Opis:: Decision making in terms of grading and evaluating students significantly contributes to unequal opportunities. In Switzerland, this is particularly true for the transition from elementary school to the stratified system of secondary schools, which oft en is determined by school authorities. Based on the case study of an elementary school in German-speaking Switzerland, this contribution explores accounts in which these decisions are related. Two types of accounts have to be taken into consideration. The first type refers to a student’s performance. This type of account is documented in a rather technical way. It aims to strengthen the procedural rationality of the decision-making process. Another type of accounts is based on material considerations. It refers to the effects of decisions on individual cases. This type of account is communicated to parents in order to achieve consent concerning a recommendation about which type of school a student should attend. The case illustrates that discriminatory decision making can be related to highly institutionalized accounts.

Opis:: Institutional discrimination against women in Poland is a social problem that persists despite constitutional guarantees of gender equality and legislation providing for compensatory measures. The article analyzes the possibility of using M. Marody’s concept of the “brave victim” as a means of designing compensatory actions in legislation and enforcement that will help eliminate institutional discrimination. Institutional discrimination is defined in legal doctrine as discrimination that occurs at the level of a given institution, organization, or even society as a whole.The article also analyzes cultural and social factors that condition or contribute to the deepening of legal and social inequality for women. The article identifies areas of institutional discrimination in Poland, including: the labor market, parental rights, social rights, access to political functions, and increasing women’s participation in public life.The analysis of national legal regulations and regulations implemented from EU law indicates the heterogeneity of protection against discrimination. The article proposes conditions and principles for the application of special legal solutions that establish anti-discrimination standards applicable in the current social conditions in Poland.The concept of the “brave victim” is a social fact that the legislator should take into account when designing policy law to avoid social tensions and develop effective legal solutions to counter discrimination.

Opierając się na zrozumieniu antycyganizmu jako zjawiska historycznie odtwarzanego i osadzonego instytucjonalnie, niniejsze badanie wskazuje, że utrzymujące się luki i braki w traktowaniu Romów oraz społeczna niezdolność do pracy nad dziedzictwem Holokaustu Romów okazały się być przeszkodą dla wysiłków UE na rzecz integracji oraz ich skuteczną ochronę praw podstawowych i dostępu do wymiaru sprawiedliwości. Postawiono hipotezę, że konflikt między naszymi wartościami równości a rzeczywistością zakorzenionego rasizmu, „problem Gadje”, stanowi główną przeszkodę w skutecznych działaniach na rzecz integracji Romów. Niniejsze badanie sugeruje innowacyjne podejście polegające na zwalczaniu antycyganizmu poprzez bardziej zdecydowane stosowanie unijnego podejścia do praworządności i praw podstawowych, które ma na celu przywrócenie prawdy historycznej.
While the history of Roma mistreatment is shocking and seemingly endless, and certainly should not be forgotten, it is of more contemporary relevance to understand why the phenomenon of antigypsyism exists, how it is legitimized into a special kind of racism and what can be done about it. Building on the understanding of antigypsyism as phenomenon historically reproduced and institutionally embedded, this research identifies that persisting gaps and deficiencies in the treatment of Roma and the social incapability of working through the legacy of Roma Holocaust, has proven to be a barrier to EU inclusion efforts and their effective protection of fundamental rights and access to justice. It is hypothesized that a conflict between our values of equality and the reality of ingrained racism, the “Gadje problem,” creates the main obstacle for effective Roma Inclusion. This study suggests an innovative approach by addressing antigypsyism via a more robust application of EU rule of law and fundamental rights approach that aims to restore the historical truth.

Opis:: The article analyzes the transformational potential of the #MeToo movement in terms of personal experience, institutional, and social transformations, looking first of all at the dynamics the movement has created in theater in Poland and around the world. The author unveils the systemic dimension of violence encoded in invisible and standardized relations of domination and subordination, inscribed in the two models which are still very common in Polish theater: the "master and apprentice" model defining the position of a director and the "feudal" model visible in institutional relations.Looking at the "Gardzienice" case and the reactions of the public to the testimonies exposing violence, the author also mentions examples of institutional and systemic reactions to similar situations in British and Belgian theater. In this way, she outlines possible directions for action in Polish theater. She asks questions about the transformative and emancipatory potential of the #MeToo movement, emphasizing the necessity to consider an intersectional perspective, to build alliances and to practice promiscuous care.

Opis:: The Master's thesis is devoted to the problem of discrimination on the grounds of religion and areligiosity in the area of employment in Poland. The aim of the study is to conduct a comprehensive analysis of the various forms of this phenomenon and the consequences for employees. In the first chapter, I focused on discussing the definition of discrimination and the characteristics of manifestations of unequal treatment. The second chapter was devoted to the concept of the prohibition of discrimination on the grounds of religion or areligion and the sources of Polish law. I then addressed the issue of legal remedies against discrimination in Polish and European Union law.
Praca magisterska poświęcona jest problematyce dyskryminacji ze względu na religię i areligijność w obszarze zatrudnienia w Polsce. Celem badania jest przeprowadzenie kompleksowej analizy różnych form tego zjawiska oraz konsekwencji dla pracowników. W pierwszym rozdziale skupiłam się na omówieniu definicji dyskryminacji oraz na charakterystyce przejawów nierównego traktowania. Drugi rozdział został poświęcony pojęciu zakazu dyskryminacji ze względu na religię lub areligijność oraz źródłom prawa polskiego. Następnie poruszyłam kwestię środków ochrony prawnej przed dyskryminacją w prawie polskim i prawie Unii Europejskiej.

Zdaniem autorki nowoczesny problem potrzebuje nowoczesnych rozwiązań, dlatego w pracy zostały wykorzystane najnowsze raporty, przyjrzano się coraz częściej wybieranej przez kobiety branży IT, aby przeanalizować kwestii poruszane w pracy na podstawie najbardziej aktualnych danych.
The aim of the presented bachelor thesis is to draw attention to the fact that women entering the labor market often face various problems, inequalities and broadly understood discrimination. The problem of increasing the professional activity of women in Poland was presented. The analysis of many aspects of women's lives that have an impact on their professional careers has been made. Interesting solutions to these problems were proposed on the example of the Kingdom of Sweden, famous for promoting gender equality, for which it works in all areas. According to the author, a modern problem needs modern solutions, which is why the latest reports were used in the work, and an analysis of the IT industry chosen by women more and more often was examined in order to analyze the issues raised at work on the basis of the most up-to-date data.

Zjawisko whitewashingu jako jeden z wymiarów dyskryminacji mniejszości azjatyckiej w Hollywood

Opis:: The following master thesis is focused on the discrimination against Asian minority in American movie industry. The main purpose of the paper is to introduce the whitewashing phenomenon and to prove that whitewashing is one of the examples of Asian marginalization in Hollywood, which is corelated with deeper exclusion of Asian group. The history of Asians in the USA and selected theoretical categories from the field of social sciences are discussed in order to prove the occurence of the whitewashing phenomenon and other manifestations of discrimination against the Asian minority. The studies carried out as a part of the master thesis are based on a film analysis of selected American movie productions, against which there were whitewashing allegations.
Niniejsza praca skupia się wokół tematyki dyskryminacji mniejszości azjatyckiej w amerykańskiej branży filmowej. Jej celem jest omówienie zjawiska whitewashingu oraz przedstawienie dowodów na to, że zjawisko to jest jedną z form marginalizacji Azjatów w Hollywood, co jest pokłosiem głębszego wykluczenia społecznego grupy azjatyckiej. Aby udowodnić występowanie zjawiska oraz innych przejawów dyskryminacji mniejszości azjatyckiej, omówiona została historia Azjatów w USA oraz wybrane kategorie teoretyczne z zakresu nauk społecznych. Przeprowadzone w ramach pracy badania opierają się na analizie filmowej wybranych produkcji amerykańskich, wobec których pojawiły się zarzuty występowania whitewashingu.
