Opis:: The aim of the article is an attempt to present more enhanced characteristics of the concept of public utility. It is a term that is also used in economic literature to describe a particular type of economic activity in the public sphere. However, despite the legal definition the category of public utility is not satisfactory and variously interpreted. The discussion conducted in the article is twofold. First, it refers to the formula of public utility enterprises; secondly, it refers to the analysis of the essential characteristics of this sphere of activity. To achieve this goal the author used literature review and legal acts. As a result, the findings concerning the conditions for the functioning of the public utility were presented and the author made an attempt to redefine the term. The article highlights the merits of the enterprise model in a separate legal regime, appropriate to the specific nature of public utility as derogation from the logic of the market.

Opis:: Modern public administration is primarily an administration that provides services to citizens. The key role is played by local government units, to which the Constitution of the Republic of Poland has assigned important public tasks in the sphere of satisfying the collective needs of their residents. The article will analyse constitutional provisions in terms of identifying those systemic principles that serve the implementation of this function of the administration.
Współczesna administracja publiczna to przede wszystkim administracja świadcząca na rzecz obywateli. Kluczową rolę odgrywają jednostki samorządu terytorialnego, którym Konstytucja RP przyznała istotne zadania publiczne w sferze zaspokajania zbiorowych potrzeb ich mieszkańców. W artykule zostanie przeprowadzona analiza przepisów konstytucyjnych pod kątem identyfikacji tych zasad ustrojowych, które służą realizacji tej funkcji administracji.

Opis:: The subject of this article is the analysis of one of own tasks, which aims to satisfy the needs of the local community by supporting and disseminating the self-government idea, including creating conditions for the operation and development of auxiliary units and implementation of programmes to stimulate civic activity. The subject matter has been presented on the basis of obligatory, quasi-obligatory and optional forms of satisfying collective needs of the community in the light of article 7 par. 1 point 17 of the Act on municipal self-government together with an indication of the role and significance of municipal bodies in the organizational and functional structure of the mechanisms presented, with the help of which the municipality’s own task is implemented. Discussing this task is important due to the fact that it is a form of implementation of the principle of subsidiarity and deconcentration in the self-government community.

Opis:: The thirtieth anniversary of the return of local government at the municipal level to the Polish legal and constitutional order prompts various reflections and summaries. There is also time to ask questions about basic issues. Such is the question about the existence of permanent and durable elements in the institution of local self-government, not susceptible to changes in the economic, technological or cultural environment. They include, first of all: 1) the legal nature of the municipal self-government (in terms of public and private law); 2) general goals justifying its existence; or 3) the ways and methods of their implementation. Considering the utilitarian and praxeological context of the existence of local self-government, it is worth paying attention, above all, to those permanent elements that determine the task-related effectiveness of the municipality. They are in particular: 1) collective needs of the community; 2) cooperation of the municipality with other entities and 3) measures conditioning the implementation of tasks entrusted to the municipality. The above enumeration does not reflect the full list of determinants of the effectiveness of local government institutions, but nevertheless it seems reasonable to present a few comments and observations on the indicated elements, which could also be treated as a source of verifying the correctness of the choice made.
