Restrictive interpretation (interpretatio restrictiva) - Autorzy:
- Próchnicki, Maciej
- Opis:
- Restrictive interpretation as the inversion of extensive interpretation remains a marginal problem in the literature. This may be due to three factors: the symmetry thesis – the belief that the restrictive interpretation is a simple counterpart of the extensive interpretation; the greater importance of the practical application of the canons prohibiting the use of the extensive interpretation as compared to the rarely proposed limitations of the restrictive interpretation; and the controversy arising from going beyond the scope of the law (absent with restrictive interpretation). These issues become apparent in the thought of Jerzy Wróblewski (who adopts symmetry) and Alf Ross (who assumes asymmetry). The asymmetry of restrictive vs. extensive interpretation manifests itself primarily in the absence of a counterpart to the prohibition of interpretation of exceptions, and the specificity of applying a given interpretation in different branches of law.
