Opis:
The paper deals with the perturbations in social dialogue in Poland, and addresses the question of whether the formula of tripartite social dialogue introduced over 20 years ago has any future. The author claims tripartism in Poland has chronically suffered from internal imbalance due to instrumental approach of the government(s) towards social partners. A possible way out of the severe crisis of social dialogue and to opening of a new chapter could lead through civic dialogue, in a formula embracing a broader spectrum of actors such as NGOs. Trade unions and employer organisations face a dilemma of a strategic weight: whether to allow new actors to the negotiation table with a view of reviving the process or defending their current position as sole partners for the government risking the continuing agony of social dialogue and petrification of unilateral government policy.

Autor w pierwszej części artykułu przedstawia wartość obrotów towarowych handlu zagranicznego Polski, w latach 2007-2016, wskazując, że do 2014 roku import przewyższał eksport. W następnej części artykułu wskazano 30 najważniejszych partnerów handlowych, uwypuklając znaczenie państw należących do Unii Europejskiej, a szczególnie Niemiec.
In the first part of the article, the author discusses the value of Poland’s foreign trade in the years 2007-2016, indicating that by 2014 import exceeded export. In the second part of the article, the author analyzes the turnover of Poland’s foreign trade with thirty of the most important partners, paying particular attention to Germany – the most important partner. Poland, however, notes the most significant deficit in foreign trade with China.

While there is a clear tendency to address research of the ratio between change and development for very specific cases in comparison with the level of various countries, we think that we should go beyond such situation and focus rather on analysing and studying transition in former Communist countries. Such analysis could even lead to finding out the reasons for more attention being paid to change instead of development, but the influence of the tendency of the international partners in Albania and the entire region of the Western Balkan in favour of change and to the detriment of development has had its adverse and irreparable consequences.

Opis:
The main aims of this article are: a presentation of the theoretical framework for the analysis of the social pacts policy (taking into consideration that social pacts are phenomena which are very difficult to clearly define) and the presentation of the practice of this policy in chosen European countries (including three cases of “using” social pacts for the shaping of public policy, taking into consideration the fact that the form and content of social pacts vary from country to country). Social pacts are very special kinds of agreements between the representatives of the state and the interest groups. They can include various issues of social and economic policies, but they can also be used for solving economic difficulties and sustaining progress, including the development of the state. Social Pacts Policy is useful for a weak state and interest groups, which as a result of it can have an influence on public policy. Although, its application is not a facile process of agreement between the state and the social partners, it can have various forms and can include different goals of social and economic policies. Similarly, the range, institutionalisation and length of social pacts are not the same in all countries. Moreover, as the article indicates it refers to the economic, cultural and social circumstances, which can also cause the disappearance of the social pacts mechanism.

Opis:
The aim of the paper is to provide an analysis of the European Union's commitments towards social partners resulting from Article 152 of the TFEU. We are witnessing a serious assault on the regulations stated in Article 152 TFEU. Firstly, the EU violates the autonomy of the social partners through country specific recommendations addressed to the Southern countries, in which it expects the member states to breach the autonomy of the national partners by arbitrarily changing the rules of collective bargaining. Secondly, the EU does not provide sufficient support to the social partners in their efforts to create a social dialogue framework in those countries where, for historical reasons, the dialogue mechanisms have not emerged. A holistic reading of Article 152 of the Treaty constitutes a basis for action on the part of the European Commission which should not only be limited to supporting social partners at the European level but also extended to enhancing capacity of trade unions operating at the national level.

The article presents technological alliances as political activities, helping establish coalitions,co-opt supporters and eliminate rivals. Using the example of Microsoft’s and Google’s partner ecosystems, it discusses specific partnership techniques and their relevance for technology companies. The article offers a rich picture of developments of Microsoft Windows and Google Android platforms, combined with the steps taken by both companies to ensure support from partner firms. The effectiveness of financial, marketing and technological incentives as well as of deterrents depends on expected outcomes (such as: decreasing transaction costs, creating lock-ins, stimulating innovativeness or restricting development of competitive products) and technology life cycle stages. The article helps shape partnership strategies and optimize investments, needed to motivate and control partners.

At the turn of the twentieth and twenty-first century, a partnership gained considerable popularity in many jurisdictions. Adjusting the present company was different in different national, but there is one thing in common. It is the responsibility of the other limited partners for the obligations of professional partners arising out of the profession in that performs in a joint partnership. Adoption of a partnership under Polish law is a consequence of the work on the reform of the Polish commercial law and try to connect it with the EU law, as a result of the adjustment process to the conditions of Polish EU. Company law on the basis of the existing Commercial Companies Code of 2000 was introduced to the company in legal partnership, bringing together representatives of the professions, as a new type of company. Polish limited partnership structure has many of the characteristics of originality and independence, but to a large extent is based on solutions that come with French law, Austrian, Swiss, but most of all, you can fi nd patterns of German and American.

Opis:
This article discusses how restructuring during the crisis has affected employment relations in the banking sector in Luxembourg. The crisis has reinforced the impact of a series of exogenous factors influencing Luxembourg's banking sector and its continental employment relations system. These include the automatic exchange of information, rapidly-evolving European and international regulation and the resulting stronger compliance of banks, the mobilisation of external expertise by social partners, as well as stronger skills and professional requirements. It is argued that although these factors challenge the consensus-based and neo-corporatist employment relations framework, coordinated decentralization with strong government involvement in tripartite bargaining arenas has meant that the functioning of the employment relations system has been maintained. Collective bargaining has contributed to a socially-responsible restructuring in the banking sector through the anticipation and management by consenting to legally-based labour agreements and certified training for dismissed employees, as well as impact management through implementing transition support instruments.
