The article concerns the question of dual responsibility of the government in the French Fifth Republic. The first part is devoted to origins and development of the dualistic parliamentary system of government in France. According to this model ministers are politically responsible not only before the monarch, but also before the parliament. In the second part the author discusses the return to this model after the adoption of the current Constitution. In the light of this act the government is politically responsible before the parliament. However, when the dual executive comes from the same part of the political scene responsibility of the government before the president of the Republic is much more important. The situation changes significantly during periods of cohabitation. Under such circumstances the government bears political responsibility for its actions only before the parliament. The head of state is no longer able to dismiss the prime minister and other members of the government at his own discretion. In conclusion, the author points out that in the French political system there is no one coherent model of dual responsibility of the government because its shape is influenced by different configurations on the political scene.

The presented paper is a preliminary attempt to answer the question: whether the so-called Confucian Constitutionalism is a positive challenge for the dominant understanding of constitutionalism (in the form of the so-called liberal constitutionalism)? This involves adopting several assumptions. First, Confucian Constitutionalism can be treated as an intellectual challenge only against particular approach to constitutionalism. Strong adherence to the exclusive position, according to which there is only one constitutionalism, significantly limits (if not excluding) the possibilities of creative appeals to Confucian Constitutionalism. Second, presented approach refers to the concept of constitutional listening developed by M.D. Dowdle, which brings general justification for treating Confucian Constitutionalism as a positive challenge. Third, the focus is on the potential benefits that are associated with studying Confucian Constitutionalism, and not considering this project neither as a kind of threat nor a dubious a priori construction. What is more, the above-mentioned question presupposes that there is room for seeking new ideas on constitutionalism, going beyond considerations carried out under the banner of liberal constitutionalism.

100 years of constitutionalism of two neighbouring European states – Czechoslovakia, later becoming the Czech Republic, and Poland – encourage a reflection on the paths of development of their respective constitutions, on the historical stages and successive olitical transformations, not just in the context of individual constitutionalisms of each of those states but with an emphasis on the similarities and differences in this domain. And this is what this study focuses on. Starting from the common fate of rebirth of both states after WWI through the inter-war efforts to establish democratic constitutional systems and the obstacles found on the way, followed by the post-WWII period of real socialism ending with the era of transformations and stabilisation as democratic states of law. The text explores all the similarities found in both general aspects – like the references to the European tradition of parliamentary governance – and in certain specific solutions – like the differences in the concept of the two-chamber parliament. But there are also situations occurring in only one of the states, e.g. the federalisation of Czechoslovakia, the emergence of two separate states of the Czechs and Slovaks, or the differences in the course and sequence of events of democratic transformations in each of the states in the 1980s, which brings us to the conclusion that despite all the possible differences, the two constitutional systems have actually been very similar to each other.

Unwelcome excess of the law : on the critique of populist constitutionalism

The aim of the paper is to provide a critical inquiry into the structure of discourses that build up contemporary analyses of populist constitutionalisms. As the legal scholarship struggles to reconfigure itself in order to address the changing boundaries between law and politics due to the rise of illiberalism, it often falls into traps of myths and clichés. The paper attempts to identify the main assumptions of the currently dominant episteme, which makes legal scholarship straddle between the legacy of undermined liberalism and the raw political intervention of populism. In order to nuance the scholarly look on the ongoing transformations of legality, I suggest perceiving illiberalism as a hybrid work in progress that confronts liberal legality, but also draws from it and is thus haunted by irremovable excess and internal pitfalls.

The future of constitutionalism revolves around two critical issues which we see against the backdrop of the crisis of liberal democracy. The first issue concerns the conflict between the “judicial” constitutionalism and “political” constitutionalism. The “judicial” constitutionalism assumes a strong role of courts in a democratic system. Only courts can decide on compatibility of law with the constitution. In turn, the “political” constitutionalism assumes that the parliament decides on constitutional law. The rivalry between these two constitutionalisms seems to be the matrix of contemporary political dilemmas. The result of this rivalry is important for the efforts to end Polish constitutional crisis, as we will have to decide on the constitutional benchmarks applicable after the crisis. The second issue concerns the limits of constitutionalism. The author argues that the current digital era created a new phenomenon of digital constitutionalism. It operates in the sphere of private law relationships, dominated by private entities (big corporations). The relevant provisions for the digital world are the private law provisions. Comparative law and comparativists are crucial for answering the questions on the future of constitutionalism. The conflict of the two visions of constitutionalism and the extension of its limits are a great “training ground” for the comparativists.

Konstytucja jest zasadniczą ustawą państwa, normą z najwyższą mocą prawną, jak również prawnym wyrazem istnienia państwa. Nawiązują na nią kolejne ustawy, poprzez które konstytucja określa fundamenty systemu ustrojowego państwa, formy rządu i status jednostki w państwie. Ewolucja konstytucjonalizmu na ziemiach czeskich odbywała się w pewnych interwałach czasowych, które były w mniejszym bądź większym stopniu powiązane zrozwojem światowego konstytucjonalizmu. Celemniniejszej pracy, podzielonej na cztery rozdziałyjest przedstawienie historii konstytucjonalizmu na ziemiach czeskich od początku jego zaistnienia w połowie 19 wieku aż do 1948 r. Pierwszy rozdział poświęcony jest wydarzeniom związanym z monarchią habsburską. Rozpoczyna się od rewolucyjnego 1848 r., w którym runął feudalny absolutyzm i został położony kamień węgielny pod przyszły nowoczesnyustrój państwa Habsburgów, kończy omówieniu Konstytucji grudniowej z 1867 r. Drugi rozdział poświęcony jest kształtowaniu się czechosłowackiego konstytucjonalizmuw początkowym okresie uzyskania niepodległości w latach 1918 - 1920, jej utrwalaniu w latach 1920 – 1938, oraz jej faktycznej dezintegracji po 1938r.Okres lat 1938 – 1945 zawarty w trzecim rozdziale dotyczy wydarzeń mających miejsce bezpośrednio po konferencji w Monachium. Praca próbuje uchwycić sytuacje, które powstały wskutek dezintegracji I Republiki. Dotyczy to nie tylko niespełna sześciu miesięcznej historii II Republiki, lecz również Protektoratu Czech i Moraw, Państwa Słowackiego i po części także tymczasowego rządu na uchodźstwie w Londynie.Okres lat 1945 – 1948 opisuje proces petryfikacji reżimu komunistycznego, który został zakotwiczony w programie nowego czechosłowackiego rządu zwanego jako koszycki program rządowy. Cześć odnosząca się do 1948 r. opisuje dojście komunistów do władzy i ogłoszenie w maju 1948 r. nowej, w pełni już komunistycznej konstytucji.
The Constitution is the basic law of the state, the norm with the highest legal force, as well as the legal expression of the existence of the state. Further laws make reference to it, through which the constitution defines the foundations of the state's political system, forms of government and the status of an individual in the state. The evolution of constitutionalism in the Czech lands took place at certain time intervals, which were more or less related to the development of world constitutionalism. The purpose of this work, divided into four chapters, is to present the history of constitutionalism in the Czech lands from the beginning of its existence in the mid-19th century until 1948.The first chapter is devoted to events related to the Habsburg monarchy. It begins with the revolutionary 1848, in which feudal absolutism collapsed and the foundation stone of the future modern Habsburg state was laid, ends with a discussion of the December Constitution of 1867. The second chapter is devoted to the formation of Czechoslovak constitutionalism in the initial period of independence in the years 1918 - 1920, its consolidation in the years 1920 - 1938, and its actual disintegration after 1938.The period of 1938-1945 contained in the third chapter concerns events taking place immediately after the Munich conference. The work tries to capture situations that arose as a result of disintegration of the First Republic. This applies not only to the less than six-month history of the Second Republic, but also to the Protectorate of Bohemia and Moravia, the Slovak State and partly also the interim government in exile in London.The period from 1945 to 1948 describes the process of petrification of the communist regime, which was anchored in the program of the new Czechoslovak government called as the Košice government program. The part referring to 1948 describes the communists coming to power and announcing in May 1948 a new, fully communist constitution.

This essay (given at the PENClub Polska) deals with the relationship between constitutional matters and poetry. The essay takes a closer look at the poetry of Adam Zagajewski, Marcin Świetlicki, Julian Tuwim and Adam Bieszek. “There is nothing on us in the Constitution” – Marcin Świetlicki angrily declaims the bitterness of civil rejection in the poem “Under the volcano”. However, the poet is not right. The Constitution sometimes means more than it says directly. If it is silent about something, that does not always amount to rejection, as Świetlicki claims. The two first parts of the essay explain why the poet could have made such a mistake as to his presence in the Constitution. The third part expounds the change that is taking place in Poland: the rejection of the foundations of the Constitution without changing its text.

While the debates of the first term of Iranian Parliament- the National Consultative Assembly, or Majles (1906-1908) - have long been an important source for historians and other scholars, no serious effort has ever been undertaken to try and properly understand this historical source. As a result, a number of misconceptions exist about the debates of the early parliament and what survives as their minutes. The present paper aims to dispel some of these misconceptions by focusing on two issues: 1) whether - and to what extent - what survived to our day (by the virtue of being published in the Majles newspaper) should be considered the official minutes of the parliament; 2) what were some of the characteristics of the later edition of the minutes published as the supplement to the Official Gazette of Iran. This is achieved by the careful analysis of a number of sources, mainly the debates themselves, legal documents, periodicals and memoirs.
