Opis:: Introduced after the Second Vatican Council, the norm permitting the lay person to be a qualified witness of marriage entered in the canonical form has not been yet further elaborated in Polish canonist literature. This study seeks to fill this gap in the Polish canonist literature. The first part of the presentation is devoted to the development of the norm in post-conciliar legislation before the promulgation of the 1983 Code of Canon Law. The next part presents the conditions for the delegation of a lay person to assist at marriage in accordance with canon 1112: a lack of priests and deacons, consent of the diocesan bishop with the favourable vote of the conference of bishops and the permission of the Holy See. The last addressed issue is the duties of delegated lay persons in connection with their task to prepare the intending parties for marriage, to verify their ability to conclude it, to preside over the ritual, and to record this fact in church documentation.

Opis:: Wprowadzona po Soborze Watykańskim II norma zezwalająca na ustanawianie osoby świeckiej świadkiem kwalifikowanym małżeństwa zawieranego w formie kanonicznej nie została dotychczas szerzej opracowana naukowo w języku polskim. Niniejszy artykuł jest próbą zapełnienia tej luki w polskiej literaturze kanonistycznej. Pierwsza część przedłożenia poświęcona jest rozwojowi normy w prawodawstwie posoborowym przed promulgacją Kodeksu Prawa Kanonicznego z 1983 r. Następnie zostały omówione warunki umożliwiające delegowanie świeckiego do asystowania przy zawarciu małżeństwa zawarte w kan. 1112 tegoż Kodeksu: brak kapłanów i diakonów oraz delegacja biskupa diecezjalnego po uzyskaniu pozytywnej opinii Konferencji Biskupów i zezwolenia ze strony Stolicy Apostolskiej. Ostatnim zaprezentowanym zagadnieniem są obowiązki delegowanego świeckiego w związku z powierzonym mu zadaniem, do których należy przygotowanie nupturientów do małżeństwa, zweryfikowanie ich zdolności do jego zawarcia, przewodniczenie obrzędowi oraz zatroszczenie się o odpowiednie odnotowanie tego faktu w dokumentacji kościelnej.
Introduced after the Second Vatican Council, the norm permitting the lay person to be a qualified witness of marriage entered into a canonical form has not been yet further elaborated in Polish language. This article is an attempt to fill this gap in Polish canonical literature. The first part of the presentation is devoted to the development of the norm in post-conciliar legislation before the promulgation of the 1983 Code of Canon Law. The next part of this dissertation presents the conditions for delegation of lay person to assist at marriage in accordance with Can. 1112 of this Code: lack of priests and deacons, consent of the diocesan bishop with favorable vote of the conference of bishops and permission of the Holy See. The last presented issue is the duties of a delegated lay persons in connection with the task entrusted to them to prepare the nupturients for marriage, to verify their ability to conclude it, to preside over the rite and to take note of this fact in the church documentation.

Opis:: This paper focuses on the procedural instrument of ‘competition-expert’ lay judges to ease damages calculations and private actions for damages for the violation of competition law in general. To this end, the paper analyses various forms of ‘expert’ lay participation that already exist in Europe. It concentrates, in particular, on commercial and intellectual property proceedings, but also delves into the few existing examples of competition-expert lay judges for private enforcement of competition law. It assesses their transferability for competition damages proceedings and attempts to test EU and national competition as well as procedural law boundaries more generally. The paper considers common grounds, advantages and disadvantages, as well as best practices in this context. It concludes with early proposals for including competition-expert lay judges in private enforcement of competition law.
Cet article se concentre sur l’instrument procédural que sont les juges non professionnels experts en concurrence pour faciliter le calcul des dommages et intérêts dans les actions privées en dommages et intérêts pour la violation du droit de la concurrence. À cette fin, l’article analyse diverses formes de participation d’experts non professionnels déjà existantes en Europe. Il se concentre en particulier sur les procédures commerciales et de propriété intellectuelle, mais se penche également sur les quelques exemples existants de juges non professionnels experts en concurrence pour l’application privée du droit de la concurrence. Il évalue leur transférabilité aux procédures de dommages-intérêts en matière de concurrence et tente de tester plus généralement les limites du droit de la concurrence et du droit procédural au niveau européen et national. L’article met en évidence les motifs communs, les avantages et les désavantages, ainsi que les meilleures pratiques. Il se conclut par des premières propositions visant à inclure des juges non professionnels experts en concurrence dans l’application privée du droit de la concurrence.

Opis:: The revival of theology of the laity that was initiated by the Vatican Council II bears fruit in the form of giving back the dignity and role to the lay faithful, which follows from the fact that they belong to the Church community. Giving them back their subjective character in the Church is tantamount to recognizing their salutary activity in the Church and in the world. The Christian formation of lay Catholics seems a particularly important issue, as it is the foundation of a complete and proper involvement of lay Catholics in the life and mission of the Church. The article undertakes the problem of the formation of lay Catholics, first showing what formation is and what its most important dimensions are. Next it discusses the aims of formation and the circles in which formation takes place. Finally, it points to the most important challenges that are faced by the formation of lay Catholics in Poland twenty years after publishing John Paul II’s post-synodal exhortation Christifideles laici.

Opis:: The article describes the spirituality of lay people of the third millennium. It involves the participation of Christians in the triple dignity and mission of Christ. New trends in the 21st century spirituality have been briefly discussed. They have been inspired by the Second Vatican Council. The broader context of the article was the universal call to holiness, which is a basis of Christian spirituality, and is the consequence of receiving baptism. As it is known, all people are called to holiness - not just consecrated persons but also lay people. One and only holiness is expressed in different ways in individuals who strive for perfect love in their chosen condition. The lay faithful pursue their vocation to holiness, living in the world, and give an example of the unity of life and of faith. The article deals with the spirituality of the third millennium: the cultural and social and spiritual-religious trends, the baptismal spirituality of the laity, and the universal vocation to holiness in response to the call of the Second Vatican Council to promote Christianity in the dignity and mission of Christ (priestly, prophetic and royal).

Opis:: The study examines the interaction effect between source epistemic authority (EA) and self epistemic authority (SEA) on the intention to follow the source’s recommendation. The results showed that high SEA subjects were more likely to follow the recommendation if its source had high EA and less likely if the source’s EA was low. The results are discussed using the Lay Epistemology framework.

Opis:: Research on the relationship between the “Big Two” dimensions of social perception-Agency and Communion-has produced inconsistent findings, from independence to positive, negative, or curvilinear associations. We propose that these inconsistencies stem from individual differences in cognitive representations of how traits interrelate, i.e., lay personality theories (LPTs). Using connectionist modeling, we simulated impression formation processes based on individuals’ unique networks of associations between Agency and Communion traits. Indeed, Simulation Study 1 successfully recreated the various relationships found in the literature. Second, an experiment demonstrated that individual differences in LPTs predicted social judgments. Simulation Study 2 showed that changes in the composition of a sample of individuals with heterogeneous LPTs result in different outcomes in the relationship between Agency and Communion. Our findings suggest that taking into account variability in LPTs helps resolve apparent contradictions in the literature, offering a new and unifying framework for understanding social perception.
