Opis:: The article points out the role and importance of standardization in the EU economic policy and development strategy and discusses European standardization activities in the field of transport and its basic institutional structure and organization of the work of the technical bodies of the European Standards Organizations (ESOs). The relation between the standardization and legislation and selected European standardization initiatives concerning transport are shown. The article also deals with the principles of cooperation of the EU Member States and ESO technical bodies as well as the main problems of the system of national standardization.

Tytuł:: Sustainable consumption and circular economy in the Directive 2019/771

Opis:: One of the aims behind issuing a new directive on consumer sales contracts (directive 2019/771) was to adjust this part of contract law so that it can contribute to sustainable de-velopment. The Rec. 32 of the directive explicitly states that one of its objectives is toachieve more sustainable consumption patterns and a circular economy. This article analyses whether and to what extent this motive is reflected in the black letter rules of the directive (the previous directive on consumer sales contracts constitutes a point of reference). The work begins with a general assessment of the interplay between the values the directive is meant to protect. The impact that the values at hand may have on the interpretation of the directive’s provisions is diagnosed (with a focus on the influence of the choice of the method of harmonization on the interpretation process). The study covers ecology-related issues emerging in the context of durability requirements, objective conformity requirements stemming from various quality standards, reparability of the good, consumers rights under the directive and the interplay be-tween the general private law rules and the directive’s norms. Based on the analysis, the first conclusions regarding the ecological effectiveness of the directive are made. Although directive 2019/711 announces striving for the achievement of sustainable consumption and a circular economy as one of its aims, within its black letter provisions no significant changes are intro-duced in comparison to its predecessor. The EU legislature has correctly diagnosed some (but not all) areas where modifications should be made to ensure sustainable consumption within the consumer market. Nevertheless, no significant changes in their regard were introduced. As a result, the interpretation of the directive’s provisions through the prism of the ecology-related values should be applied to ensure that this regulatory intervention brings about the intended change to the consumer sales law.

Opis:: During the development of the Treaty of Rome it was decided that, to assure a common market, it was enough to harmonise indirect taxes and remove trade barriers as they were the prime inhibitors to the flow of goods and services. The harmonisation of direct (income) taxes was not considered as they were seen as not signifi cantly affecting the single internal market. Problems tied to direct taxation became visible as integration proceeded, the EU grew, its citizens began to migrate, multinational enterprises increased in size and scope and their financial flows (capital and profi t transfers between headquarters and subsidiaries in different EU countries) became seriously affected.

The product placement is today one of most debated issue for the media law experts in Europe. What is the “product placement”? In what kind of programmes the product placement is allowed? What are the conditions these programmes have to fulfill in order to contain the product placement? The AVMS Directive states even the programmes during which is not allowed the product placement. How are reflected into the new Albanian draft-law on audiovisual media services the AVMS Directive obligations? These are some of the questions that the following article tries to answers.

Opis:: This paper emphasises that Europeanisation of law contributes greatly to the phenomenon of decodification. The impact of European legislation on the position of the civil code as the main source of private law is clearly visible in the case of directly effective regulations. Also, implementation of directives can (and often does) lead to the creation of legislation regulating civil law matters, yet separate from the civil code. The Polish experience with implementation of directives concerning consumers protection makes for a good example. Regulation of timeshare contracts completely outside the civil code is – according to the Polish doctrine – a result of difficulties with integrating this particular provision into the codification of private law. If such difficulties are inevitable, so is also progressing decodification of civil law due to its advancing harmonization on the European level.

Opis:: This paper focuses on the civil liability of asset managers in Polish law. Following the transformation of the economic system and the development of the capital market in Poland, the importance of asset management has been gradually increasing, though it remains disproportionally lower when compared to the role of collective asset management in the form of investment funds. The chief purpose of both MiFID directives is to harmonize the rules applicable to investment firms providing brokerage services in Europe, and to protect the interests of investors using brokerage services. Although the civil liability of investment firms offering brokerage services is part of what is broadly construed as investor protection, the regulations on this matter have been left to the member states’ discretion. There is no doubt that discrepancies between member states in this respect diminish the harmonizing effect of both directives. This paper sets out todetermine the basic rules of civil liability of asset managers in Polish law, and present suggestions for the most common problems in this field.

Opis:: Dyrektywa INSPIRE ustanawiająca ramowe podstawy w zakresie infrastruktury informacji przestrzennej (SDI) definiuje założenia funkcjonowania polityki wspólnotowej w tym zakresie, m.in. odnośnie publicznego dostępu do danych. Ponadto Dyrektywa wprowadza podział zbiorów danych przestrzennych oraz ich klasyfikację zgodnie z tematami załącznika I. W zależności od przynależności do tematu, zaawansowania zasobu oraz dostępności danych, zbiory danych przestrzennych różnicują się w zakresie interoperacyjności. Opracowana Mapa Podziału Hydrograficznego Polski w skali 1:10 000 wpisuje się w założenia i wytyczne Dyrektywy realizując zobowiązania Polski w ramach tematu Hydrografia. Artykuł opisuje uwarunkowania realizacyjne projektu w kontekście zgodności i spójności danych przestrzennych z Dyrektywą INSPIRE. Poddano analizie modele danych MPHP10 oraz INSPIRE, wskazując główne różnice. Następnie opisano główne etapy procesu, poczynając od budowy modeli mapujących obie struktury, a kończąc na migracji danych.
The INSPIRE Directive establishes a framework for spatial information infrastructure (SDI) in the European Union and defines the main policy goals across the EU, among others in terms of public access to data. The Hydrographic Map of Poland at the 1:10 000 scale fits the guidelines and framework of the Directive, fulfilling Polish obligations under the theme Hydrography. This paper describes conditions for execution of the MPHP10 project in the context of consistency and compatibility of spatial data with the INSPIRE Directive. The data models of MPHP10 and INSPIRE have been analyzed, indicating major differences. The paper then describes the main stages of the process, starting from construction of models mapping both data structures and ending with data migration.

Opis:: The purpose of this paper is to answer the question whether, despite the differentiation of the corporate income tax in the European Union, there are similarity patterns allowing for the harmonization of the bases of this tax. The analysed CIT static data both quantitative and qualitative concerns the years 2018 and 2020. The method of hierarchical cluster analysis allowed a grouping of EU countries according to their similarities. It also indicated the greatest tax diefrences between EU member states. In turn the afinity analysis made it possible to distinguish groups of countries which are similar in terms of CIT with the simultaneous identification of a pattern. Results show that despite significant diefrences in tax rates some EU states show convergence in tax bases. The geographical criterion still plays an important role in determining CIT structure and tax incentives are one of the tools that may be used in the approximation of the bases.

Opis:: W publikacji podjęto próbę pokazania możliwości wykorzystania danych topograficznych pochodzących z Bazy Danych Obiektów Topograficznych (BDOT10k) i z wojskowej Wektorowej Mapy Topograficznej nowej edycji (Vmap_L2+), w poszczególnych etapach prowadzenia odkrywkowej działalności górniczej. Pokazano, iż na każdym z tych etapów należy opracowywać różnego rodzaju dokumentację cyfrową zawierającą załączniki graficzne w postaci szkiców, profili, przekrojów, planów i map. Przeanalizowano na jakim etapie wdrażania INSPIRE potrzebna jest topograficzna i tematyczna geoinformacja do interoperacyjnego zasilenia map górniczych danymi topograficznymi. Dokonano również analizy porównawczej wybranych elementów map górniczych takich jak wyrobisko górnicze i zwałowisko. Zaproponowano zestandaryzowanie danych atrybutowych w BDOT10k dla obiektów potrzebnych do dokumentacji górniczej oraz dodanie dwóch nowych klas obiektów. W chwili obecnej, przy okazji modernizacji zasobu geodezyjnego i kartograficznego, a przede wszystkim ewidencji gruntów i budynków oraz tworzeniu baz BDOT500 i GESUT, możliwe jest uspójnienie danych graficznych i opisowych, potrzebnych do kartograficznych opracowań dla górnictwa.
The paper shows the possibilities of using topographical data from the Topographic Objects Database (BDOT10k) and the Vector Military Topographic Map (new edition, Vmap_L2 +), at various stages of conducting opencast mining operations. It is shown that at each of these stages all sorts of digital documents must be developed, which contain graphical attachments in the form of sketches, profiles, sections, plans and maps. It has been analyzed at which stage of INSPIRE implementation topographical and thematic geoinformation was required to supply interoperable topographic data mining maps. A comparative analysis of selected elements of mining maps such as pit mining and dumping ground was also performed. The standardization of data attributes in BDOT10k for objects needed for mining documentation was proposed. At present, on the occasion of modernization of geodetic and cartographic resources, and, above all, the land and buildings registers, as well as creating BDOT500 and GESUT databases, it is possible to improve coherence graphic and descriptive data needed to cartographic studies for mining.
