The civil service in Poland after 1989

The aim of the work is to present the development of the civil service in Poland after 1989. The first chapter, "The essence of the civil service" is a theoretical introduction to the issue of the state administration and civil service. Based on a series of definitions, articles of the Constitution and the Court's judgment is shown by its role in the country and the empowerment of the law. This chapter contains a description of the principles which it is characterized by professionalism, integrity, impartiality, political neutrality. The second chapter is a discussion on the historical aspects of the development of the civil service. Analyzed are individual laws and documents, introducing significant changes. In a detailed chapter refers to changes in the civil service system introduced by the Act of 21 November 2008. The third chapter is a characterization of theoretical models of the civil service and their practical aspects. Detailed analysis allows to show positional specificity Polish model, which combines elements of both. The fourth chapter is a broad description of the problems with which the Polish civil service at present is measured. There are present: negative image of the civil service, the problem of corruption and politicization of the process of public administration, especially the civil service. The author examines these issues further by searching for the cause. In the analysis of the problems used are statistics and studies conducted by the CBOS. In addition, the thesis is based on reports Wold Values Survey, the Internal Security Agency, the World Bank and social research. The final chapter, the fifth, entirely devoted to the challenges facing the civil service. Pictured is the direction in which it evolves, and what action needs to take to function effectively in a changing world. Discussed challenges such as: the phenomenon of Europeanisation of the civil service, the implementation of the concept of e-government and implying modern methods of public administration. The work emerges a picture of an evolving civil service, developing in the direction of greater flexibility and better organization.
Praca dotyczy rozwoju służby cywilnej w Polsce po 1989 roku. Przestawione w niej są uwarunkowania prawne oraz zachodzące zmiany legislacyjne, problemy oraz wyzwania przed jakimi obecnie ona stoi.Pierwszy rozdział „Istota służby cywilnej” to wstęp teoretyczny wprowadzający w tematykę administracji państwowej oraz korpusu służby cywilnej. W oparciu o szereg definicji, artykuły Konstytucji oraz orzeczenia Trybunału ukazana jest jej rola w państwie oraz umocowanie w prawie. Rozdział zawiera także opis zasad jakimi jest ona charakteryzowana: profesjonalizm, rzetelność, bezstronność, neutralność polityczna. Rozdział drugi to rozważania nad historycznymi aspektami rozwoju służby cywilnej. Przeanalizowane są poszczególne ustawy oraz dokumenty, wprowadzające istotne zmiany w charakterze korpusu. Wskazany jest szeroki kontekst transformacji, zarówno instytucjonalny jak i polityczny. W sposób szczegółowy rozdział odnosi się do zmian w systemie służby cywilnej wprowadzonych przez ustawę z dnia 21 listopada 2008 r. Rozdział trzeci to charakterystyka teoretycznych modeli służby cywilnej oraz ich praktycznych zastosowań. Szczegółowa analiza dwóch modeli: kariery i pozycyjnego umożliwia pokazanie specyfiki modelu polskiego, łączącego elementy obu. Rozdział czwarty to szeroki opis problemów z jakimi polska służba cywilna obecnie się mierzy. Kolejno opisane są: negatywny wizerunek służby cywilnej, problem występowania korupcji oraz proces upolityczniania administracji publicznej, szczególnie służby cywilnej. Autor analizuje wymienione problemy, dodatkowo doszukując się ich przyczyn. W analizie problemów wykorzystane są dane statystyczne i badania przeprowadzone przez CBOS. Dodatkowo tezy oparto o raporty Wold Values Survey, Agencji Bezpieczeństwa Wewnętrznego, Banku Światowego oraz badania społeczne. Rozdział ostatni, piąty, w całości poświęcony jest wyzwaniom przed jakimi stoi służba cywilna. Ukazany jest kierunek, w jakim ona ewoluuje, a także jakie działania musi podjąć by sprawnie funkcjonować w zmieniającym się świecie. Omówiono takie wyzwania jak: zjawisko europeizacji służby cywilnej, realizacja koncepcji e-government oraz implikowanie nowoczesnych metod zarządzania w administracji publicznej. Z pracy wyłania się obraz ewoluującej służby cywilnej, rozwijającej się w kierunku większej elastyczności i lepszej organizacji.

Ukraina, jako dawne państwo posowieckie, szczególnie od czasu nieudanej pomarańczowej rewolucji 2005 roku, stanęła przed koniecznością budowania nowoczesnego państwa, w tym nowoczesnej administracji. Niniejszy artykuł ma na celu przedstawienie rozwoju e-government i e-governance w Ukrainie. Odniesiono się do światowych oraz polskich definicji powyższych pojęć. Przeanalizowano najważniejsze dokumenty rządowe i wyróżniono trzy etapy budowania e-gov w Ukrainie. W początkowym okresie Ukraina jedynie cyfryzowała swoją administrację. Jednak główną przeszkodą w osiągnięciu sukcesu była niska liczba użytkowników internetu. W kolejnych latach – także dzięki pieniądzom i pomysłom pochodzącym z bardziej doświadczonych państw – polityka cyfryzacji administracji ewoluowała w kierunku e-governance i e-demokracji. Przyspieszenie nastąpiło wraz z wyraźnym wyartykułowaniem dążeń integracyjnych z Unią Europejską.
Ukraine, as a post-Soviet state, especially since the rather unsuccessful Orange Revolution of 2005, has faced the need to build a modern state with modern administration. This article aims to present the evolution of e-government and e-governance in Ukraine with reference to the definitions of these terms. The most important government documents were analyzed and three stages of building e-gov in Ukraine were distinguished. In the initial period, Ukraine only digitized its administration. However, the main obstacle to success was the low number of Internet users. In the following years – also thanks to money and ideas from more experienced countries – the policy of digitalization of administration evolved towards e-governance and e-democracy. The process accelerated when Ukraine articulated its aspirations for integration with the European Union.

Opis:
Adopting new technologies into the practice of national government can significantly improve the quality of public services and the government’s general performance. In this paper we present the results of our research on Poland’s performance of e-government in comparison to EU15 and NMS12. The analysis is based on data provided by Eurostat’s Information Society’s comprehensive database. We find that Poland, on average, is lagging behind other European countries from both SMEs perspective and especially from citizens perspective in implementing effective technologies in public sector. In this paper we deliver some recommendations for the polish government.

The subject of this master's thesis is the process of informatisation in broadly understood administrative law. The first chapter presents the title concept and a brief history of informatisation in Poland, as well as the perspectives related to the discussed phenomenon. The second chapter is devoted to the legal conditions of computerisation in the Polish legal order. The objective and subjective scope of the Act on informatisation of the activities of entities performing public tasks was also discussed. The third chapter focuses on public administration bodies and how computerisation affects the performance of its tasks. The subject of the last, fourth chapter is the relationship of the discussed phenomenon with the court-administrative justice system.
Tematem niniejszej pracy magisterskiej jest proces informatyzacji w szeroko rozumianym prawie administracyjnym. W rozdziale pierwszym przedstawiono tytułowe pojęcie oraz krótką historię informatyzacji w Polsce, a także perspektywy związane z omawianym zjawiskiem. Rozdział drugi został poświęcony prawnym uwarunkowaniom informatyzacji w polskim porządku prawnym. Omówiono również zakres przedmiotowy oraz podmiotowy ustawy o informatyzacji działalności podmiotów realizujących zadania publiczne. W rozdziale trzecim skupiono się na organach administracji publicznej oraz tym jak informatyzacja wpływa na wykonywanie jej zadań. Z kolei przedmiotem ostatniego, czwartego rozdziału jest związek omawianego zjawiska z sądowoadministracyjnym wymiarem sprawiedliwości.

The article analyzes the peculiarities and problems of introducing e-democracy in Ukraine. It is noted that separate e-democracy tools, namely, e-reception of the mayor, possibility to submit e-appeals, holding on-line polls etc. have been introduced in many cities of Ukraine. A common e-appeal portal, “e-parliament” have been created, the system of e-petitions has been introduced. The article looks into the development of e-democracy in the context of four components: transparency, accountability, civic education and e-participation. Attention is drawn to the fact that under certain circumstances e democracy may become an imitation of democracy, a technology for manipulation. It is stated that introduction of e-participation tools alone does not guarantee their wide usage by the population, and what is most important – their usage with the aim of causing quality changes in governance. That is why a very important task is to raise the level of civic education with regard to e-democracy. This may be proved by the results of the first year after the introduction of the system of e-petitions to the central bodies of executive power and the single system of local petitions in Ukraine. Many of the submitted petitions either contradicted the norms of Ukrainian legislation or were sent to those bodies of power, which are not competent to solve the issue. The article draws attention to the problem of digital inequality, i.e. the level of Internet access among the citizens of Ukraine. According to different evaluations, form 14 to 26 million people are active Internet users in Ukraine, and from21% to 29% of those constantly visit the sites of the bodies of power and local self-governing. Even though a mass introduction of various electronic services may be observed, it is also necessary to increase the popularity and the level of trust to electronic systems of the society in general as it is one of the least computerized ones in Europe. According to Google data, a bit more than 60% of Ukrainians are Internet-users. The authors insist that for effective e-democracy functioning, it is necessary to strengthen the infrastructural component. The existence of the material and technical base is the necessary condition for the development e-literacy among the population, which, in its turn, will lead to their active participation in e-democracy processes. It is obvious that the citizens of Ukraine cannot effectively use the existing and potential possibilities in the sphere of e-governance unless they have the sufficient competence level and have the access to the information-communication technologies. The article analyzes the situation in which the paradox of creating a “false democracy” arouses, meaning the situation when specialists make an effort to form e-democracy tools and the target group does not know about them, people do not have the necessary competence level for using these resources, there is no interest in using the concrete instruments. So it becomes understandable that attention should be focused on using effective practices of e-democracy functioning, on raising citizen competence and on encouraging them to actively participate in state building through e-democracy, e-participation etc. It has been determined that in case of uniting the efforts of IT-specialists, public activists and representatives of the authorities and business, a complex evaluation of the needs of modern society and effective mechanisms of e-democracy introduction will be received. Internet-technologies have unbelievable possibilities, and searching for like-minded people online and attracting people to common activity (“crowdsourcing”) may become one of effective mechanisms of introduction of e-democracy instruments. One of the best examples of its usage in Ukraine was the so-called “e-Maydan”. A conclusion has been made that the existence of considerable restrictions in Internet access (electronic inequality), low level of interest in e-communication the public bodies of power among Internet-users, lack of competence in e-governance and e-democracy, low level of interest among the citizens to e-communication in general; absence of Internet-platforms for mass deliberation and selection of acute sociopolitical issues etc. are all among the problems of implementation of e-democracy. Transparency, decrease of bureaucracy levels, increasing the efficiency of state institutions etc. should be the results of e-democracy introduction.

Purpose: One of the doctrines of New Public Management is increased efficiency and consumer satisfaction in local government. Implementing new technologies like digital administration and blockchain could be very helpful in achieving this objective. The article focuses on the usability of e-government as a management tool and the possibility of implementing blockchain technology in local government accounting. This re-search attempts to answer the following research question: What are local government employees’ perceptions of e-governance and blockchain technology? Methodology/approach: A survey was used as a research tool to determine the role of digital administration and blockchain technology in local government units at the community level. A questionnaire was emailed to all municipalities in Poland: rural, urban and urban-rural. Findings: The results of the research show that, in the respondents’ opinion, the use of e-governance in local government is very helpful in management. However, the use of blockchain technology in local government accounting is debatable. Research limitation/implications: This paper will be useful to academics and practitioners to enable an understanding of the problems associated with introducing and using new technologies in local government. The limitation of the research is that blockchain technology is new and, unfortunately, there are very few examples of its implementation by local governments in Poland. Therefore, it is difficult to assess the positive and effective implementation of blockchain technology by local governments. The article shows the point of view of local government officials, which is also a limitation of our research. Originality/value: The article makes an important contribution to the research on the use of new technologies in local government units. The research has made it possible to assess e-government as a tool for managing local government units and to present officials’ attitudes to the possibility of using blockchain technology in local government accounting.

The key aspects of the state policy of Ukraine are considered in the context of the development of the civilizational challenges of the present day and the requirements of ensuring national safety. Separate attention applies on determination of role of national political class in realization of public policy in area of modernisation transformations. After all, the readiness of the national political class to implement the reform program of the systemic transformation of the state and society is one of the determining factors of the success of the state policy. The author argues that the emergence of a consolidated political class, which clearly recognizes national priorities and is able to defend and defend national interests, is an urgent need for the present and future for Ukraine. In the context of the coverage of the studied issues, the peculiarities of the institutional design of the Ukrainian state and its influence on state policy were determined. It is stressed that despite the tangible democratic progress of recent decades, the threat of an increase in autocratic and authoritarian tendencies in state policy, on the one hand, and the weakening of those already shaky germs of forms of direct democracy (for example, participation democracy, self-governing forms of organization citizens), without the development of which it makes no sense to speak about the modernization potential of the state policy of modern Ukraine. For example, the real political state of the basic state and social institutions, the domination of informal rules of the game on the political field, allows us to characterize the state of the political system of Ukraine today and its separate political institutions as hybrid. One of the examples of successful implementation of the state policy of modernization of the Ukrainian state can be considered a gradual transition to the e-governance system. E-Governance refers to innovative state policy and government technologies that are designed to ensure the effective implementation of the three functions of public policy - information, communication and participation. Therefore, the active introduction of e-governance is not just time requirements; it is the approximation of state policy to modern standards of democratic, modernized state-political control. However, it should be noted that the proliferation of e-governance entails tangible threats to the national state and national security. Let’s say the threat of violation of sovereignty. In a geopolitical situation in which Ukraine emerged after 2014, such a threat is not only virtual, but quite tangible, which puts forward special requirements to the system of state policy both at the personalized and institutionalized levels of functioning. Under such conditions, one of the main tasks of state policy is to create a reliable system of cybernetic protection of state sovereignty and national security of the country, which would maximally protect the Ukrainian state and Ukrainian citizens on the institutional and personal levels, respectively. On the other hand, an e-governance system that would be able to organically integrate into the system of global e-communication should be developed, pushing the Ukrainian state into a group of countries - pioneers of the total internetisation of the state and society. Further research on this issue should be concentrated, among other things, as the author believes, in the development of models for reviewing the principles of state policy in Ukraine in the context of the deployment of the integration of the national state into a globalized world political process.

Today, information and communication technologies are widely used in all spheres of public life; state policy is gradually gaining publicity and social accessibility; it becomes possible for society to actively participate in globalization policies and processes; the digitalization of public services is globalized and covers the whole world, which indicates a netocratic vector of development of modern society. Given the pace of development of globalized e-democracy and the world’s efforts for socio-economic recovery, it is necessary to update the priorities of digital governance in order to increase trust in governments and state institutions, and for this it is necessary to create effective legislation that determines the possibility of forming a perfect governance system and regulatory state policy in the field of e-democracy. The article considers domestic legislative acts designed to regulate and streamline management processes in the conditions of netocracy of society, to ensure their consistency, stability, balance (laws of Ukraine: «On Information », «On Information Protection in Information and Communication Systems», «On the National Informatization Program», «On Electronic Documents and Electronic Document Management», «On Electronic Digital Signature», «On Electronic Trust Services», «On State Registration of Legal Entities, Individuals – Enterprises and Public Formations», «On telecommunications», «On the licensing system in the field of economic activity», «On the Fundamentals of the Development of the Information Society in Ukraine for 2007–2015», «On the Protection of Personal Data», etc.). An analysis of the indicated domestic legislative framework indicates a quantitative growth and improvement of regulatory documents covering the digital spheres of public administration. It has been established that the issue of harmonization of Ukrainian legislation with world legal norms remains important.

The article conducts a comprehensive study of public information and communication space in Ukraine, analyzes its current state considering regulatory and organizational features, identifies key challenges for quality development and modernization of the industry, and identifies key dysfunctional problems that prevent high performance in domestic development of information and communication technologies. It is argued that an important role in the constructive formation of the public information and communication sector is played by the state information policy, which should be based on such principles as openness, system, equality of interests, priority of domestic producers, social orientation. It turns out that the formation of a quality public information space contributes to the development of civil society, information society and information democracy. Comprehensive digitalization of public communication will promote openness, transparency and accessibility of public information, the formation of partnerships between the public, business, and civil sectors. Three basic stages of formation of information and communication space have been identified: strategic, organizational and control ones.

Comparatively new in the field of urban development, the concept of “Smart city” is considered to be a crucial tool to overcome urban challenges faced by the citizens in XXI century. The article discusses the basics of the concept, analyzing its key dimensions. An overview of digital market in Ukraine and its positions in the world rankings are provided along with the evolution of e-governance in Ukraine, as one of the components in “Smart city” concept. We have outlined the most interesting smart solutions presented in Ukrainian cities and built a comparative table for those among 4 cities. Based on the analysis conducted we have created a list of challenges faced by Ukraine on its way to “smartization”.
