Opis:
The author of this article makes an attempt to present legal regulations relating to the legal scope of the constitutional principle of the autonomy of parliament. This principle is indicated in Article 112 of the Constitution of the Republic of Poland. It means that chambers of parliament can independently determine their internal organization and mode of work as well as detailed matters related to their functioning. But the scope of the principle of the autonomy of the parliament is determined also by other provisions of the Constitution, as well as the provisions of the laws and the Standing Orders of the Sejm of the Republic of Poland. The article also deals with the question whether this principle affects constitutional review of acts of chambers of parliament.

A deputy of the European Parliament is obliged to submit an asset declaration to both the Mar‑ shal of the Sejm and the President of the European Parliament. The declaration submitted to the Marshal of the Sejm is verified by the tax authorities with regard to consistency with previous dec‑ larations and the annual tax return. The declaration submitted to the President of the European Parliament is assessed by the President, who pays particular attention to the issue of the existence of a conflict of interest.

The opinion points out that the rules and procedures of Sejm’s international cooperation, especially contacts within the European Union, must be regulated by the Standing Orders of the Sejm. Currently, both EU law and national law allow the Sejm to cooperate with the European Parliament on impact assessment of European Union legislation, involving the transfer to the European Parliament of the possessed materials relating to the exercise of EU law. It is advisable to regulate the cooperation on the basis of Article 9 of the Protocol (No. 1) and – prior to the adoption of the said regulation – the cooperation should be based on the structure of COSAC.

The aim of the work is to show the management and functioning of the present swedish parliament – the Riksdag.The first chapter is devoted to the history of this organ, which has been setting up wildly since 1435. This year is considered as the first Riksdag.In the following chapter the parliamentary election is discussed, with the remarkable emphasis on its democratic character. This part shows also the idea of the deputy substitute – varamen.Afterwards the management structure of the Riksdag is presented, which in spite of unicameral character, since 1969, is very multiplex. The unusual and strongly privileged position of the speaker – talman, is well worth attention. He is responsible for creating the government.The consideration is closed by the explanation of the Riksdag functions, starting with the constitutional and legislative, ending up on creational and control ones.The swedish constitution gives the constitutional rules of the law protecting character, because its modification demands qualified majority voting, which is hard to gain. The legislative initiative can come from the government and deputies, with the small supremacy of the executive. The deputies initiatives are usually adjustments to the government proposals.The creational function comes down to appoint the government leader by the talman. The approval of the nomination for the prime minister requires speaker consultation with the parties representatives in the Riksdag. Fourfold disapproval leads to dissolving the parliament and extraordinary election.The parliamentary control resposes first and foremost on the parliament members and comittees. Deputies resort to interpellations and questions, while the comittees acomplish this duty mostly durring the legislative process. The abject result of the parliamentary control is non confidence vote for the government.
Niniejsza praca opisuje organizację i funkcjonowanie współczesnego parlamentu szwedzkiego – Riksdagu.Pierwszy rozdział poświęcony jest historii tego organu, która bardzo burzliwie kształtowała się od 1435 roku. Datę tą uznaje się za pierwszy Riksdag.Kolejny rozdział opisuje wybory parlamentarne ze szczególnym naciskiem na ich demokratyczny charakter. W rozdziale tym przedstawiana jest również idea instytucji zastępcy deputowanego – varamena.Następnie prezentowana jest struktura organizacyjna Riksdagu, który pomimo jednoizbowego charakteru, od 1969 roku, jest organem bardzo złożonym. Szczególnie warta uwagi jest również mocno uprzywilejowana pozycja przewodniczącego izby – talmana. Na jego barkach spoczywa bowiem obowiązek powołania rządu.Rozważania zamyka wyjaśnienie funkcji Riksdagu, począwszy od ustrojodawczej i ustawodawczej, a skończywszy na kreacyjnej i kontrolnej. Szwedzkie ustrojodawstwo nadaje regulacjom konstytucyjnym protekcjonistyczny charakter, gdyż ich zmiana wymaga trudnej do osiągnięcia kwalifikowanej większości parlamentarnej. Inicjatywa ustawodawcza wypływać może od rządu i deputowanych, z nieznaczną jednak przewagą egzekutywy. Propozycje poselskie to z reguły poprawki do projektów rządowych.Funkcja kreacyjna sprowadza się do powołania szefa rządu przez talmana. Zaaprobowanie kandydatury na premiera wymaga konsultacji przewodniczącego z przedstawicielami partii politycznych w Riksdagu. Czterokrotny brak akceptacji prowadzi do rozwiązania parlamentu i wyborów nadzwyczajnych.Parlamentarna kontrola rządu spoczywa przede wszystkim na deputowanych i komisjach stałych. Posłowie uciekają się w tym zakresie do interpelacji i zapytań, a komisje realizują tą powinność głównie w trakcie procedury ustawodawczej. Skrajnym efektem kontroli jest wyrażenie egzekutywie votum nieufności.

The paper concerns selected issues related to parliamentary procedures. The primary aim is to investigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally “formal motions”). In Poland, points of order are recognised as a separate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how motions of similar subject scope are regulated in foreign national parliaments.

The publication presents detailed issues related to the budgetary sovereignty of the Polish Parliament (i.e., the Sejm and the Senate) and the nature of the control / audit of budgetary expenditures. It analyses the role of the Parliament in preparation, adoption, and implementation of its budget in relation to, inter alia, funding and controlling expenditures allocated to parliamentary groups and political parties. It indicates the most important legal regulations related to this area and the amounts of expenditure from the budgets of the Chancellery of the Sejm and Senate, including the expenditure allocated to Deputies’ and Senators’ offices, as well as to parliamentary clubs, and groups.

Religion in the narratives of Polish members of the European Parliament : politicising European integration

The contribution investigates the role of religion in the work and attitudes of Polish members of the European Parliament (MEPs). It draws on two types of data: the results of the Polish part of the survey on Religion in the European Parliament and in European multilevel governance II (RelEP2) and qualitative content analysis of Polish MEPs’ speeches from the first part of the European Parliament’s ninth term of office (July 2019–June 2021). The analysis of the MEPs’ plenary speeches reveals the pivotal role religion plays in articulating the main national political divide between sovereig-nists and Europeanists over attitudes to European integration. Religion, treated primarily as a cultural resource and identity mar-ker, has become instrumental for the process of politicisation of EU integration at the supranational level – mirroring processes on the domestic level – pursued especially by MEPs representing right- wing orientations. The analysis of the survey results demonstrates that Catholicism constitutes an important element of many Polish MEPs’ individual value systems and identities. However, this trans-lates into an ambivalent perception of the role of religion in the context of the public sphere

Opis:
This article focuses on women's motivation to enter politics (5th Term of RP Parliament's Office). Presented conclusions are part of the study on gender's influence on performing the role of politician. The purpose of this article is to confront what women say with the theories concerning the common objectives in the selfishly motivated world. Firstly I describe Public Choice Theory. Then I comment on the research method and population characteristics, moreover I discuss the course of the study. The main part of this article presents motives of entering politics that were revealed by women-politicians. Women politicians declared different motives of entering into politics. I divided all revealed reasons into seven parts. The most frequently mentioned one was the desire to continue the career in Local Government at the central level. The second one was named by me willingness to help. There were also women that entered politics by other reasons, such as: the suggestion of significant others, challenge, et cetera.

Podstawowym celem niniejszego artykułu jest próba ustalenia granic, w obrębie których porusza się prawodawca tworzący przepisy regulaminów Sejmu, Senatu oraz Zgromadzenia Narodowego. Czyniąc punktem odniesienia treść art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 konstytucji, statuujących zasadę autonomii parlamentu (a więc wyznaczających także normatywną płaszczyznę autonomii regulacyjnej) autor ukazuje, jaki wpływ na ustanawianie norm regulaminu ma otaczające go środowisko prawne. W kolejnych częściach artykułu pojawiają się rozważania poświęcone ingerencji w materie wewnętrzne parlamentu różnych aktów normatywnych, tj. konstytucji, ustaw zwykłych, aktów prawa unijnego, Europejskiej Konwencji o Ochroni Prawa Człowieka i Podstawowych Wolności oraz ingerujących względem siebie regulaminów izb. Główna teza badawcza tego opracowania opiera się na przekonaniu, że wytyczony w ramach przepisów konstytucyjnych zakres autonomii regulacyjnej doznaje poważnych ograniczeń, i że decyzje parlamentu regulującego własną organizację wewnętrzną podyktowane są w określonym wymiarze uwarunkowaniami zewnętrznymi.
The main purpose of this article is an attempt to delineate boundaries, within which the lawmaker has got discretionary power to establish rules of the standing orders of the Sejm, the Senat and the National Assembly. As making reference point to the content of art. art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 of the constitution, the author demonstrates what is the impact of the surrounding legal environment on establishing that rules. Consequently, the following parts of this article present the interference of different normativeacts into internal parliamentary affairs, i.e. the constitution, bills, UE law acts, the European Convention on Human Rights and the standing orders of parliament. The key thesis of the article is based on convenience that the scope of regulative autonomy, laid down by the constitution, is the subject of further limitations and that the decisions of parliament in this area have to meet some external (imposed „from outside”) conditions.

From the rector’s chair to deputies’ benches : the rectors of the Lviv University as virilist deputies of the National Galician Parliament

In 1861, the National Galician Parliament was established. Among its deputies, there were the representatives of Galician Universities. It was the institution of the so-called ex-officio members of parliament or chancellors virilists. Despite its many shortcomings, the chancellors stayed in the benches of the Galician Parliament until the end of the Habsburg Monarchy. In the years 1861-1914, the University of Lviv sent 50 rectors to the Galician Parliament. They were mostly Poles, and to a lesser extent Germans and Ukrainians. The rectors were rather not involved in political debates. The main area of their interest was the field of education.

W artykule poruszona zostaje problematyka konstrukcji prawnej kadencji Izby Gmin pod rządami przepisów ustawy o sztywnej kadencji parlamentów z 2011 r. Autor dokonuje analizy przyjętych rozwiązań prawnych, wskazując na ich daleko idące konsekwencje ustrojowe. W pierwszej kolejności wyjaśnia on na czym polegała zmiana, na jaką zdecydował się brytyjski ustrojodawca w 2011 r. Następnie przedstawia skutki zniesienia dotychczasowej prerogatywy królewskiej służącej rozwiązywaniu parlamentu. W końcowej części artykułu omawia wreszcie nowe procedury rozwiązywania parlamentu, z założeniem wyeksponowania ich znaczenia dla funkcjonującego nad Tamizą konstytucyjnego systemu państwa.
The article raises an issue of legal construction of cadence of the House of Commons under the regime of the Fixed-term Parliament Act 2011. The author examines the legal rules included in the bill, showing all the constitutional consequences that they trigger. First, he makes an explanation what was the change that the lawmaker has decided to apply. Second, he also depicts the results of abolishing the prerogative of monarch for dissolving parliament. Finally, he performs the new procedures on the dissolving parliament, which he makes with an assumption to put emphasis on the meaning of these rules for the constitutional system on the Thames.

The 100th anniversary of creation of the quazi parliament in the form of the State Duma as the Lower Chamber and in general reorganized State Council as the Upper Chamber takes place in 2006 and is of great interest not only historians but also of the specialists in study of literature, as they watch and research the social changes in the Russian state organization and can’t stand paying attention to the influence of this event on the political consciousness of the Russians of the first decade of the XXth century which was consolidated in a lot of works, also works of literature.The subject of the article is to show the attitude to that event of the Polish society, especially of the Poles from the Polish Kingdom, which was under the Russian reign in those times. The author represents this attitude through the utterances of the most influential people of the Polish public opinion, such as: Bolesław Prus, Jozef Piłsudski, Wladysław Studnicki, Tadeusz Grużewski, Hipolit Korwin-Milewski, Konstanty Skirmunt and gen. Jan Jacyna, also the utterances of the leading figures of ND, PPS and the editors of the popular „Kurier Warszawski”.A conclusion, to which the author comes on the basis of this discourse, is the following: inPolish opinion, in the majority of cases the skepticism prevailed, which regarded the reformatory possibilities of the Duma and also the attitude to the new system in Russia, which replaced the former autocratic tsarist absolutism in 1906, as a system, which, despite all its limitations, nevertheless was constitutional, and of Russia itself, as a monarchy, already representative.

The article concerns the competences of the organs of the Sejm and the Senate related to protecting the dignity of the chambers. These competences were established as a part of a reaction to the course of the so-called “Sejm crisis”, consisting in the occupation, initially, of the Sejm’s rostrum and then the Sejm’s Meeting Room by MPs from opposition parties at the turn of 2016 and 2017. Using the dogmatic method, the publication aims to define the essence of competences, their applicable and planned regulations, and to evaluate these regulations and formulate possible de lege ferenda postulates on the basis of this evaluation. The main thesis of the article includes a negative evaluation of the applicable regulations of competences due to their contradiction with certain provisions of the Constitution, in particular with Art. 2 of the Constitution, i.e. within the framework of the principle of a democratic state ruled by law established in this provision and the resulting, inter alia, principles of decent legislation, including the principle of the specificity of law, as well as Art. 54 sec. 1 in connection with Art. 31 sec. 3 of the Constitution (i.e. the freedom of expression), Art. 11 of the Constitution (i.e. the freedom to establish and freedom of activity of political parties within the scope of the purpose of their activity, which is to influence on state policy by democratic methods) and Art. 32 of the Constitution (i.e. the principle of equality of political parties resulting from the principle of political pluralism). In this context, the most important is the risk of the so-called “chilling effect”. The publication also includes a positive evaluation of a few of the planned regulations of competences, which may allow for the elimination of the above contradictions or ensure a more complete implementation of the objective of competences, including guaranteeing the dignity of the chambers.

W opracowaniu omówiono przepisy regulaminów parlamentów narodowych wybranych państw członkowskich UE, a także Wielkiej Brytanii, Stanów Zjednoczonych i regulaminu Parlamentu Europejskiego, odnoszące się do kwestii objętych w regulaminie Sejmu RP pojęciem „wniosków formalnych”. Pojęcie to nie zostało wyodrębnione we wszystkich omówionych regulaminach parlamentarnych. W wielu z nich regulacja odpowiadająca przedmiotowo poszczególnym wnioskom formalnym wyodrębnionym na gruncie regulaminu Sejmu pozostaje rozproszona. Z kolei w niektórych regulaminach, choć pojęcie wniosku formalnego zostało wyodrębnione, to nie zostało ono zdefiniowane i nie przewidziano zamkniętego katalogu takich wniosków.
The paper concerns selected issues related to parliamentary procedures. The primary aim is to in‑vestigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally “formal motions”). In Poland, points of order are recognised as a sepa‑rate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how mo‑tions of similar subject scope are regulated in foreign national parliaments.

Competing visions : discursive articulations of Polish and European identity after the Eastern enlargement of the EU

The enlargement of 2004 and 2007 significantly transformed the European Union in political, economic, and social terms. It also challenged the collective identities of Western Europeans as well as each of the newcomers. However, for new members, the prospect of joining a supranational political entity posed a threat to their newly established or regained sovereignty and nationhood. The integration triggered a process of redefinition of both their self-perception and the perception of Europe as a common project. The article offers a case study of how the Polish Members of the European Parliament discursively (re)construct national and European identities and how these constructions relate to each other. The analysis reveals three main visions of the European identity that are voiced by the Polish representation and corresponding visions of national identity. By focusing on the supranational level of the European Parliament and contextualising the analysed constructions with references to national debates, the study is able to nuance the existing theoretical accounts of European and national identities.

Opis:
The article presents the essence of parliamentary interpellations, refers to the obligation incumbent on the addressee to provide an answer within the time limit indicated in the Constitution. The author is of the opinion that not replying or replying after the deadline is a constitutional tort and is subject to liability before the State Tribunal. The currently occurring, rather negative parliamentary practice necessitates appropriate amendments to the Parliament’s Rules of Procedure. These changes should also cover the issues of abuse of the right of interpellation and enquiry by.
W artykule przedstawiono istotę interpelacji poselskich, odniesiono się do obowiązku spoczywającego na adresacie, aby odpowiedź udzielić we wskazanym w Konstytucji przepisie. Zdaniem autora nie udzielenie odpowiedzi bądź udzielenie, ale po upływie terminu, jest deliktem konstytucyjnym i podlega odpowiedzialności przed Trybunałem Stanu. Obecnie występująca, dość negatywna praktyka parlamentarna wymusza dokonanie odpowiednich zmian w regulaminie Sejmu. Zmiany te powinny objąć także kwestie nadużywania przez posłów prawa do interpelacji i zapytań.

Parliamentary representation of political parties is nowadays becoming an important field of activity of every grouping. Members of Parliament, following the standards of party charters, become an element of party elite, holding the official positions in collegiate organs. Personal changes in the parliament then mean changes in the party elite. The goal of the article is defining the scale of the phenomenon of debut Members of Parliament in the years of 2011, 2015 and 2019. The research question which the author was faced with is the question about the scale of the phenomenon of debut Members of Parliament and its consequences for the demographic structure of the Polish Sejm and the particular party representations in the parliament, defined as party elites. Detailed questions concern: the importance of parliamentary representatives in contemporary political groupings; defining whether the scale of the phenomenon in 2015 was significantly different from the election results from 2011 and 2019. The established hypotheses assume that: the important of parliamentary representation in contemporary parties is on a constant growth on the formal level and also within the political praxis, and consequently, Members of Parliament can be called party elites. Another hypothesis assumes that the phenomenon of debut MPs has stood out quantitatively in the analyzed period of time, nevertheless, it has not changed the demographic structure of the parliament dramatically, concerning the other two analyzed terms. The period of the analysis concerns the three parliamentary elections in 2011, 2015 and 2019, which allowed to pick up on the possible tendency of the phenomenon.
Parlamentarna reprezentacja partii politycznych współcześnie staje się istotnym obszarem działalności każdego ugrupowania. Posłowie, zgodnie ze standardami statutów partyjnych stają się elementem elity partyjnej, piastując oficjalne funkcje w organach kolegialnych. Zmiany personalne w parlamencie oznaczają zatem zmiany w partyjnej elicie. W tym kontekście celem artykułu jest określenie skali zjawiska debiutujących posłów w latach 2011, 2015, 2019. Problemem badawczym sformułowanym przez autora jest pytanie o skalę zjawiska posłów debiutantów oraz o jego konsekwencje dla struktury demograficznej polskiego Sejmu, jak i poszczególnych partyjnych reprezentacji w parlamencie ujmowanych jako partyjne elity. Pytania szczegółowe dotyczą natomiast znaczenia parlamentarnej reprezentacji we współczesnych ugrupowaniach politycznych oraz określenia czy skala zjawiska w 2015 r. była znacząco różna od wyników elekcji z 2011 i 2019 r.? Przyjęte hipotezy zakładają, że: znaczenie reprezentacji parlamentarnej we współczesnych partiach na poziomie formalnym, jak i w ramach politycznej praktyki, stale rośnie, a co za tym idzie można o posłach mówić jako o partyjnej elicie. Druga hipoteza zakłada z kolei, że zjawisko posłów debiutantów ilościowo wyróżniało się po wyborach w 2015 r., niemniej jednak radykalnie nie zmieniało struktury demograficznej parlamentu w odniesieniu do dwóch pozostałych analizowanych kadencji. Okres podjętej analizy dotyczy stanu osobowego parlamentu wygenerowanego w wyniku trzech elekcji parlamentarnych w latach 2011, 2015, oraz 2019, co pozwoliło wychwycić ewentualną tendencję zjawiska.

This paper presents the attitude of the European Parliament to those issues that fall within the scope of interest of the Eastern Partnership. In the analysis of this attitude, the author stresses the significant role the EP has played in developing EU Eastern policy, in particular as concerns the promotion of democratic ideas and values within the scope of this policy. It should be emphasised that the EP is exceptionally interested in the advancement of democracy in East European partner countries, whose geopolitical significance the EP appreciates, frequently calling for the tightening of relations with these countries, and even opening European prospects to them. The deepening of cooperation between the EU and East European countries is conditioned by the EP by their adoption of what is called European values (i.e. democracy, rule of law, protection of human rights, etc.). Acting as the ‘guard of democracy,’ the EP is an institution of political influence which allows it to shape Eastern policy in ways that go beyond the formal rights vested in it by the treaties.

In the article the main characteristics of the European Parliament elections in 2014 in relation to the characteristics of the both previous elections to the Parliament were analysed. First, the legal framework is presented, followed by the presentation of candidate lists. As it is frequently the case, the authors for the analysis employed the analytical framework presented by Reif and Schmitt (1980). Following the framework, it is obvious the elections in Slovenia again demonstrated many elements of the second-order elections framework, for example in terms of the turnout, success of the governmental parties, success of small parties, as well as almost complete absence of party programmes, Euroscepticism and European topics in the campaign. Since several important domestic events happened just before the EP elections (e.g. resignation of the government at the beginning of May and the fact the leader of the biggest opposition party was by the court found guilty of corruption activity and sent to the prison at the end of April) such developments did not come as a big surprise.

One of the key issues in the process of preparing for an election to the European Parliament is to determine the number of seats for each country. The Treaty of Lisbon, signed by Member States of the European Union, has obliged the European Parliament to establish rules guaranteeing that the distribution of seats should be done according to, inter alia, the principle of degressive proportionality. The purpose of this paper is to explore how the principle of degressive proportionality is actually implemented, and to propose a compromise – a mathematical solution, guaranteeing that the distribution of seats is consistent with the requirements of the Lisbon Treaty.

Politicians and political campaigns are not inadvertent to the development of social media platforms as environments that allow access to a larger audience. Not relying solely on the traditional media as a mouthpiece for their messages and taking matters into their own hands offers new segues for analyzing political communication. However, not all elections are of equal interest, both for the electorate and for the candidates, as second-order election theory suggests (Reif & Schmitt, 1980; Hix & Marsh, 2004). Th is paper investigates the area situated at the intersection of these two research directions. This quantitative study aims to analyze how Romanian political parties and candidates used Facebook in the electoral campaign for the European Parliament, in May 2019. The study follows the correlation between Facebook metrics, like frequency of posts and the popularity of the pages, and the political agendas refl ected in each party’s Facebook posts. The conclusions are consistent with second-order elections theory, but raise questions about the dependable nature of Facebook metrics.

The Kuyavian-Pomeranian Voivodeship constitutes one of the smallest of the Polish voivodeships. It is composed of nineteen land districts and four city counties, including Bydgoszcz, Torun, Wloclawek and Grudziadz. According to the data provided by the Public Electoral Commission (PKW), in 2009 the Kuyavian-Pomeranian Voivodeship was inhabited by more than 2 million people, 1.65 million of whom had the right to vote. Despite the relatively small number of inhabitants, due to provisions of the act regulating the process of voting for the Members of the European Parliament, the voivodeship in question became a separate electoral district with the electoral commission located in Bydgoszcz. This decision was infl uenced mostly by members of the Democratic Left Alliance (SLD) representing this region in the Polish Parliament. This lobbing activity seemed benefi cial from the party’s perspective, since SLD has been gaining extraordinary support in the region. But for this lobbing, the voivodeship under consideration would have been included in one district together with the Pomeranian Voivodeship, where the majority of voters are prone to give their support to the right-wing and centre-wing parties.

StreszczeniePowyższa praca magisterska przedstawia analizę udziału kobiet w Parlamencie Europejskim. We wszystkich społecznościach dominowało przekonanie, że kobiety miały spełniać swoje prywatne role, natomiast mężczyźni mieli realizować role społeczne. To oni mieli wyłączne prawo wpływania na podejmowanie najważniejszych decyzji politycznych. Przez wieki ta część życia politycznego była zarezerwowana wyłącznie dla mężczyzn. Taki sposób myślenia uległ zmianie w XX wieku. W Europie w ciągu kilkudziesięciu minionych lat, polityka przestała być wyłącznie sferą działalności mężczyzn, coraz więcej kobiet zostało posłami i uzyskało wpływ na kreowanie polityki Unii Europejskiej. Jednak pomimo zmian jakie się dokonały w tej kwestii, kobiety wciąż jeszcze mają przed sobą do pokonania stereotypy płci zakorzenione w społeczeństwie. W mojej pracy opisuję trendy i tendencje odnoszące się do uwarunkowań uczestnictwa kobiet w polityce, a dotyczące wykształcenia, narodowości czy stanu cywilnego.Praca składa się z czterech rozdziałów. Jej fundamentalną tezą jest założenie, że równość płci w każdej sferze życia publicznego musi być oparta zarówno na równości zagwarantowanej prawnie jak i na równości faktycznej wynikającej z rzeczywistości społecznej. Pierwszy rozdział stanowi opis najważniejszych kwestii dotyczących polityki równości płci w Unii Europejskiej. Przedstawia on najważniejsze uregulowania prawne zawarte w traktatach. Polityka równości płci jest jednym z najważniejszych zadań realizowanych przez Unię Europejską. Drugi rozdział przedstawia informacje na temat praktycznych aspektów równości kobiet i mężczyzn w Unii Europejskiej. Opisane zostały w nim także programy, których celem jest zapewnienie i zagwarantowanie kobietom ich praw. Trzeci rozdział w sposób szczegółowy omawia udział kobiet we wszystkich organach i instytucjach unijnych. Ostatni rozdział opisuje działalność kobiet w Parlamencie Europejskim. Ukazuje on jak zmieniała się liczba kobiet w tym unijnym organie począwszy od pierwszych wyborów do roku 2009. W ciągu minionych 25 lat liczba kobiet uległa podwojeniu. Dziś kobiety stanowią jedną trzecią wszystkich członków Parlamentu Europejskiego. Kobiety w PE zajmują stanowiska eksperckie we wszystkich obszarach, a ich działalność jak tak samo profesjonalna jak mężczyzn. Dzięki temu chociaż częściowo udało się przezwyciężyć stereotyp płci w polityce. Wydaję się, że członkom Parlamentu Europejskiego udało się odejść od negatywnego postrzegania kobiet w polityce. Należy jednak pamiętać, że stereotypy są głęboko zakorzenione w społeczeństwie, w związku z tym cechy wyróżniające daną grupę zostają wciąż niezauważone wśród grup, w których dane stereotypy zostały utwierdzone. Uregulowania prawne czy system instytucjonalny łatwo jest zmienić, zaś specyfiką stereotypów jest trudność ich wyeliminowania przez pokolenia. Jednak dzięki zawodowym kwalifikacjom i doświadczeniu kobiet, płeć coraz rzadziej jest czynnikiem determinującym ich polityczną działalność.
AbstractMy work presents an analysis of participation of women in the European Parliament. In all known communities women were supposed to fulfill their life goals as mothers and housewives, men were destined for public roles. They had the ability to influence political decisions. For centuries this part of social life was reserved exclusively for men. But all that changed in the 20th century. In Europe over the past several dozens of years politics has ceased to be a male playground as more and more women were becoming MPs, assuming government posts and influencing the policies of the European Union. However, they still have to overcome stereotypes, largely rooted in the visible, distinctive, and universal issue of gender.I described certain trends and tendencies, that point to diverse determinants of the women`s predilection for specific political issues, as well as life and professional experience, nationality, and marital status. The work consists of four chapters. The fundamental thesis is the assumption that gender equality in every sphere of public life must be based on both the equality guaranteed by law and in equity arising out of actual social reality. The first chapter contains general points about gender equality in the European Union. It shows the characteristics of the major law regulatory contained in the treaties. Gender policy is one of the most important activities in the European Union.The second chapter contains the most important information about practical aspects of equality between women and men. It also describes the programs and funds to protect women`s rights. The third chapters shows a participation of women in all of the European Union bodies and institutions. The last chapter, which is the most important, is about women in the European Parliament. It shows how the number of women in this body varied in time, starting from the first election in 1979 to 2009. Throughout 25 years this number doubled. Women constitute one third of Members of the European Parliament. They are included as experts in all fields and their activities are as professional as those performed by men. It helps them to overcome the stereotype of women that has been present in politics.It seems that members of the European Parliament have been successfully departing from this view of women in politics. However, we should remember that stereotypes are deeply rooted, which means that even if the distinguishing features of a particular group change, this viewpoint remains unnoticed by members of the groups where this stereotype has developed. Legal regulations and institutional system are easy to change, but the nature of stereotypes is difficult to eliminate through the generations. Thanks to women's professional competence and experience, their political activities are less and less likely to be determined by their gender.

The activities of the two chambers of the Polish parliament – the Sejm and the Senate – during the twenty years of Poland’s membership in the European Union can be analysed by taking two research approaches, the first of which is universalism, which addresses the civilisational need to build, harmonise, and unify. Universalism, which refers to the neo-functionalism paradigm, has characterised the European activity of both chambers of the Polish parliament. The other perspective is provided by neo-realist particularism, which takes an anti-idealist and anti-utopian stance. It is distinguished by national egotism expressed as an attachment to achieving the nation’s own interests. Today, particularism understood in this way is based on sovereign distinctiveness, independence, and self-reliance. The purpose of this article is to positively verify the hypothesis that the parliamentary dimension of Poland’s membership in the EU observed through the participation of the Sejm and Senate in the process of Europeanisation and de-Europeanisation simultaneously contributes to the dependence and independence of both chambers on the European Union and its institutions. The universalist and particularist approaches have allowed the author of this analysis to reach an empirically-confirmed conclusion that both chambers of the Polish parliament in the period under study had an influence on the following: (1) the political power of the government, reinforcing or sapping it during negotiations; (2) the effectiveness or ineffectiveness of coalition-building in the EU; (3) cooperation with or resistance to the dominance of the parliaments of large EU states; (4) varied responsibility for the integrative system as a united and harmonious whole; and (5) the union of the peoples of Europe or a Europe of Homelands.

While the debates of the first term of Iranian Parliament- the National Consultative Assembly, or Majles (1906-1908) - have long been an important source for historians and other scholars, no serious effort has ever been undertaken to try and properly understand this historical source. As a result, a number of misconceptions exist about the debates of the early parliament and what survives as their minutes. The present paper aims to dispel some of these misconceptions by focusing on two issues: 1) whether - and to what extent - what survived to our day (by the virtue of being published in the Majles newspaper) should be considered the official minutes of the parliament; 2) what were some of the characteristics of the later edition of the minutes published as the supplement to the Official Gazette of Iran. This is achieved by the careful analysis of a number of sources, mainly the debates themselves, legal documents, periodicals and memoirs.

Between human rights and security concerns : politicisation of EU-Turkey and EU-Libya agreements on migration in national parliaments

For the past few decades, the increased perception of migration as an issue in Europe resulted in the development of the externalisation of the EU’s migration governance to third countries. EU-Turkey and EU-Libya cooperation frameworks on migration have in this perspective been established in the wake of the 2015 migration crisis and triggered major controversies. The agreements received fierce contestation from non-governmental and international actors, highlighting the poor protection of human rights through this management. This paper analyses the dynamics of politicisation of EU-Turkey and EU-Libya agreements on migration in domestic political discourse. A qualitative comparison between German, French and Polish parliamentary debates constitutes the main empirical basis of this research. The analysis focuses on the different patterns of politicisation with emphasis on contesting arguments. This paper examines members of parliaments’ stances on EU-Turkey and EU-Libya cooperation focusing on humanitarian and securitisation frames. Results demonstrate an uneven process of politicisation in national parliaments dependent on the robustness of parliamentary majority and political parties’ issue positions. Overall, the analysis of discourse on the two agreements clearly illustrates the prioritisation of security over human rights when it comes to migration management.

The increased number of migrants and refugees coming to Europe since 2015 has challenged the member states of the European Union (EU). Despite a rather small number of refugees coming to Poland, their arrival has been framed as a major issue for the country. The aim of this paper is therefore to analyse the images associated with migrants and refugees during Polish parliamentary debates. The paper focuses on the discursive representations of migrants and refugees: how discursive images around migrants and refugees are created and reproduced in a specific political setting, i.e. the Sejm. The main question leading this paper concerns the concept of securitisation and how political actors, in this case members of parliament (MPs), link migration with security concerns through discursive practices for political ends. The methodology used is primarily discourse analysis, applied on data collected from 2014 onwards in the Polish parliament. The discursive construction of claims demonstrates that throughout the migration crisis migrants and refugees tend to be more and more associated with the image of an outsider threatening the nation. Additionally, migration as an object of concerns has been instrumentally addressed by Polish political parties to achieve political gains.

The proposal is worthy of support from the government in the Council of the EU. The draft position of Polish government on the proposed directive does not raise doubts, and the impact assessment of the proposal contained therein is consistent with the assessment by the Bureau of Research of the Chancellery of the Sejm. The draft position was submitted to the Sejm 30 days after the expiry of the time limit specified by the so-called Cooperation Act.

The article examines the main state-building acts adopted by the highest authorities of Ukraine and the Baltic states starting from 1990 (as a result of the first free election of deputies of these republics in the post-war period) and until 2004 (when significant changes took place in the internal political and geopolitical context, in particular – the accession of the Baltic states to NATO and the EU, as well as changes in the form of government in Ukraine in amendments to the Constitution as a result of the so-called «Orange Revolution»). The article reflects not only the legal part of the specified period, but also the institutional part, in particular, in the part of the formation of both legislative and executive power in the specified countries. The interaction of political, regulatory and historical components in this article forms a holistic vision of state-building processes in their synergistic unity. The purpose of the study is to conduct a chronological comparison of the main statebuilding acts of Ukraine and the Baltic countries in the period from 1990 to 2004. The methodological basis is a chronological comparison of the normative framework of countries in the context of the processes of state formation. It was determined that the parliaments of these countries, which were elected in the spring of 1990, immediately began to fight for their sovereignty and set a course for separation from the union center. The August 1991 putsch in Moscow became the «trigger mechanism» in the declaration of independence of the Baltic states and Ukraine. From that time, these countries began to build their states independently, in particular in the political and legal sphere. First, there is a change in the name of the state itself and its parliament (getting rid of the Soviet one) at the legislative level, as well as the complete subordination of power structures and other authorities exclusively to republican structures. Subsequently, the main state symbols (flag, coat of arms and anthem), constitutions are adopted, the course of states towards a market economy through the denationalization of property and privatization is introduced, each has its own currency, property is divided with other republics, international treaties and agreements are adopted, and countries The Baltics (but not Ukraine) manage to completely get rid of Russian troops from their territory through complex diplomatic efforts. The latter also contributed to the fact that the Baltic countries, having immediately taken a course towards the West, later became full members of NATO and the EU. During this period, Ukraine only decided on its geopolitical vector, that it intends to join these international associations in the future.

This article analyses the position of the European Parliament on the priorities for the development of the EU Common Security and Defence Policy. The issues covered by this policy after the entry into force of the Lisbon Treaty remained the domain of intergovernmental cooperation mechanisms. Despite the changes made to the Lisbon Treaty to unify the Union’s external relations by removing its pillars and expanding CSDP tasks, the role of the EP in its creation has not increased in line with its expectations. In accordance with the provisions of the TEU, decisions on the operation of the CSDP shall be adopted by the Council, acting unanimously on a proposal from the High Representative of the Union for Foreign Affairs and Security Policy or from a Member State. As a result of such Treaty arrangements, the EP is unable to play such a role in the area of CSDP that would correspond to the importance of this body in the EU’s institutional system. Therefore, the main instrument for the implementation of the EP policy in the area of CSDP remain resolutions in which this body calls for the inclusion of transnational cooperation mechanisms in it. By expressing its position in resolutions, the EP advocates for the development of a strong, unified CSDP based on defined European security interests, as well as the development of a pan-European approach to the issues covered by this policy.

Ensuring the energy security is currently one of the EU’s top priorities. The EU energy policy, after the entry into force of the Treaty of Lisbon, is regulated by Article 194 TFEU, which guarantees a solid legal basis for European Union actions in this area on the basis of the Community method. The European Parliament, within the scope of its Community competences, as a participant in the decision-making process, contributes to shaping the face of the EU energy policy. Furthermore, by adopting nonlegislative resolutions, the EP expresses its position on the most crucial issues included in this policy and has an indirect influence on its shape. The aim of this article is the analysis of the content of these resolutions and presentation of the EP’s opinion on the challenges facing the EU in the field of energy. It should be highlighted that the European Parliament is the EU body with a strong emphasis on a supranational approach to energy security. The European Parliament prefers the view that all Member States, in a spirit of solidarity, must take actions to guarantee the EU’s common energy security. In favour of a common, integrated European energy market, the EP puts great emphasis on the necessity to implement ambitious climate policy objectives within its framework, the key element of which is the reduction of greenhouse gas emissions.

The history of the Polish parliamentarianism has aroused numerous disputes since long due to many factors, causing difficulties in determining the beginnings of existence of this institution in the former Poland. The basic problem emerged in the distinction of the term “Sejm” (“Polish Parliament”) from the earlier rallies, court veches, local conventions or those covering larger areas of the country, or even all-state conventions, summoned by the particular regional dukes and after the unification of the state by monarchs. The disputes were related to the critical look at the role of Parliament in the history of the state: some glorified it, others expressed their critical view, determined by the historical school which the particular author belonged to. During those disputes, the final form was gained by the Polish Parliament as a bicameral parliament with the king, as one of the states, with the Senate and the Chamber of Deputies in the years 1493–1505.

At the end of World War I, in many European countries women won the active and passive right to vote. Poland was one of the first countries, where women were allowed to participate in political life. Already at the time of establishing the Legislative Sejm (1919) the first women-MPs took their seats in Parliament. Similarly, the situation presented itself in the case of the Senate. During its first session (1922) women participated in the works of the upper chamber. The purpose of this paper is to present the participation of women in the legislative work of the Senate in various terms of office. The participation of women in the legislative work of Parliament was characterized by their involvement in issues concerning education or social services, while avoiding participation in the legislative work or that dealing with political matters. The situation presented itself differently as regards women’s involvement in the work of the Senate. A good example here was the activity of Dorota Kałuszyńska, who – during the work on the so called April Constitution of 1935 – not only participated in it very actively, but also ruthlessly attacked the then ruling camp. Another very interesting episode related to activities of women in the Senate was an informal covenant during the work on the bill to limit the sale, administration and consumption of alcoholic beverages. Belonging to different political groups: the said D. Kłuszyńska as a representative of the Polish Socialist Party, Helena Kisielewska from the Bloc of National Minorities and Hanna Hubicka of BBWR [the Nonpartisan Bloc for Cooperation with the Government] unanimously criticized the regulations in force, which – in their opinion – did not fulfill their role when it came to anti-alcohol protection. The participation of women as far as their number was concerned was indeed small, but the Senate (like Parliament) of the Second Republic functioned in the period when women had just begun their activity on the legislative forum. Undoubtedly, it was a very interesting period, in which women had the benefit in the form of gaining their parliamentary experience. For example, it gave rise to subsequent activities of Dorota Kłuszyńska, who actively participated in the legislative works of the Sejm in the years 1947–1952, dealing with social issues or family.

The statutory prohibition on taking up paid employment is the most rigorous one among analogous restrictions on regarding functionaries of other uniformed services. This regulation prohibits officers of the Parliament’s Guard from undertaking other gaining activities than the ones of scientific or scientific-didactic nature, to which the Chief of the Chancellery of the Sejm consents on condition that it does not interfere with the performance of official tasks. The Parliamentary Guardian also cannot run his own economic activity.

Opis:
The present paper offers an analysis of the attitudes of Polish citizens towards the process of European integration. Two major points can be highlighted, based on the data obtained from various opinion surveys, e.g. CBOS, PBS, ISP, OPTEM, and Eurobarometer. The first one concerns the initial high level of scepticism in Poland about the decision to join the EU. The results of the public opinion polls indicated that Poles had agreed to be the Member State more “under pressure exerted by the course of history and that of the current European affairs” rather than “by an informed choice”. It may well be that due to this scepticism, Poland, as one of the few countries to join the EU, did not experience the socalled post-accession shock. On the contrary, the results of surveys suggested that there was a rapidly growing belief among Poles in positive repercussions of the accession, at least until the time when the effects of the economic crisis began to transpire. The second problem deals with how Poles see themselves as the members of the European Community. The data show that Polish citizens consider the membership in the EU as a fact of life, an existing condition that does not stimulate their action if the affairs are not directly associated with their own interests. That is probably the reason why Poles do not feel co-responsible for the European project. They still see the Union as an organisation that is supposed to bring profit but, at the same time, they do not feel obliged to actively take on responsibilities that follow.

According to Montesquieu tripartite system, formed in the European constitutionalism, the organs of authority, in a democratic state, affect each other in an inhibitory way, balancing mutually. Traditionally, it is understood that the executive power is performed by the Head of State (monarch, president) and government, legislative power belongs to the parliament, whereas the judicial power is exercised by independent courts. Analyzing the political reality of member states it is necessary to note, that the executive participates in the national legislative processes more actively, for example, through executing constitutionally granted right of legislative initiative (usually together with deputies), by issuing acts with the power of law, or incorporating Community directives into the internal legal order.

The arguments embraced here are those that examine the discourses of parliamentarians and their proposals that represent Evangelical fundamentalism with the support of conservatism of a moral and religious character, no longer exclusive to the right-wing Catholics, as pointed out in the literature of Political Science. The interpretation of religious politicians’ speeches is as legitimate and necessary as the discussion of the reverse of secularization and the increasing presence of religion in politics. Secularity is only an issue in Brazilian politics nowadays because of the conflict between conservative evangelical parliamentarians and Brazilian scientists. The latter are representatives of the scientific theories of evolutionism and proponents of scientific research on stem cells and embryos, considered as early as the beginning of the 20th century as threats to Christian civilization according to the Bible. The former, some of them propagators of the Bible, repeat this argument in public discourse, a symptom of fundamentalism as defined by Marsden. It discusses then the dispute between politics of morality and the process of informalization and permissiveness that have gained much widespread support of the young population since the 1960s. This dispute is still going on in Brazil, a country that has aroused the interest of missionaries because of its customs and non-Christian religions, especially Afro-Brazilians. The political crisis and the flaws of a fragmented public security policy has also called attention to the issues relative to the possession and use of guns as well as the role of repressive policies considered by the fundamentalist members of a divided Evangelical Front as the only way to stop violence and crime. This discourse is in flagrant contradiction with their defense of life in pregnancies.

The opinion shows that, specifying the range of entities that can participate in closed committee meetings, the Standing Orders of the Sejm expressly states that such meetings may be attended by Deputies who are not members of that committee and the persons whose participation the committee deems indispensable. There is no legal basis for the admissibility of participation of MEPs in closed meetings of Sejm committees that involve classified information. The author of the opinion notes that the possible attendance of a Member of the European Parliament at such a meeting would implicate the recognition by the Commission of their attendance “as indispensable” and the requirement to present of an appropriate security clearance.

The obligation to immediately undertake actions to execute binding results of a referendum through issuing normative acts or taking other decisions derives from the Act on the Nationwide Referendum. The adopted statute, which constitutes the execution of the results of the referendum, may be referred to the Constitutional Tribunal (both in the procedure of preventive and subsequent control). The Constitutional Tribunal is not bound by the results of a nationwide referendum. In the event of omission of the obligation to immediately undertake actions to execute the binding results of the referendum by the Sejm and the Senate, the Deputies and Senators are not legally accountable. However, in the case of the President of the Republic of Poland and members of the Council of Ministers, the question of their constitutional accountability shall be taken into account.

The article examines the meaning of the Sami Parliament in Sweden from the perspective of the self‑determination discourse. The Sami Parliament is believed to be the most important political institution for contemporary Sami society. The creation of the Sami Parliament was a fundamental step for this society be‑ cause it increased Sami minority influence. What is more, Sami people are the only minority in Sweden which has its own representative body. The author of the article analyses how this institution works as a part of the Swedish political system and in comparison to other similar institutions. The aim is to predict Sami Parliament’s possible ways of development and its future role within Sami society’s right to self‑determination.

Szczególnie było to widoczne w czasie trwania etapu tzw. konkluzji. W oczach królewskich najważniejszą rolę jaką mieli do odegrania senatorowie to pośrednictwo między nim , a bracią szlachecką. Urzędnicy wyżsi tę misje wypełniali podczas trwania różnego rodzaju komisji, deputacji, kolokwiów czy sesji prowincjonalnych. Monarcha, do stworzenia oddanej grupy senatorów regalistów, która miała zadanie godnie go reprezentować w izbie poselskiej, wykorzystywał politykę rozdawniczą. Ekipę władzy według króla Władysława IV powinni tworzyć ludzie należycie do tego przygotowani tzn, podsiadający odpowiednie wykształcenie, uposażenie finansowe, często popularni przed nominacją w oczach szlacheckich. Dla drugiego Wazy bardziej niż zapełnienie szkatuły liczyły się kwalifikacje danego urzędnika, korzyści szczególnie odrzucał przy rozdawaniu wakansów na urzędy wielkosenatorskie. Pomimo dobrej koniunktory na początku rządów , Władysławowi IV nie udało się stworzyć oddanego stronnictwa senatorów.Praca stanowi próbę odpowiedzi na pytanie jak senatorowie wywiązywali się ze swoich powinności na sejmie koronacyjnym z 1633 roku kiedy istotne stało się podjęcie szybkich decyzji, w związku z zagrożeniem zewnętrznym. Zaś sejmy z lat 1645-1647 ukazują jaka była postawa urzędników wyższych w momencie naruszenia przez króla praw Rzeczypospolitej.
During the reign of elective rulers, the Senate played a significant role as a parliamentary state. The senators, as members of one of the legislative chambers, guarded the rights of the Polish-Lithuanian Commonwealth and royal majesty. In the legislative process, they took part in the creation of new constitutions. This was particularly noticeable during the so-called conclusions. From royal’s perspective, the most important role the senators had to play was mediation between king and the noble brothers. Officials fulfilled this mission during various commissions, deputations, colloquia and provincial sessions. To create a dedicated group of regalia senators, who had the task of proudly representing him in the chamber of deputies, king used the policy of giving dignity. According to Wladislaw IV the ruling team should be created by people who are properly prepared for this -,had a proper financial education, and before nomination, in the eyes of nobility was poppular. For the second Vasa, the qualification of official’s was more important than the filling of the treasury, he particularly refused benefits when handing out vacancies for large department etc. Despite the good conditions at the beginning of the rule, Wladislaw IV did not manage to create a dedicated party of senators. This theisis is an attempt to answer the question of how senators fulfilled their duties at the coronation parliament in 1633, when it was important to make quick decisions in connection with external threats. Whereas the parliaments from 1645-1647 show what was the attitude of senior officials when the king violated the rights of the Polish-Lithuanian Commonwealth.

Just before the 2019 European Parliament (EP) elections many authors have indicated their exceptional nature. In this article the author attempts to analyze how these particular characteristics and fi rst decisions taken after the elections by the key EU level actors may shape the EU integration process in the coming years. The article focuses on how the fragmentation of the EP may infl uence the choice of the European integration directions in the near future. One of the first observed effects of this fragmentation was the failure of leading candidates system during the appointment process of the Commission President. Another one is Ursula von der Leyen’s political programme for the European Commission, built on the strong awareness of the need to create a governing coalition between the EP and the European Commission. Acknowledgment of the challenge of the EP diversity by the New Commission President may have a positive effect on the EU-level democracy, however with a decrease in the efficiency of the EP legislative process.

Election of Members of the European Parliament on Polish territory for the first time took place in 2004. This election is a historic moment, because Poland and Polish people for the first time we were able to choose their representatives to the European Parliament. For the first time will Parliamentarians have its European family, the structures of the Polish accession to the European Communities, so that we share responsibility for the further development and future of our Europe. The elections were conducted under the Act of 23 January 2004 – Elections to the European Parliament. The literature on this subject is small, they are mainly publications concerning mechanisms for passing laws and discussing its main goals. Existing data do not cover the whole subject, as appeared before the majority of the Ordinance implementing acts. I hope that my article although the closer the issue of electoral law and the holding of elections to the European Parliament, and will be for the reader an introduction to the handbook and knowledge for entry to the course of European integration, European communities law and will bring the functioning of the institutions of the European Union.

The article concerns an analysis of the types of positioning an electoral agenda adopted by the Polish political parties during the political campaign before the elections to the European Parliament in 2014. Positioning the electoral offer has been treated as one of the main elements of the electoral strategies of political parties, as the way of defining their electoral goals and identifying their strengths and weaknesses as well as opportunities and threats. The scope of analysis assumes main Polish political parties represented in the Polish parliament in the years 2011 - 2014 and additionally the party that managed to cross the entry barrier into the parliamentary market in the EP election in 2014.

This article discusses the problem of the definition of degressive proportionality. This term is used in many areas of economics but its meaning is not standardized. It is understood differently when related to tax issues compared to distribution of seats in the European Parliament. The differences are small but significant. The article provides and analyzes the different meanings of the concept of degressive proportionality and proposes to introduce two new concepts – concave degressive proportionality and convex degressive proportionality.

The European Union (UE) is a unique organization, the representative organ of which – European Parliament (EP) – is chosen in universe elections. It was established in 1951 under Treaty of Paris as the General Assembly of the European Coal and Steel Com- munity. The Rome Treaties, establishing the European Economic Community and the European Community of Atomic Energy, continued the idea of a representative body by creating the Assembly of the European Communities. In 1962 the members changed the name from Assembly to European Parliament. A new name was officially recognized by the European Single Act in 1986. At the beginning, the members of the Assembly were appointed by national parliaments, since 1979 they have been elected in direct elections in accordance with the national law of the Member States. The aim of this article is to analyze EP direct elections through depicting the process of their implementation, discuss the turnout and introduce a new proposal for the electoral system such as electronic voting (e-voting).

Opis:
The topic of this comparative study is the republican character of the system of governance in Kosovo. In the public discourse and political communication, as well as in academic discourse Kosovo is considered a Parliamentary Republic, based on the principle “of the separation of powers and checks and balances between them.” Although the constitutional definition of the relationship between the executive and legislative favors parliamentary republicanism, the constitutional powers of the president, the government and especially the constitutional and political power of the prime minister, significantly weaken the parliamentary character, in favor of a semi-presidential system. However, neither the current theories of government, nor constitutional provisions can rank Kosovo among semi-presidential systems, or pure parliamentary systems. Comparisons of competence powers relations in Kosovo, with similar relations and competences of the countries of the region and beyond, testify to the specific nature of parliamentary democracy in Kosovo. It is precisely the comparison of the Kosovo constitutional-legal system of governance with similar systems and theoretical analysis of parliamentary models facing Kosovo model which will be the basis of support of the hypothesis that Kosovo is not a typical parliamentary republic.

The Swiss political system is an extremely specific management model, unparalleled in practically any other country in the world. It is a unique parliamentary committee system. The only organs that directly legitimize the public are the lower and upper houses of the Swiss Parliament, known as the National Council and the Council of Cantons. Both chambers have extensive systemic powers unparalleled anywhere else in the world. There is a kind of „safety valve” in the Swiss political system. They are the citizens themselves, whose voices may challenge the decision of the representative bodies that are strong in the political system. The voice of the citizens is indispensable for the conclusion of the legislative process. However, the widespread use of forms of direct democracy also has negative repercussions.

Relations between Poland and the EU has been one of the key issues of political bargaining since 2015, leading to its significant politicization. Views on European integration became crucial between 2015 and 2023, during the rule of the Euro-sceptic Law and Justice Party and its right-wing coalition United Right, marked by multidimensional conflicts with the EU and its institutions, specifically over the rule of law in Poland. However, this Euro-sceptic government was ruling in a country where European integration was consistently highly supported by society. This chapter provides an overview of Polish representation in the European Parliament (EP). It discusses the place and main agenda of the Polish representation from its entry to the EP back in 2004 to 2023 and how its participation in the EP has contributed to (re)shaping the EP’s discourses on European integration. We first present the electoral patterns in the elections between 2004 and 2019 using the idea of the second-ordered elections. Despite the initial lack of interest of the general public, the European elections became an important element of the democratic landscape in Poland. Second, we present how Polish members of the European Parliament (MEPs) fit into European party groups and how they use their ideological orientations, national party interests, and competition in the domestic context to collaborate at the European level. The final part of the chapter reflects on how Polish MEPs have shaped discourses on European integration in the EP.

The topic of MA thesis is legal status of Deputy and Senator in the light of the Constitution of the Polish Republic from 1997. The work consists of four chapters. In the first is explained the concept of representation and parliamentary mandate is presented the history of mandate and is characterized the free mandate and the imperative mandate. Then is indicated the moment of acquisition of the representative mandate and are explained the reasons for its termination. The first chapter is completed with considerations that show the principle of incompatibility parliamentary mandate, by explaining the concept of incompatibilitas and to distinguish of two aspects of the incompatibility. The next chapter describes the guarantees of independence of Deputy and Senator. It explains the concept of material immunity, formal immunity and parliamentary inviolability. It also indicates differences between these institutions. The third chapter is dedicated to the rights and obligations of the members of the Parliament. At the beginning are the rights and obligations of parliamentarians performed both in and outside the Chancellery. Then are characterized the rights that guarantee the conditions of the implementation of the mandate of the parliamentary. The last chapter concerns the constitutional responsibility of Deputies and Senators. There’re analyzed the basics and the scope of this responsibility.
Tematem pracy magisterskiej jest status prawny posła i senatora w świetle Konstytucji Rzeczypospolitej Polskiej z 1997 roku. Praca składa się z czterech rozdziałów. W pierwszym z nich wyjaśniono pojęcie reprezentacji i mandatu parlamentarnego. Przedstawiono dzieje historyczne oraz scharakteryzowano osobno mandat wolny i mandat imperatywny. Następnie wskazano moment nabycia mandatu przedstawicielskiego oraz wyjaśniono przyczyny jego wygaśnięcia. Rozdział pierwszy zakończono rozważaniami przybliżającymi zasadę niepołączalności mandatu parlamentarnego, poprzez wyjaśnienie pojęcia incompatibilitas i rozróżnienie dwóch aspektów niepołączalności. Kolejny rozdział opisuje gwarancje niezależności posła i senatora. Wyjaśniono w nim pojęcie immunitetu materialnego, immunitetu formalnego oraz nietykalności parlamentarnej. Wskazano również różnice pomiędzy tymi instytucjami. Rozdział trzeci poświęcono prawom i obowiązkom członków parlamentu. W pierwszej kolejności przedstawiono prawa i obowiązki parlamentarzystów wykonywane zarówno w izbie, jak i poza nią. Następnie scharakteryzowano uprawnienia służące zagwarantowaniu warunków wykonywania mandatu parlamentarnego. Rozdział ostatni dotyczy odpowiedzialności konstytucyjnej posłów i senatorów. Przeanalizowano w nim podstawy tej odpowiedzialności oraz jej zakres.

The withdrawal of Great Britain from the European Union turned out to be important not only for the citizens of this country but for all Member States of the European Union. One of the important consequences of the notification of the withdrawal from the organization was to determine the constitution of the European Parliament taking into account variants of the moment when Brexit takes effect. The paper analyzes the impact of the UK’s withdrawal from the European Union on the conduct of elections and the appointment of seats in the European Parliament. This issue is presented primarily on the example of the elections held in Poland. The first part of the article discusses the procedure for the withdrawal of Great Britain from the EU and related problems. The second part is devoted to the impact of Brexit on the distribution of seats in the EP depending on the moment of Great Britain’s withdrawal from the European Union. The third part of the article examines problems associated with the procedure for indicating a Polish representative awaiting his mandate and his status.

The principle of degressively proportional distribution of seats in the European Parliament has been legally sanctioned under the terms of the Lisbon Treaty. Thus there appeared a solution which defied the perception of justice of distribution according to culturally shaped proportional allocation rules. Previous methods of determining the composition of collegiate bodies generally used the rule of proportional to the population of each constituency, composition of the legal body representing the society. On this basis, there are many socially accepted methods which have been tried and tested. In the field of electoral law regulations the rule of degressive proportionality is a new solution, and as such it still lacks tradition and already shaped approval that may justify its use. This article aims to find justification for this solution as opposed to the socially accep- table methods of distribution of goods and debts. In order to arrive at this argument the article reaches back to Aristotle’s philosophical concept, as well as solutions taken from the Talmud. It turns out that the degressive proportionality falls within the accepted concepts of equitable distribution. It offers an intermediate solution between equal and proportional allocation. There are also legitimate reasons for the use of degressively proportional rule in the process of allocating seats in the European Parliament. The problem is only the lack of unambiguity of the rule and the lack of precise reasoning to determine the boundary conditions at the level set in the Lisbon Treaty. This creates a very high degree of freedom of interpretation, leaving room for political negotiations on the acceptance of specific proposals. This situation has led to the point that, since the legal acceptance of the principle of degressive proportionality, the rule has not been applied in practice. Proposals for the composition of the European Parliament presented at the beginning of 2013 for the term 2014-2019 indicate that over the next five years exceptions to this rule will be approved. The second part of the paper presents proposals on solving the problem that can be found in the literature, as well as two other directions for seeking fair allocation. They cannot be deprived of discretion, as, of course, it is not possible to obtain conclusive decisions without the introduction of additional postulates. These postulates aim at clarifying the determination of the boundary conditions in such a way as to reduce the number of possible solutions or introduce an additional rule that will allow for an unambiguous (for a given population) specification of composition of the European Parliament. This is possible thanks to, inter alia, the ability to generate all feasible solutions. In this situation the solution of the problem is to select one out of a finite number of known divisions according to an established criterion. This frees the process of selecting the composition of the European Parliament from political considerations, and moves the weight of the debate to the ground of determining the said additional criterion. The current problem concerning the distribution of seats in the European Parliament is of course more general. The conditions that caused sanctioning of such a solution are of economic and social origin. It is expected that in the future the number of problems associated with allocation of goods, that are solved in this way, will be greater than they are currently. Undoubtedly, inequalities in various aspects of social existence favor the issue.

A study of the Euro-barometer performed at the end of January and beginning of February 2009 showed that not even 34% of the surveyed in all the 27 countries of the European Union declares the desire to cast their vote in the approaching election to the Euro-community. 15% of the respondents answered that they would de! nitely not vote in the coming election. The participation in the European Parliament Elections has fallen from election to election. This tendency persists and no signs of improvement of the situation can be seen. In 1994, 56.8% of the entitled to vote participated in the elections in all the member countries. Ten years later, only 45.6% of voters cast their votes. New member countries with low level of interest in European matters have considerably contributed to the fall in the level of legitimisation of the European Parliament.

These rights refer to active and passive electoral law with regard to elections to the European Parliament and to local self-government (commune). Electoral rights are treated as an institution intended only for Polish citizens. Thus there is a situation of incompatibility between the constitutional standard and the electoral rights of all EU citizens. This problem has been considered by the Polish Constitutional Tribunal, but due to its complexity and its systemic nature has not been resolved.

The salary of a Member of European Parliament is taxed on the same terms as salaries of officials and other employees of the European Union. Benefits related to exercising of a MEP mandate are tax free (exempt from EU tax). MEPs’ salaries, parliamentary allowances and other incomes are exempt from Polish income tax. The Polish domestic MPs’ salaries are taxed with a personal income tax as an income from employment. The parliamentary allowance and certain other benefits are exempt from the income tax.

Authentic interpretation of laws is an interpretation of legal provisions that, due to their lack of clarity or misinterpretation in their application, is provided by the parliament. Unlike the legislative procedure, which is conducted, as a rule, in two (exceptionally three) readings, a proposal for giving an authentic interpretation is discussed in one reading. Starting from the understandings of some authors that the act of authentic interpretation of laws is contrary to the principle of democratic pluralism, and that it lacks the necessary level of democratic control and citizen participation, the author examines whether the Croatian parliamentary law enables public participation in the procedure for authentic interpretation of laws and, if so, what legal instruments can be used to implement it in parliamentary practice. To this end, the paper analyzes several relevant constitutional, legal, and procedural provisions of the Croatian parliamentary law, with reference to a parliamentary practice. Given the fact that the procedure for authentic interpretation in the Republic of Croatia, the Republic of Northern Macedonia, the Republic of Slovenia and the Republic of Serbia is regulated in a similar way by the rules of procedure of their respective parliaments, the relevant regulations of the latter three countries on the possibility of public participation in this procedure are analyzed as well. It was concluded that Croatian parliamentary law enables public participation in the procedure for authentic interpretation, through the instruments of petition, information and involvement in working groups and working bodies, and the same instruments, with certain specifics, are recognized in the parliamentary law of the latter three countries.

Regulation of this matter is based on the specific division of lawmaking powers – in the Fifth Republic, which makes the government superior to the parliament. Although the change in the Constitution in 2008 greatly depleted the government’s prerogatives in the legislative procedure, it also imposed new obligations on the government to draft laws of better quality. The government is still the main actor in the legislative process. It is also responsible for ensuring progress in the implementation of EU legislation in France and for conformity of French national legislation with EU law.

Praca magisterska opiera się na aktach normatywnych, komentarzach do Konstytucji RP, podręczników omawiających zagadnienia z zakresu prawa konstytucyjnego, a także z artykułów zamieszczonych w publikacjach prawniczych.
The subject of my thesis is to present the legal and constitutional position of the Senate, in the light of the Constitution of 1997. The work consists of five chapters. In the first chapter were raised the functions of the Senate in the twentieth century to the recent adoption of the Constitution. The second chapter is a description of the organizational structure and the functioning of the Senate. In the following chapters there are presented: the problems of the function of the Senate, its role in the legislative process and the legal status of the senator. Master's thesis is based on the normative acts, comments on the Constitution, textbooks discuss issues of constitutional law, as well as articles published in legal publications.

The subject of the thesis is election campaign to the European Parliament in Poland in 2014. Elections that were held after almost two and a half year break, started the next election cycle. Therefore, they were treated by the parties as a test before national elections. The thesis contains an analysis of the parties’ actions during the election campaign, personal strategy of the party election programs, methods that were used and tools of political marketing. The role of the party leaders was also discussed as well as the burden of conducting the campaign. The current situation on the Polish political scene was taken into account and the relationship between the parties participating in the elections which had a crucial impact on the competition. The thesis is mainly focused on the foreground rivalry election between the ruling Civic Platform since 2007 and remaining in opposition Law and Justice. In the following part the campaigns of other committees were discussed that won the mandates, which is coalition Democratic Left Alliance – Labour Ynion, Polish People’s Party and Congress of the New Right.
Przedmiotem pracy jest kampania wyborcza przed wyborami do Parlamentu Europejskiego w Polsce w 2014 r. Odbywające się po prawie dwu i pół rocznej przerwie wybory, rozpoczynały kolejny cykl wyborczy. W związku z tym zostały potraktowane przez partie jako test przez wyborami krajowymi. Praca zawiera analizę działań partii w trakcie kampanii wyborczej, strategii personalnych partii, programów wyborczych oraz zastosowanych metod i narzędzi marketingu politycznego. Omówiono też rolę liderów partyjnych, na których spoczywał ciężar prowadzenia kampanii. Uwzględniono aktualną sytuację na polskiej scenie politycznej i relacje między partiami biorącymi udział w wyborach, co miało kluczowy wpływ na przebieg rywalizacji. Przede wszystkim skupiono się rozgrywającej się na pierwszym planie rywalizacji wyborczej między rządzącą od 2007 r. Platformą Obywatelską oraz pozostającym w opozycji Prawem i Sprawiedliwością. W dalszej części omówiono kampanie pozostałych komitetów, które zdobyły mandaty, czyli koalicji SLD-UP, PSL i KNP.

It is without any doubt that one of the most important elements of every democratic political system is a Parliament, that is, a collective authority elected in direct elections, which is simultaneously an emanation of will of citizens as a sovereign. Over the years of the technological development of societies and evolution of the economic cooperation amongst states, its role and scope of responsibilities have gradually grown. The European Parliament is one of the key elements of the institutional system of the European Union, and thus, the only body, the composition of which is elected in direct election. This body, as a forum for universal representation by the elected deputies from the member states, brings together views and positions not only of the representatives but also of their electorate. The parliament is also an expression of the multinational EU community, its voice and its desire to have influence on the fate of the entire EU. This article presents the evolution of the European Parliament and of the election law concerning this body, since its formation as an institution of the European Union until now. The purpose of this article is to present changes which have taken place in the EU legislation in respect of the electoral law, on the basis of which members of the parliament are elected, since the formation of the EP. The main subject of this article covers following issues: how the evolution process of the parliament has looked like over the years, how its position in the institutional architecture of the EU has been evolving and how it has been endeavoured to harmonize electoral procedures to this body over the years. The article is about the evolutionary political position of the EP. The article focuses on selected aspects of unification of the electoral procedure for the election to the EP due to their path-breaking character and importance of the procedure being currently in force.
Jednym z najważniejszych elementów przesądzających o demokratycznym ustroju państwa jest bez wątpienia parlament, czyli kolegialny organ wyłaniany z bezpośrednich wyborów, będący jednocześnie emanacją woli obywateli jako suwerena. Na początku parlamenty wypełniały mało skomplikowane zadania, były jedynie organem reprezentacyjnym. Z upływem lat, rozwojem technologicznym społeczeństw i ewolucją realiów ekonomicznej współpracy państw ich rola oraz zakres kompetencyjny ulegały stopniowemu wzrostowi. PE jest jednym z kluczowych elementów systemu instytucjonalnego Unii Europejskiej, a tym samym jedynym organem, którego skład jest wybierany w bezpośredniej elekcji. Organ ten, jako forum powszechnej reprezentacji przez wybranych deputowanych z państw wspólnoty, skupia poglądy i stanowiska nie tylko samych reprezentantów, ale również ich elektoratu. Parlament jest również wyrazem wielonarodowej społeczności UE, jej głosem i dążeniem do wpływania na losy całej UE. Artykuł przedstawia ewolucję Parlamentu Europejskiego oraz ordynacji wyborczej w wyborach do tegoż organu od początku jego kształtowania się jako instytucji Unii Europejskiej do chwili obecnej. Celem niniejszego artykułu jest ukazanie przemian, jakie od początku tworzenia się PE następowały w ustawodawstwie UE w odniesieniu do samego PE oraz do ordynacji wyborczej, w oparciu o którą wyłaniani są jego członkowie. Podstawową tezą przedmiotowego artykułu jest zagadnienie, jak wyglądał proces ewolucji PE na przestrzeni lat, jak zmieniała się jego pozycja w systemie instytucjonalnym UE oraz jak z biegiem lat dążono do ujednolicenia procedury wyborczej w wyborach do tegoż organu. Artykuł dotyczy ewolucyjnej pozycji ustrojowej PE. Skupia się na wybranych aspektach ujednolicania procedury wyborczej w wyborach do PE z uwagi na ich przełomowość i doniosłość w obowiązującej obecnie procedurze.

The migrant crisis in Europe, which reached its zenith in 2015, made EU politicians realize the urgent need for a more effective migration policy that would rely more on supranational cooperation. Absence of this policy triggers migrant influx to Europe, in particular of unqualified labour force, and enhances illegal migration from which organized criminal groups profit enormously. Moreover, uncontrolled migration processes give rise to a number of social, economic, political and cultural problems all across the EU, and thus nurture the Eurosceptic mood. This leads to societal negation of the European integration project and provides fertile soil to the spread of radicalism and xenophobia. The aim of the study is to capture the position of European Parliament on recent migrant crisis. The Parliament, a democratically legitimate body, which claims the right to represent European societies, advocates adoption of systemic EU approach to migration which should be based on the respect of human rights and creation of legal migration pathways for refugees and workers needed by Europe. The solution of the present migrant crisis is sought by the EP in moving towards a common, comprehensive European immigration policy and enhanced solidarity of EU member states in response to increased influx of refugees from conflict zones.

The author proves, that in Ukraine the level of political consolidation, when it would be possible to clearly define, whether a transition is completed or not, and what regime is firmly established in the state, is not achieved yet. Political players are far from confessing the inviolability of democratic rules of political game; there is a considerable threat of authoritarianism. Freedom House considers the Ukrainian state a free electoral state, not a liberal democracy. The judicial features of Ukraine in the democratization process are as follows: lack of fulfillment of one of the first tasks of the transition: replacement of elites; lack of legal culture of the authorities, their inability to realize the rules of governance; formal institutionalization; relative weakness of the basic opposition; slowness of the reformation and sustainable failure to perform the tasks of every stage of the transition; weakness and low legitimacy of democratic institutions, conjuncture reformation for party-group interests; gradual replacement of bits and pieces of the post-communist authoritarianism with the new oligarchic authoritarianism on the behavior level of some elite groups.

The paper refers to the essential problem of the European political space, namely the insufficient implementation scale of accountability standards, which has a direct effect on the democratization of the European political system, specifically on the democracy deficit. The paper was presented the accountability standard on the background on the EP election in 2014, with the strong focus on the relations between the voters and the EP candidates. In the analyses the factors characterizing the quality of political discourse were considered taking into account both, the electorate political activity (principal – in the meaning Principal-Agent-Theory), as well as the offer of the running politicians (as the agents).

Poland came up to the EU membership gradually, reorientation on the West in trade and economic sphere was accompanied by desire of establishing with them close political relations. After the Warsaw Pact expiration polish leaders had to decide also the question of safety concerning the incorporation in NATO, at that membership in EU and NATO was considered as the related key objectives of the foreign policy. In 1988-1993 years the democratic reform of the armed forces of Poland was characterized by the political forces unsuccessful attempts to achieve a certain visibility of macro-stablity and come to an agreement concerning control of the armed forces. Poland received an offer of cooperation with NATO within the program «Partnership for the sake of peace» in January 1994 at the summit in Brussels with other CEE countries. In 1999 year the Polish Parliament ratified the North Atlantic Treaty, demonstrating consolidated position of the political forces concerning that question. To the Council of Europe took a decision for the start of negotiations concerning the accession to the EU, Poland had to satisfy the political criteria, for execution of which, the consolidated position of the political forces concerning eurointegrational question had to exist. The application for membership in EU was made then, when the majority of places in parliament belonged to the political party, which had been created before the parliamentary elections in 1991 year from the political forces connected with the previous system. Already on July 16 of the 1997 year the „Agenda 2000”, which was presented at the meeting of European parliament, denoted that, the political institutes of Poland function stably and consistently, and the parliamentary elections in 1991 and 1993 years had been free. Poland was recommended to negotiations concerning its membership, and its accession to the European Union took place while the fourth parliament cadence was functioning, when the majority belong to leftist forces.

This paper aims to present a case study analysis of the condition of the electoral system in the Republic of Belarus after more than a quarter of a century of independence. The main purpose of the paper is to explain the discrepancies between legislation and practice. The author intended to note a real situation that dominates the country’s political scene in comparison to theoretical establishments. A Constitution of the Republic (created in 1994, with minor changes in 1996 and 2004) is the legal ground of the electoral system, however, procedural details were drawn up in the Electoral Code. The principles of Belarusian electoral code consist of some statements known from democratic models, such as universal suffrage, direct suffrage, secret ballot and equality. There are different types of elections in Belarus but the most important ones are presidential and parliamentary elections. Despite the detailed legal rules for conducting these elections, in fact, the principles of democracy, as well as the internal rules in Belarus, are not respected. Both presidential and parliamentary elections have shown this in recent years. Independent observers for a long time have been alarming about worrying electoral practices in Belarus. It is also worth emphasizing that since 1994, one man has been in power uninterruptedly, and Parliament has in fact a symbolic function. In the source materials, the author used Belarusian legal acts, analyses and reports, press notes as well as scientific papers.

Members of the European Parliament are entitled to a transitional allowance in the amount of their salary for the period of one month for each year in which their mandate has been exercised. In case of exercising the mandate of a Deputy to the Sejm of the Republic of Poland, the allowance should be reduced by the amount of the Deputy’s salary. Should a former MEP be entitled simultaneously to the payment of the transitional allowance and the old-age pension, he or she must choose one or the other. While exercising the mandate of a Deputy to the Sejm the European Parliament old-age pension is reduced by the amount of the Deputy’s salary.

The adoption of the draft regulation constitutes a further step in the development of the electoral procedure for elections to the European Parliament. It will replace the 1976 Council Decision and the Act concerning the election of the representatives of the European Parliament by direct universal suffrage annexed to that Decision. The authors set out concerns relating to, inter alia, the proposed institution of an EU-wide constituency and common provisions for election campaigns. Further doubts are raised regarding the proposal to fix uniformly the voting day for EP elections and the institution of a ‘temporary MEP’. In the draft position of the RP, the Council of Ministers “assesses the draft regulation negatively, due to the contradiction of some of the solutions proposed in the proposal with the legal order currently in force in the Republic of Poland”.

Praca magisterska porusza tematykę dwóch organów władzy ustawodawczej we Włoszech - Izby Deputowanych i Senatu. W pierwszym rozdziale pracy została omówiona Konstytucja Republiki Włoskiej. Kolejne rozdziały dotyczyły zasadniczego przedmiotu pracy magisterskiej, czyli przedstawienia istoty funkcjonowania parlamentu Republiki Włoskiej. Ostatni rozdział pracy został poświęcony omówieniu systemu partyjnego we Włoszech.
The master's thesis focuses on the two legislative bodies in Italy - the Chamber of Deputies and the Senate. At the beginning was characterised the concept the Constitution of the Italian Republic. The essence of the functioning of the parliament of the Italian Republic was described in next chapters. My final dissertation chapter concerned the party system in Italy.

Celem pracy jest identyfikacja modelu inkumbenta, czyli polityka, który najdłużej zasiada w Sejmie RP. Dla tej pracy istotni są posłowie i wybory parlamentarne, jakie odbyły się w Polsce w latach 1991 – 2011. Praca odpowiada również na pytanie, jakie relacje występują pomiędzy działalnością i wizerunkiem polityka, a jego wybieralnością do polskiego Sejmu. W odpowiedziach na powyższe pytania pomogła analiza zarówno cech personalnych, jak i instytucjonalnych inkumbentów. Praca składa się z części teoretyczne i badawczej. W pierwszej części opisano strukturę i funkcjonowanie Sejmu RP oraz podstawy marketingu politycznego. Empiryczna część pracy zawiera metodologię badań oraz analizę zgromadzonego materiału badawczego. Badania podzielono na dwie części: metryczkę (m.in. wiek posła, wykształcenie, miejsce pochodzenia i strategię polityczną (m.in. czynniki związane z wyborami, miejsce na sali sejmowej, partie polityczne).
The aim of this thesis is to identify the model od incumbent, that is a politician who sits in the Polish Parliament the longest. The most essential for this dissertation are Members of Parliament and parliamentary election held over the period 1991-2011. The thesis consists of theoretical and research part. The former includes structure and function of the parliament as well as the basics of the political marketing. The latter part consists of methodology of the studies and the analysis od the research material gathered. Research was separated into two parts: the imprint - inter alia politicians' age, their seat in the parliamentary hall, place of origin and political strategy - inter alia factors connected with election, seat in the PH and political parties

The paper presents an outline of Georgian parliamentarism and, subsequently, the institution of the Georgian parliament itself in the period between 1990 and 2013. The next section describes the structural position of the Parliament of Georgia by analyzing its Constitution of 1995, as well other acts of parliament. It also mentions the systemic principles, definition of sovereign authority, competence of the governing bodies of the state, the relationships between the President and the Government, as well as the existing internal organization and the scope of legislation. In the conclusion it is stressed that the structural position of the Georgian Parliament in the given period is similar to the position of parliaments in the presidential model of government.
W artykule omówiono zarys problematyki gruzińskiego parlamentaryzmu, ze szczególnym uwzględnieniem funkcjonowania Parlamentu Gruzji w okresie między 1990 i 2013 rokiem. Autorzy na podstawie zapisów Konstytucji z 1995 roku oraz innych ustaw przedstawili pozycję ustrojową gruzińskiego parlamentu. Nakreślili zasady systemowe i suwerena, omówili kompetencje poszczególnych organów państwa, relacje między prezydentem a rządem, zasady funkcjonowania i całą organizację procesu prawodawczego. Podsumowując należy podkreślić, że pozycja ustrojowa gruzińskiego parlamentu w omawianym okresie jest podobna do funkcjonowania parlamentu w klasycznym systemie prezydenckim.

The Development of public media in Latvia as a post-communist country has essentially been influenced by politicians. The political community has had consensus that certain reforms are necessary to ensure the development of public media given the changes in the communication space and its role in the facilitation of the strengthening of democracy, yet during the last fifteen years the political elite has not been able to come to a common agreement and to make decisions on systemic reforming and the development of public media. Since the communication environment has changed post digitalisation of television, the question about public media development and legitimisation has become increasingly topical. The aim of the study is to explore how the members of the parliament of Latvia (Saeima) position public service media (PSM) in Latvia and assess the public value of PSM. The theoretical framework for the research is based on the concept of public value „strategic triangle” (Benington & Moore 2011), which consists of three main elements: public value outcomes, the authorising environment and operational capacity. The study is based on qualitative research methods including 18 semi-structured interviews conducted with members of the Saeima in 2012 and 2013. The acquired data has been analysed by the principles of thematic analysis (Attride-Stirling 2001). Analysis of the interviews show that members of the Saeima recognise the need for public media to be independent whilst at the same time supporting a model in which public media is not supposed to have independent funding and they will continue competing with commercial media in the advertising market. High competition and resentment are characteristic features of the political elite in Latvia that apparently would also in future hamper the making of such decisions about public media that will facilitate their high-quality. Results of the research show the tendency for members of parliament to lack the necessary knowledge to formulate their opinion and to modulate relations of public media with society and their place in the overall media system in Latvia.

This article focuses on the issue of equality of elections, in the context of the 2014 European Parliament election in Poland. Most often the definition of principles of elections’ equality comes down to emphasizing its two aspects: the formal one and the material one. The first of them refers to guaranteeing each person with the active voting right the same number of votes. The material aspect of the equality principle is connected with striving to guarantee the same “voting power” to the election participants. Most briefly, it means that a given number of people elect as many representatives as another group with the same numerical strength. The main aim of this article is focus on the material aspect of implementing the principle of equality in EP elections. In the article will be emphasized three issues decisive for the specific features of the electoral system (electoral districts, election threshold and electoral formula), at the same time influencing the range of implementation of the material equality of elections. General findings will be confronted with empirical data, which will allow to formulate conclusions about the degree to which the European Parliament election conducted in Poland on 25th May 2014 met the principle of material equality.

As a cultural institution for debate on European history, the House of European History in Brussels is a perfect example for the complementary relation between history and the present, since its main aim, as it is being claimed, “gives visitors the opportunity to learn about European history and to engage them in critical reflection about its meaning for the present day”. The main focus of the article is the analysis of the speeches of German and Austrian MPs presented in the plenary debates of the European Parliament in spring 2011 on the expenditures on the building, in which the House of the European History is to be established. The focus of the analysis lies on the lexical level in order to prove the typical aspect of the political language in the European Parliament, which is the special mixture of various specialist languages.

Ensuring cyber security in scope of cyber defense is currently among the top priorities of the EU Common Security and Defense Policy (CSDP). Matters included in scope of cyber defense are a competence of the Member States and cooperation at EU level in this area is governed by decisions of the EU Council based on unanimity. This means that the European Parliament (EP) in the field of cyber defens acts only as an opinion-forming body expressing its position through the adoption of non-legislative resolutions. The aim of the article is to analyze the content of these resolutions and present the EP’s opinion on the challenges facing the EU in the field of cyber defense. It should be stressed that the EP is the EU body that strongly emphasizes the need for a common EU approach to these issues. Given that the area of cyber defence is subject to intergovernmental cooperation mechanisms, the EP considers that the EU needs to develop not only cooperation and coordination mechanisms at the level of its institutions, but also to take action to enhance the EU’s capability to counter cyber threats. These significant cyber defense capabilities should be essential elements of the CSDP and of the development of the European Defense Union, as it is becoming increasingly difficult to counter cyber attacks for the Member State level alone. The role of the CSDP should be to ensure that the EU, in cooperation with NATO, has an autonomous strategic capability to act in the field of cyber defense.

The systemic transformation in Poland affected virtually all spheres of the country’s social and economic life.One of its important elements was the restitution of the local government, which was both the object andthe subject of the transformation processes. This article aims to elucidate the relationship between the ideas of state, constitution, and Parliament in the Spanish constitutional debate of 1931. It argues that Members of Parliament (MPs) made a valuable contribution when understanding the relevance of this interrelation in terms of political philosophy and legal theory. From a methodological perspective, this study pays attention to the arguments of MPs in the course of the constitutional sessions which took place between August and December 1931. In doing so, it portrays the ideological differences of left-wing, centrist and right-wing parties in that constituent assembly. In the first section (“European influences on the Constitution of 1931”) the intellectual links with interwar trends of public law, administrative law and European constitutionalism are highlighted. The second section (“Constitution and Parliament according to Spanish representatives”), shows the meanings given to this nascent constitutional democracy by MPs. Despite their ideological differences they were in favour of strengthening Parliament and the Constitution as a prerequisite for safeguarding democracy. The conclusions resume the argumentative thread, that is to say, that the regime, a democratic republic, was understood by a large majority of MPs as the confluence of three conditions founded on doctrinal and conceptual exchanges from interwar European constitutionalism: the acknowledgement of parliamentary sovereignty, the legal and administrative revamping of institutions, and state intervention in the economy.

Podstawowym celem pracy magisterskiej jest zbadanie konstytucyjnych podstaw parlamentarnej kontroli nad działalnością wywiadowczą w Niemczech. W pierwszym rozdziale pracy przedstawiona została „tajność” jako podstawowa cecha działalności wywiadowczej i konsekwencje, jakie niesie ona dla funkcjonowania państwa demokratycznego. W drugiej części pracy został rozpoznany przedmiot kontroli – federalne służby wywiadowcze: Federalny Urząd Ochrony Konstytucji (Bundesamt für Verfassungsschutz, BfV), Wojskowa Służba Kontrwywiadowcza (Amt für den militärischen Abschirmdienst, MAD), Federalna Służba Wywiadowcza (Bundesnachrichtendienst, BND). W rozdziale trzecim poddano analizie znaczenie tradycyjnych środków parlamentarnej kontroli nad rządem w kontekście działalności wywiadowczej. W rozdziale czwartym przedstawiono szczególne środki kontroli nad służbami wywiadowczymi. Osobne miejsce poświęcono najważniejszym z nich: Parlamentarnemu Gremium Kontrolnemu, Komisji G-10 i Gremium Zaufania Komisji Budżetowej. Praca magisterska skupia się na kontroli parlamentarnej nad działalnością wywiadowczą na poziomie federalnym. Rozważania zostały oparte o analizę źródeł i dostępnej literatury przedmiotu.
The primary purpose of the MA thesis is to examine the constitutional basis of parliamentary oversight of intelligence activities in Germany. The first chapter presents "secrecy" as an essential feature of intelligence activities and its consequences for the functioning of a democratic state. Then, the second part describes the object of oversight - the federal intelligence services: Federal Office for the Protection of the Constitution (Bundesamt für Verfassungsschutz, BfV), Military Counterintelligence Service (Amt für den militärischen Abschirmdienst, MAD), Federal Intelligence Service (Bundesnachrichtendienst, BND). The third chapter analyzes the significance of general information instruments for parliamentary oversight. The fourth chapter presents specific measures of scrutiny of the intelligence services. A separate place is devoted to the most important: Parliamentary Oversight Panel (Parlamentarische Kontrollgremium PKGr), G 10 Commission (the G-10 Committee), and the Confidential Committee of the German Bundestag (Vertrauensgremium, VG). The thesis focuses on parliamentary scrutiny of intelligence activities at the federal level. The considerations are based on the analysis of sources and available literature on the subject.

The parliaments of Australia and Canada, as continuators of the British legal system, took over many of its precursor features which until now occur in the functioning of the parliament. This does not mean that they are a complete reflection of the current British legal system. Each of these parliaments in the present state have the characteristics that distinguish it from other parliaments. Parliament of Australia, although it is not a body that has a very long tradition, developed specific electoral system involving preferential vote counting system. When it comes to the Parliament of Canada the trait that distinguish it among other is the length of operation of senators (excluding, countries with roots in the common law) that could hold their office more than forty years. The parliaments of Australia and Canada are significant to the functioning of the legal system because the most import_ant functions have been passed to them by the legislature. These functions are: legislative function which consists of adopting-law, so that on which the whole country works, and the control function-having fundamental import_ance because it is the only entity parliament can control the government and all its activities. Parliaments are, as I mentioned derive from the common law system-and thus the features of this system are still visible, the authorities despite its prominence tradition developed a specific operation system, which is only suitable for them.e
Parlamenty Australii i Kanady jako kontynuatorzy brytyjskiego sytemu prawnego, przejęły wiele od swojego prekursora wiele cech, które do tej pory mają miejsce w funkcjonowaniu tych parlamentów. Nie znaczy to, że są one całkowitym odbiciem aktualnego brytyjskiego systemu prawnego. Każdy z tych parlamentów ma w dzisiejszym stanie cechy, które odróżniają go od innych parlamentów. Parlament Australii mimo, iż nie jest to organ, który ma bardzo długą tradycję wykształcił specyficzny system wyborczy polegający na preferencyjnym systemie liczenia głosów. Natomiast jeśli chodzi o parlament Kanady to cechą wyróżniającą go pośród innych tego typu organów jest długość funkcjonowania senatorów (oczywiście wyłączając kraje mające swoje korzenie w systemie common law), którzy swój urząd mogą sprawować ponad czterdzieści lat. Parlamenty Australii i Kanady mają centralne znaczenie dla funkcjonowania systemu prawnego ponieważ zostały im przekazane przez ustawodawcę najważniejsze funkcje. Tymi funkcjami są: funkcja ustawodawcza- polegająca na uchwalaniu prawa, a więc tego na czym funkcjonuje całe państwo, oraz funkcja kontrolna- mająca fundamentalne znaczenie, ponieważ to parlament jako jedyny podmiot może skontrolować rząd i wszystkie jego działania. Parlamenty te, tak jak wspomniałem wywodzą się z systemu common law- a co za tym idzie cechy tego systemu będą cały czas widoczne, to te organy mimo swojej niedługiej tradycji wykształciły specyficzny system funkcjonowania, który jest tylko dla nich odpowiedni.

Wine lobbying at the European Parliament: the Wine Intergroup in the mobilization against the planting rights’ liberalization.

This study aims at deepening the knowledge on the multi-level imbricated logics which led to the exceptional collective mobilization of national and European actors against the 2008 reform of the CMO-wine, which plans the planting rights’ liberalization. Since the entry into force of the Lisbon Treaty, the role of the European Parliament has been strengthened in the EU institutional balance – which upholds the role of its Wine Intergroup in the EU decision-making on wine issues. This Wine Intergroup is examined under various perspectives, outlining its unique composition, history and legitimacy, in order to consider whether it is a wine organized lobby within the European Parliament on this case study. It is a key forum to define and legitimize common positions on wine-related matters through a priviledged coalition of "wine MEPs" and wine organizations. This is why it is targeted by various interests, standing as a pivotal point, around which the EU stakeholders of the wine sector oscillate.

Celem niniejszej pracy była analiza procesu legislacyjnego w polskim parlamencie. Pracę tę rozpocząłem od przedstawienia hierarchii aktów prawnych w Polsce, dużo uwagi w tej części poświęciłem Konstytucji. Następnie zaprezentowałem źródła powszechnie obowiązującego prawa w naszym kraju. W swojej pracy starałem się przedstawić specyfikę postępowania ustawodawczego w Sejmie i Senacie. Dlatego też sporo miejsca poświęciłem w pierwszym rozdziale pojęciu „ustawa”. Opisałem tu dość szczegółowo wszystkie najważniejsze cechy ustawy i jej budowę. Właściwe rozwinięcie tematu mojej pracy nastąpiło w następnym rozdziale. Tu najpierw przedstawiłem i rozróżniłem funkcję ustrojodawczą i ustawodawczą polskiego parlamentu, później zająłem się definicja inicjatywy ustawodawczej oraz podmiotami, którzy takie prawo posiadają. W dalszej części zaprezentowałem organy Sejmu z Marszałkiem na czele, ponieważ jest on kluczową postacią w postępowaniu ustawodawczym w Polsce. Sejmowe postępowanie ustawodawcze – to właśnie o tym w moje pracy jest najwięcej. Moim celem było ukazanie w sposób jak najlepszy dość szczegółowo całego procesu postępowania z projektem ustawy w Sejmie. Przedstawiłem tu dogłębną analizę poszczególnych faz, poczynając od 1 czytania poprzez prace w komisjach, możliwości składania poprawek, kolejnego czytania aż do 3 czytania kończącego proces ustanowienia nowej normy prawnej. Sporo miejsca poświęciłem też specyficznym trybom ustawodawczym takim jak postępowanie z projektem pilnym czy projektem ustawy budżetowej. Żeby ustawa została prawidłowo ustanowiona niezbędny jest udział w tym procesie Senatu i Prezydenta RP. Właśnie to ich role i kompetencje w tej dziedzinie zaprezentowałem na kolejnych stronach. W sposób rozbudowany omówiłem tu finalne fazy procesu legislacyjnego. Weto Prezydenta jego rola oraz możliwość zwrócenie się do Trybunału Konstytucyjnego( który pełni doniosłą rolę w procesie stanowienia prawa , głównie jego orzeczenia) została przeze mnie opisane w sposób dość szeroki. W pracy tej omówione także zostały zagadnienia związane z wejściem w życie ustawy, rolą jaką pełni w tworzeniu prawa Trybunał Konstytucyjny , oraz wspomniałem również o ustawie o działalności lobbingowej z 2005 r. w procesie stanowienia prawa w Polsce.
The analysis of legislative process was at Polish parliament the aim of present work. I began from performance of hierarchy of legal acts work this in Poland, I dedicated in this part a lot of attention Constitution. I presented source universally valid right in our country then. I in my work tried to introduce at Lower house the specific of legislative conduct and Senate. I therefore dedicated place also sporo in first chapter notion "law”. Artykuł poświęcony jest trybowi powoływania rządu w Republice Chorwacji. Przepisy Konstytucji chorwackiej tryb ten określają w dość wąskim zakresie. W praktyce doprowadziło to do kryzysu rządowego po wyborach w 2015 r. Ostatecznie doszło do powołania rządu w tym czasie. Jednakże w toku stosowania przepisów konstytucji pojawiły się istotne problemy związane z interpretacją jej postanowień. Artykuł przybliża tę problematykę.
The article is devoted to the procedure of appointing the government in the Republic of Croatia. The provisions of the Croatian Constitution define this procedure in a rather narrow scope. In practice, this led to a government crisis after the 2015 elections. A government was finally formed at that time. However, in the course of applying the provisions of the Constitution, there were significant problems related to the interpretation of its provisions. The article brings this issue closer.

The author analyses the matter of the immunities to which Deputies are entitled in connection with their participation in the work of: the Parliamentary Assembly of the Council of Europe, the NATO Parliamentary Assembly, the OSCE Parliamentary Assembly, the Assembly of the Inter-Parliamentary Union and other international bodies of a parliamentary nature. He states that there is no uniform system of privileges and immunities for members of the various international parliamentary bodies who are Deputies. It is possible to waive the immunities enjoyed by virtue of membership of a particular parliamentary assembly. Immunities are always waived by that assembly. Its members may not waive them themselves.
