Niniejsza praca magisterska dotyczy kwestii mocy dowodowej zagranicznych dokumentów urzędowych w Polsce. Praca składa się z pięciu rozdziałów dotyczących kolejno:1.Uznawania zagranicznych dokumentów urzędowych na podstawie krajowego prawa procesowego, ze szczególnym uwzględnieniem nowelizacji Kodeksu postępowania cywilnego z lipca 2009 r.2.Zniesienia legalizacji dokumentów według umów międzynarodowych bilateralnych zawartych przez Polskę.3.Zniesienia legalizacji dokumentów według umów międzynarodowych multilateralnych ratyfikowanych przez Polskę, ze szczególnym uwzględnieniem Konwencji haskiej z 5 października 1961 r. znoszącej wymóg legalizacji zagranicznych dokumentów urzędowych, jak również Konwencji londyńskiej z 1968 r. i Konwencji wspólnotowej z 1987 r. 4.Problemu zagranicznych dokumentów urzędowych dotyczących przeniesienia własności nieruchomości położonej w Polsce, ze szczególnym uwzględnieniem pełnomocnictwa do dokonania tej czynności.5.Zniesienia wymogu legalizacji dokumentów w świetle prawa Unii Europejskiej z uwzględnieniem postanowień Zielonej Księgi z 14 grudnia 2010 r.
The master thesis concerns the topic of force of evidence of foreign official documents in the Republic of Poland. The thesis contains five chapters regarding respectively:1.Recognition of foreign official documents based on the Polish procedural law, in particular with consideration of the amendment of Civil Procedural Code of July 2009.2.Abolition of legalization of documents according to international billateral agreements concluded by the Republic of Poland.3.Abolition of legalization of documents according to international multilateral agreements ratified by the Republic of Poland, in particular to the Hague Convention of 5 October 1961, which abolished the requirement of legalization of foreign official documents as well as London Convention of 1968 and the Communitarian Convention of 1987. 4.The question of foreign official documents regarding the transfer of ownership of a real estate located in Poland, in particular the letter of attorney for such action.5.Abolition of requirement of legalization of documents according to the European Union law including the regulation of the Green Paper of 14 December 2010 - Dostawca treści:
