Opis:
Occurrence of conflicts in the workplace can be a significant expense for the organization. One of the actions that can be taken to manage the emerging conflict and to facilitate agreement between the parties is mediation. The mediation procedure is based on the principle of voluntariness and confidentiality. It is important to maintain the neutrality and impartiality of the mediator. The Mediator is a third party incorporated to assist the parties in reaching an agreement and the mediation process itself can be used successfully by organizations in the face of the occurrence of an internal conflict. Circumstances accompanying the occurrence of some organizational conflicts make it possible to classify them as collective disputes where (by law) mediation is a mandatory stage of dispute resolution. Mediation is potentially a profitable way to resolve disputes in an organization but is not a commonly used method. The authors of this article participated in an international project implemented under the European Commission’s “New European Industrial Relations (NEIRE): Mediation system effectiveness for collective organizational conflicts: A comparative study in Europe”. They undertake an attempt to analyze the mediation system in Poland and to answer the question of what might affect the dissemination of this method of conflict resolution.

Opis:
The aim of this paper is to analyse the image of Yugoslavia in the collective memories of the post–Yugoslav societies. The author of this text, basing on an assumption that every society has a great number of collective memories, highlights the fact that among the Balkan nations one can find both supporters and opponents not only of the SFRY but also of the idea of the cooperation among the Southern Slavs. Both positive and negative opinions of Yugoslavia in the collective memories are based not on the sober assessment of the historical facts but on collective emotions and historical and political myths. The anti–Yugoslav discourse in primarily based on the national mythology. The discourse of the supporters of the Yugoslav tradition one the other hand, goes back in a large extend to the transnational myths. By discussing these two types of ideas about Yugoslavia, the author of this text tries to show their impact on the current political decisions.

Although the competences of the EU in the field of industrial relations are limited, European standards concerning collective labour law have significantly affected domestic legal systems, including Polish law. EU legislation forced a reconstruction of a model of collective representation of employee interests. Polish law shifted from single- to double-channel representation with trade unions and employee councils (involved in information and consultation procedures). Under the influence of EU law the Polish legislator has established a number of collective procedures aimed at the protection of employee interests (e.g. collective redundancies, transfer of undertaking). As a rule, they reflect basic protective standards determined at the European level. There are, however, some lesser problems that weaken the effect intended by EU legislation. Nonetheless, implementation of European standards has contributed to the development of industrial relations and protection of workers.

In the judgment of the ECtHR in the case of Association of Academics v. Iceland, the Court commented on two important issues concerning the broadly understood procedure for resolving collective disputes. Firstly, the Court pointed out that “found that the taking of industrial action should be accorded the status of an essential element of the Article 11 guarantee but it is clear that strike action is protected by Article 11 as it is considered to be a part of trade union activity”. Secondly, it considered that the institution of mandatory arbitration could be a substitute for the right to strike, which was prohibited due to the need to protect the health of Icelandic citizens. In the context of the issues outlined in this way, the aim of the gloss is to verify the two theses mentioned above. First, the thesis was analyzed according to which the right to strike is not an essential element of freedom of association. For this reason, the jurisprudence of the Tribunal has been discussed against the background of ILO standards, taking into account the doctrine’s views on the status of the right to strike in the system of human rights protection and its relationship with other irenic methods of dispute resolution. Secondly, the thesis of the ECtHR was verified, according to which the mandatory arbitration established by the Icelandic legislator in the circumstances presented in the facts of the case does not constitute a violation of the right to strike. As part of the second thesis, the concept of mandatory arbitration and its status in the jurisprudence of the Court, as well as ILO bodies and labor law doctrine were analyzed. Finally, the relationship between the right to strike and social arbitration was examined.

The problem of collective industrial disputes and, in particular the legal regulations in this respect, have always raised controversies in the literature that examines labour rights, mainly due to the seriousness of the issue. Among other things, the doubts are related to the legislator-guaranteed trade union monopoly power to initiate collective disputes as well as their right to sole representation of employees in a collective dispute. While emphasizing the necessity to allow for the essentially Polish reality of collective employment relations, the author attempts to answer the question whether these regulations are in correlation with the constitutional right to collective bargaining and to what extend they can be changed.

Opis:
Collective self-reliance is an interesting, nowadays forgotten development strategy that was popular between the 1950s and 1970s, particularly among the newly independent states of the “Third World”. It was widely discussed in the 1960s, 1970s and 1980s by Yugoslav researchers, among others. This paper aims to examine Yugoslav ideas on collective self-reliance from a historical perspective on the basis of original works from the time. It presents a brief history of the idea and its resonance in the non-aligned world, contemporary criticism, as well as political, economic and spatial dimensions of the strategy and the means by which it aims to achieve the goal of an economically independent, sovereign “Third World region”. A summary of basic contrasts between two interpretations of collective self-reliance is given to illustrate the specifics of the Yugoslav approach. This developed strategy serves as a theoretical impulse to reintroduce the ideas of south-south cooperation to the development discourse.

Opis:
Methods of improving the state and rate of progress within the domain of philosophy using collective intelligence systems are considered. By applying mASI systems superintelligence, debiasing, and humanity’s current sum of knowledge may be applied to this domain in novel ways. Such systems may also serve to strongly facilitate new forms and degrees of cooperation and understanding between different philosophies and cultures. The integration of these philosophies directly into their own machine intelligence seeds as cornerstones could further serve to reduce existential risk while improving both ethical quality and performance.

The author of this paper tries to answer the question whether sins, wrongdoings and injustice done by past generations are inherited. The article presents theoretical reflections on the concepts of individuality and collectivity and their relationships; the themes of collective quilt and collective responsibility and the difference between them and the role and importance of collective memory, not only in context of heroic acts but also in the context of shameful past and misdeeds. The scientific theory is compared with empirical research results on today’s Germany decision-making policy in relation to Second World War tragedy. The presented theoretical background and analyzed material gives base to draw conclusions and answer the hypothesis set at the very beginning.
