text is considered the only instance of prose in 11Q5. The main aim of the paper is to analyse the text of David’s Compositions in order to determine its literary form and structure. The paper is divided into several sections. The first section presents the Hebrew text with an English translation and a few remarks focused on the physical description of the text of David’s Compositions. The next one is a brief analysis of the internal context of the end of the Great Psalms Scroll, where the analysed text of David’s Compositions can be found. Finally, and most importantly, the Compositions were divided into verses and their literary form and structure was determined.

Organisation and functioning of local self-government in the Republic of Poland in the light of selected constitutional norms

Opis:: Przegląd regulacji zawartych w Konstytucji Rzeczpospolitej Polski z dnia 2 kwietnia 1997 r. wskazuje, iż jednym z zasadniczych filarów funkcjonowania państwa jest zapewnienie sprawnego działania samorządu terytorialnego. W tym stanie rzeczy przedmiotem niniejszej pracy magisterskiej jest dokonanie wykładni poszczególnych norm prawnych dotyczących organizacji i funkcjonowania samorządu terytorialnego oraz sformułowanie oceny wdrożenia poszczególnych rozwiązań konstytucyjnych do ustaw samorządowych. Praca składa się z dwóch rozdziałów. W rozdziale pierwszym omówiono zagadnienia dotyczące organizacji samorządu terytorialnego. Rozważanie w tym przedmiocie rozpoczęto od przedstawienia struktury podziału terytorialnego państwa. Następnie przeanalizowano procedurę tworzenia, łączenia, dzielenia i znoszenia poszczególnych jednostek samorządu terytorialnego. Kolejno omówiono kwestie dotyczące statusu organów jednostek samorządu terytorialnego. W tym obszarze przedstawiono genezę pojęcia organu stanowiącego i wykonawczego, wskazując na płynące z tego wytyczne konieczne do uwzględnienia przez ustawodawcę. Ponadto scharakteryzowano sposób organizacji organów gminy, powiatu i województwa ze szczególnym uwzględnieniem przypisanych im zadań i kompetencji. W rozdziale drugim dokonano przeglądu norm konstytucyjnych wyznaczających sposób funkcjonowania samorządu terytorialnego. W tej materii po pierwsze omówiono zagadnienia związane z zasadą samodzielności samorządu terytorialnego. Po drugie wyłożono zakres i charakter zadań publicznych realizowanych przez samorząd terytorialny, rozróżniając zadania własne i zlecone. Po trzecie, przeanalizowano strukturę dochodów samorządu terytorialnego w tym jej poszczególne składowe w postaci dochodów własnych, dotacji i subwencji. Po czwarte, scharakteryzowano pojęcie nadzoru nad samorządem terytorialnym ze szczególnym uwzględnienie kryterium nadzoru w postaci legalności. Pracę zakończyło podsumowanie w którym zaprezentowano wyniki poczynionych rozważań.
A review of the regulations contained in the Constitution of the Republic of Poland of 2 April 1997 indicates that one of the fundamental pillars of the functioning of the state is to ensure the efficient operation of a local self-government. Taking this into consideration, the subject of the present thesis is the interpretation of individual legal norms concerning the set-up and functioning of local self-government and the formulation of an assessment of the implementation of individual constitutional solutions in local government laws. The thesis consists of two chapters. The first chapter discusses issues concerning the organisation of local self-government. Consideration of this subject began with a presentation of the structure of the territorial division of the state. Then, the procedure of creation, merging, division and dissolution of individual units of local self-government was analysed. Subsequently, issues concerning the status of the bodies of local government units were discussed. In this regard, the genesis of the concept of the constituting and executive bodies was presented, indicating the resulting guidelines necessary to be taken into account by the legislator. In addition, the manner of organisation of commune, district and voivodeship bodies was characterised, with particular emphasis on the tasks and competences ascribed to them. The second chapter reviews the constitutional norms determining the functioning of the local government. In this matter, firstly, the issues related to the principle of self-government independence were discussed. Secondly, the scope and nature of public tasks performed by the local self-government were outlined, distinguishing between own and commissioned tasks. Thirdly, the structure of revenues of the local government was analysed, including its individual components in the form of own revenues, subsidies and subventions. Fourthly, the concept of supervision over the local government was characterised, with particular attention paid to the criterion of supervision in the form of legality. The thesis concludes with a summary, which presents the results of considerations made in the course of the work.
