Opis:: In the paper the analysis of risk of different type is performed in the context of Civil and Construction law. There are some tools and procedures that are helpful to manage the risk that is coming from different sources. The reasons of contractual liability that are discussed in the paper are: damage, failure or improper performance of an obligation arising from the contractual relationship existing between the parties, the causal link between the injury and the failure or improper performance and the fault of the perpetrator.
Zagadnienia odpowiedzialności za szkody powstałe na terenie budowy zawsze budziły wiele kontrowersji i były źródłem sporów między uczestnikami procesu budowlanego. Szkody te mają często skomplikowany charakter zarówno pod względem faktycznym jak prawnym. Sformułowanie przepisów Prawa budowlanego i Kodeksu cywilnego nie zawsze wskazują rozwiązanie tych problemów. W artykule przeprowadzona została analiza i wykładnia uregulowań odpowiedzialności za szkody na terenie budowy oraz wskazano sposoby minimalizacji ryzyka w procesie budowlanym.

Opis:: Modern construction technologies strongly affect the environment. Therefore, design and building construction should also follow the sustainable development principle. In this case, design and construction work based on the sustainable development principle should aim at creating a safe and healthy living environment, the economical use of natural resources, and the stimulation of economic development to create the welfare for humans and favourable natural conditions. The article proposes a mathematical algorithm as a comprehensive solution for engineering management of the planning construction site, from the calculation of the earthworks to the automated creation of the engineering geological cross-sections. The paper integrates engineering management, mathematical modelling, and BIM technology. The application of the building information model is undoubtedly one of the most advanced technologies used in the engineering management field, whose advantages have been shown by researchers. In the preliminary stage of construction and production management, decisions should be made regarding material and human resources, schedules, and estimates. The main purpose of this article is the optimisation of the excavation. Other issues important to the organisation and management of the construction are the planning of safe work on the construction site, depending on the soil type. Geotechnical sections allow ascertaining the need for additional fortifications and the depth of the fortifications for safe work. The paper describes the principal mathematical model developed by the authors to design a construction site using BIM technologies. It presents the main formulas of a mathematical algorithm aimed at selecting the objects used on the building site and the need for them. It also gives the main principles of engineering management and methods for selecting the mechanisms used on the construction site. Understandably, a specialist’s visit to the construction site will not be avoided, and it is difficult to present the entire current situation only with a review report or photographs. Using a photogrammetric model, the expert has the opportunity not only to visually evaluate the current condition but also to perform measurements (length, width, and volume) directly in the photogrammetric model. Important and new information about the construction site indicates all relevant obstacles, i.e., plants, surrounding constructions, and other objects.

Opis:: Postępowanie w sprawie pozwolenia na budowę.Kwestia uzyskania pozwolenia na budowę jest złożona i skomplikowana nie tylko z punktu widzenia inwestora, ale także organu administracji publicznej. Pozwolenie na budowę ma charakter decyzji administracyjnej, czyli jest skierowana do konkretnego adresata i posiada ona wiążące konsekwencje. Nawiązując do możliwości prowadzenia inwestycji budowlanej, zgodnie z zasadą wolności budowlanej każda osoba posiadająca grunt i prawo do dysponowania nim na cele budowlane ma prawo do zabudowania nieruchomości gruntowej. Oczywiście zasada ta ograniczona jest pewnymi warunkami.Pozwolenie na budowę jest następstwem zatwierdzenia projektu budowlanego. Projekt ten sporządzany jest przez projektanta i musi być zgodny z różnymi przepisami. Projekt budowlany składa się z trzech części, projektu zagospodarowania działki lub terenu, projektu architektoniczno-budowlanego oraz projektu technicznego. W procesie budowlanym bierze udział nie tylko inwestor, ale również inspektor nadzoru inwestorskiego, projektant oraz kierownik budowy. Każdy z nich ma bardzo odpowiedzialne zadania. Pierwszym krokiem do uzyskania pozwolenia na budowę jest zebranie obligatoryjnych dokumentów, które trzeba dołączyć do wniosku. Jest to decyzja o warunkach zabudowy i zagospodarowania terenu, oświadczenie o posiadanym prawie do dysponowania nieruchomością na cele budowlane, projekt zagospodarowania działki lub terenu oraz projekt architektoniczno-budowlany. Gdy dokumenty zostaną zebrane przez inwestora, to należy je dołączyć do wniosku i złożyć w odpowiednim urzędzie. Gdy wniosek trafi do organu administracji publicznej, organ musi sprawdzić swoją właściwość. Jeśli jest on niewłaściwy to musi przekazać wniosek do właściwego organu. W przypadku, gdy jest on właściwy to sprawdza wymogi formalne wniosku a następnie bada dopuszczalność wszczęcia postępowania. Następnie organ musi ustalić kręg stron postępowania i merytorycznie skontrolować zawartość wniosku i załączników. Gdy organ nie ma żadnych zastrzeżeń to wydaje pozwolenie na budowę. Organ może odmówić udzielenia pozwolenia na budowę, gdy inwestycja jest niezgodna z przepisami lub z miejscowym planem zagospodarowania przestrzennego. W przypadku, gdy inwestor uzyska pozwolenie na budowę, ale po pewnym czasie chce sprzedać lub podarować nieruchomość gruntową osobie trzeciej, to pozwolenie na budowę można przenieść na inny podmiot. Posiadając pozytywną decyzję o pozwoleniu na budowę organ może ją unieważnić. Jednym z powodów jest skierowaniem jej do osoby, która nie jest stroną w sprawie. Pozwolenie również może się przedawnić, jeśli inwestor nie rozpocznie prac budowlanych w ciągu 3 lat od momentu, gdy decyzja stała się ostateczna lub budowa zostanie przerwana na czas dłuższy niż 3 lata.
Building permit proceedings.The issue of obtaining a building permit is complex and complicated not only from the point of view of the investor, but also from the point of view of the public administration body.A building permit is an administrative decision, i.e. it is addressed to a specific addressee and has binding consequences.According to the principle of freedom of construction, any person who owns land and the right to dispose of it for construction purposes may develop the area.A building permit is a consequence of the approval of a construction project. This design is drawn up by the designer and must comply with various regulations. A construction project consists of three parts, a land or land development project, an architectural and construction project and a technical design.Not only the investor participates in the construction process, but also the investor's supervision inspector, designer and construction manager. Each of them has very responsible tasks.The first step to obtaining a building permit is to collect mandatory documents that must be attached to the application. When the documents are collected by the investor, they should be attached to the application and submitted to the appropriate office.When the application goes to a public administration body, the authority must check its competence. If he is competent, he checks the formal requirements of the application and then examines the admissibility of initiating proceedings. Next, the authority must determine the circle of parties to the proceedings and substantively check the content of the application and annexes. When the authority has no objections, it issues a building permit.The authority may refuse to grant a building permit if the investment does not comply with the regulations.The permit may also expire if the investor does not start construction works within 3 years or the construction is interrupted for more than 3 years.

The article deals with the determination of the parameters of bioclimatic building site assessment, taking into account the main environmental factors that shape the bioclimate areas (atmosphere, lithosphere, hydrosphere, biosphere) and the influence of factors on them, resulting in the development of the territory. This approach makes it possible to extend the capabilities of climatic factors accounting for addressing optimization of environmental and energy problems of construction.

This article focuses on the issues of conducting research on the behavior of workers on construction sites. Both indirect methods, i.e. mainly survey research, and research conducted directly at the work site (in situ) were discussed. Particular attention was paid to discussing the advantages and disadvantages of non-invasive measurement methods using radio sensors and video image analysis. The basic requirements for real-time worker tracking technologies were analyzed.

Opis:: "Duzce Turkey earthquake with Mw= 7.2 occured on 12 November 1999 at 6.58 a.m. (local time) in western Turkey and caused the loss of life and heavy damage, as well. In this region where the earthquakes occured, a large number of reinforced concrete structures were affected. This study is devoted to assess the damages on reinforced concrete structures due to the 12 November Duzce earthquake 1999 in Duzce region. Damages observed in the structures may be occur due to the several reasons such as site effect, soil amplifications, poor construction quality, low concrete strength, unqualified detailing in beam-clomn joints, the stronger beam than clomn, constructing soft storeys and weak storeys, inefficient reinforcement, wrogn end hook and short clomns. This study revealed that most of the damaged structures were not designed and constructed Turkish earthquake codde which is Specifications for structres to be built in Seismic Zones."

W trzecim rozdziale omówiono problematykę przesłanek warunkujących wydanie decyzji o warunkach zabudowy i zagospodarowania terenu oraz zakres podmiotowy sprawy rozstrzyganej w postępowaniu administracyjnym o wydanie warunków zabudowy. W czwartym rozdziale opisano zagadnienia proceduralne związane z postępowaniem w sprawie wydania decyzji o warunkach zabudowy i zagospodarowania terenu. Piąty rozdział niniejszej pracy został poświęcony problematyce obowiązywania w czasie omawianej decyzji.
Purpose of my master's thesis is attempting to present the issues bound up with issuing the development conditions decisions. Realizing my purpose, all the master's thesis has been divided into five sections. In the first is devoted to the town and country planning history and the primary institutions of legal town and country planning. The second chapter were included general issues related to the institution, essence and types the development conditions desicions and land development decisions. The third chapter is devoted to the problem of determining the conditions for the development conditions decisions and its entity. The fourth of this work is procedural issues in the proceedings leading to the development conditions decisions. The fifth chapter of this work has been devoted to the issues of duration at the time of this decision.

Opis:: The goal of this thesis is to show the particular problems of law and financial aspects of permanent establishment's functioning, based on wide range of sources of law, judicature and tax authorities interpretations. It presents the concept of the permanent establishment according to legal regulations (Polish regulations on income taxation, selected agreements on the avoidance of double taxation, OECD Model Tax Convention on Income and on Capital), exemplary types of the permanent establishment (basic type - fixed place, building site, agency permanent establishment), types of activities that are exemptions from the permanent establishment's definition, taxation and other public law obligations of permanent establishment, artificial actions aimed to avoid taxation and counterfeiting regulations.
Praca ma na celu ukazanie problematyki prawnofinansowych aspektów funkcjonowania zakładu podmiotu zagranicznego, w oparciu o szeroki zakres źródeł prawa, orzecznictwo oraz interpretacje organów podatkowych. Przedstawia pojęcie zakładu podmiotu zagranicznego w świetle regulacji prawnych (polskie przepisy dotyczące opodatkowania dochodu, wybrane umowy o unikaniu podwójnego opodatkowania, Konwencja Modelowa OECD w sprawie podatku od dochodu i majątku), przykładowe rodzaje zakładów podmiotów zagranicznych (zakład typu podstawowego - stała placówka, zakład budowlany, zależny agent), rodzaje działalności stanowiącej wyjątek od konstrukcji zakładu podmiotu zagranicznego, opodatkowanie zakładu zagranicznego oraz jego inne obowiązki publicznoprawne, a także omawia sztuczne działania zmierzające do uniknięcia opodatkowania i przeciwdziałające im regulacje publicznoprawne.
