The article is about the legal character of the institution of forfeiture (article 412 of the Civil Code). It aims to determine the character (civil or criminal) of this institution. It demonstrates the purpose of the regulation and the history of its development. It shows the perceived character of article 412 of the Civil Code in several periods, and presents a detailed analysis of the expression doctrine of individual periods relating to forfeiture. Particular attention is paid to the mechanism of action of the institution, its similarity to forfeiture as known in criminal law. Establishing the nature of the provision is based primarily on functions and purposes of the forfeiture provision.

On 23 March 2017 the Sejm (the lower chamber of the Polish Parliament) passed the Act on Amending the Criminal Code and Numerous Other Acts23. In the reasons appended to the draft bill it was asserted that the law intended “to introduce into Polish substantive, executive and procedural criminal law amendments with a view to enhancing the effectiveness of mechanisms employed to deprive offenders of the benefits they accrued as a result of committing a crime”. This paper sets out to present a construction of Article 45 of the Polish Criminal Code as amended and to assess the correctness of the amendment, particularly in the context of the Polish Constitution and the Directive 2014/42/EU of the European Parliament and of the Council of 3 April 2014 on the freezing and confiscation of instrumentalities and proceeds of crime in the European Union.

Opis:
Combating drug crime is one of the most important challenges faced by law enforcement agencies in the modern world. The infamous popularity of prohibited substances, in particular amphetamine and marijuana, is due to its availability and reasonable price. Eliminating the indicated threat requires such diligent operational work from the law enforcement authorities and the comprehensive use of legal tools provided by the legislator. Taking appropriate steps, both procedural and non-procedural, leads to a factual conduct of criminal proceedings in the in rem and ad personam phase. In the presented article, the author analyzed the current legal status in terms of possible procedural and non-trial activities aimed at disclosing and securing prohibited substances. An important element of this publication is also an indication of activities aimed at collecting comprehensive evidence in accordance with the principle of material truth, which is a constitutive principle of criminal procedure. The conducted analysis leads to the conclusion that in global terms, combating drug crime is a measurable benefit not only in legal but also social, economic and sociological terms.

The article aims to present the functioning of the institution of animal forfeiture under the Act of August 21, 1997 on animal protection. It is a repressive-preventive institution, which is closely related to the property rights of every citizen under the Constitution of the Republic of Poland. At the beginning of the considerations, an attempt was made to define the concept of “animal forfeiture” and to indicate the legal basis for ruling on this legal measure. The types of animal forfeiture occurring under the Act are presented and the circumstances determining their ruling identified. The analysis is extended to include the presentation of cases of application of this institution taken from court rulings and supported by statistical data regarding their adjudication. An interesting aspect of the article is the presentation of resolutions of City Councils, which were declared invalid by the Provincial Administrative Court to the extent that they were inconsistent with the Animal Protection Act. Extensive legal considerations, reinforced by case law and analysis of statistics, have made it possible to present de lege ferenda postulates with regard to raising the level of protection of animal rights. One of the proposals is to combine the institution of forfeiture with a total ban on animal ownership, as well as to articulate in the law the justification for ordering the forfeiture of an animal’s carcass. The article is an attempt to present legal solutions that will enhance the legal protection of animals. As shown in the article, this measure is used relatively rarely. Statistics show that it was applied in only 21.5% of the cases analyzed. Such results may raise legitimate doubts, since most animals against which crimes have been committed are still under the care of their perpetrators, which should undoubtedly change.

Under the Act of 20 February 2015 – changing the Penal Code and some other acts, from 1 July 2015 the forfeiture has been removed from the catalogue of penalties – the art. 39 point 4 of the Penal Code was repealed – and also from the catalogue of security measures of an administrative nature – the wording of the art. 99 § 1 of the Penal Code has been changed, the art. 100 of the Penal Code has been repealed and its content has been transferred to the art. 49a of the Penal Code. Currently, the forfeiture is fully regulated in chapter Va of the Penal Code, entitled „Forfeiture and compensatory measures”. Changing the normative status of the forfeiture is not understood. I consider it as a mistake. This change was not associated with changes of the normative status of forfeiture in the Fiscal Penal Code and Code of Offences. Besides the changes concerning the status of the forfeiture which has obviously system nature under the amendment came to repeal the provisions of articles 44 § 8, 45 § 6 and art. 45 § 4 of the Penal Code. These were changes of organizational character. They were accompanied by changes in the provisions of the Executive Penal Code and Code of Criminal Procedure, which took over the content of the repealed provisions of the Penal Code. The wording of the art. 45 § 3 of the Penal Code regulating one of the legal presumptions relating to the forfeiture of financial benefits has been changed. This has increased the warranty standard of that provision.

The author in this research paperpresents the description of restorative concept of justice. Specifically, it focuses on the description of alternative sentencing of monetary character, its role and characterization in the system of criminal law in the Slovak republic. The objective of forfeiture of property is to reach for the property of an offender, as well as, last but not the least, it aims to recondition the offender. The objective of forfeiture of an object is to eliminate the thing, which could be used for criminal offence. The basis is to obstruct the conditions of an offender for further criminal activity, or to deprive the benefit acquired by committing a crime.
Autor studium naukowego bada opis rekonstruującej koncepcji kary. W szczególności, alternatywna kara charakteru nieruchomości, ich statusu i definicji w systemie prawa karnego w Republice Słowackiej. Rolą kary za przepadek mienia jest dotarcie do własności sprawcy, a na koniec - do odbudowy sprawcy. Celem ukarania przepadku jest wyeliminowanie rzeczy, która może służyć popełnieniu przestępstwa. Istotą jest pogorszenie warunków sprawcy za popełnienie innych przestępstw lub wycofanie jego świadczenia, które przestępca uzyskał w wyniku przestępstwa.

The draft amendments to criminal law, presented by a group of politicians from the Ministry of Justice, include the mandatory forfeiture of a driver's vehicle if they commit a specific traffic-related crime.

Should gains from criminal knowledge be forfeited?

Nobody should profit from crime; this fundamental moral principle is uncontroversial. At the level of public declaration, few people are likely to disagree with this statement; however, controversies arise when the implementation of this principle is under discussion. Numerous provisions exist that aim to strip criminals of the proceeds from their crimes, but not all aspects of this issue are immediately apparent. For example, a significant question is how to treat profits that a criminal makes from activities including recounting stories about their criminal activities, publishing books describing their actions, or creating YouTube videos presenting details about their crimes. Such profits are either treated as legitimate or are targeted by complicated legal methods of deprivation. The view presented in this paper could facilitate the ability to strip criminals from these forms of profit. This article argues that revenue accruing from knowledge gained from association with crime should be treated as indirect proceeds of crime and, as such, should be forfeited.
