Rozważania rozpoczynają się historycznym zarysem regulacji prawa cytatu ukazując tym samym w jaki sposób wydarzenia historyczne miały wpływ na kształtowanie się prawa autorskiego w tej kwestii. Dalsze rozważania poświęcone są regulacji prawa cytatu w aktualnie obowiązującej ustawie oraz przedstawieniu cytatu występującego w różnej postaci w poszczególnych dziedzinach twórczości.

Opis:: Our study deals with relatively short statements embedded in semiotically complex digital messages, both pictorial and verbal, which are created and exchanged by Internet users thanks to on-line generators. These messages are called internet memes (IM). We treat them as a new kind of on-line speech (determined by the so-called participatory web 2.0 digital medium), semiotically heterogeneous (both graphic and verbal in nature), putting into circulation comments on events and especially on the political word (slogans, catchphrases, slip of the tongue). These IM are subject to various verbo-graphic mutations. IM are thus endowed with a content that takes the form of a micro-political commentary, lapidary, playful and carnivalesque (Bakhtine 1970), characterised by a form of argumentation that can be said peripheral, because it refers more to the political person than to the political issues themselves (Gauthier 1992 et 1995, Amossy 1999, Perelman and Olbrecht-Tyteca 1970). IM are peripheral micro-argumentation acts of descriptive character, the impact of which is cumulative. In our study, we show that the funny side of the memes is a complex verbo-pictorial strategy centred on big political actors and based on the ad hominem arguments.

Opis:: The article is a part of outcome from a research project carried out by the author and devoted to quotations in Polish media and mass communication after 1989. The present elaboration includes an analysis of journalistic information, viewed as a particular kind of journalistic communication distinguishable from column writing due to its specific functions. A number of monographs and text books devoted to the development of the writing skills required for producing media texts are examined to single out those properties of journalistic information that the authors consider to be the most important. Within the context of the indications obtained in the process and the factographic pact between the author and the reader as it has been described by Zbigniew Bauer, the functions of quotation in direct speech are discussed. An attempt has been made to introduce a classification of persons using journalistic text in their presentations, while one of the their categories, a participant of described events, is examined more thoroughly.

Opis:: Jak wskazał Lawrence Lessig, żyjemy w czasach „kultury remiksu” – powszechny dostęp do Internetu, a przez to do wielu dóbr kultury, sprawia, że artyści często przerabiają lub w inny sposób wykorzystują twórczość innych osób. Jest to szczególnie widoczne w muzyce. Celem niniejszego artykułu jest wykazanie, że sampling muzyczny jest co do zasady zgodny z polskim prawem autorskim. W badaniach wykorzystano przede wszystkim metodę dogmatyczną, dokonując analizy przepisów ustawy o prawie autorskim i prawach pokrewnych regulujących pojęcia utworu i inspiracji oraz instytucję prawa cytatu. We wnioskach wskazano, że sampling muzyczny w wielu przypadkach nie narusza prawa autorskiego, ponieważ polega na wykorzystaniu nietwórczego (niechronionego) fragmentu utworu pierwotnego. Natomiast w pozostałych sytuacjach, tzn. wtedy gdy uzna się, że dany sampel jest jednak objęty ochroną prawnoautorską, przeważnie dopuszczalne będzie jego wykorzystywanie w ramach prawa cytatu. Niemniej powyższe twierdzenia nie oznaczają, że sampling stanowi w każdym przypadku działanie etyczne lub moralnie uzasadnione.
As Lawrence Lessig pointed out, we live in times of ‘remix culture’ – as a result of universal access to the Internet, and thus to many cultural goods, artists often remake or otherwise use the work of other people. This is especially common in music. The purpose of this article is to show that music sampling is generally compliant with Polish copyright law. The research mainly used the dogmatic method, analysing the provisions of the Act on Copyright and Related Rights regulating the concepts of work and inspiration, as well as the institution of the right to quote. The conclusions indicate that music sampling in many cases does not infringe copyright because it consists in the use of a non-creative (unprotected) fragment of the original work. In other situations, when it is considered that a given sample is protected by copyright protection, it will usually be permissible to use it under the right to quote. Nevertheless, the above statements do not mean that sampling is always ethical or morally justified.

Sampling a prawo autorskie

Opis:: The following work focuses on copyright analysis of musical works which are made by using someone's else sound recordings. Sampling raises a lot of controversy in the copyright law. It is mostly related to the thin border between the musical plagiarism and the copy of a music sample within the law. The first part of the work presents a cultural and historical context of sampling and its evolution. The next part contains an analysis of the components which create a musical composition such as text, melodic, harmonic and rhytmic layer, in relation to copyrights. The fird, final part of the paper deals with the legal frameworks in which it is possible to grasp the works using the sampling technique. Most of the theoretical aspects of both the structure of the musical composition and the legal area in which the concept of sampling can be taken are exemplified by quoting judgments from Polish and American judiciary.
Przedmiotem niniejszej pracy magisterskiej jest prawno-autorska analiza utworów muzycznych, których częścią są recypowane fragmenty nagrań dźwiękowych pochodzące z innych dzieł. Proces samplingu, bo tak nazywa się technika wykorzystywania cudzych utworów muzycznych, budzi wiele kontrowersji na gruncie prawa autorskiego. Związane są one głównie z cienką granicą jaka leży między muzycznym plagiatem, a skopiowaniem fragmentu utworu pozostając w granicach prawa. Pierwszą część pracy stanowi przedstawienie kontekstu kulturowego samplingu oraz jego ewolucji na tle historii. W następnej części zawarta jest analiza poszczególnych elementów składowych utworu muzycznego, czyli warstwy tekstowej, melodycznej, harmonicznej i rytmicznej, w relacji do praw autorskich. Trzecia, ostatnia część pracy dotyczy ram prawnych w jakie można ująć utwory powstałe przy wykorzystaniu techniki samplingu. Większość z teoretycznych aspektów zarówno struktury utworu muzycznego, jak i prawnego obszaru w jaki można ująć pojęcie samplingu poddane będzie egzemplifikacji poprzez przytaczanie orzeczeń z polskiej oraz amerykańskiej judykatury.

Po kolei analizując przesłanki występujące w art. 29 pr. aut. dochodzi do wniosku, że czynnikiem, który wpływa na prawną dopuszczalność cytatu, jest jego funkcja i cel, który pełni w utworze. W podsumowaniu w sposób syntetyczny wskazuje na wszystkie problemy i stara się udzielić odpowiedzi na postawione pytania.
In the article the author succinctly points out the basic problems connected with the size of the quotation and its influence on the legal admissibility of using this form of fair use in Polish copyright law. In turn, by analyzing the premises of Article 29 polish copyright code it concludes that the factor that influences the legal admissibility of a quote is its function and purpose, which is fulfilled in the work. In summarizing in a synthetic way, the author point out to all the problems and try to answer the previous questions.

Niniejsza praca dotyczy problematyki ochrony twórczości poza zakresem prawa autorskiego oraz związanej z nią możliwości stosowania kodeksu cywilnego. W pierwszej części omówiona została definicja utworu oraz jego ochrona w prawie autorskim. Przedstawione zostały również przesłanki, które nadają utworom ochronę lub wykluczają je spod jej stosowania. Niniejsza praca zawiera analizę statusu twórców i współtwórców w prawie autorskim. Kolejnym punktem pracy jest możliwość wykorzystywania chronionych utworów oraz ich fragmentów, w szczególności w ramach prawa cytatu. Podane przykłady dotyczą aktów normatywnych oraz dokumentów i materiałów urzędowych. Ostatnia część pracy stanowi porównanie regulacji dotyczących ochrony twórczości na podstawie kodeksu cywilnego oraz ustawy o prawie autorskim i prawach pokrewnych. Zaprezentowane zostały odmienne poglądy na temat relacji pomiędzy przedstawionymi regulacjami oraz ich wspólne funkcjonowanie w systemie prawnym.

The article aims to synthesize the representation of the right of quotation on the basis of different legal orders. The author presents this regulation in French, German, British and United States law. The provisions governing the right of quotation in France and Germany are subject to comparison with those of the Polish Copyright and Related Rights Act. The legal order relating to the United Kingdom and United States citation was presented autonomously for the sake of a completely different common law system

Opis:: This article concerns the nature of the pattern and extent of referring to the convention in opposition to the originality of the creator being part of a trend of historical novels. The basis of this article is a historical novel by Jacek Komuda entitled “Bohun” (Lublin 2012) juxtaposed with “Trilogy” by Henryk Sienkiewicz. The comparative analysis is based on text linguistics tools, and above all on two criteria of textuality: intentionality and intertextuality. The combination of the writing workshops of two novelists is motivated by the genre (historical novel), setting in the reality of Sarmatian Poland and source base. However, a very clear division between both texts is the understanding of literary elements in historical novel, and thus the approach to historical truth. The irony mentioned in the title can be seen in conscious opposition to the proposed by Sienkiewicz and strongly rooted in Polish readership tradition pattern of historical novel written for “spirit lifting” and thus in a negative reflection of the ideological concept of Sienkiewicz. This is done by selecting the main themes of the novel – natural history of the Polish army, a negative image of the Polish gentry and ennobling image of the Cossack. The similarity between the two texts is reflected in the language realisation. In the novel by Komuda linguistic elements common in Sienkiewicz are present, specific and reproducible, obtaining the status of so-called “winged words” repeatedly documented by lexicographers by quotes from Sienkiewicz.
