According to Art. 9 sec. 2 of Regulation (EC) No.861/2007 of the European Parliament and of the Council of 11 July 2007 establishing a European Small Claims Procedure, the court or tribunal may allow written evidence from witnesses, experts or parties to be taken. The Regulation applies to cross-border cases (Regulation of 11 July 2007), i.e., cases in which at least one of the parties is domiciled or habitually resident in a Member State other than the Member State of the court or tribunal examining the case (Article 3). On the other hand, the Act amending the Act - Code of Civil Procedure and some other acts of 5 December 2008 added Art. 505 25. Pursuant to § 1 of this provision: The witness shall testify in writing if the court so decides. In this case, the witness shall make an oath by signing the text of the oath. The witness is obliged to submit the text of the testimony to the court within the time limit set by the court. The provisions of art. 165 § 2, art. 274 § 1 and art. 276 shall apply accordingly. As indicated in the justification for the draft of this legal act: Due to the fact that Polish law does not know the written form of testifying by witnesses and hearing the parties (the exception applies to mute and deaf people, cf. Art. 271 § 2 of the Code of Civil Procedure; this provision applies accordingly to hear the parties pursuant to the third sentence of Article 304), it was necessary to introduce appropriate regulations in this respect applicable to the European Small Claims Procedure.

Our approach to the liar paradox is based on the Wittgensteinian approach to semantic and logical paradoxes. The main aim of this article is to point out that the liar sentence is only seemingly intelligible, and that it has not been given any sense. First, we will present the traditional solutions of the paradox, especially those which we call modificational. Then we will determine what the defects of these solutions are. Our main objection is that the modificational approaches assume that we can express in languages certain senses which are improper. Next, we will explain why we think that the liar sentence is a mere nonsense. This sentence does not have any role in any language game – it is completely useless. We will also respond to several objections to our approach. 1. That it is not consistent with the principle of compositionality of sense. 2. According to the Quineian philosophy of logic, paradoxical sentences can be conceived as false assumptions leading to crises of logical paradigms. 3. The liar sentence seems to be, contrary to our approach, intelligible.

The article examines the mechanisms of personnel motivation that affect the work of the company's employees. Today, company managers need to solve various tasks, and most importantly, how to achieve the strategic goals of the company's activities and retain valuable employees for the company and improve their work performance. One of the ways to solve this issue is to build an effective system of motivating the company's personnel. The main focus of the study is on the formation and improvement of the mechanism of motivation of the company's personnel, which includes economic, social and psychological laws of influence on the behavior of employees. It is proposed to use the basic principles of motivation, methods of motivation, which effectively affect the improvement of the efficiency of the labor activity of employees and the achievement of the company's goals. The proposed personnel motivation mechanism is a prerequisite for increasing labor productivity and has a positive effect on the efficiency of the company's activities and the achievement of set goals.

In the article it was shown how Henri Bergson and Franz Rosenzweig understand love, as a principle, which actualise in the double context: as a me¬ta¬physical and ethical principle. Love in its first context actualises as a me¬taphysical principle, as a principle of originate life in toto, in the second it is a regulatory of social life of human beings. In its first context it was ex-pressed as love of God to man, whereas in the second as man’s love to God. God’s love and its metaphysical character expresses in creation/the gift of existence received in the power of loving the other man, whereas we- humanity- response on God’s love in voluntary acts of other’s love. There-fore this love has the ethical character as well.

Up to the end of the World War I, the foundation of German constitutionalism was the monarchical principle. For many 19th‑ century state and law theoreticians in Germany this principle was indeed synonymous to constitutionalism. Constitutionalism itself, in turn, was commonly identified with the contemporary monarchical system of German countries. On the other hand, the foundation of the constitution enacted in August 1919 in Weimar was the principle of democracy, which was set out in the Art. 1 of the constitution as the principle of the sovereignty of the nation. The principle of democracy took a specific form in the Weimarian constitution, combining direct democracy with representative democracy. The elements of the direct democracy were people’s initiative and referendum. The representative democracy, on the other hand, was realized by means of citizen rights with regard to the election of deputies to the Reichstag and the president of the German Reich. Due to the lack of appropriate democratic traditions and a complex social and political situation of the Weimar Republic, the democracy did not gain a foothold in Germany. Neither the mechanisms of direct democracy nor the ones of representative democracy passed muster with the voters. The referendum was held twice, however due to the low electoral turnout it was not valid. Also, the presidential election was conducted twice, and it was won by the opponent of parliamentary democracy, the marshal Paul von Hindenburg. In contrast, the results of parliamentary elections usually resulted in the political split of Reichstag. Yet, up to the beginning of 1930s new governments managed to be set up, which were supported by the parliamentary majority. In the final years of the Weimar Republic, however, such a possibility did not exist. A habit was formed of convening the so‑ called presidential cabinets. These were the governments convened by the President which took advantage of his support, and their activity was enabled by the President’s emergency powers specified by the Art.48, par. 2 of the constitution. It turned out that the actual demise of Weimarian democracy was the takeover of the government by Adolf Hitler in January 1933 as a consequence of the electoral success of his Nazi Party.

We show a somewhat surprising result concerning the relationship between the Principal Principle and its allegedly generalized form. Then, we formulate a few desiderata concerning chance-credence norms and argue that none of the norms widely discussed in the literature satisfies all of them. We suggest that the New Principle comes out as the best contender.

The fundamental holographic principle is first proposed, then demonstrated in its validity and viability through a thought experiment and then finally derived. The Heisenberg uncertainty relations are shown to follow from this fundamental relation. The quantum blackhole entropy is then demonstrated using this holographic uncertainty relation along with the application of the Landauer’s principle for the thermodynamic erasure of a bit yielding a formula with a logarithmic correction. The blackhole entropy is found to be half the value normally delivered by any other method. So, it is proposed that there is a real relevant physical horizon at the twice the Schwarzschild radius dubbed the holographic information geometric horizon.
