The goal of the article is an attempt to give an answer to the question whether the concepts of compromise on the management of the public administration may be used in the management of the justice system and if so to what extent? The article presents selected concepts of the management of the public sector with regards to their possibilities of adaptation for the needs of the justice system. It also shows the specificity of justice system Justice system plays an important role in the course of shaping an efficient state. In the light of the praxeological understanding the state is an organization, i.e. the entirety consisting of linked different networks contributing to the success or inducing failure of the entirety. A poorly managed justice system as a part of the entirety may be a serious obstacle on the way to modernize the management of the country. Therefore the discussion over the optimal model of management of justice system becomes an urgent challenge in the science of management. The prevailing role of justice system is meting out justice and other functions must comply with the prevailing role – ergo they play an ancillary role to the main role. No one and nothing may interfere in the competences of the independent court in meting out justice even the internal and external administrative supervision. It seems that the response to the needs of the justice system may be the model of participative bureaucracy as a combination of different bureaucratic models and other organizational models with the awareness of the needs of the responsible court.

Opis:
Restorative justice is without any doubt one of the most important steps in the development of criminal law, which at the same time increased the level of humanity in the approach towards perpetrators and victims and managed to achieve the principle goals of criminal law. A few decades have passed since its idea and approach was borrowed from the traditional communities that among themselves applied it for centuries and it was transformed into the new approach of justice offering many benefits to the community where it is established. Formally, it has been more than 20 years since Bosnia and Herzegovina embraced restorative justice within its criminal law. This paper aims to discuss how much de facto it has been applied in this country and to present results of interviews with representatives from legal theory and practice where they refer to restorative justice and its major challenges for application and propose mechanisms for overcoming existing difficulties. In this article, the authors use normative, descriptive scientific methods and statistics and interviews as tools for the collection of data.

Opis:
One can look at the improvement of the effectiveness and efficiency of the justice system from three perspectives: macro, mezo, and micro. After all, the general goal is to enhance the effectiveness and efficiency of the justice system as a whole (the macro perspective), the courts (the mezo scale), and court proceedings (the micro scale). The need to improve the effectiveness and efficiency of the justice system was noticed in the Strategy of modernization of justice in Poland in the years 2014–2020 prepared by the Ministry of Justice incorporates the three abovementioned perspectives. From the perspective of this paper, emphasis has been placed on courts. The Strategy, as a matter of fact, assumes that the improvement of the effectiveness and efficiency of courts may occur by introducing a model of management based on the idea of “managerialism” to run them. Effective and efficient courts, just like the proceedings they operate, are particularly important in the face of globalization, regulatory arbitration, as well as forum shopping. Based on a case study, this paper outlines the results of an innovative pilot project of implementing management methods of running common courts, and sets out to answer the question of the extent to which the state of institutional development of courts allows one to employ good practices in courts already successful in the world of business. During the pilot study, in 60 selected regional, district, and appellate courts, with the support of external experts, „good practices” were implemented to serve as management enhancements (Final report…, 2014). The results of the pilot study prove that the level of institutional development of courts determines the possibility of introducing good management practices that have already been approved in the world of business. This situation is further complicated by the diverse level of institutional development among courts. The type of a given court (its size, regional, district, appellate) may impact the possible upgrade of the maturity of the way a given practice functions. Also, not all business practices are eligible for implementation, given the different level of managers’ competence, as well as the frequently clear process of taking on the management staff.

In the article analysed the practice of obtaining opinions of expert psychologist in juvenile delinquency cases. The choice of types of cases is premeditated, and is based on their specific character. Juvenile delinquency cases are special in terms of their subjects (children and adolescence) and aims to be achieved (the welfare of the child/adolescence). Forensic psychology expertise plays a significant part in arriving at a court ruling. Therefore, it is important to raise the quality of diagnostic procedures, expertise activities, and to establish evaluation standards for evidence from psychological expertise. The presentation of proposed psychological expertise standards should take a form of guidelines and recommendations to be met by the experts, and serve as an aid to expertise evaluation performed by courts. To reach these goals, we gathered and analyzed court records of juvenile cases in six districts (N = 253). The results of the research are related to a) the analysis of the methodological and diagnostic procedures used by experts in the process of psychological evaluation in juvenile cases and b) the formulation of principles for evaluating the evidence of psychological opinions for trial authorities. The research project indicates the practice of psychological experts by the court, the diagnostic procedure and the method of formulating psychological opinions. The analysis of the material showed, first of all, the diversity of the diagnostic and opinion practices of psychologists, thus confirming the lack of procedures standardizing the process of psychological evaluation. The variety of assessment tools, and method, and areas of diagnosis make difficulties in assessing of the evidentiary value of psychological-court opinions. The lack of principle for assessing level of opinions’ quality may promote the practice of so-called junk science.

Opis:
Principle of accusatorial procedure states that criminal proceedings should be conducted only upon the request of a party and thus, the court cannot take the initiative. By the Act of 11 March 2016 the courts’ right to demand supplementing preparatory proceeding during preliminary verification of indictment has been brought back to the criminal procedure. The possibility of adjourning or defer- ring the trial in order to demand additional evidence has also been restored. The aim of the paper is to consider how these court powers affect the principle of accusatorial procedure and to answer the question whether departure from this principle is justified, for example, by the need to comply with other principles of criminal proceedings.

This paper is an essay on the problematic of the globalization of political power and on the increased relevance of institutions in contexts of multifaceted populism. A case study of the Portuguese justice system was used to illustrate the arguments presented. First, the Troika intervention in Portugal is offered as an instance of globalization of political power. Secondly, a model of argumentation analysis of political parties is used to contend that the media coverage of the discourse about austerity during the period of external intervention constituted what can be called multifaceted populism. Finally, the Directorate-General for Justice Policy is presented as an example of the decisive and increased role that institutions can play in times of crisis by presenting a factual and dispassionate vision of the results obtained at the level of public policies.
