Opis:: On the basis of the Polish law of entrepreneurs, a competency dispute arose between the Minister of Digitization and the President of the Office of Personal Data Protection. Both authorities deem it appropriate to interpret GDPR. The Minister of Digitization believes that he is authorized because of the rights to create a policy in the field of personal data protection. The President of the Office for Personal Data Protection believes that he is authorized as a supervisory body according to GDRP and the competent authority for the protection of personal data. Due to the fact that the GDPR is an act of a higher rank than the Polish law, it is necessary to admit to the supervisory body that it is the only person entitled to a binding interpretation of GDPR regulations.

AN UNEMPLOYMENT A YOUNG PEOPLE IN AGED 18 - 25 YEARS IN THE PERIOD 2002-2012 IN THE EXAMPLE OF DISTRICT NOWY SACZ

Opis:: The thesis presents the problem of unemployment among the young people in the age between 18 and 25 in the Nowy Sącz district. The key concepts, for instance the functions and types of unemployment, associated with that issue are explained and depicted. Furthermore, the project presents the variety of barriers to young people’s professional career. Based on the survey conducted on a representative sample of 100 people under the age of 25, including 50 unemployed people and 50 students, examined the main causes of youth unemployment. The specialized literature in economics and sociology, publications of the Central Statistical Office of Poland and the Statistical Office of the European Union ”Eurostat” as well as legal acts have been used in the process of writing of the thesis.
W pracy przedstawiono problem bezrobocia występujący wśród ludzi młodych w wieku 18 – 25 lat w powiecie nowosądeckim. Wyjaśniono najważniejsze pojęcia z nim związane. Opisano funkcje i rodzaje bezrobocia. Omówiono najczęstsze bariery oraz ograniczenia stojące na ścieżce kariery młodych ludzi. Na podstawie ankiety przeprowadzonej na reprezentatywnej próbie badawczej 100 osób poniżej 25 roku życia, w tym 50 bezrobotnych i 50 studentów, zbadano główne przyczyny bezrobocia ludzi młodych. W niniejszej pracy wykorzystano specjalistyczną literaturę z zakresu ekonomii i socjologii, publikacje Głównego Urzędu Statystycznego oraz Europejskiego Urzędu Statystycznego „Eurostatu”, a także akty prawne.

Tytuł:: Hidden strategy of open intellectual capital acquisition : a case study of innovative, software-developing SMEs

Opis:: Existing studies into information technology (IT) agile project management (APM) focus on describing the mechanism of how this process should be executed. The distinctive feature of the extensive literature on the subject is the consensus on the events and stages included in APM processes and maintaining discipline in their execution. However, a study of open intellectual capital acquisition (OICA) in innovative small and medium-sized enterprises in Poland that develop software (2009–2023) reveals the presence of an OICA stage in the events of the IT APM process, which is missing in the existing literature on the subject. The current study reveals that OICA is based on strategy. This strategy is inherently incorporated into the mechanism of APM. Moreover, the study shows that artificial intelligence and machine learning are increasingly used in this strategy, which makes it innovative. This text aims to present the results of the study, focusing on identifying and describing the strategy of OICA as an integral component of the IT APM process.

Opis:: Celem artykułu jest analiza i usystematyzowanie normatywnych podstaw określenia podmiotu uprawnionego z tytułu praw własności intelektualnej do wytworów intelektualnych tworzonych na uczelniach. Przedstawione w nim zostały zasady nabycia praw autorskich oraz praw własności przemysłowej przewidziane w obowiązujących, ogólnych regulacjach z tego zakresu, z uwzględnieniem szczególnych zasad określających tryb nabycia praw i komercjalizacji wyników badań naukowych i prac rozwojowych oraz know-how związanego z tymi wynikami, przewidzianych we wprowadzonych nowelizacją z 2014 r. przepisach ustawy – Prawo o szkolnictwie wyższym.
The aim of the article is to analyse and review legal grounds for determining an entity owning intellectual property rights to intellectual creations performed at universities. The article presents rules for acquiring copyrights and industrial property rights provided in binding IP regulations, with a special consideration to specifi c rules applying to results of research and developments works, provided in the amendment of 2014 of the Law of the higher education.
