Opis:: Otoczenie prawne polskich przedsiębiorstw energetycznych, działających w strukturach zintegrowanych pionowo, uległo istotnej zmianie po przystąpieniu Polski do UE. Wcześniej przedmiot działalności ówczesnych zakładów energetycznych, działających w formie przedsiębiorstw państwowych na majątku Skarbu Państwa, a następnie uwłaszczonych na tym majątku i przekształconych w jednoosobowe spółki Skarbu Państwa, obejmował zarówno przesył lub dystrybucję energii, jak i jej sprzedaż lub wytwarzanie. W tym czasie w obszarze WE zdiagnozowano, jako główną barierę rozwoju wolnego i konkurencyjnego rynku sprzedaży energii, funkcjonowanie przedsiębiorstw, będących monopolistami w zakresie przesyłu lub dystrybucji energii, a jednocześnie działających w sferze sprzedaży energii. Stwarzało to realne ryzyko nieuprawnionego uprzywilejowania własnego, zintegrowanego sprzedawcy. W związku z taką diagnozą podjęto działania w celu zapewnienia zainteresowanym podmiotom niedyskryminacyjnego dostępu do sieci energetycznych, których głównym narzędziem stała się instytucja unbundlingu, rozumianego jako rozdzielenie sprzedaży i wytwarzania energii od działalności operatorskiej na sieciach.

Opis:: This article provides an overview of challenges facing the Polish power industry. The author claims that the investments in new electricity production assets and capacity of transmission systems are of crucial importance. Development of electricity markets by introducing the capacity market, development of electricity and gas transmission systems that allow wide use of pipe gas as fuel in power stations are necessary to that end as well. The article begins with information on legal framework of energy market (including unbundling process and its results). Next, plans and prospects for future development of power industry in Poland are presented.

Opis:: This paper applies the general insights of liberalization of the electricity and gas market to the market conditions of a particularly important new Member State in the EU, Poland. To this end the aim of this paper is to explain the Polish experience of liberalizing its energy market by reviewing those developments that produced its current shape. In fact there are two possible scenarios Polish policy makers can follow in liberalizing its energy sector. One would involve the UK approach that encompasses: ownership unbundling, less market concentration, less public ownership and more private capital in the industry. The second scenario follows the continental model: more concentration and vertical integration and more State or public ownership in the energy field (for instance, the French model). These two widely diverging approaches reflect different energy consumption patterns, energy mixes, sources of supply and natural resources of various countries. Having these differences in mind this research reviews developments that have produced the current state of liberalization of the electricity and gas sectors in Poland and discusses the prospects for further progress towards an integrated, competitive and liberalized European electricity and gas market in the light of the challenges that remain. These challenges include uneven unbundling, discriminatory third party access, insufficient independency of national regulator, consolidation and anti-competitive behaviour of incumbents or abuse of one’s dominant position on the market.

The European Commission recommends the Local Loop Unbundling (LLU) in the European Union and LLU has already been introduced in some Member States. The paper presents basic means of access to the local loop, market power of incumbents, objectives and the key role of LLU, modalities for unbundled access to the local loop, duties and a particular role of national regulatory authorities.

Opis:: The question about an appropriate structure for the electricity industry has been extensively discussed in scientific literature and experts studies. Since the beginning of electricity liberalization, it was apparent for its promoters that such a structure (in this paper referred to as the model structure or ideal structural model) for the electricity sector should involve a separation of its four sub-sectors, i.e., generation, transmission, distribution, and supply. With the exception of transmission, each sub-sector should consist of many stand-alone type companies. Given the high degree of vertical and horizontal integration of the electricity sectors, their procompetitive restructuring (i.e., de-integration) became a standard component of electricity sector reform packages. This paper provides a concise review of the origins and justification of the initial model structure for electricity liberalization, as well as an overview of the restructuring developments in the early years of electricity liberalization. Some attention is also devoted to the EU’s unbundling initiatives. The core part of this paper discusses the first signs indicating the crisis of the initial structural canon. The paper concludes with some comments referring to the modified form for a model structure that is emerging. It involves vertical integration of generation and supply and allows a higher degree of horizontal concentration of the electricity competitive markets.
La question de la structure de l’industrie de l’électricité appropriée a été beaucoup discutée dans la littérature scientifique et les études d’experts. Depuis le début de la libéralisation du marché de l’électricité, il était évident pour son promoteurs que cette structure (dans cet article elle est appelée “structure modèle”) du secteur de l’électricité devra contenir la séparation de ses quatre sous-secteurs (génération, transmission, distribution et provision). A l’exception de la transmission, chaque sous-secteur devra contenir plusieurs entreprises indépendantes. Étant donné le haut niveau de l’intégration horizontale et verticale des secteurs de l’électricité, leur restructuration pro-concurrentielle (désintégration), est devenue un composent standard des paquets des reformes du secteur de l’électricité. L’article présente une révision des origines et la justification du modèle initial de la structure de la libéralisation du marché de l’électricité, aussi que la révision du processus de restructuration dans les premières années de la libéralisation du marché de l’énergie. L’article discute aussi les initiatives d’unbundling de l’UE. La partie la plus importante de l’article présente les premiers signaux indiquant la crise de la structure initiale. Finalement, l’article contient commentaires concernant la forme modifiée de la structure modèle qui émerge. Elle content l’intégration verticale de la génération et la provision et permet le niveau plus élevé de la concentration horizontale du marché de l’électricité concurrentiel.

Opis:: Pioneer trains in Indonesia have been fully funded by the government. The construction needs a lot of funding that would burden the state budget. One of the alternatives is the public-private partnership scheme. This study aims to analyze the most effective unbundling scenario for financing and maintaining the Indralaya-Tanjung Senai train. The life cycle costs and conducting sensitivity analysis according to applicable regulations. The scenarios are based on ticket price increases and government support for the operation and maintenance (O&M) for this pioneer train route, calculated net present value (NPV) and internal rate of return (IRR) value. Scenario 1 assumes that tickets do not receive subsidies; private companies are responsible for O&M costs. Scenario 2 assumes that ticket prices are set by private companies; the government is responsible for procurement and maintenance costs. Scenario 3 assumes that the government provides subsidies of IDR 10,000 per passenger as well as railway infrastructure; private companies bear the cost of procuring railbuses and operational expenses. Based on calculations with Scenario 1 NPV is IDR 0.73 billion; with Scenario 2 is IDR 4.64 billion and with Scenario 3 is IDR (–)1.34 billion. The analysis shows that increasing passenger fares according to price raises and inflation rates, and subsidies from governments for maintenance costs will make this railroad project financially feasible.

Opis:: The paper reviews the performance of the German regulatory framework as regards unbundled access to local loop (ULL). The argumentation is based on the assumption that the goal of regulatory interference into telecom markets is to promote sustainable competition in order to maximise social welfare. For Germany, it is demonstrated that - due to a comprehensive regulatory framework - a considerable degree of competition has evolved since the local telecom market has been opended in 1998. Thereby it also becomes evident that pricing is the most controversial issue to be resolved when regulating ULL access.
