Opis:: The conjunctive "i" is one of the four interpretations, along with the accessory, sequential and explicatory ones, which are distinguished by Olgierd Wojtasiewicz. Its characteristic feature, as in the case of the functor of conjunction in logic, is commutativity. However, this property is associated with certain problems of a stylistic or phonetic nature, problems related to building an open series of compound sentences or the occurrence of the component expressing the attitude of the speaker.
„I” koniunkcyjne, to jedna z czterech interpretacji spójnika „i”, obok akcesoryjnego, sekwencyjnego i eksplikatywnego, które wyróżnia Olgierd Wojtasiewicz. Spójnik ten jest najbliższy funktorowi koniunkcji ze względu na cechę komutatywności. Niemniej jednak pojawiają się pewne problemy właśnie z komutatywnością tegoż spójnika, takie jak: względy stylistyczne, brzmieniowe, problemy z tworzeniem otwartej serii, czy też występowaniem składnika wyrażającego postawę mówiącego względem danego wyrażenia.

Opis:: Autor rozważa Wittgensteinowską krytykę „prawa tożsamości” oraz Jadwigi Wajszczuk koncepcję koniunkcji, zakładającej wymaganie uzupełnienia treści tego, co aktualnie zostało powiedziane. Autor omówił także dewiacyjny charakter (dewiacyjny z punktu widzenia kodu naturalno-językowego) znanego przykładu Boys are boys. i wskazuje na jego czysto perlokucyjny – jako jedyny możliwy – efekt. Wszystko to przemawia przeciw zakładanemu katalogowi skodyfikowanych „znaczeń”, w ujęciu np. Wierzbickiej. Omówiono także szereg zjawisk pokrewnych.
The author submits a reflection on Wittgenstein’s critique of the “law of identity” and on Wajszczuk’s idea of conjunction entailing the necessity of broadening the contents of what has momentarily been said. The author insists on the deviant nature (deviant from the point of view of the natural-linguistic code) of the famous example Boys are boys. and on its purely perlocutionary effect as its only possible effect. All of this is opposed to the would-be catalogue of codified “meanings”, as those imagined, e.g., by Wierzbicka. A number of related phenomena are also discussed.

Opis:: A language grounding problem is considered for nonuniform sets of modal conjunctions consisting of conjunctions extended with more than one modal operator of knowledge, belief or possibility. The grounding is considered in the context of semiotic triangles built from language symbols, communicative cognitive agents and external objects. The communicative cognitive agents are assumed to be able to observe external worlds and store the results of observations in internal knowledge bases. It is assumed that the only meaning accessible to these agents and assigned to modal conjunctions can be extracted from these internal knowledge bases. Commonsense requirements are discussed for the phenomenon of grounding nonuniform sets of modal conjunctions and confronted with an original idea of epistemic satisfaction relation used to define proper conditions for language grounding. Theorems are formulated and proved to show that the communicative cognitive agents based on the proposed model of grounding fulfill some commonsense requirements given for processing sets of nonuniform modal conjunctions. The main result is that the communicative cognitive agents considered can be constructed in a way that makes them rational and intentional as regards the processing of modal conjunctions and from the human point of view.

Tytuł:: Analiza zagadnień teoretycznych i praktycznych występujących na gruncie art. 37b Kodeksu karnego
A theoretical and practical analysis of the legal problems related to Art. 37b Criminal Code

Opis:: Niniejsza praca ma na celu przedstawienie problematyki związanej z art. 37b k.k. Na początku rozstrzygnięto problemy terminologiczne oraz związane z charakterem prawnym zawartej tam instytucji. Przedstawiono także genezę nowelizacji Kodeksu karnego, która weszła w życie 1 lipca 2015 roku oraz historię wprowadzenia do Kodeksu karnego art. 37b k.k. W dalszej części omówiony został charakter jurydyczny konstrukcji znajdującej się w art. 37b k.k. oraz zostały poruszone problemy interpretacyjne pojawiające się na gruncie omawianego przepisu. Przeprowadzona została także analiza prawno-porównawcza, w której polska konstrukcja z art. 37b k.k. została porównana do podobnych istniejących w porządkach prawnych Francji oraz Anglii i Walii. Uzupełnieniem rozważań teoretycznych są wyniki badań aktowych własnych przeprowadzonych w II Wydziale Karnym Sądu Rejonowego dla Krakowa – Śródmieścia w Krakowie. Wyniki pokazują niewielką część orzecznictwa, dlatego nie mogą stanowić podstawy do wyciągania z nich daleko idących wniosków. Obrazują one jednak jak funkcjonuje art. 37b k.k. w praktyce orzeczniczej. Na końcu przedstawiono ocenę de lege lata obowiązującej wersji przepisu oraz zaproponowano liczne postulaty de lege ferenda.
The main aim of the thesis is to present and analyse the issues of Art. 37b C.C. At the beginning, terminological and other problems related to the legal nature of the institution concluded under Art. 37b C.C were resolved. The genesis of the amendment to the Criminal Code, which came into force on July 1, 2015, and the history of the introduction of Art. 37b C.C to the Criminal Code. In the next part, the juridical character of the structure found in Art. 37b C.C. and the interpretation problems arising on the basis of the provision were discussed. A brief legal and comparative analysis was also carried out, in which the Polish structure from Art. 37b C.C was compared to similar ones existing in the legal orders of France, England and Wales. The theoretical considerations are completed by the results of own file research conducted in the II Criminal Division of the District Court for Kraków-Śródmieście in Kraków. The results show a small part of the case-law, therefore it is not possible to form the basis for drawing far-reaching conclusions from them. However, the results illustrate how the article works in judicial practice. Finally, a de lege lata assessment of the current version of the provision is presented and numerous de lege ferenda postulates have been proposed.

Opis:: The first part of the paper shows two types of the systems of contemporary logic placed in one of J. Bocheński’s works. The second part of the paper contains Bocheński’s theses concerning contemporary logic. They have been shown against the backdrop of the views held by other authors who discussed some kin issues. In order to supplement Bocheński’s considerations a division of functors has been added. They are divided into extensional and non-extensional. Much attention has been devoted to the problems of logical constants that is rarely discussed in learned literature. It has been stressed that at least one of Bocheński’s typologies should basically be changed, having taken into account the remarks in the paper that supplement Bocheński’s analyses. The above issues have been discussed against the backdrop of the question of relations that obtain between contemporary logic, mathematics, and philosophy.

Opis:: An axiomatic characterisation of the functor of sequential assertion is propsed here. By means of it the functor of sequential conjunction is defined. In the temporal interpretation these functors are respectively read as: next/then and and-next/and-then. It is proved that the proposed system (SAS) and its strenghtening (SAS*) comprise respectively von Wright’s And Next and And Then systems. The consistency and independence of axioms of the richer of the two proposed structures (SAS*) is settled by interpretation in the quadrivalent propositional calculus.
