Opis:: In recent years nearly 5000 seafarers have been hijacked and detained for months often in appalling conditions, while thousands of others have been the victims of a pirate attack. Given these numerous concerns, a pan-industry alliance of ship owners, unions, managers, manning agents, insurers and shipping- and welfare associations (maritime, labour, faith or secular) has come together to establish the "Maritime Piracy: a Humanitarian Response Programme" (MPHRP). The objectives of this Programme address the three phases of "pre-, during and post-incident", with the aim of implementing a model of assisting seafarers and their families with the humanitarian aspects of a traumatic incident caused by a piracy attack, armed robbery or being taken hostage.

Opis:: The article analyzes the provisions of the EU security strategy, with particular regard to the identified threats and proposed actions to reduce their negative impact. An attempt was also made to analyze the maritime safety strategy. The exploration allows us to conclude that the documents are much more complementary than the previous ones, which gives hope for an effective security policy.

Opis:: Contemporary maritime shipping is subject to a large number of constraints given by tight shipping schedules and very low margins. Additionally, problematic areas with increased security needs dynamically changing in time, combined with seasonal oceanographic and meteorological conditions pose a challenging voyage planning problem. In this work we present a risk-aware voyage planner taking into account spatio-temporal environmental conditions. The planner is based on a graph-based search algorithm A* . We discretize the required area into a graph, we store various layers of information into the edges of the graph (such as risk and weather conditions) in a form of numeric weights and we define a bi-objective planning problem with a tradeoff between security and duration of the voyage. The nature of the algorithm guarantees a complete and optimal solution in a form of an optimized voyage with respect to the criterion function composed of the two weighted components, i.e, duration and security of the voyage. We demonstrate the approach on our area of interest: Indian Ocean. We use NATO piracy activity risk surface as the risk layer and we compute all transit voyages between relevant routing points in the area. Finally, thanks to the discretization of the problem, we are able to integrate corridors imposed by the shipping authorities and evaluate additional what-if scenarios with extended corridor systems. The resulting planner is exposed to the public using a web service with an easy interface requiring start time of the voyage and the origin and the destination point of voyage. Combined with an expressive visualization, this tool demonstrates the capabilities of the proposed solution.

Opis:: Praca magisterska przedstawia tematykę piractwa morskiego w świetle Prawa Międzynarodowego Publicznego na przykładzie Somalii. Obejmuje ona wieloaspektową analizą wskazanego problemu, ze szczególnym uwzględnieniem zagadnień prawnych. Szczególnie tych wpływających bezpośrednio na rozwój jak i zahamowanie piractwa morskiego, a także innych, które mają pośredni ale rzeczywisty związek z tematem. Oprócz analizy prawnej, praca ta obejmuje także zjawiska polityczne, społeczne czy geograficzne, jak również ważną część historyczną oraz dotyczącą najważniejszych źródeł prawa.Celem analizy jest dokładne przedstawienie aktualnego obrazu zjawiska piractwa morskiego na podstawie jego najważniejszych mechanizmów, ze szczególnym uwzględnieniem tych o charakterze prawnym.Aby praca była interesująca i przejrzysta zastosowałem kilka metod badawczych. Przede wszystkim oparłem się na porównaniu i wykorzystaniu fachowych publikacji dotyczących piractwa morskiego, ale także krótszych artykułów czy notek. Wykorzystałem także metodę historyczną opisując wydarzenia, które miały miejsce w przeszłości, zarówno w tej bardzo dalekiej, sięgającej starożytności, a kończąc na wydarzeniach współczesnych. Ważnym elementem jest analiza oraz porównanie aktów prawa międzynarodowego.Praca składa się z czterech rozdziałów oraz wchodzących w ich skład podrozdziałów. Pierwszy rozdział zawiera zagadnienia historyczne, źródła PMP dotyczące piractwa morskiego oraz rozróżnia piractwo od terroryzmu morskiego. Obejmuje ona elementy wprowadzające, a jednocześnie najbardziej fundamentalne. Rozdział drugi składa się z kilku kluczowych elementów. Przede wszystkim omawia przyczyny powstania piractwa morskiego, ze szczególną analizą wpływu prawa, a także rozwój tego zjawiska na morzach i oceanach. Następnie wskazuje przedmioty ataków pirackich, a także rejonizację tychże ataków i dotyczącą ich statystykę. Rozdział trzeci przestawia problematykę piractwa morskiego w Prawie Międzynarodowym Publicznym. Poruszane są w nim tak znaczące kwestie jak jurysdykcja uniwersalna, czy międzynarodowa akcja militarna, a także wszelakie prawne aspekty dotyczące opisywanych zdarzeń. Dla pełnego zrozumienia analizowanej tematyki i aby nie była ona tylko czystą teorią, w rozdziale czwartym przedstawiam fenomen piractwa morskiego na przykładzie Somalii. Opisuje jego przyczyny, ewolucję, studium przypadków oraz skutki.Po lekturze niniejszej pracy można wyciągnąć wiele wniosków. Przede wszystkim łatwo zauważyć, że problem piractwa morskiego jest wielkim wyzwaniem dla społeczności międzynarodowej. Jednocześnie stał się impulsem do dostosowania prawa do zaistniałej sytuacji. Przede wszystkim specyficznej instytucji – jurysdykcji uniwersalnej. Jednakże jej stosowanie w obecnej formie wywołuje wiele problemów i wątpliwości. Należy także zauważyć, że kształtujący się system wymiaru sprawiedliwości zajmujący się piractwem morskim, nie jest jedynym i wystarczającym elementem walki z piratami. Niezwykle ważne są sprawnie prowadzone akcje międzynarodowych sił morskich, działania śledcze, operacyjne i prewencyjne.
The aim of the thesis is to present a maritime piracy in the light of International Public Law using Somalia as an example. The multipronged topic has been analysed focusing on the legal issues. Especially on those directly affecting increase or decrease in maritime piracy, as well as others that have an indirect but real influence on the subject. Apart from the legal aspects, the thesis also describes political, social and geographic circumstances of piracy and its historical and law sources.Several research methods has been used to make the thesis interesting and clear. It has been based mainly on papers on maritime piracy and their comparison, but also historical research has been done and described starting from antiquity to present time. Of a great importance is also analysis and comparison of international legislation covered in the thesis.The topic has been fulfilled in four chapters and their constituent sub-sections. The first chapter describes the historical circumstances and sources of Public international law on maritime piracy as well as distinguishes terrorism from piracy. It covers introductory elements being at the same time the most fundamental. The second chapter consists of several key elements. First of all, it discusses the roots of maritime piracy focusing on a law factor, and its spread over the seas and oceans. Secondly, it describes the main aims of pirate attacks, their zoning and statistics. The third chapter presents maritime piracy issues covered in a Public international law. It addresses such significant issues as an universal jurisdiction or an international military action, as well as all kinds of other legal aspects considering the topic. And finally, the fourth chapter provides a real live example of piracy - piracy off the coast of Somalia to make the topic fully understandable. It describes its roots, evolution, case studies and consequences.The paper brings many conclusions. First of all, it is easy to see that the maritime piracy is a huge challenge for the international community. At the same time it has pushed the law forward to deal with the situation. Mainly a specific institution - the universal jurisdiction. However, it is still imperfect and its use in its present form causes many problems and doubts. It should also be noted that developing the justice system is not sufficient to decrease the amount of pirates attacks. Extremely important is an efficiency of international naval forces, as well as other investigative, operational and preventive activities.

This paper explores risk m International maritime transport. It discusses current trends in unlawful activity in the waters of Southeast Asia, the Caribbean, the Gulf of Guinea and off the Somali toast. The first part of the paper examines why piracy is effective. The second part focuses on the consequences of pirate attacks for the life and Health of seafarers on vessels transiting high-risk areas. Seafarers' work on a ship requires additional safety measures.

Rozdziały trzeci i czwarty stanowią część pracy poświęconą współczesnym próbom rozwiązania problemu. Kolejno omówione zostały działania podmiotów prywatnych (armatorów, prywatnych firm wojskowych) i publicznych (UE, ONZ, inne) ukierunkowane na podniesienie bezpieczeństwa żeglugi.Pracę zamyka rozdział stanowiący studium przypadku dwóch najniebezpieczniejszych na przestrzeni ostatnich lat obszarów żeglugi – cieśniny Malakka oraz wód Zatoki Adeńskiej.W pracy wykorzystano liczne, zarówno polskie, jak i zagraniczne opracowania i artykuły naukowe, akty prawne oraz raporty instytucji zajmujących się tą problematyką.
The following thesis is devoted to selected aspects of a remarkably broad issue of Maritime Safety. The author, choosing significance of those matters as a selection criterion, focuses on the problem of maritime piracy and armed robbery. The phenomenon, already known in ancient times, keeps on returning as a problem to this day, affecting both the local as well as international communities.The first chapter introduces the reader to concepts related to the thesis' subject and the history of maritime crime. The second chapter is devoted to the issues of international law concerning the safety of navigation and selected acts of hard - and soft - law. The third and fourth chapters are dedicated to modern-day attempts of solving the problem. Subsequently discussed are the activities of private bodies (ship-owners, private military companies) as well as public organisations (EU , UN, etc.) aimed at increasing the level of maritime safety. The thesis ends with a chapter which is a case study of the two most dangerous areas in recent years of sea navigation - Malacca Strait and waters of the Gulf of Aden.

The article presents th problem of maritime piracy in the regions of the Horn of Africa, Gulf of Aden and Indian Ocean and its impact on maritime transportation and global economy. It also discusses the strategic role and importance of securing sea lanes of communication, like the Gulf of Aden and the Indian Ocean, by international and multilateral co-operation. The article also deals with the definitions of maritime piracy and the most important reasons for the increase in violent activities which take place in the maritime environment in the region.

Opis:: The primary aim of this paper is to analyse the legal definition of piracy stipulated in Article 101 of the United Nations Convention on the Law of the Sea. As the title of the paper itself suggests, the phenomenon of maritime piracy is examined only from the perspective of international law of the sea, which means that state municipal laws remain beyond the scope of the analysis. The authors attempt to interpret and critically assess relevant legal provisions, rather than recount in detail facts related to cases of maritime piracy or present statistics describing the scale of this phenomenon. The article is divided into six relatively short sections. Key considerations are contained within sections 3–5, which cover the relevant provisions of the Montego Bay Convention. These sections deal, respectively, with the definition of piracy, the “private ends” requirement, and the “two-vessel” requirement. The remainder of the article is divided into introduction, historical background and conclusions.

Autorzy dążą w artykule do poznania i omówienia formalnych czynników determinujących udział Danii w dwustronnej i wielostronnej współpracy z państwami Zatoki Gwinejskiej w dziedzinie bezpieczeństwa międzynarodowego. Uwaga autorów skupiona została przede wszystkim na najważniejszych duńskich dokumentach, które wyznaczają kierunki i charakter polityki bezpieczeństwa państwa, w tym zakres użycia sił zbrojnych w relacjach ze światem zewnętrznym, od początku drugiej dekady XXI wieku. The purpose of this article is to provide an analysis of the doctrinal rationale – doctrinal roots behind Denmark’s involvement in the security of the Gulf of Guinea region in West Africa. The subject of the considerations is, above all Denmark’s military support’s strategic goals to selected countries in the region. Taking into account the military potential of the Kingdom of Denmark and the possibility of projecting military force beyond the borders of Europe, Denmark’s active military involvement in West Africa should be considered a unique type of international use of armed forces in order to pursue the vital interests of the state, including security interests. In the article, the authors attempt to learn and discuss the formal factors that influence and motivate Denmark’s participation in bilateral and multilateral cooperation with the states of the Gulf of Guinea in the field of international security. The authors’ attention is focused primarily on the most important Danish documents that set the directions and nature of the state of Danish security policy, including the scope of the use of armed forces in relations with the outside world, from the beginning of the second decade of the 21st century. The authors use the qualitative analysis of sources and critical content analysis, mainly of Danish doctrine and strategy documents. The aim of the study is to find an answer to the question: What are the premises and interests that shape the foundations of Danish involvement in the Gulf of Guinea?
