This text seeks to present basic knowledge on the detention of foreigners in Poland and the research perspective adopted in the project involving the authors of the papers published in this volume. The article has been divided into two parts. The first one contains characteristics of the detention of foreigners in the Polish context: directions of migration flows resulting from the location of our country, as well as the whereabouts and profiles of the centres administered by the Border Guard. Part two familiarises the reader with the specific nature of our detention study project: its conceptual apparatus, the adopted research paradigms, the applied methodology, and the challenges related to our exploratory efforts being performed in a very specific place - the guarded centres for foreigners. In the authors’ intention, all this information is to constitute a useful background to the detailed considerations contained in the subsequent papers presented in this volume of the journal.

Opis:
The article presents information on the activities of the National Preventive Mechanism (NPM) in Poland with regard to detention centres. The study covers all NPM’s reports, both annual and those from regular and ad hoc visits conducted in detention centres during all years of operation of this preventive institution in Poland (2008-2022). The crisis along Poland’s border with Belarus in 2021 and 2022 led to increased involvement of the NPM in conducting preventive visits to places where foreigners can be deprived of liberty. These are places of isolation under the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. The article presents a summary of the most important recommendations that the NPM made regarding these particular places of isolation, including children in detention, living conditions and the right to privacy.

Law, life, impossibility : theorising 'Law Application' in detention centres for foreigners

The paper attempts to grasp conceptually the nature of law application in zones of confined life. Drawing upon empirical research, it uses the example of closed centres for foreigners. Approaching the topic with methods of sociology of law and legal anthropology, as well as drawing on Agamben’s conceptualisations of law and life, I would like to propose a more general understanding of the role that law plays in total institutions such as detention centres. A great majority of legal provisions pertaining to them is stipulated with the intention of defending the detainees from abuses of power. Nonetheless, the positivist view of the law which translates noble principles, enshrined in constitutions and international law, into low-rank acts and then regulates the behaviour of officers, is at odds with the practice revealed by the sociological and anthropological research. The law remains a foreign body to officers: it is acknowledged as a body of rules which officially regulate all the actions of the institution, but in truth it functions rather as the Other’s gaze. It embodies external control and the possibility of intervention. As such, it never regulates the actions per se (it is too unfamiliar to do so), but rather constitutes an external foothold which stops officers from applying all the methods of discipline that they spontaneously invent. It also provides a free object of criticism which mediates between officers’ projected goals of border guards and their expected practice. Consequently, the vision of the law as a tool that ‘regulates’ detention centres is empirically contradicted. The paper addresses this relation with the use of Agambenian conceptuality, seeking points of contact between the law and life as well asking to what degree life is lawrepellent in confined zones.

Opis:
Prison sentence used in Polish penal system is one of the most widely criticised punishments used for criminals. The convicted are sent into prisons or detention centres, which makes them (the incarcerated) even more vulnerable to committing a crime due to their isolation and solitary confinement. In this way, a distinct subculture is created. It is conditioned by many factors which determine its size, form, norms and rules enforced by the prisoners. The phenomenon of prison subculture causes a wide range of negative consequences, e.g. self-aggression; aggression towards other inmates, prison officers, or even family; mental or physical abuse; mental or sexual disorders. Such situations have a negative influence on the process of resocialisation, because they are destructive for the personality of a prisoner, especially for a juvenile delinquent as his/her decision making possibilities related to themselves are limited. Therefore, one might venture to say that the bigger the influence of subculture norms and rules, the more disturbed the process of resocialisation.

This Master's thesis is a description of the pre-trial detention in Poland, including its practical aspect during the previous years. It is supposed to be an answer to the question of how pre-trial detention looked like in the past and how it is formed nowadays. The analysis of the pre-trial detention’s legal nature and shape recording to polish law is this master thesis’ focal point. The author is mainly focused on the pre-trial detention as a tool of the justice system.The institution should be efficient on one side but not interfere in basic human rights in an irrational and unreasoned way on the other.              The thesis starts with definitions, purposes and functions, the role of the pre-trial detention as one form of preventive measures is important as well. One part is a chapter devoted to the historical side of this institution, from World War I to 1997. The investigation is focused on the Polish Code of Criminal Procedure of 1928, the Polish Code of Criminal Procedure and the Executive Penal Code of 1969.Another part of the Master’s thesis is the analysis of provisions, which contains the basis of detention, its limitations, the decision-making process and the control in this area. Much attention is also given to the extending of this institution and the amendments administrated over the years. This interpretation applies mainly to the provisions of the Code of Criminal Procedure of 1997.Next chapter is dedicated strictly to executive proceedings. It emphasizes on the mode, the competences of the judicial bodies and the legal status of the arrested person. The work is completed by the analysis of statistical data about pre-trial detention during the last years.
Praca stanowi monografię poświęconą tymczasowemu aresztowaniu w Polsce, nie pomijając praktyki jego stosowania na przełomie ostatnich lat. Odpowiada na pytanie jak wyglądała, a jak wygląda współcześnie ta instytucja. Praca spełnia funkcję opisową, jej główny problem badawczy stanowi zaś analiza kształtu tymczasowego aresztowania, wyznaczonego przez obowiązujące obecnie przepisy. Autorka skupiła się przede wszystkim na tymczasowym aresztowaniu jako narzędziu wymiaru sprawiedliwości, które ma zapewnić jego skuteczność, przy czym nie ingerować w podstawowe prawa człowieka w sposób nadmierny, nieracjonalny i niczym nieuzasadniony. Definiując podstawowe pojęcia autorka skupia się także na celach i funkcjach tymczasowego aresztowania oraz na jego miejscu w systemie środków przymusu. W pracy zawarte są podrozdziały historyczne obejmujące okres od zakończenia I wojny światowej po wejście w życie kodeksu karnego z 1997 r. obowiązującego obecnie. Analiza dotyczy przede wszystkim rozporządzenia Prezydenta Kodeks postępowania karnego z 1928 roku, rozporządzenia Ministra Sprawiedliwości o służbie więziennej z 1931 roku, a jeżeli chodzi o okres PRL: Kodeksu postępowania karnego i Kodeksu karnego wykonawczego z 1969 roku. W pracy zawarta jest analiza przepisów dotyczących podstaw stosowania tymczasowego aresztowania, jego ograniczeń i niedopuszczalności, trybu podejmowania decyzji oraz kontroli, w tym zakresie. Dużo uwagi poświęcone jest również instytucji przedłużania tymczasowego aresztowania oraz poszczególnym nowelizacjom. Interpretacja w tym zakresie dotyczy przede wszystkim przepisów Kodeksu postępowania karnego z 1997 roku.Kolejny z rozdziałów poświęcony jest stricte postępowaniu wykonawczemu. Skupia się na trybie, uprawnieniach poszczególnych organów oraz na statusie prawnym tymczasowo aresztowanego, jego prawach i obowiązkach. Dopełnienie pracy stanowi analiza danych statystycznych dotyczących stosowania tymczasowego aresztowania na przełomie ostatnich lat.

W ostatnich latach w Polsce obserwowany jest wzrost liczby osób tymczasowo aresztowanych. Jednocześnie poziom przestępczości nie jest wysoki i wykazuje tendencję spadkową. Obserwowana jest zatem tendencja, która wyłamuje się spod logicznego, naturalnego uzasadnienia, iż to w przypadku wzrostu przestępczości, szczególnie tej najpoważniejszej powinna wzrastać liczba stosowania najsurowszego środka zapobiegawczego. W artykule przedstawiono cele oraz funkcje tymczasowego aresztowania. Ich analiza wskazuje, że niedopuszczalne wykorzystywanie funkcji pozaprocesowych, któremu sprzyjają określone czynniki mogą prowadzić do nadużywania stosowania tymczasowego aresztowania.
In recent years, Poland has observed an increase in the number of people in pre-trial detention. At parallel, crime rates are not high and are on declining trend. There is therefore a tendency which defies the logical, natural justification that the number of pre-trial detentions should increase in line with the growth of crime, especially the most serious types of crimes. The article discusses purposes and functions of detention in Polish criminal procedure. The analysis of them indicates that the illegal use of non-procedural functions, which is facilitated by certain factors, may lead to overused pre-trial detention in Poland.

The issue of operiational work carried out in penitentiary units has for years aroused considerable controversy, opposition and disputes both among representatives of the prison systemand among representatives of science. Undoubtedly, this state of affairs was influenced by the negative experiences of the prison reality of the Polish Peopless Republic and the inglorious role played therein by special units established to conduct operational activities. Due to the breadth of the topic of operational work in prison on the one hand, and the limited scope of this publication on the other. The whole thing was divided into four independent parts. The first part will present the framework, forms and methods of conducting operational work in the years 1944–1989. In the second part, I will present how the situation in this area developed after the change of the political system and in the conditio of the new socio-political situation determined by the requirements of a democratic state of law. The third part will be devoted to the analysis of currently applicable institutions that regulate the conduct of operational and reconnaissance activities in prisons and detention centers. Finally, in part four, I will assess the individual allegations presented by opponents denying the admissibility of conducting operational work in a penitentiary institution.
