Opis:: The subject of the article is to determine the circumstances in which state and church notaries are obligated to refuse notary conveyancing. After analyzing the canonical and state law from the article it can be concluded that there is a far-reaching analogy between law basics of refusing notary convenience for state and church notaries. It has been established that the reasons for this refusal-are in both legal orders: contradiction with the law, lack of full legal capacity and no legal interest.

Opis:: Effective land registers ensuring the accessibility of land information are of cru- cial importance for the development of cross-border conveyancing which falls within the scope of free movement of capital in the European Union. Specific to the European countries’ land registration systems is that they diverge consider- ably, the result being that they have not been directly subject to harmonisation so far. Nevertheless, efforts are undertaken to increase cooperation among national land registration authorities and what particularly contributes to achieve this objective is a common tendency towards informatisation. The article presents of assumptions and outcomes of selected information and communication technol- ogies-based projects implemented at the European level in order to streamline cross-border conveyancing by way of interconnecting land registers. On this basis, an attempt has been made to assess the effectiveness of hitherto cooperation initiatives and the prospects for enhancing the integration of real estate markets.

Opis:: Współcześnie występują zagrożenia przejawiające się w nieuprawnionym pozyskiwaniu danych osobowych oraz danych dotyczących nieruchomości, które zawarte są w księgach wieczystych. Zapobieganie takim ryzykom staje się tym trudniejsze, im więcej informacji zostało wpisanych w jawnie prowadzonych księgach wieczystych dających rękojmię ujawnionych w nich treści. W takich uwarunkowaniach wyzwaniem dla administracji staje się wspólne z wymiarem sprawiedliwości umożliwienie ochrony treści ksiąg wieczystych i dokumentów dołączonych do ich akt, a jednocześnie zapewnienie powszechnego dostępu do ksiąg wieczystych jako gwaranta obrotu nieruchomościami.
One of the risks society has to cope with nowadays is the unauthorised acquisition of personal and real estate data recorded in land and mortgage registers. The problems involved in the prevention of risks of this kind are proportional to the amount of information recorded in generally accessible land and mortgage registers which guarantee the truth and accuracy of such data. One of the challenges facing public administrative bodies is to work together with the judiciary to protect the data in land and mortgage registers and the documents attached to them, while at the same time ensuring the accessibility of the land and mortgage registers, which are the instruments guaranteeing the security of conveyancing.

Opis:: W nauce prawa szczególną uwagę zwraca się na konieczność zapewnienia wiarygodnego udokumentowania określonych zdarzeń, a w szczególności tych z zakresu obrotu prawnego. Niewątpliwie zaliczyć do nich można wiele czynności z zakresu prawa gospodarczego i handlowego. Aby osiągnąć cel jakim jest prawidłowe zabezpieczenie interesu stron umowy, a także obrotu gospodarczego i cywilnoprawnego, prawodawca przekazuje notariuszom kompetencję do tworzenia dokumentów o szczególnej doniosłości i mocy dowodowej. Notariusz stoi na straży legalności i bezpieczeństwa obrotu gospodarczego i cywilnoprawnego. Tezą niniejszej pracy jest przedstawienie czynności dokonywanych przez notariusza w kontekście prawa spółek jako czynności o szczególnym znaczeniu i doniosłości, ze szczególnym uwzględnieniem spółki z ograniczoną odpowiedzialnością. W pracy przedstawione zostaną czynności notarialne w aspekcie czynności konwencjonalnych, aby wskazać różnice pojawiające się pomiędzy zakresem znaczeniowym pojęć odnoszących się do konkretnych czynności dokonywanych przez rejentów. Następnie omówiona zostanie rola notariusza oraz uzasadnienie dokonywanych przez niego czynności notarialnych przewidzianych w przepisach ustawy Prawo o notariacie, a także ich znaczenie dla spółek. Praca zawiera również konkretne przykłady czynności notarialnych spotykanych w spółce z ograniczoną odpowiedzialnością wraz z omówieniem ich elementów, a także problemów, które mogą pojawić się na etapie ich sporządzania. Szczególna uwaga zwrócona została na rolę oraz znaczenie czynności notarialnych, z uwzględnieniem ustawowych obowiązków notariusza jako punkt wyjścia.
In the science of law, special attention is paid to the need to ensure reliable documentation of certain events, in particular those related to legal transactions. Undoubtedly, they include many activities in the field of economic and commercial law. In order to achieve the goal of properly securing the interests of the parties to the contract, as well as economic and civil law transactions, the legislator delegates to notaries the power to create documents of particular importance and probative value. A notary protects the legality and security of economic and civil law transactions. The thesis of this work is to present the activities performed by a notary public in the context of company law as activities of special significance and importance, with particular emphasis on a limited liability company. The paper presents notarial acts in the aspect of conventional acts in order to indicate the differences between the meaning of terms relating to specific acts performed by notaries. Then, the role of a notary and the justification for the notarial activities performed by him, provided for in the provisions of the Act on Notaries, as well as their significance for companies will be discussed. The work also contains specific examples of notarial activities encountered in a limited liability company along with an overview of their elements, as well as problems that may arise at the stage of their preparation. Particular attention was paid to the role and importance of notarial activities, taking into account the statutory duties of a notary as a starting point.

Opis:: Zasadniczym celem pracy było zbadanie sytuacji procesowej „osoby trzeciej”. Analizie zostało poddane zagadnienie aktualności legitymacji biernej pozwanego, w sytuacji gdy w trakcie procesu ze skargi pauliańskiej kontrahent dłużnika rozporządził uzyskaną korzyścią. Ponadto w pracy rozważono możliwość zastosowania instytucji podstawienia procesowego lub następstwa procesowego pod tytułem szczególnym. W niniejszej pracy magisterskiej poruszono także tematykę ewentualnego wpływu prawomocnego wyroku uwzględniającego powództwo przeciwko osobie trzeciej, na sposób ukształtowania orzeczenia w procesie podjętym wobec kolejnego nabywcy.
The main purpose of this master’s degree work is to described a position of defendant as a result of purchasing a benefit that has been transfered from debitor’s property.In addtion, there is conducted an analysis of possibility to continue the litigation against debtor’s contracting partner due to the fact that present defendant has already sold the benefit from a fraudulent venture. In the aftermath of a legal research that has been done in this work there is a conclusion that the creditor is able to continue the litigation against present defendant and he is also entitle to sue another purchaser – defendant’s contracting partner.
