Opis:: Nowadays, there is a lot of research regarding two problems. One of them concerns a shaping of an identity in a period of adolescence and another one refers to aggression among young people. Researchers look for conditions of both phenomena in temperamental traits, personality, family, school, and peer environment specification. In the current research, attention was focused on a relationship between identity processes and entering a role of a perpetrator and a victim of aggression. An experimental group consisted of 167 adolescents aged between 16 and 17 years old. The following measurement scales were used: Mini-DIA (The Mini Direct Indirect Aggression Inventory, Österman, Björkqvist, 2008) and DIDS (The Dimensions of Identity Development Scale, Luyckx et al., 2008). The study’s results suggest a similarity in identity processes among girls and boys and a differentiating gender role in entering a role of a perpetrator and a victim. Moreover, there were identified significant relationships between an intensity of identity processes and experiences of a perpetrator and a victim.

Opis:: This master’s thesis describes all the causative forms of complicity under regulations of the Polish Criminal Code. The considerations contained in it refer to each of the forms of complicity in a crime referring to their premises, constitutive features as well as analysis based on specifically chosen examples.Beginning on the causative theories through specific forms of complicity, ending with criminal responsibility for each of these types, one can come to the conclusion that the legislator closed the catalog of causative forms of complicity and included in it every possible formation, or in other words the possibility of fulfilling the characteristic elements of a particular type of act offense.Referring to particular forms of complicity, it can be stated that the legislator wanted to express disapproval for illegal activities, being taken in a group in which people share tasks, that through individual behaviors lead to the completion in forbidden act. The paper explains reasons for which legislator created a well-conceived measure to bring to justice all those who participated in the accomplishment of a of a prohibited act. The introduction of the institution of the complicity the Polish Criminal Code allowed for a wider fulfillment of both rightfulness and preventive functions of the criminal law.In the feelings of citizens wanting to protect legal goods which are connected to practically every element of their existence, this is important to have a regulation which includes all of the possible forms of complicity in crime, even those that at the first sight might seem permitted and unpunishable, in order to bring all accomplices to justice and furthermore discourage future perpetrators from future actions.This master's thesis is a consideration of each of the grounds for regulating causative forms of complicity, analysis of the necessity of their existence in Polish criminal law and expression of a personal opinion, which is a civic voice on the usefulness of all these forms.
Niniejsza praca opisuje wszystkie postaci sprawcze przestępnego współdziałania istniejące na gruncie polskiego Kodeksu karnego. Rozważania w niej zawarte dotyczą każdej z form przestępnego współdziałania odnosząc się do ich przesłanek, cech konstytutywnych jak i analizy w oparciu o konkretne przykłady. Poczynając od teorii sprawczych poprzez konkretne już formy przestępnego współdziałania kończąc na odpowiedzialności karnej za każdy z tych typów działania przestępnego można dojść do konkluzji, iż ustawodawca zamknął katalog sprawczych form przestępnego współdziałania a także uwzględnił w nim każdą formację, innymi słowy możliwość na wypełnienie znamion określonego typu czynu zabronionego.Odnosząc się do poszczególnych postaci sprawczego współdziałania można stwierdzić, że ustawodawca chciał wyrazić dezaprobatę dla działań w grupie, w której osoby dzielą się zadaniami, aby poprzez poszczególne zachowania doprowadzić do dokonania czynu zabronionego. Praca wyjaśnia, że to bardzo dobry zabieg ustawodawcy w celu pociągnięcia do odpowiedzialności karnej wszystkich, którzy brali udział w realizacji danego typu czynu zabronionego. Wprowadzenie do polskiego kodeksu karnego figury współsprawstwa pozwoliło na szersze spełnianie funkcji sprawiedliwościowej jak i prewencyjnej prawa karnego. W odczuciach obywateli chcących chronić dobra prawne, które dotyczą praktycznie ich każdej strefy życiowej, te wszystkie figury sprawcze odnoszą się do wielu różnych możliwości popełnienia przestępstw i pozwalają na pociągnięcie do odpowiedzialności a więc także zniechęcenie przyszłych sprawców do działań planowanych przez więcej niż jedną osobę, które przy pierwszym odczuciu mogłyby się wydawać bezkarne. Opisywany wywód magisterski rozważa każde z tych podstaw do określoności sprawczych form współdziałania, analizuje konieczność ich zaistnienia w polskim prawie karnym a także wyraża osobiste zdanie, będące obywatelskim głosem na temat przydatności tych wszystkich form.

Opis:: The objective of the research conducted by the author was to obtain an answer to the question: could we distinguish different types of intrafamily violence perpetrators considering a specified profile of personality factors and temperament traits and how domestic violence perpetrators cope with stressful situations? The research was conducted on a group of 325 men who were convicted pursuant to article 207§1 & 2 of harassment over family members. In terms of a gender the group was homogenous. On the basis of the literature on the subject, the following personality traits of violence perpetrators were categorised: locus of control, self-acceptance, aggressiveness, hostility, intelligent quotient and temperament traits. The following research techniques were employed in the study: the Wechsler Intelligence Scale, Berger's Self-Acceptance Scale, the Delta Questionnaire by R. Drwal, the SABD Questionnaire - Buss-Durkee (prepared by J.M. Stanik, A. Roszkowska, J. Kucharewicz), Formal Characteristics of Behaviour - Temperament Inventory (FCZ-KT) by J. Strelau, the WCQ questionnaire (The Ways of Coping Questionnaire) by R.S. Lazarus and S. Folkman, a categorised interview and an analysis of court records. As a result of the analysis conducted on a group of the studied sample of violence perpetrators, four subgroups (clusters), differing in terms of selected personality traits, were specified. They are reactively aggressive perpetrators (113 persons), perpetrators of low preventive competences (71 persons), psychopathic and retaliatory perpetrators (66 persons) and perpetrators with a big adaptive potential (75 persons). Further on, four distinguished groups have been characterised in terms of stress-coping strategies, and psychological processes of coping with stress proceeded differently in the research group.

Tytuł:: The effect of providing descriptions of perpetrators on their identification by eyewitness and investigative bodies

Opis:: In two experiments, we analysed how different forms of verbalisation of the appearance of a perpetrator influenced future recognition of that perpetrator by witnesses and persons who had only been provided with a description of his appearance. During the first experiment, 75 participants watched a film showing a robbery, and then, depending on the group: 1) did not describe the perpetrator’s appearance, 2) provided a description, 3) described the perpetrator’s appearance, filling out a Face Rating Scale (FRS) which requires assessment of multiple characteristics of a face on rating scales. After two weeks, persons were supposed to recognise (identify) the perpetrator from among presented pictures. In the second experiment, participants (N = 50) received either a perpetrator’s description or a filled-in FRS scale and were also supposed to recognise the perpetrator from among presented pictures. Amongst persons who had seen the perpetrator, provision of a description did not reduce the number of correct identifications, but inclined persons to refrain more often from indicating someone. Among persons who had not seen the perpetrator, the FRS scale did not improve level of recognition when compared to a supplied description: in fact, unexpectedly, the opposite tendency was observed.

Opis:: Article concerns the issue of trace as a part of investigation, its importance for detecting crime and perpetrators. since the middle of 20th century, the palynological technique became a valuable source of information. For these reasons, the paper focuses mainly on the judicial (forensic) palynology. Briefly the phenomenon of pollen and spores spectrum is presented, ways of its’ analysis, the value of obtained results and the scope of application. Examples of inquiry and judicial practices are given, although not only limited to the usefulness of palynology in investigations. In addition, scientific methods of palynology and the verification procedure are indicated.

Kobieta - sprawczyni zabójstwa.

Opis:: The main purpose of this thesis is the attempt to indicate the distinctive features of murders committed by women.The theoretical part covers issues related to the content of murder, reason of commitment and legal aspects connected with this type of crime. It also presents issues of delinquency among women. It contains detailed analysis of specific of the murder committed by a woman in which the characteristic of the perpetrator herself, was taken into account, motives directing undertaken by her activity and ways of committing crimes by them. In this thesis several portraits of women, who became famous due to the crimes committed by them, are presented.The second part of the thesis contains results of the research conducted by the author, where some crimes perpetrated by women were taken into consideration. The purpose of this research was to verify the assumptions presented in the first part of this thesis, related to the specific characteristic of this type of crime.
Celem niniejszej pracy jest próba wskazania charakterystycznych cech zabójstw dokonywanych przez kobiety.Część teoretyczna pracy obejmuje m.in. zagadnienia dotyczące istoty zabójstwa, przyczyn jego popełniania oraz aspektów prawnych związanych z tego rodzaju przestępstwem. Przedstawia także problematykę zjawiska przestępczości wśród kobiet. Zawiera szczegółową analizę specyfiki zabójstwa dokonanego przez kobietę, w której uwzględniono przede wszystkim charakterystykę samej sprawczyni, motywy kierujące podejmowanym przez nią działaniem oraz sposoby dokonywania przez nią zbrodni. W pracy ukazane są również sylwetki kilku kobiet, które stały się sławne dzięki popełnionym przez siebie zbrodniom.Drugą część pracy stanowią wyniki badań przeprowadzonych przez autorkę, w ramach których analizie poddano konkretne przypadki zabójstw dokonywanych przez kobiety. Celem niniejszych badań była m.in. weryfikacja założeń przedstawionych w pierwszej części pracy, dotyczących specyficznego charakteru tego rodzaju zbrodni.

Opis:: A frequent reason for women remaining in harmful, abusive relationships is mainly fear of revenge, losing children, sense of guilt and erroneous conviction on abuse. Financial dependence and a lack of familiarity with forms of assistance and available support force a woman to remain in a disordered relationship, sometimes running afoul of the law. Sometimes it is the case that during yet another bout of abuse they reach for any object at hand and give a fatal blow to their torturer-the worst and at the same time the saddest scenario. Both options result in “the end” of one suffering-experiencing violence and the onset of another one related to serving a custodial sentence. In this article I would like to signal that some life paths combine those two awful experiences implying an absence of support of the immediate environment as well as of institutional support by entities whose responsibility it is to provide help.
