Obowiazki celne i podatkowe w imporcie towarów
Customs duties and taxes on imported goods

The thesis describes the basic concept of imports of goods and associated with the activity of customs and tax duties. It is a compendium of its kind, in which the person who wants to start a business involving the importation of goods can find basic information and can treat it as a guide to the customs rules. Accordingly issues were discussed the concept of importing goods, and different definitions of imports in domestic and Community legislation. Subsequently, the basic obligations under the customs laws, such as the obligation to submit a customs declaration or the goods imported to give the appropriate destination customs. Were also raised issues relating to tax liabilities arising from the incident, which is the import of goods. The whole closes the chapter on tax offenses arising out of violation of customs or tax on imports of goods.
W danej pracy magisterskiej zostały opisane podstawowe zagadnienia dotyczące importu towarów oraz związanych z tą czynnością obowiązków celnych i podatkowych. Stanowi ona swojego rodzaju kompendium, w którym osoba chcąca rozpocząć działalność gospodarczą polegającą na imporcie towarów, możne znaleźć podstawowe informacje i może traktować ją jako przewodnik po przepisach celnych. Odpowiednio zostały omówione kwestie dotyczące samego pojęcia importu towaru oraz różne definicje importu w przepisach krajowych oraz wspólnotowych. Następnie przedstawione zostały podstawowe obowiązki wynikające z przepisów celnych, takie jak obowiązek przedstawienia zgłoszenia celnego czy też nadanie importowanym towarom odpowiedniego przeznaczenia celnego. Poruszone zostały również kwestie dotyczące należności podatkowych wynikających ze zdarzenia, którym jest import towarów. Całość zamyka rozdział dotyczący przestępstw i wykroczeń skarbowych wynikających z naruszenia przepisów prawa celnego lub podatkowego, związanych z importem towarów.

Medical duty versus the code-based regulation of employee duty in the light of the non-national standards

Opis:
Employee's duty is one of the institutions of general labour law, regulated in the Labour Code. However, with regard to medical professionals employed in healthcare institutions, the legislator introduced special provisions in this respect, prior to the general code regulation. Employee's duty has also been the subject of numerous considerations by the Court of Justice of the European Union. In Poland, only with regard to medical duty, the wording of national provisions has been adapted to EU law and the interpretation of the Court of Justice. The aim of this article is to analyse the legal nature of employee's duty and medical duty in terms of non-national standards, especially the interpretation made by the Court of Justice in this respect.

Opis:
The article concerns the subject of homeschooling practice conditions in Poland – it focuses on the legal conditions and outlines the socio-economic conditions in which Polish homeschoolers operate. It discusses the specific kind of right which is the right to education, its position in the systematics of the constitution and the connection to the learning duty and school duty. It brings attention to state-citizen relations and the rule of state subsidiarity. It points to legal regulations which allow realization of the school duty outside of school, underlining the controversial and discriminatory regulations which ignore the parents’ priority to decide on their own children’s education and treat children learning in this way unequally to those who attend school. The article is ended by an observation about the state remaining decisive on the form of education of each citizen, despite the constant change of legal regulations, which in relation to the discussed subject characterizes the last three decades.

Praca magisterska o tytule "Konsekwencje administracyjnoprawne zniesienia obowiązku meldunkowego" traktuje o zmianie nadchodzącej w polskim prawie, która z wielu względów ma bardzo doniosły charakter. Mianowicie obowiązek meldunkowy zniknie z polskiego systemu prawnego 1 stycznia 2018 roku po niemal dziewięćdziesięciu latach funkcjonowania. W pracy została przedstawiona istota instytucji obowiązku meldunkowego oraz najważniejsze, zdaniem autora, konsekwencje administracyjnoprawne zniesienia obowiązku meldunkowego. Począwszy od wymiaru konstytucyjnego, przez zmiany w prawie materialnym, a kończąc na zmianach odnoszących się do prawa proceduralnego.

According to the Polish constitutional tradition, regulations concerning the duties of man and citizen can be found in chapter II of the Constitution of the Republic of Poland devoted to the rights and freedoms of the Polish Constitution, specifically in Articles 82-86 inclusive. The Constitution devotes relatively little space to its duties, and the catalog indicated therein is not extensive. The purpose of articulating obligations in the Constitution of the Republic of Poland is primarily to emphasize the most important ones from the point of view of the state, society and individual. In each country, some constitutional obligations are addressed only to citizens, while others are imposed on all who are subject to the authority of a given country. The Constitution of the Republic of Poland also does so. Indicated in art. 86 the obligation to care for the state of the environment and responsibility for its deterioration is in the group of universal obligations in terms of subject, which are imposed on every person who is within the jurisdiction of the Republic of Poland. This study is an analysis of the concept of environment, care for the state of the environment and the provisions of the constitution on this subject.

Opis:
The article attempts to signal problems related to the increase of defence readiness of the state. There are presented procedures for launching regular standby duty and issues concerning its functioning. In addition, tasks for individual persons fulfilling on-call duties are listed. Issues taken in connection with the unstable geopolitical situation in Eastern Europe are important as far as increasing defence readiness of the state is concerned.
