Opis:: The article focuses on the role of state purchasing policy as the primary aim of public procurement in Poland, considering its key aspects and impact on various spheres of economic activity. It presents detailed analyses of strategic objectives, legal regulations, and implementation practices, demonstrating the complexity and signiﬁcance of this process for the way the public procurement market functions. The main research objective of the article is to understand the role that state purchasing policy plays in shaping the structure of the public procurement market and its impact on the efficiency of public expenditure and the economic development of the country. Through the analysis of empirical data and observations gathered from various sectors of the economy, the article seeks to illustrate how effective purchasing policy can support market competitiveness, fostering innovation and entrepreneurship development. The article analyzes the state purchasing policy as a key goal of public procurement, and presents its impact on the economy, competitiveness and sustainable development, emphasizing the efficiency, transparency and innovation of procedures.However, the article not only highlights the positive aspects of purchasing policy but also identiﬁes challenges associated with it. Among them are combating corruption, ensuring the transparency of processes, and promoting fair competition. The ﬁndings presented may serve as a valuable source of information for political decision-makers and practitioners involved in public procurement management, aiming to improve the Polish public procurement system in the context of changing economic and social trends on the international stage.

Opis:: The involvement of the public authorities in socio-economic processes serves to achieve the objectives of the adopted policy of the State (or, respectively, the European Union). The state’s policy devised to foster socio-economic development is an instance of active state interventionism. In Polish legislation, this policy has been defined by the legislator as development policy. The aim of this paper is to demonstrate that public procurement is an instrument for achieving the strategic objectives of the development policy, thus drawing on the concept of ‘strategic use of public procurement’: a particular notion of the role of public procurement in the context of the strategic approach to development. One of the premises here is that a specific public goal – whose achievement is desirable from the standpoint of public procurement law – should serve to achieve the strategic objectives of development policy law. The article underscores the instrumental (albeit crucial) nature of public procurement with respect to state policy. For the purposes of the study, it was assumed that failure to appreciate the essence of using public procurement in the pursuit of strategic development objectives will adversely affect the consistency of public objectives and, consequently, result in incoherent actions. In this context, the author assesses the provisions of the Public Procurement Law, which provides the grounds for the adoption of the national purchasing policy that emphasizes the relevance of linking public procurement with the achievement of state objectives. The article shows that the introduction of the obligation to prepare a state purchasing policy and linking this document with the system of strategic development planning confirms the strategic use of procurement, which should serve the implementation of important public interests.
Ingerencja władzy publicznej w procesy społeczno-gospodarcze służy osiąganiu celów przyjętej polityki państwa (czy odpowiednio Unii Europejskiej). Polityka państwa na rzecz rozwoju społeczno-gospodarczego stanowi urzeczywistnienie interwencjonizmu państwowego. W polskim ustawodawstwie polityka ta została określona przez prawodawcę jako polityka rozwoju. Celem artykułu jest wykazanie, że instrument osiągania strategicznych celów polityki rozwoju stanowią zamówienia publiczne, nawiązując tym samym do koncepcji „strategic use of public procurement”, a więc szczególnego sposobu postrzegania roli zamówień publicznych w kontekście strategicznego podejścia do rozwoju. Przyjęto, że określony cel publiczny, pożądany z punktu widzenia prawa zamówień publicznych, służyć powinien osiągnięciu strategicznych celów prawa prowadzenia polityki rozwoju. W artkule zaprezentowano podejście, które akcentuje instrumentalny (choć kluczowy) charakter zamówień publicznych wobec polityki państwa. Na potrzeby badań przyjęto, że brak zrozumienia istoty wykorzystywania zamówień publicznych w realizacji strategicznych celów rozwoju prowadzić będzie do braku spójności celów publicznych, a w konsekwencji braku spójności działań. W tym kontekście ocenie poddane zostały przepisy ustawy Prawo zamówień publicznych stanowiące podstawę przyjęcia polityki zakupowej państwa, w której podkreśla się istotność łączenia zamówień publicznych z osiąganiem celów państwa. Przeprowadzone badania wskazują, że wprowadzenie obowiązku przygotowania polityki zakupowej państwa i powiązanie tego dokumentu z systemem strategicznego planowania rozwoju potwierdza strategiczne wykorzystanie zamówień, które powinny służyć realizacji ważnych interesów publicznych.

Opis:: Dnia 1 stycznia 2021 r. wejdzie w życie nowa ustawa – Prawo zamówień publicznych. Jej postanowienia z jednej strony modyfikują istniejące już rozwiązania z zakresu planowania zamówień, z drugiej – wprowadzają nowe konstrukcje, takie jak określanie polityki zakupowej państwa lub zobowiązanie zamawiającego do przeprowadzenia analizy potrzeb przez zamawiającego. Przedmiotem niniejszego artykułu jest omówienie narzędzi utworzonych na gruncie nowej ustawy – Prawo zamówień publicznych związanych z planowaniem w kontekście realizacji przez nie celów zamówień publicznych, tj. uwzględnienia aspektów środowiskowych, społecznych i innowacyjnych w zamówieniu. Przeprowadzone rozważania mają na celu wyjaśnić, w jaki sposób narzędzia te mogą przyczynić się do zwiększenia efektywności zamówień publicznych, oraz pokazać ewentualne słabe strony zaproponowanych rozwiązań.
On January 1, 2021, the new Act, Public Procurement Law, will come into force. On the one hand, its provisions modify existing procurement planning solutions, on the other hand, they introduce new constructions such as the state purchasing policy or the contracting authority’s obligation to conduct a needs analysis. The purpose of this article is to present solutions in the field of public procurement planning provided for in the new Public Procurement Law and to clarify their significance for the effective spending of public resources.

Opis:: Na skutek reformy unijnego systemu zamówień publicznych z 2014 r. doszło do zmiany paradygmatu prawa zamówień publicznych. W dyrektywach z 2014 r. podkreślono, że zamówienia publiczne odgrywają kluczową rolę w realizacji strategii EUROPA 2020, ponieważ są jednym z instrumentów rynkowych wykorzystywanych w celu osiągnięcia inteligentnego, trwałego wzrostu gospodarczego, sprzyjającego włączeniu społecznemu, przy jednoczesnym zagwarantowaniu najbardziej efektywnego wykorzystania środków publicznych. Strategiczne zamówienia publiczne, związane z realizacją zasady zrównoważonego rozwoju oraz promowaniem innowacji, zostały uznane za jeden z podstawowych elementów środowiska inwestycyjnego i strategiczny instrument w zestawie narzędzi polityki gospodarczej każdego państwa członkowskiego. W konsekwencji przyjęcia dyrektyw z 2014 r. doszło do zmian w polskim prawie zamówień publicznych. Ustawa z 11 września 2019 r. położyła większy nacisk na realizację zasady Best Value for Money z jednoczesną realizacją zasady zrównoważonego rozwoju. Jednakże samo unormowanie instrumentów prawa zamówień publicznych nie jest wystarczające do wykorzystania potencjału strategicznych zamówień publicznych na potrzeby polityki rozwoju. Artykuł wskazuje, że potrzebna jest skoordynowana i przemyślana polityka państwa w tym zakresie, uwzględniająca podejście z wykorzystaniem ekonomii behawioralnej oraz behawioralnej ekonomicznej analizy prawa, aby wykształcić właściwe praktyki na rynku zamówień publicznych, pozwalające na korektę dysfunkcji mechanizmów rynkowych i osiągnięcie celów rozwoju społeczno-gospodarczego.
As a result of the 2014 reform of the EU public procurement system, there has been a paradigm shift in public procurement law. The 2014 Directives underlined that public procurement plays a key role in implementing the EUROPA 2020 strategy, as one of the market-based instruments used to achieve smart, sustainable and inclusive growth while ensuring the most efficient use of public funds. Strategic public procurement, related to the implementation of the principle of sustainable development and the promotion of innovation, has been recognized as one of the basic elements of the investment environment and a strategic instrument in the economic policy toolkit of each Member State. As a consequence of the implementation of the 2014 directives,changes have been made to the Polish public procurement law. The Act of 11 September 2019 put more emphasis on the implementation of the Best Value for Money principle while simultaneously focusing on the principle of sustainable development. However, the mere regulation of public procurement law instruments is not sufficient to use the potential of strategic public procurement for the needs of development policy. This article suggests that a well-coordinated state policy should be taken into account in order to improve the efficiency of the procurement process. It also states that the adopting of behavioral economics tools and behavioral law & economic analysis, in order to develop appropriate practices on the public procurement market, might be crucial for correcting the dysfunctions of market mechanisms and achieving socioeconomic development goals.
