Opis:: The subject of this analysis is the legal basis for cooperation between police services and informers. This form of operational and reconnaissance activities plays a key role in the system of activities aimed at combating crime. The issues raised herein have an important theoretical and practical significance because all police services cooperate with informers, and the collected information often cause seemingly imperceptible but far-reaching legal effects. In the Polish legal system, this cooperation has been unregulated for many years, which results in a constant decrease in its effectiveness and is a serious threat to the legal security of officers who conduct this kind of activities. Thus it is necessary to regulate many important problems related to this cooperation in the competence acts of the police services.

The first part will present the framework, forms and methods of conducting operational work in the years 1944–1989. In the second part, I will present how the situation in this area developed after the change of the political system and in the conditio of the new socio-political situation determined by the requirements of a democratic state of law. The third part will be devoted to the analysis of currently applicable institutions that regulate the conduct of operational and reconnaissance activities in prisons and detention centers. Finally, in part four, I will assess the individual allegations presented by opponents denying the admissibility of conducting operational work in a penitentiary institution.

Opis:: Celem artykułu jest prezentacja założeń metodycznych oraz wstępnych rezultatów projektu „Rozwój infrastruktury transportowej a przesunięcia międzygałęziowe w przestrzeni Polski w latach 2000-2010” w jego części poświęconej tworzeniu bazy danych dotyczącej potoków ruchu pojazdów samochodowych oraz pociągów. Baza danych została nazwana „TRRAPS XXI database” (Transport Road and Railway Activity in the Polish Space in the XXI Century) i jest zbiorem kilkunastu tysięcy rekordów. Każdy rekord w bazie odpowiada odcinkowi lądowej sieci drogowej lub kolejowej i został opisany możliwie największą ilością danych dotyczących potoków ruchu pojazdów samochodowych (na podstawie Generalnego Pomiaru Ruchu GDDKiA) oraz potoków ruchu pociągów (na podstawie bazy danych PKP PLK S.A.).
The aim of the article is to present the methodological assumption sand preliminary results of the project „Transport infrastructure development and modal shift in the space of Poland in the years 2000-2010”. The database has been called „TRRAPS XXI database” (Road and Railway Transport Activity in the Polish Space in the XXI Century) and it is a collection of more than 10000 records. Each record in the database corresponds to the short section of the road or rail network and is described by the data on traffic flows (based on the General Traffic Measurement GDDKiA and PKP PLKSA database).

Opis:: This master's dissertation is devoted to the institution of operational control.In the first chapter I analyse the institution of operational control from the perspective of operational and exploratory activities. I make an attempt to define not normatively defined operational and exploratory activities and I present concepts formulated by selected juristic authorities. Moreover I present particular features ascribed to these activities, outlining the disputes existing in this area in the doctrine. The chapter ends with considerations about the functions of these activities, which are enriched with observations about the influence of selected functions on the structure of law enforcement agencies.In the second chapter I look at the institution of operational control from the point of view of constitutional, convention and treaty norms. I draw attention to selected norms that constitute human and civil liberties and rights, which seem to be particularly related to the institution of operational control, and I also point to the conditions of limiting these rights formulated both in legal acts and in the jurisprudence (including international bodies). The above considerations became a stimulus to take a closer look at the operational control itself in the third chapter. First, I interpret the provisions that define what it is, show their legislative incorrectness and emphasize the interpretation problems that arise from the wording of these provisions. In the next part I refer to the prerequisites of its execution, I decompose the procedure of its ordering into first factors - at the same time showing errors in its formulation - and I formulate postulates de lege ferenda. Finally, I present selected issues related to its execution and termination.In the fourth chapter I analyze the problems related to the procedural use of materials obtained as a result of operational control. In particular, I consider the issues of admissibility of the use of accidental findings and the use of materials from the inspection conducted in violation of the law. At the end I refer to the modes of introducing materials to the trial, pointing to the differences in the introduction of audiovisual materials, as well as analyze the admissibility of introducing to the trial the materials from the operational control carried out by another state.
Niniejsza magisterska dysertacja poświęcona jest instytucji kontroli operacyjnej.W pierwszym rozdziale analizuję instytucję kontroli operacyjnej przez pryzmat instytucji czynności operacyjno-rozpoznawczych. Podejmuję się próby zdefiniowania niezdefiniowanych normatywnie czynności operacyjno-rozpoznawczych i przedstawiam koncepcje sformułowane przez wybrane autorytety jurystyczne. Nadto przedstawiam poszczególne cechy przypisywane tym czynnościom, jednocześnie nakreślając istniejące w tym zakresie spory w doktrynie. Rozdział kończą rozważania o funkcjach tych czynności, które to rozważania wzbogacone są o spostrzeżenia w kwestii wpływu wybranych funkcji na strukturę organów ścigania.W drugim rozdziale patrzę na instytucję kontroli operacyjnej z punktu widzenia norm konstytucyjnych, konwencyjnych i traktatowych. Zwracam uwagę na wybrane normy, stanowiące wolności i prawa człowieka i obywatela, które zdają się być szczególnie związane z instytucją kontroli operacyjnej, a także wskazuję na sformułowane tak w aktach prawnych, jak i w orzecznictwie (w tym organów międzynarodowych), warunki ograniczania tychże praw.Powyższe rozważania stały się asumptem do tego, by w rozdziale trzecim bliżej przyjrzeć się samej kontroli operacyjnej. Wpierw wykładam przepisy określające czym ona jest, wykazuję ich legislacyjną niepoprawność i akcentuję problemy interpretacyjne, które rodzi brzmienie tych przepisów. W dalszej części referuję przesłanki jej wykonywania, rozkładam na czynniki pierwsze procedurę jej zarządzenia – jednocześnie wykazując błędy w jej ukształtowaniu – oraz formułuję postulaty de lege ferenda. Na koniec przybliżam wybrane kwestie związane z jej wykonywaniem i zakończeniem.W rozdziale czwartym analizuję problemy związane z procesowym wykorzystaniem materiałów, pozyskanych w wyniku wykonanej kontroli operacyjnej. W szczególności rozważam kwestie dopuszczalności wykorzystania przypadkowych znalezisk i wykorzystania materiałów z kontroli przeprowadzonej z naruszeniem prawa. Ad extremum referuję tryby wprowadzenia materiałów do procesu, wskazując na odmienności wprowadzania materiałów audiowizualnych, a także analizuję dopuszczalność wprowadzenia do procesu materiałów z kontroli operacyjnej wykonanej przez inne państwo.

Opis:: Milicja Obywatelska po okresie stalinowskim poszukiwała nowego modelu pracy operacyjnej. Instrukcje operacyjne powstałe po 1956 r. służyły przede wszystkim zwalczaniu przestępczości kryminalnej i gospodarczej. Kierownictwo MO dążyło do tego, by główne zagadnienia pracy operacyjnej (agentura, inwigilacja, sprawy operacyjne) ująć w jednym akcie normatywnym. Ostatecznie udało się to w 1974 r., gdy wprowadzono nową instrukcję. Stworzenie tej koncepcji przyniosło owoce w latach siedemdziesiątych i osiemdziesiątych, kiedy obowiązywały określone standardy pracy operacyjnej. Instrukcja z 1974 r. nie została uchylona do końca działalności MO, tj. do roku 1990.
The Citizens’ Militia (MO) after the Stalinist period was looking for a new operating model. Operational instructions created after 1956 were aimed primarily at combating criminal and economic crime. The goal of the MO’s management was to include the main issues of operational work (spies, surveillance, operational matters) into one normative act. Ultimately, this was achieved in 1974, when a new operational manual was introduced, which generally covered all aspects of the MO’s operational work. The search for the concept of MO’s operational work bore fruit in the seventies and eighties, when certain standards of this work were in force, and the operational manual of 1974 was not repealed until the end of MO’s activity, that is until 1990.

Opis:: W artykule podjęto próbę syntetycznej oceny drogowego i kolejowego wyposażenia infrastrukturalnego województw. Wykorzystano opracowany przez autora sumaryczny wskaźnik wyposażenia infrastrukturalnego uwzględniający zarówno ilość, jak i jakość infrastruktury. Na tej bazie dokonano porównania gęstości sieci drogowej i kolejowej województw za pomocą trzech wskaźników gęstości. Szczególną uwagę autor poświęcił analizie pracy eksploatacyjnej na drogach krajowych oraz pracy eksploatacyjnej pociągów. Wskazał też, że udziały w pracy eksploatacyjnej są wysoko skorelowane z udziałami województw w PKB.
A synthetic assessment of the equipping of Poland’s voivodships with road and railway infrastructure was conducted to identify needs, as well as future action to be taken as regards infrastructure development. Reference was made to two main approaches to assessment: one providing econometric estimates of infrastructure productivity, where transport infrastructure equals public capital in production functions; and the other analyzing changes in regional road and rail accessibility. This paper in fact presents an indicator incorporating both the quantity and the quality of road and rail infrastructure, with two widely-used density indicators relating to population and area being applied. A third indicator including both population and area was also taken into account. A comparison of Poland’s voivodships was made on the basis of the results. Particular attention has been paid to operational work on the state road network and train operations. Traffic intensity was found to vary markedly between voivodships, and this should be the main reason to improve the degree to which given areas are equipped with road and rail infrastructure. It is concluded overall that the shares of operational work regions account for correlate strongly with the shares of GDP they take. Priority should thus be given to investment in voivodships displaying the highest level of operational work, in particular centrally-located regions. The second goal of the investment policy should be attained via investments in the regions of highest GDP growth, because operational work is probably going to be higher there as well. Eventually, infrastructure should also be improved in regions where the needs as regards operational work are less urgent, e.g. in south-eastern Poland – an area that unfortunately suffers from poor transport infrastructure. The conclusion is nevertheless that asymmetrical investments leading to greater differences in equipping with infrastructure from region to region do represent the best solution for Poland at this time.

Opis:: Zagadnienia omawiane w niniejszym artykule dotyczą statusu normatywnego czynności operacyjno-rozpoznawczych w kontekście ustawy o Policji oraz kodeksu postępowania karnego. Podjęto próbę wskazania warunków, które rzutują na legalny charakter inwigilacji, a co za tym idzie – na skuteczne wykorzystanie materiału operacyjnego w procesie karnym. W tym celu scharakteryzowano niejawną aktywność Policji, wyszczególniając dopuszczalne metody operacyjne oraz definiując czynności operacyjno-rozpoznawcze w świetle literatury przedmiotu. Aby w pełni zobrazować problematykę poruszoną w artykule, przeanalizowano relację prawną między dowodem nielegalnym, o którym mowa w art. 168a kpk, a dowodem z czynności operacyjno-rozpoznawczych, na przykładzie zarządzonej kontroli operacyjnej. Praktyczny wymiar tych rozważań omówiono z punktu widzenia postępowania dowodowego, z uwzględnieniem ról i obowiązków procesowych prokuratora oraz sądu.
The issues discussed in this article refer to the normative status of operational and investigative activities in the context of the Police Act and the Code of Criminal Procedure. Namely, an attempt was made to demonstrate the conditions that affect the legal nature of surveillance, and thus the effective use of operational material in a criminal trial. For this purpose, the covert activity of the Police has been characterized by listing acceptable operational methods and defining operational and reconnaissance activities in the light of the literature on the subject. Therefore, in order to fully illustrate the issues discussed, an analysis was conducted of the legal relationship between the illegal evidence referred to in Art. 168a of the Code of Criminal Procedure and the evidence from operational and reconnaissance activities, on the example of an ordered operational control. The practical dimension of these considerations is discussed from the point of view of evidence proceedings, taking into account the procedural roles and responsibilities of the prosecutor and the court.

Opis:: Autor artykułu, analizując fenomen skuteczności sowieckich służb specjalnych, wysuwa hipotezę, że była ona skutkiem splotu kilku czynników. Wśród głównych elementów składających się na niebywałą sprawność służb sowieckich w pierwszej dekadzie po przewrocie październikowym, zdaniem autora znajdują się: fuzja doświadczeń instytucjonalnych Ochrany z wiedzą środowisk kryminalno-rewolucyjnych tworzących WCzK oraz rozwiązania operacyjne niespotykane wśród cywilizowanych społeczeństw. Zdaniem autora, sowieckie służby zostały de facto wyjęte spod prawa i nakazów moralności (uznawanych za przeżytek burżuazyjny), co umożliwiło stosowanie metod i form pracy niemożliwych w Europie Zachodniej. Tak rozumiane instrumentarium sowieckich służb składało się z mieszanki terroru, infiltracji, prowokacji i dezinformacji.
The article author, analyzing the phenomenon of the effectiveness of the Soviet special services, puts forward the hypothesis that it was the result of a combination of several factors. Among the main elements that made up the incredible efficiency of the Soviet services in the first decade after the October coup, according to the author there were: a fusion of institutional experiences of the Okhrana with the knowledge of criminal-revolutionary environments creating the VChK and operational solutions unheard of in civilized societies. According to the author, the Soviet services acted under no law and moral obligations (considered by revolutionaries as bourgeois remnant), which allowed the use of methods and forms of operational work unthinkable in Western Europe. The instruments of the Soviet services consisted of a mixture of terror, infiltration, provocation and disinformation.
