Opis:: The paper discusses some negative aspects of the work of Poland’s customs system after the country’s entry to the European Union on May 1, 2004. The author attempts to explain the reasons for these shortcomings and also examines their social and economic implications. Negative developments in the Polish customs service have included misguided organizational changes that have led to conflicts among customs officers, Mosiej says. Another problem is corruption among customs administration employees, a trend that has risen considerably since the country’s EU accession, according to Mosiej. Other unsettling trends include decreased customs protection of the domestic market, a major drop in government revenue from customs duties, and the closure of many customs agencies and the resulting loss of jobs, the author says. All these negative trends have resulted from both exogenous and endogenous factors. The former include the adopted EU customs regulations, while the latter involve the activities of Polish customs officers themselves. All the negative aspects of the work of Poland’s customs system should be eliminated as soon as possible, Mosiej concludes, because this harms the image of the country’s customs system in the EU and elsewhere.

Opis:: The COVID-19 pandemic has unprecedented and multidimensional repercussions for economic systems both at a national and a global level. The EU legislation provides for unique instruments designed, among other things, to extend aid to the victims of natural disasters (but not only), which may be utilised in order to respond to an unprecedented health crisis caused by the coronavirus. Customs administrations must play an important role here. Countries which reduced the time and costs of customs clearance at their borders are gaining advantage over those which failed to do so. The crisis sparked off by the COVID-19 pandemic led to questions about the application of customs regulations, customs procedures and customs formalities. Customs clearance should be assigned a high priority when it comes to “critical” goods relating to the protection of human health or life, whereas some imports should be exempt from the customs duty and (national) VAT, if it is possible to demonstrate that such commodities have been given free of charge as a donation. This article aims to describe actions and initiatives associated with customs procedures, which were taken by the EU to combat the pandemic. Measures relating to COVID-19, which concern customs procedures and trade, provide, at the same time, a review of challenges that both Member States and the whole European Union must confront to ensure the availability of goods on the one hand, and to facilitate the movement of goods and guarantee the safety of trade in goods on the other.
Pandemia COVID-19 wywołała bezprecedensowe i wielowymiarowe reperkusje dla systemów gospodarczych zarówno na poziomie krajowym, jak i globalnym. W prawodawstwie UE dostępne są wyjątkowe narzędzia mające na celu m.in. pomoc ofiarom klęsk żywiołowych (ale nie tylko), które można wykorzystać do stawienia czoła bezprecedensowemu kryzysowi zdrowotnemu spowodowanemu przez koronawirusa. Administracje celne mają tu do odegrania kluczową rolę. Kraje, które zminimalizowały czas i koszty odpraw celnych na granicy, zyskują przewagę nad tymi, które tego nie zrobiły. W wyniku kryzysu wywołanego pandemią COVID-19 pojawiły się pytania dotyczące stosowania przepisów, procedur i formalności celnych. Odprawa celna powinna zostać potraktowana priorytetowo dla towarów „krytycznych” związanych z ochroną zdrowia czy życia ludzi, a niektóre towary importowane powinny być zwolnione z cła i (krajowego) podatku VAT, jeśli udowodni się, że zostały nieodpłatnie przekazane w formie darowizny. Celem artykułu jest charakterystyka działań i inicjatyw związanych z procedurami celnymi podjętych przez UE w ramach walki z pandemią. Środki dotyczące COVID-19, które odnoszą się do procedur celnych i handlu, dają jednocześnie przegląd wyzwań, przed którymi stoją zarówno poszczególne państwa członkowskie UE, jak i cała Unia Europejska, aby zapewnić dostępność towarów przy jednoczesnym ułatwieniu ich przepływu i zapewnieniu bezpieczeństwa obrotu towarowego.

Opis:: The customs law system within the EU Customs Union is characterized by the coexistence of EU law and national legislation respecting the primacy of EU law. The above-mentioned basic premise led the authors to a deeper reflection on the significance of Slovak customs legislation. In this context, the scientific publication first emphasizes the basic starting points of the legal regulation of the EU customs area in general, such as the exclusive competences of the EU in the customs area and in the common commercial policy and the legal basis of the EU customs union directly in primary law. Subsequently, the authors provide a comparative and historical view of the Slovak legal regulation of customs law in the period before and after the accession of the Slovak Republic to the EU. In conclusion, the authors summarize the basic impacts of the existence of the EU customs union on Slovak legislation in a positive and negative sense.

Opis:: Przepisy prawa celnego ustanawiają prawa i obowiązki osób przywożących i wywożących towary z terytorium Unii Europejskiej oraz uprawnienia i obowiązki organów celnych. Jednym z podstawowych obowiązków osób przywożących lub wywożących towary z terytorium Unii jest obowiązek uiszczenia należności celnych. Nakładane one są nie tylko w celach stricte fiskalnych, ale służą ochronie rynku unijnego przed konkurencyjnymi towarami sprowadzanymi z zagranicy. Należności celne są jedną z podstawowych instytucji prawa celnego Unii Europejskiej. Pomimo to wciąż brakuje opracowań teoretycznych poświęconych tej instytucji prawnej.
Customs legislation establish rights and obligations of importing and exporting goods from the territory of the European Union and the powers and duties of the customs authorities. One of the primary responsibilities of the persons importing or exporting goods from the territory of the state is obliged to pay customs duties. They are not imposed only for strictly fiscal, but serve to protect the EU market against competing goods imported from abroad. Customs duties are one of the basic institutions of the European Union customs law. Despite it still lacks theoretical studies devoted to this legal institution.

Opis:: The article constitutes another contribution to the debate regarding the place of customs in the system of public levies. Customs have been for ages seen as a benefit collected from persons trading internationally. Currently, the institution of customs as the only public levy collected by Polish customs au-thorities, contributes not only to the state budget, but it primarily constitutes income of a public-law union, that is, the European Union. Customs is fre-quently an element of trade policy of the European Union and predominantly provides protection for the Union market, it is aimed at preventing import of selected goods. Opis:: In this research paper the author considers the problematic aspects of interaction of bodies (units) of state border protection and customs of the State Customs Service of Ukraine during the detection of signs of violations of customs rules, as well as the indentifying property that has no owner or owner unknown at border crossings. entry-exit checkpoint, in the controlled border area. At the same time, the current state of legal regulation of this issue, the main legislative developments in this area, which took place in connection with the joint order of the Ministry of Finance and the Ministry of Internal Affairs of Ukraine number 849/828, foreign approaches to cooperation between customs and border units. Based on the study, it was concluded that the issues of cooperation between state border guards and customs of the State Customs Service of Ukraine are regulated by the updated Procedure number 849/828, approved by a joint order of the Ministry of Internal Affairs and the Ministry of Finance of Ukraine. a number of powers from the administrative-operational group to draw up reports on administrative offenses, to send an act of detection, and on the property of the owner, who is unknown or as has no owner - transfer of property to the relevant department of the State Customs Service of Ukraine, to other officials of state border guards, and also extended the validity of this document not only to cases of violations of customs rules, property whose owner has no owner or whose owner is unknown, detected at checkpoints across the state border of Ukraine, but also for similar cases detected at the checkpoint of entry-exit, in the controlled border area. At the same time, the mentioned Procedure number 849/828 does not solve a number of urgent issues of such interaction, such as: insufficiently effective coordination of work of state border guards and customs of the State Customs Service of Ukraine on ensuring unity of customs and border control, impossibility to send a representative protection of the state border (units of protection of the state border) and customs of the State Customs Service of Ukraine, carrying out separate control in cases when it is necessary to carry out joint control, lack of interest in such interaction, lack of a specific list of reasons when a joint inspection should be conducted, lack of sanctions for failure to conduct a joint inspection in case of detection of goods moving in violation of customs rules and border legislation without sufficient reasons. Therefore, a solution to these problems is proposed.

Opis:: 1 lipca 2018 roku przypada 50. rocznica powstania unii celnej w Unii Europejskiej, a tym samym rocznica funkcjonowania unijnego systemu celnego – składającego się z 28 administracji celnych. Administracje celne państw członkowskich, wykonując swoje zadania, muszą działać sprawnie i skutecznie, szybko reagować na wszelkie potrzeby wynikające ze zmiany otoczenia celnego i winny to robić tak, jakby tworzyły jeden podmiot – jedną administrację. Odpowiedź na pytanie, czy i na ile działania administracji celnych Unii Europejskiej zostały ujednolicone tak, aby można było mówić w praktyce o jednej, a nie o 28 różnych służbach celnych, jest celem artykułu. Przeprowadzone rozważania pozwoliły wysunąć wniosek, że w przyszłości nie będzie jednej administracji celnej na poziomie wyłącznie Unii Europejskiej – nadal będą funkcjonować służby celne poszczególnych państw członkowskich, z nieco różniącymi się strukturami organizacyjnymi, ale pełniącymi takie same funkcje i działającymi w oparciu o zharmonizowane prawo celne. Ważnym jest jednak, by różnice w ich funkcjonowaniu były jak najmniejsze i temu służą działania podejmowane w ostatnich latach przez Unię Europejską.
July 1, 2018 is the 50th anniversary of the establishment of the customs union in the European Union and, at the same time, the anniversary of functioning of the Union customs system – a system composed of 28 customs administrations. In the course of performing their tasks, customs administrations of Member States need to act effectively and efficiently; quickly respond to all the needs necessitated by the changing customs surroundings and they must do it in such a way as if they were one entity – one administration. The aim of the present article is to answer the question whether, and, if so, to what extent the operations of the European Union customs administrations have been standardized so that they may be regarded as one, not 28 distinct administrations. The carried out considerations allowed drawing a conclusion that, in the future, there will be no one customs administration, functioning solely on the European Union level – there will still be customs administrations of respective Member States, with slightly-varying organizational structures but performing the same functions and acting on the basis of harmonized customs law. However, it is crucial for the differences in their functioning to be as little as possible, and that has been the main objective of steps undertaken by the European Union in recent years.

Opis:: The article describes the contribution of customs to the implementation of sustainable development goals included in the UN 2030 Agenda. The paper presents the historical outline of the sustainable development concept and explains how basic tasks performed by customs contribute to the achievement of these goals. World Customs Organization plays an important role in activities for sustainable development, especially its numerous political and practical initiatives, including international operations of customs services aimed at combating environmental crime. The article analyzes also the EU customs regulations and activities of the EU Member States’ customs services. The decisive role of customs in controlling the compliance with the sustainable development requirements related to international trade in goods as well as a need for wider cooperation with other control services and business is emphasized.
W artykule omówiono wkład celnictwa w realizację celów zrównoważonego rozwoju zawartych w dokumencie ONZ Agenda 2030. Przedstawiono zarys historyczny koncepcji zrównoważonego rozwoju oraz pokazano, w jaki sposób celnictwo, pełniąc swoje podstawowe funkcje, przyczynia się do osiągania tych celów. W działaniach na rzecz zrównoważonego rozwoju ważną rolę odgrywa Światowa Organizacja Celna, w szczególności jej liczne polityczne i praktyczne inicjatywy, w tym międzynarodowe operacje służb celnych, mające na celu zwalczanie przestępstw przeciwko środowisku. Analizie poddano także unijne regulacje celne i działalność służb celnych państw członkowskich UE. Podkreślono decydującą rolę celnictwa w kontroli przestrzegania wymogów zrównoważonego rozwoju w międzynarodowych obrotach towarowych oraz konieczność szerszej niż dotychczas współpracy z innymi służbami kontrolnymi i biznesem.
