Opis:: Marian Smoluchowski solved the greatest scientific problem of his time. It was the explanation of the phenomenon of the Brownian motion. In the article, I show that Smoluchowski in fact in this explanation used an ontological interpretation of the causality principle, although in his writings he applied it also in the epistemological interpretation. This is understandable because in the scientific practice some kinds of ontological commitment are required.

Opis:: Marian Smoluchowski was a prominent Polish physicist whose greatest achievement was the development – independently of Albert Einstein – of the mathematical theory of Brownian motion. In his theoretical view of the problem of Brownian motion Smoluchowski employed the concept of causal relevance, which was never analysed in numerous publications devoted to his scientific achievement. In this article I am attempting to demonstrate that the concept of causal relevance which Smoluchowski employed in his works devoted to the issue of Brownian motion may be interpreted as analogous to the concept of causal relevance articulated by Max Kistler. I present a number of arguments which demonstrate that just such a concept of causal relevance was established by Smoluchowski. Since the explanation of the phenomenon of Brownian motion presented by Smoluchowski has been universally accepted, so in the same way the physicalistic concept of causal relevance has been widely propagated. In this I detect Smoluchowski’s contribution to the philosophy of causality.

Opis:: The paper presents and discusses the principle of causability as expressed in many civil codes. This principle requires that the existence of any obligations of transfers of ownership the legal cause – usually associated with 3 types of dealings having been identified by Roman jurists and elaborated by postglosators and founders of the 17th-century natural law movement, namely: causa solvendi, donandi, aquirendi, or causa cavendi – creates a condition for validity of legal act. Referring to the philosophical background of the analytical philosophy of intention and intersubjectivity, authors advocate a modified theory of causability, according to which it is permissible for the parties to invoke abstract actions if this is not opposed by binding legal provisions.
Artykuł przedstawia różne teorie dotyczące zasady kauzalności czynności prawnych przysparzających, obowiązującej w różnych kodyfikacjach prawa cywilnego. Zasada ta w ogólnym zarysie stanowi warunek ważności czynności prawnych przysparzających, wpływając na konstrukcję zobowiązań oraz przeniesienia własności. Wywodzące się jeszcze z prawa rzymskiego, a następnie rozwinięte przez postglosatorów oraz zwolenników szkoły prawa natury typy kauza, takie jak causa solvendi, donandi, aquirendi czy causa cavendi stały się zatem punktem odniesienia dla oceny ważności przysporzeń. Odnosząc się do intencjonalnego działania na płaszczyźnie intersubiektywnej w ujęciu filozofii analitycznej, autorzy opowiadają się za modyfikacją zasady kauzalności i dopuszczeniem możliwości kształtowania czynności oderwanych od przyczyny prawnej, o ile nie jest to sprzeczne z obowiązującymi przepisami.

Opis:: Following paper is concerned with the problem of Is/Ought dichotomy in Hans Kelsen’s Pure Theory of Law. This is one of the most important problems which needs to be addressed in order to provide autonomous legitimacy of law in terms of normativism. The claim that those two spheres ought to be separated, is analysed from three different philosophical perspectives: ontological, epistemological and normative. Each of them posits Kelsen’s dichotomy as essential to a development of his concepts. The paper is an attempt to answer the question why this distinction is necessary in the context of legal validity and effectiveness.

Krytyka determinizmu w pracach Isaiaha Berlina

Opis:: The thesis refers to the critique of determinism presented in the work of the Oxford philosopher Isaiah Berlin. In expressing his views, Berlin referred to the position he held, based on liberal thought. The opinions he put forward mainly concern the problem of the incompatibility of the deterministic concept with commonly accepted thoughts and terms, based on the idea of free will.The thesis presents Berlin's accentuated specificity of the relationship that exists between the concept of freedom and determinism. Furthermore, the objections formulated by the British philosopher, who was also a proponent of the idea of free will, pointing to the non-conclusiveness of deterministic assumptions, are indicated.One of the objections discussed in the thesis refers to the inconsistency between determinism and the concept of responsibility and moral judgments, of which the source of meaning is manifested in free will.The objections related to the inconsistency in determinist attitudes and the need to revise basic thoughts and terms, resulting from the hypothetical acceptance of determinism, are then described.The final part of the thesis concludes with a summary of the most important issues raised and expresses the author's personal opinions on the topic discussed.
Praca odnosi się do krytyki determinizmu prezentowanej w pracach oksfordzkiego filozofa Isaiaha Berlina. Berlin, wyrażając swe poglądy, odwoływał się do zajmowanego przez niego stanowiska, opierającego się na myśli liberalnej. Przedstawione przez niego przekonania dotyczą głównie problemu nieadekwatności koncepcji deterministycznej do powszechnie przyjętych myśli oraz terminów, bazujących na idei wolnej woli.W pracy przedstawiono podkreślaną przez Berlina specyfikę relacji, która łączy pojęcie wolności i determinizmu. Ponadto wskazano formułowane przez brytyjskiego myśliciela, będącego jednocześnie zwolennikiem idei wolnej woli, zarzuty, wskazujące na niekonkluzywny charakter założeń deterministycznych.Jeden z omawianych w pracy zarzutów, odnosi się do niespójności, zachodzącej między determinizmem a pojęciem odpowiedzialności oraz sądami moralnymi, których źródło znaczenia przejawia się w wolnej woli.Następnie opisano zarzuty związane z niekonsekwencją w postawach deterministów, a także wynikającą z hipotetycznego przyjęcia determinizmu, potrzebą rewizji podstawowych myśli oraz terminów.W ostatniej części pracy podsumowano najważniejsze poruszone kwestie, a także wyrażona zostały własne poglądy autorki w przedmiocie omawianej problematyki.

Opis:: The article aims at presenting the relationship between science and philosophy based on the works of Werner Heisenberg. It deals with the infl uence of the scientifi c breakthrough on the understanding of physical concepts such as matter, time and causality.
