Opis:: The merging of the Constitutional and Legal History of Poland with the General Constitutional and Legal History into one subject Constitutional and Legal History gave rise to the fear that Polish constitutional and legal institutions may be blurred in the area of general history. The absence of individual subject, whose name reflected Polishness, might contribute to the weakening of the spirit of historical community of Polish society, the spirit being previously moulded by the discussed subject. The essential educational element in the forming of the frame of mind of the lawyer inclined toward humanities is the knowledge of above all the constitutional history of his own country, the evolution of its political institutions and the law applied in courts. The discussed modification of the process of educating future lawyers at the Faculty of Law, Administration and Economy of the University of Wrocław may push to the background questions which laid the emphasis on the vernacular legal culture of the state. It is from the native constitutional and legal history that we obtain the first line experience. The subject that was thus eliminated was the one characterized by rich historiography and the one that emphasized the historical continuity of Polish state and law.

Opis:: The article concerns the role of Roman law in the education of Polish lawyers. The author compares the conditions and methods of teaching the law of ancient Romans at law faculties in Poland during the period between the two World Wars with those of today. In conclusion, the author states that Roman law is undoubtedly one of the most important components of ancient culture, which has exerted a speciﬁc inﬂuence on shaping the modern world. The study of Roman law oﬀers a possibility of histori- cal perspective on law, enriches students’ knowledge on the theory and dogmatics of law and teaches the ways of legal thinking. It is impossible to comprehensively under- stand the evolution and functioning of many modern European legal systems, which stem from solutions formerly adopted already in the law of ancient Rome, without the competence derived from the study of Roman law.

Opis:: In 1912 Filippo E. Vassalli published PSI I 55 and partly recon- structed its contents. His editio princeps was subsequently thoroughly checked in 1971 by Wolfgang Wodke, who completed Vassalli’s text; he, moreover, attributed it to the antecessor Stephanus. Here, all earlier readings and conjectures will be examined and partly corrected. The text is seen critically in the light of the publications that have disproved Wodke’s attribution to Stephanus. Besides, some new readings and conjectures are added. The papyrus was a part of a book based on East Roman law teaching in the Greek language. It is a paraphrasis combining two series of lessons on the Digest, an index, and a paragraphai lecture. They are dated between spring of 534 and March of 536 and were taught by an unknown law teacher (in either Beirut or Constantinople). Afterwards, they were used by Stephanus for his paragraphai on the digest. The latter seems to have taught between March 536 and a short time after 542. The unknown law teacher was probably one of the eight addressees of Justinian’s constitution Omnem, who taught at two law schools. Four of those antecessores have already been excluded by other authors. The others have left either no or too few texts. Therefore, the attribution to one of these antecessores is impossible, perhaps except for Anatolius, who taught in Beirut.

Opis:: The article contains characteristics of the fourteen professors who gained their appointment to the Regius Chair of Civil Law in Oxford and Cambridge in the 18th century. Their academic careers as well as their many out-of-academia duties are described in the article. The analyses of the collected materials allowed the author to assert that the condition of teaching Roman law in the 18th-century England resembled the general crises of the university education in England in the aforementioned epoch. For most of the lecturers the academic posts were more or less sinecures that provided a social prestige and honourable social position. Only the late 18th century brought some changes in the methods of teaching Roman law and in the appointments of the professors. To a fuller extent these changes could not be observed to bring expected effects before the mid-19th century.

Opis:: This article examines the history and development of legal education in Australia by tracing the establishment of university law schools and other forms of legal education in the states and territories from the time of European settlement in 1788 until the present day. It considers the critical role played by legal education in shaping the culture of law and thus determining how well the legal system operates in practice. It argues that Australian legal education can satisfactorily meet the twin objectives of training individuals as legal practitioners, whilst providing a liberal education that facilitates the acquisition of knowledge and transferable legal skills.
W artykule przedstawiono historię oraz rozwój australijskiej edukacji prawniczej poprzez omówienie sposobu ustanawiania uniwersyteckich szkół prawniczych oraz innych form nauczania prawa w australijskich stanach i terytoriach, zaczynając od osadnictwa europejskiego w 1788 roku, a kończąc na czasach współczesnych. Zwraca się w nim uwagę na kluczową rolę, jaką edukacja prawnicza odegrała w kształtowaniu się kultury prawniczej, tym samym przesądzając o tym, w jaki sposób działa system prawny w praktyce. W artykule wskazuje się, że australijska edukacja prawnicza może w satysfakcjonujący sposób zmierzyć się z podwójnym celem, jakim jest kształcenie praktyków prawa, zapewniając jednocześnie edukację, która ułatwia zdobywanie wiedzy i przekazywanie umiejętności prawniczych.

Opis:: The changes in the social and economic system taking place in the Kingdom of Poland prompted the need for legal education at the university level. The functioning of universities dealing with teaching in this area, however, met various obstacles, mainly due to the reluctance of the central authorities of the Russian Empire. At the universities established in the following years, the aim was not only to prepare future lawyers in practice, but also to implement a broader model of education. Therefore, among other fields, the old Polish law was tutored, which gradually ceased to be binding, and finally became a historical law.
Zachodzące w Królestwie Polskim zmiany w systemie społecznym i gospodarczym rodziły potrzebę kształcenia prawniczego na poziomie uniwersyteckim. Funkcjonowanie uczelni wyższych, które zajmowałyby się nauczaniem w tym obszarze, napotykało jednak liczne trudności, przede wszystkim wynikające z niechęci centralnych władz Cesarstwa Rosyjskiego. Na uczelniach tworzonych pomimo tego w kolejnych latach, dążono nie tylko do przygotowania praktycznego przyszłych prawników, ale starano się realizować szerszy model kształcenia. W związku z tym wykładano między innymi dawne prawo polskie, które z biegiem czasu przestawało być prawem obowiązującym, a stawało się prawem historycznym.

Opis:: The monograph is an introduction to the history of the teaching of law in Trnava during the existence of the university (1667–1777, and subsequently since 1998) and during the functioning of the Royal Law School (1777–1784). Among the issues analyzed were the circumstances of the establishment of the Faculty of Law at the University of Trnava in 1667, curricula with particular emphasis on the study of Hungarian law, and the significance of the juridical works of the university’s professors. The work emphasized how Corpus Iuris Hungarici, a two-volume collection of Hungarian law (vol. 1 contains Tripartitum by Štefan Werbőczy), was developed and published in Trnava (1696), where advanced studies in the area of criminal law were also conducted.
